Findings of Fact. Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on December 28, 1998, January 25, February
8, 1999 by application of Michael Turner and Mary Jo Reale for a variance to operate a home occupation from the second
floor of a 24' x 34' detached garage located at 110 central Avenue according to plans submitted. The Board of
Adjustment finds as follows:
1) Section 26.40 of the zoning by-laws provide "that a minor portion of a dwelling may be used for a home
occupation."
2) The applicant is requesting to use approximately 300 square feet on the second floor of a detached garage for a
home business.
3) Concerns by the neighbors were truck deliveries and off-street parking.
4) The property in question is located on a cul-de-sac and parking is at a minimum.
5) The applicant testified that he has 56 truck trips monthly by UPS.
6) An increase in the size of his family warrants the need to relocate his family business to within the garage. The
garage is finished into guest quarters and an office area.
7) The applicant has support of his neighbors and petition with 26 signatures is on record.
ORDER
The variance to operate a home business from the garage (second floor area) located at 110 Central Avenue is hereby
GRANTED
Stiuulations:
1) No products associated with the business will be delivered to 110 Central Avenue.
2) No commercial vehicles will park on the Central Avenue cul-de-sac.
3) Parking spaces for the office manager will be redesigned.
4) No on -site customer sales is permitted.
5) Should the applicant change home occupations. the new occupation would require review and approval by the
Zoning Administrator
