HomeMy WebLinkAboutSP-92-0000 - Decision - 0031 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Gary Bourne for use of 1,500 square feet of a 5,500 square foot building for automobile repair, 31 Swift Street. On the 26th of May, 1992 the South Burlington Planning Commission approved the request of Gary Bourne for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting 1500 square feet of an existing building to auto repair use to serve as an annex to the applicant's adjoining service station. The applicant was granted a conditional use permit for this use by the Zoning Board of Adjustment on April 27, 1992. The approval was conditioned on the requirement that no more than one (1) wrecked or junk type vehicle be stored on this property at any one time. 2. This property located at 31 Swift Street is within the Commercial 1 District. It is bounded on the north by Swift Street, on the east by an office/warehouse building, on the south by Pizza Hut and on the west by an auto service station owned by the applicant. 3. Access/circulation: Access is currently provided by a 30 foot curb cut on Swift Street. An additional access is proposed to the adjoining property to the west to be used to move vehicles between the main service station and this proposed annex. This connection drive will be located at the rear of the property. Traffic circulation will be acceptable. 4. Coverage/setbacks: Building coverage is 33% (maximum allowed is 30%). Overall coverage is 77% (maximum allowed is 70%). Although current coverage limitations are being exceeded, this application will not increase the degree of noncompliance. Building does not meet setback requirements and is therefore noncomplying. This application will not increase the degree of noncompliance. 5. Landscaping: The landscaping requirement for this project is $240 which will be met. A cedar hedge is proposed along the westerly boundary. 6. Parking: This project requires a total of 21 parking spaces and the plan shows a total of 23 spaces including one (1) handicapped space. This parking lot is substandard in size but it was approved this way by the Planning Commission on 12/15/87. 7. Traffic: This property is in Traffic Overlay Zone 1 which limits this property to 6.6 vehicle trip ends (vte's) during the P.M. peak hour. The current trip generation is estimated to be 14.1 vte's. ITE does not provide a trip rate for auto repair only. Staff does not see a problem with proposed uses since auto repair trips will use connecting drive and not Swift Street. Traffic generation for the vacant space will be evaluated at the time it is reviewed by the Planning Commission. 8. Lighting: All exterior lighting is existing. It consists of four (4) 75 watt incandescent lights and one (1) mercury vapor light, all attached to the building. 9. Other: --- this use will share the dumpster on the adjacent Bourne's Service Center property. DECISION & CONDITIONS Based on the above Findings of Fact, the Planning Commission approves the site plan application of Gary Bourne for use of 1,500 square feet of a 5,500 square foot building for automobile repair at 31 Swift Street, as depicted on a plan entitled "Site Plan, Former Vermont Gas Garage Building, 31 Swift Street, South Burlington, Vermont", prepared by Bourne Consulting Engineering and dated 5/10/92, with the following stipulation: The applicant shall obtain a zoning/building permit, if necessary, within 6 months or this approval is null and void.
