HomeMy WebLinkAboutVR-98-0000 - Decision - 0039 Sunset AvenueSOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Jack & Cathy Milne Request for variance 39 Sunset Avenue Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on June 8, 1998 by application of Jack and Cathy Milne, for a variance to construct a 8' x 12' deck to within twenty- four (24) feet of the required front yard at 39 Sunset Avenue according to plans submitted. The Board of Adjustment as follows: 1) The area in question is zoned Residential 4 District. 2) Section 25.00 Dimensional requirements requires a minimum setback of thirty (30) feet. 3) Existing setback of structure is thirty two (32) feet. 4) Property developed as a single family dwelling in 1954. 5) Lot is narrow preventing construction of a deck within side yard. 6) Other houses within the neighborhood have front decks or porches with setbacks less than 20 feet. 7) The proposed deck will not alter the general character of the area. 8) Lots in this area are long and narrow which creates a hardship for placement of a deck or porch. ORDER The variance to construct a 8' x 12' deck at 39 Sunset Avenue is hereby GRANTED Dated at City Hall, South Burlington, Vermont this Akrday of 98.
