I have reviewed the proposed sidewalk easements for 760
Shelburne Road and 31 Swift Street.
It is my understanding that there is no immediate need
regarding the 760 Shelburne Road property. For this reason, I
would like to postpone finalizing this easement until the drawing
showing the location of the easement is finalized.
With regard to the easement for 31 Swift Street, I request
use of the following description:
Being a strip of land, five feet in uniform depth which
extends across the entire northerly boundary line of
Grantor's property and adjoins the right-of-way line for
Swift Street, so-called, in the City of South Burlington.
I further request modification of the fourth paragraph as
follows:
Grantee further agrees, for itself and its successors and
assigns, that any premises affected by its entry pursuant to
the temporary construction easement conveyed hereby shall be
restored to their condition prior to such entry at its own
cost and within a reasonable time.
This modification is necessary since the area within the
permanent easement will not be restored to its preexisting
condition.

If this property is subject to a mortgage, I request that
this easement be released from the mortgage. I have attached
release language which is typically included in the easement deed
instead of being recorded as a separate document.
Finally, please prepare a transfer tax return for use along
with the easement.
Please prepare final documents and have them signed by your
client and delivered to the City. Please fax me copies of the
final documents for my review.

Being a strip of land, five W) feet in uniform depth, which extends
across the entire northerly boundary line of Grantor's property and ad-
joins the right-of-way line for Swift Street, so-called, in the City of
South Burlington.
Being located on property commonly known as 31 Swift Street in the City
of South Burlington, which was acquired by Grantor by Warranty Deed of
V/M Realty Partnership, dated June 19, 1992, and recorded in Book 326,
Page 49 of the City of South Burlington Land Records.
Grantee, its successors and assigns, shall have the right to construct,
reconstruct, repair, maintain, replace, patrol, level, fill, drain and
pave said sidewalk, including all necessary bridges, culverts, cuts and
ramps, at its sole cost and expense.
Grantee further agrees, for itself and its successors and assigns, that
any premises affected by its entry pursuant to the temporary construc-
tion easement conveyed hereby shall be restored to their condition prior
to such entry at its own cost and within a reasonable time.
Grantee agrees, for itself and its successors, that it will indemnfiy
and hold Grantor harmless, to the full limits of liability insurance
that it customarily maintains, for any injury or damage resulting from
the public use of said right of way not attributable to acts of the
Grantor.

For purposes of construction, a temporary easement and right of way five
(51) feet wide on the southerly aide of said permanent easement and
right of way is hereby granted. Said temporary easement and right of
way shall expire once construction is completed and the sidewalk is open
to the public.
TO HAVE AND TO HOLD the above granted and privileges, in, upon and over
said premises, unto and to the use of the said Grantee, its successors and as-

AND I the said Grantor, GARY J. BOURNE, for myself and my heirs, ex-

PROJECT DESCRIPTION
Gary Bourne, hereafter referred to as the applicant, is seeking conditional use and site plan
approval to convert 2850 sq. ft. of office space to social services use, 31 Swift Street.
COMMENTS
Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein
as Staff, have reviewed the plans submitted on October 29, 2007 and have the following
comments.
CONDITIONAL USE CRITERIA
Pursuant to Section 14.10(E) of the South Burlington Land Development Regulations the
proposed conditional use shall meet the following standards:
1. The proposed use, in its location and operation, shall be consistent with the
planned character of the area as defined by the City of South Burlington
Comprehensive Plan.
The proposed change in use is consistent with the planned character of the area and the
existing uses in the area.
2. The proposed use shall conform to the stated purpose of the district in which the
proposed use is located.
Pursuant to Section 5.01(A) of the SBLDR, the Commercial 1 Zoning District is formed to
encourage the location of general retail and office uses in a manner that serves as or
enhances a compact central business area.
Staff feels the proposed social services use is in compliance with the stated purpose of the
C1 District, as it is in an area that is densely developed with commercial and office uses.
3. The Development Review Board must find that the proposed uses will not adversely
affect the following:
(a) The capacity of existing or planned municipal or educational facilities.
Staff believes that the proposal will not adversely affect municipal services.
(b) The essential character of the neighborhood or district in which the property is
located, nor ability to develop adjacent property for appropriate uses.
Staff believes that the proposal is in keeping with the character of uses on surrounding
properties and will not adversely affect the character of the area or the ability to develop
adjacent properties.
(c) Traffic on roads and highways in the vicinity.
According to the ITE, 7" Edition, the proposed uses will result in a decrease in PM peak vehicle
trip ends from 14.2 to 11.4.

