The South Burlington Board of Civil Authority held a meeting on Friday, 17 September 2021,
at 1 p.m., in the Auditorium, City Hall, 180 Market Street.
Members Present: C. Shaw, Chair; D. Kinville, M. Mahoney, P. Mahoney, C. Wagner
Also Present: M. Lyons, T. Eustace
1. Review evacuation plans in case of an emergency.
Ms. Kinville reviewed emergency plans. Mr. Shaw noted that the wearing of masks is
encouraged in City Hall.
2. Comments and questions from the public not related to the agenda:
No comments or questions were presented.
3. Any change to the order of the agenda:
No changes were made to the agenda.
4. BCA oath administered:
Ms. Kinville administered the oath to Board members.
5. Hear Appeal from:
a. Farwater, Ltd. 320 Lime Kiln Rd.
Ms. Lyons said that late yesterday, Farwater, Ltd., submitted an income approach to the
assessment. The city has accepted that, and there is no need for a hearing.
Mr. Eustace said they are appearing in order to follow the statutory requirements. They are in
agreement with the city.
Ms. Lyons said she felt that based on the income approach, $16,975,000 was a fair and
reasonable value. Mr. Eustace said if that is the new number, they agree to it and withdraw
their appeal.

Ms. Kinville advised that these three appeals have been withdrawn.
6. Determine if appeals should be heard from:

a. Pizzagalli Properties 55 Green Mountain Drive
Ms. Lyons said that during the hearing when Mr. Eustace spoke with John Valente, Mr. Eustace
presented an income approach. He assumed Mr. Valente would use this to recalculate the
assessment and said he agreed to that approach and to the figures he had presented. Mr.
Valente’s report indicates “information only, dropped appeal.” Ms. Lyons also noted there is an
email from Mr. Valente to this effect.
Mr. Shaw said the Board needs to determine whether to accept the report that the appeal was
dropped. He asked if the Board can overrule that. Ms. Kinville said they can.
Maurice Mahoney then moved to hear Mr. Eustace’s testimony and to treat it as a normal
procedure. Patrick Mahoney seconded. Motion passed 4-1.
Ms. Lyons then asked that she and Mr. Eustace be given time to go through the process as he
did with Mr. Valente. Ms. Lyons felt that by Monday she should be able to let Mr. Eustace
know where the city stands.
Ms. Kinville noted there is room on the agenda for 16 October.
Mr. Shaw moved to continue the appeal of Pizzagalli Properties for 55 Green Mountain Drive
until 16 October. Maurice Mahoney seconded. Motion passed with all present voting in favor.
b. Keypoint Partners 215 Dorset Street
Ms. Lyons noted this is the Party City building in the UMall complex. She said she was
contacted by the appellant who asked if they had appealed 215 Dorset Street. She told him
there was nothing in the records to that effect. She then checked with Tyler Technologies who
said no hearing had been held, and this was not discussed with the other UMall appeals. They
had scheduled hearings on all the other UMall properties, but this one was not included on that
list.
Ms. Kinville noted the appellant submitted a letter to the city appealing to the Board of Civil
Authority. Ms. Kinville said that by law the Board cannot hear this appeal as it has not gone
through the initial process.
No action was taken on this appeal as the appellant did not go through the initial process.

Ms. Lyons noted the appellant can appeal in June, 2022.
7. Other Business:
No other business was presented.
As there was no further business to come before the Board, Maurice. Mahoney moved to
adjourn. Patrick Mahoney seconded. The meeting was adjourned at 1:35 p.m.
