HomeMy WebLinkAboutMinutes - Board of Civil Authority - 08/26/2021BOARD OF CIVIL AUTHORITY 26 AUGUST 2021 The South Burlington Board of Civil Authority held a meeting on Thursday, 26 August 2021, at 6:00 p.m., in the Conference Room, City Hall, 180 Market Street. Members Present: C. Shaw, Chair; C. Trombly, D. Kinville, M. St. Germain, M. Emery, T. Barritt, H. Riehle, Sen. M. Sirotkin, P. Mahoney, C. Wagner, M. Mahoney, B. Nowak, C. Callea, M. Cota Also Present: J. Ebbers 1. Emergency Evacuation Plans: Ms. Kinville reviewed the procedure for evacuation in case of an emergency. Mr. Shaw reviewed guidance for the wearing of masks which is encouraged but not mandated. 2. Comments from the public not related to the agenda: No comments were made. 3. Any change in the order of the agenda No changes were made to the Agenda. 4. Approve Minutes from 21 August 2021: It was also noted that on page 4, under the McLane hearing, the time adjusted value of the house at #560 should be $493,000. On the same page, paragraph 3, #51 should be deleted. Ms. Riehle moved to approve the Minutes of 21 August 2021 as amended. Ms. Emery seconded. Motion passed with Mr. St. Germain abstaining and all others present voting in favor. 5. Hear inspection reports from 21 August hearings: a. Jonathon & Heather Ebbers 8 Butler Drive Ms. Riehle said she, Mr. Cota and Sen. Sirotkin inspected the property at 9 a.m. on 22 August. They noted that the roof needs replacing and there is settling around the front stoop. The basement is damp, and there are cracks in the driveway. There have been no upgrades. There is a 40 sq. foot discrepancy with the card which Ms. Ebbers felt may be due to the bay windows. BOARD OF CIVIL AUTHORITY 26 AUGUST 2021 PAGE 2 b. Peter & Linda Mikel 21 Bower St. Ms. Riehle said she, Mr. Cota and Sen. Sirotkin inspected the property at 9:30 a.m. on 22 August. The deck appears to be uneven. There is a fire pit. They found that there is no access to the “false garage dormer” which resulted in extra square footage being applied. The property backs up to open space, and the grounds are lovely. They rated the interior and exterior as average/good. c. Tricia Azur 51 Bower St. Ms. Riehle said she, Mr. Cota and Sen. Sirotkin inspected the property at 10:30 a.m. on 22 August. The garage door needs repair, and the siding is poor. The deck is badly constructed. There is water damage downstairs and carpeting is worn. Painting is needed. There have been no updates to the property. The team did notice the mold between the glass and storm windows which Ms. Azur had explained. They rated the property as average rather than the average/good on the card. d. James McLane 577 Golf Course Road Mr. Trombly reported that he, Mr. Nowak and Mr. Maurice Mahoney visited the property on 22 August. It is a duplex condo with a rear patio and private backyard with a view of the golf course. It is in excellent condition. They could not see the crack in the basement mentioned by Mr. McLane. e. Gerald & Cheryl Couture 4 Cabot Court Ms. Kinville said the team including Mr. Nowak and Mr. Maurice Mahoney visited the property on 22 August. It is a 2-story home. The porch needs painting. The basement is unfinished and is not heated. The foundation is sound. There are no discrepancies with the lister’s card. They would rate the property average/good. f. Tom & Lori Piper 7 Pavilion Avenue Ms. Kinville said the team including Mr. Nowak and Mr. Maurice Mahoney visited the property on 22 August at 10:40 a.m. It is on a one-lane dirt road. It is a 3-story home with the bottom floor having a front and rear entry. There is a porch in front on 2 levels and a huge deck in the rear. There is no defined yard area. The lister’s card lists only 2 stories. It also says there is an unfinished basement. There is no basement. There is also a half bath more than indicated on the card. BOARD OF CIVIL AUTHORITY 26 AUGUST 2021 PAGE 3 g. Sheldon Katz & Claudia Berger 29 Imperial Drive Mr. Trombly reported that he and Ms. Riehle and Ms. Wagner visited the property on 22 August. There is a private fenced backyard with a water feature and a deck with an entrance to the kitchen area. It is a 2-story home with attached garage. Some of the basement is unfinished. There are no discrepancies with the lister card. h. Jeanne Kellner 5 Adams Court Mr. Trombly reported that he and Ms. Riehle and Ms. Wagner visited the property on 22 August. The roof is good, but there is some peeling paint. The deck is good. There are no views. The driveway slopes down. There are 2 stories including a family room above the garage. Downstairs bedrooms are rented to tenants. There are no discrepancies with the lister’s card. Ms. Emery then moved that the Board meet in deliberative session. Ms. Riehle seconded. The motion passed with all present voting in favor. The Board entered deliberative session at 6:27 and resumed open session at 7:01 p.m. 6. Other Business: Mr. Shaw reminded members of the Saturday 9 a.m. and 1 p.m. sessions Ms. Kinville said she had sent letters to all appellants asking them to show up before their scheduled time in case there are “no shows.” She also asked them to advise her if they are withdrawing their appeal. Mr. Shaw suggested that rather than rescheduling the “no shows,” the Board make a decision on the spot and inspect the property the next day. As there was no further business to come before the Board, Mr. Cota moved to adjourn. Ms. Riehle seconded. The meeting was adjourned at 7:10 p.m. _____________________________ Clerk