(d) Bylaws in effect.
The proposal is in keeping with applicable regulations.
(e) Utilization of renewable energy resources.
The proposal will not affect renewable energy resources.
(0 General public health and welfare.
Staff does not believe that the proposal will have an adverse affect on general public welfare
or the health of the surrounding public.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Requlations establishes the following
general review standards for all site plan applications:
(a) The site shall be planned to accomplish a desirable transition from structure to
site, from structure to structure, and to provide for adequate planting, safe
pedestrian movement, and adequate parking areas.
The change in use results in a requirement of one additional parking space, from 19 to 20.
Twenty one (21) are shown on site, including one which is designated for handicapped
accessibility. This is sufficient to satisfy this criterion.
(b) Parking shall be located to the rear or sides of buildings to the greatest extent
practicable.
There are no changes to the proposed building. The change in use proposed herein does not
necessitate any changes to this criterion.
(c) Without restricting the permissible limits of the applicable zoning district, the
height and scale of each building shall be compatible with its site and existing or
adjoining buildings.
There are no changes to the proposed building. The change in use proposed herein does not
necessitate any changes to this criterion.
(d) Newly installed utility services and service modifications necessitated by exterior
alterations or building expansions shall, to the extent feasible, be underground.
Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines,
services, and service modifications shall be underground.
(e) The DRB shall encourage the use of a combination of common materials and
architectural characteristics, landscaping, buffers, screens and visual
interruptions to create attractive transitions between buildings of different
architectural styles.
There are no changes to the proposed building. The change in use proposed herein does not
necessitate any changes to this criterion.

(t) Proposed structures shall be related harmoniously to themselves, the terrain, and
to existing buildings and roads in the vicinity that have a visual relationship to the
proposed structures.
There are no changes to the proposed building. The change in use proposed herein does not
necessitate any changes to these criteria. The building has been recently re -faced; staff finds
that it is sufficiently and aesthetically pleasing.
Site plan applications shall meet the following specific standards as set forth in Section
14.07 of the South Burlington Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access to
abutting properties whenever such access is deemed necessary to reduce curb
cuts onto an arterial of collector street, to provide additional access for
emergency or other purposes, or to improve general access and circulation in the
area.
Staff does not feel it is necessary to require any additional access to abutting properties.
(b) Electric, telephone and other wire -served utility lines and service connections
shall be underground. Any utility installations remaining above ground shall be
located so as to have a harmonious relation to neighboring properties and to the
site.
Staff has already stated that pursuant to Section 15.13(E) of the Land Development
Regulations, any new utility lines, services, and service modifications shall be underground.
(c) All dumpsters and other facilities to handle solid waste, including compliance
with any recycling or other requirements, shall be accessible, secure and properly
screened with opaque fencing to ensure that trash and debris do not escape the
enclosure(s).
Trash storage is accommodated on the abutting property which is also under ownership of the
applicant.
(d) Landscaping and Screening Requirements
Because no buildings are proposed, there are no requirements for additional landscaping.
RECOMMENDATION
Staff recommends that the Development Review Board approve Conditional Use application
#CU-07-82 and Site Plan application #SP-07-08.

Mr. Bourne identified the building as the former Vermont Gas loca-
tion. The space in the middle of the building has been empty since
the applicant purchased it. He now proposes to use 1,000 sq. ft.
of the space for an accounting business.
Mr. Bourne acknowledged that parking is tight and it has been hard
to come up with a use that would generate less traffic than the
proposed accounting business. Four spaces are required for this
use.
Mrs. Maher asked about the sidewalk easement. Mr. Bourne said if
there isn't one he will give it.
Mr. Austin moved the Planning Commission approve the site plan ap-
plication of Gary Bourne for conversion of 1,000 sq. ft. of vacant
space to general office use in an existing 5,500 sq. ft. building
currently used for automobile repair and beauty salon, 31 Swift
St., as depicted on a plan entitled "Site Plan, Former Vermont Gas
Garage Building, 31 Swift Street, South Burlington, VT," prepared
by Bourne Consulting Engineering, dated April, 1992 with a last re-
vision date of 12/21/93, with the following stipulations:
1. All previous approvals and stipulations which are not superseded
by this approval shall remain in effect.
2. This site plan approval shall not be construed as approval to
alter a noncomplying structure. The decision of whether or not to
approve alteration to a noncomplying structure shall be made by the
Administrative Officer in accordance with Section 19.002 of the
Zoning Regulations.

