HomeMy WebLinkAboutSD-00-13 - Decision - 0069 0085 Swift Street#SD-00-13 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of Daniel Morrissey for a planned unit development consisting of the existing Vermont Gas building and a 38,428 square foot building for general office use and a bank with drive -through service, 69 and 85 Swift Street as approved on July 15, 1997. The amendment consists of amending condition #5 of the 7/15/97 approval to extend by three (3) years the date by which the proposed internal future access drive shall be constructed. On the 4th of April, 2000, the South Burlington Development Review Board approved the final plat application of the Daniel Morrissey under Section 204 of the South Burlington Subdivision Regulations based on the following findings: These properties are located at 69 and 85 Swift Street lie within the C1 District. They are bounded on the east by the access to Farrell Park, on the north by Swift Street and an auto body repair shop, on the south by Farrell Park, and several residences, and on the west by a mini -warehouse complex. 1. The owners of record are Daniel Morrissey, Mark Stevens, and Vermont Gas Systems. 2. Access/circulation: access to the PUD is currently provided by a 36-foot curb cut at 85 Swift Street. A 24-foot curb cut has been approved for the new building at 69 Swift Street. The future internal access drive will connect 69 Swift Street and 85 Swift Street. This access road will connect the parking lot at 85 Swift Street at the southwesterly corner. 3. Planned Unit Developments are, by nature, intended to have internal circulation between buildings and parking areas. The Development Review Board considered the implications of delaying this internal access drive and how it potentially affected the intended relation of the approved structures. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat application #SD-00-13 of Daniel Morrissey to amend a planned unit development consisting of the existing Vermont Gas building and a 38,428 square foot building for general office use and a bank with drive -through service, 69 and 85 Swift Street. The amendment consists of amending condition #5 of the 7/15/97 approval to extend by three (3) years the date by which the proposed internal future access drive shall be constructed, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Condition #5 of the 7/15/97 approval shall be revised to read as follows: "The proposed internal future access drive shall be constructed within six (6) years from the date of final approval. Prior to issuance of a zoning permit, a bond to cover the cost of the future access drive shall be posted and shall remain in effect until said future access drive is constructed." *L hair Clerk bate e�i� South Burlington Development Review Board