required parking spaces from 25 to 24 spaces. It is the Planning
Commission's opinion that 24 parking spaces will adequately serve

in the South Burlington land records prior to issuance of a zoning/
building permit.
6. The applicant shall obtain a zoninglbuilding permit within six
months or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to Occupancy of the newly constructed
areas.
8. Any changes to the site plan shall require approval by the South
Burlington Planning Commission.
9. Any changes to existing exterior lighting or any new lighting
shall be downcasting and shielded so as not to cast light beyond
the property line. Any change to exterior lighting shall be ap-
proved by the City Planner prior to installation.

Parking: This parking area will be used as an overflow lot during
peak demand. This area will accommodate approximately 41 vehicles.
Lighting: No additional lighting proposed for Phase 1.
Sewer: No additional sewer allocation needed.
Other: The lot size indicated on the site plan includes a portion
of the street r.o.w. The lot size should be revised to reflect the
size of the lot outside the r.o.w.
3) GARY BOURNE - OFFICE USE - SITE PLAN
This project consists of converting 1,000 square feet of vacant ,
space to general office use in a 5,500 square foot building used
for automotive repair and a beauty salon. $
This property located at 31 Swift Street is within the Commercial
1 District. It is bounded on the north by Swift Street, on the
east by an office/warehouse building, on the south by Pizza Hut and
on the west by an auto service station owned by the applicant.
Access/circulation: Access is provided by a 30 foot curb cut on
Swift Street and an access drive at the rear of the property to the
adjacent service station. No access changes proposed.
Circulation is adequate.
Coverage/setbacks: Building coverage is 33% (maximum allowed is
30%). Overall coverage is 77% (maximum allowed is 70%). Although
current coverage limitations are being exceeded, this application
will not increase the degree of noncompliance.
Building does not meet setback requirements and is therefore
subject to Section 19.002 of the zoning regulations.
Landscaping: The minimum landscaping requirement, based on
building costs is $60 which is not being met. The site is well
landscaped so staff does not recommend any additional landscaping.
Parking: The existing and proposed uses require a total of 25
spaces and only 24 spaces including one (1) handicapped space are
being provided. Applicant should provide justification for the one

(1) space shortfall. This parking lot is substandard in size but
it was approved this way by the Planning Commission on 12/15/87.
Traffic: This property is in Traffic Overlay Zone 1 which limits
this property to 6.6 vehicle trip ends (vte's) during the P.M. peak
hour. The previous trip generation was estimated to be 14.1 vte's.
ITE estimates the existing and proposed uses to generate 13.5 vte's
which is less than was previously generated.
Lighting: All exterior lighting is existing. It consists of four
(4) 75 watt incandescent lights and one (1) mercury vapor light,
all attached to the building.
Sidewalk: The previous owner of this property contributed $1,000
to the sidewalk fund in 1988 as required by the Planning
Commission. It was also required that the City be given an
easement for this sidewalk. No evidence can be found that this
easement was ever granted. The current owner should therefore
grant the City an easement for this sidewalk. The legal documents
for the easement should be reviewed and approved by the City
Attorney. This document should be recorded prior to issuance of a
zoning/building permit.

4) HEATHCOTE ASSOCIATES - BANK PARKING/CIRCULATION CHANGES -
REVISED FINAL PLAT
The purpose of this application is to amend condition #8 of the
9/27/88 approval for the TJ Maxx addition. This condition was
subsequently amended on 10/29/91 and 4/28/92 (9/27/88 approval and
subsequent amendment approvals enclosed). This condition required
the drive -through banking service to terminate by 10/29/92.
The applicant is requesting to amend condition #8 so that the
drive -through bank service may remain. As part of the request, the
applicant is proposing changes to the bank building and parking and
circulation changes in the vicinity of the bank.

tain manufacturing business will be moving out.
An overhead door will be put in back. The would like to connect
to the service station in front so they won't have to go onto
Swift St. with cars. Customer cars would be left off and picked
up at the service station. Mr. Sheahan asked if there is
adequate parking. Mr. Bourne noted a lot of the parking is
restaurant overflow. He said if they rent the rest of the
building they would have to deal with a parking problem.
Mr. Austin raised the question of circulation on the other site
if the connection is approved. Mr. Bourne said traffic flow is
basically one way back to this building. Only the mechanics will
be driving cars from lot to lot.
Mr. Sheahan asked if the dumpster is screened. Mr. Bourne said
it is screened by pines and a white fence.

curb cuts and ingress/egress from the other. Two cuts are needed
so trucks won't have to turn around. Most deliveries will be on
Saturday and Sunday. The main business day is Saturday.
There will be no one resident on this lot. Customers will call
Mr. O'Brien at home and he will go to the lot to meet them.
No transactions will take place on the lot; it is just a place
to store their fieldstone. The company sells mainly to
contractors, masons, homeowners.
The front yard will be grassed. They propose a stone fence for
security and buffering. The ingress/egress will be barred when
not being used, probably by a metal gate.
Mr. Weith said he spoke with Mr. Audette about boulders in the
right of way. These need to be at least 10 ft. from the sidewalk
because the area is mowed by the city.
Mr. Craig asked why this is a temporary use. Mr. O'Brien said
they will probably be booted out when there is a permanent use
for the land. He also wasn't sure the business would be success-
ful.
Mr. O'Brien asked if they can come back in 2 to 3 years to be
reviewed for the sidewalk and other landscaping. Members agreed
to 3 years.

This project consists of converting 1500 square feet of an
existing building to auto repair use to serve as an annex to the
applicant's adjoining service station. The applicant was granted
a conditional use permit for this use by the Zoning Board of
Adjustment on April 27, 1992. The approval was conditioned on
the requirement that no more than one (1) wrecked or junk type
vehicle be stored on this property at any one time.
This property located at 31 Swift Street is within the Commercial
1 District. It is bounded on the north by Swift Street, on the
east by an office/warehouse building, on the south by Pizza Hut
and on the west by an auto service station owned by the
applicant.
Access/circulation: Access is currently provided by a 30 foot
curb cut on Swift Street. An additional access is proposed to
the adjoining property to the west to be used to move vehicles
between the main service station and this proposed annex. This
connection drive will be located at the rear of the property.
Traffic circulation will be acceptable.
Coverage/setbacks: Building coverage is 33% (maximum allowed is
30%). Overall coverage is 77% (maximum allowed is 70%).
Although current coverage limitations are being exceeded, this
application will not increase the degree of noncompliance.
Building does not meet setback requirements and is therefore
noncomplying. This application will not increase the degree of
noncompliance.

Landscaping: The landscaping requirement for this project is
$240 which will be met. A cedar hedge is proposed along the
westerly boundary.
Parking: This project requires a total of 21 parking spaces and
the plan shows a total of 23 spaces including one (1) handicapped
space. This parking lot is substandard in size but it was
approved this way by the Planning Commission on 12/15/87.
Traffic: This property is in Traffic Overlay Zone 1 which limits
this property to 6.6 vehicle trip ends (vte's) during the P.M.
peak hour. The current trip generation is estimated to be 14.1
vte's. ITE does not provide a trip rate for auto repair only.
Staff does not see a problem with proposed uses since auto repair
trips will use connecting drive and not Swift Street. Traffic
generation for the vacant space will be evaluated at the time it
is reviewed by the Planning Commission.
Lighting: All exterior lighting is existing. It consists of
four (4) 75 watt incandescent lights and one (1) mercury vapor
light, all attached to the building.
Other:
--- this use will share the dumpster on the adjacent Bourne's
Service Center property.
7) PATRICK O'BRIEN - OUTSIDE STORAGE - 60 KIMBALL AVENUE
This project consists of the use of an undeveloped lot for
outside storage and contractor's yard on a temporary basis. The
Zoning Board of Adjustment granted a conditional use permit for
this use on April 27, 1992.
This property located at 60 Kimball Avenue (lot #3) is within the
Mixed Industrial and Commercial District. It is bounded on the
west by a vacant lot, on the north by the rear portion of the
former Mayo's Subaru property (now vacant), on the east by the
INS building, and on the south by Kimball Avenue.
