The tree was designated on the plan to be retained. While is is impossible to do anything at this point to satisfactorily remedy the situation, I am asking you to plant a substantial tree in its place. Furthermore, due to a significant number of infractions such as this, from this point forward, I will be asking all site plan and subdivision applicants to clearly designate which trees will. be saved. E+URLINGTON Dear Mr. Brown; Since I sent a crew down early in July to lower curb boxes, we have had several calls requesting that the curb stops be set to grade. After that experience I found that the Water Department is not responsible for the line in the clusters at Stonehedge. We are responsible only for the mains in the streets. We found that the service lines into the individual units were not installed as designed. I have enclosed a copy of the designed service connection and sketched what is actually in the ground. The problem with the existing service connection is that when the curb box is at the bottom of its adjustment a load or impact on the curb box above ground will break the 2" PVC tee. This is what happened when one of my people used a hammer to lower a curb box which was almost to grade. The proper way to adjust the curb box now is to pull the box up to its maximum adjust- ment, cut the box off as close to the ground as possible allowing room to rethread the box for the cap. Then the cap can be pushed back down so that the cap is flush with the ground. Even if the curb box is flush with the ground if there is no adjustment left in the box a vehicle driven up on the box could cause a break. May117, 1983 letter concerning water and sewer easements for Phase I of Stonehedge, I have discussed the situation with representatives of the Stonehedge :�omeowners' Association and have the following convhmts. It appears that the homeowners will have no problem in granting the appropriate utility easement extensions, however, they do not wish to pay the cost of preparing the legal documents. Since I still feel that the problem was created by the developer and/or his representatives I concur with the homecmners' position. If you agree to prepare the necessary dOCILTents and forward them+ to me, I will ?rake the necessary arrangements with the honmers. I believe this may be the best way to finally resolve this situation. Please let nie know if this is acceptable to you. As a final conwent, I am happy to say that all other Stone -hedge legal documents have been recorded and/or stored in the Clerk's office. P M E M O R A N D U M To: South Burlington Planning Commission From: David Spitz, City Planner Re: Next Week's Agenda Items Date: 11/21/79 #2 Windridge Apartments at 200 Kennedy Drive Sidewalk has been relocated at the fill area to a distance of 4 feet from the road. Culvert beneath additional fill will be extended as*needed. Ill- uminated sign has been added at the entrance to the property. #3 Stonehedge, Phase II Plans for loop road have been upgraded to a 24' paved width and 30' base. Minor revisions must be made, such as reducing the sharpness of curves (by in- creasing curve radii from 150' to 200'), so that loop road may be acceptable as a city street. Second entrances have been added to several clusters as requested by fire chief to improve accessibility for fire fighting. #4 McDonald's at 1225 Williston Road City Attorney's opinion is that McDonald's proposed lease of land from the Citgo station will increase the degree of nonconformity of the Citgo lot in violation of the City's zoning regulation. Therefore the City Attorney re- commends denial of the application. #5 South Burlington Realty, San Remo Drive On November 22 1977, the Planning Commission gave site plan approval for a gymnastics instructional facility at this site. For that type of use a circular drive was required. However, for the currently proposed warehouse - commercial building with limited traffic and no children involved, a circular drive no longer appears necessary Zoning Board has granted variance to allow fifty foot setback with stip- ulationr that uses be those permitted in the BPD zone and that parking spaces be 14 as shown. If applicant requests a conditional use, he must return for Zoning Board review. Loading dock is in front with sufficient setback for any trailer trucks to be off the street when unloading. Drainage is towards the front of the lot. M E M O R A N D U M To: South Burlington Planning Commission From: David Spitz, City Planner Re: Agenda Items for 11/13/79 Date: 11/9/79 #2 Blanchard Subdivision at 162 East Terrace Proposed lot meets zoning requirements for the R4 zone sufficient lot size for a single family house or duplex, sufficient setbacks from the existing house, and sufficient frontage for both lots. In order to meet these requirements irregular lot lines have been created. The Zoning Board will consider the re- quest for a duplex at their November 26 meeting. #3 Windridge Apartments at 200 Kennedy Drive The easement to the adjacent property for secondary or emergency access -has been shown on the plat. Legal aspects of the easement should be reviewed. Sidewalks: The Natural Resources Committee has recommended that no filling into the C-0 district take place for purposes of building a sidewalk. Applicant has proposed a peastone footpath with 2 footbridges across the streams to be located outside of the street right-of-way. Because of the footbridges and the steepness of the path at points the City will not be able to maintain the footpath. However, the possibility of an easement for public access with no maintenance reasponsibilities should be reviewed. Watermain layout has been approved. Stonehedge, hase II Engineering data on individual clusters is incomplete. Certain cluster re- locations may take place if a planned land swap occurs in connection with a recreational grant that the City is seeking. Details on finished building grades, drainage, sewer elevations, walkways and other items will be presented prior to construction of each individual cluster. Roadway status remains to be determined. Applicant requests private, City Manager wants public. Proposed streets are 20' paved width with swails for drainage. Details for the road base are equivalent to public streets. If public streets are required, building setbacks should be addressed. Walkways should be provided throughout the development to the public street in addition to the proposed linkage between buildings and parking lots. Cluster "M" has been relocated to maintain existing trees. Easements for public sewer and water mains should be provided. Szymanski, City Manager Re: Stonehedge Date: 11/9/79 1. Loop road should be a public street. J2. Sewer layout is acceptable. 3. Construction plans shall be submitted for review prior to any building or site work. 5. PLANNING COMMISSION NOVEMBER 5. 1979 developer could make the improvements and maintain it. Mr. Woolery did not want that access open until the Commission, City Engineer,aand Fire and Police Chiefs could agree on how to handle it. Mr. O'Bryan felt the abutting development could maintain the easement since it was so short on this developer's side. Mr. Mona felt the note on the drawing relating to the access should be removed. It was suggested that there be a simple recording of the right of way. Nx. Poger said the easement should be provided as the City Attorney suggests. Mr. Page said they had looked at the two nearest sigrallized intersections to this project - Williston Road and Kennedy Drive, and Hinesburg Road and Kennedy Drive. He said that traffic consultant Bruce Houghton's analysis of the capacity of those intersections is based on a one hour count on January 9.: The applicants observed the intersection themselves for 4,112 hour periods and found it not to be as congested as Mr. Houghton suggests. Mr. Page noted that they had not calculated the capacity or the range of service. Mr. Woolery noted that this development would not affect the left turn movement from Hinesburg Road onto Kennedy but said it would affect the left turn off Williston Road onto Kennedy, both of which movements are at high capacities according to Mr. Houghton. It was suggested that left turn arrows be put in place before the application was approved. ter. Page felt the intersections were not at level D. At Hinesburg Road, he said they looked at 41 cycles and no car waited through a signal change to get through. The average was 4 cars through during a cycle, the maximum was 8, and 10; of the cycles had no traffic going through. The traffic study for the project, done by Land Plan Inc. shows that only one car will come from the Williston -Kennedy intersection, where 'Mr. Houghton shows it is not lower than level C service. Tor. Woolery felt this developer was putting an exceptionally costly sidewalk in and he felt left turn arrows were an imposition on top of that cost. Yx. Mona moved to continue the public hearing on the final plat application of L.T.H. Associates for a 17 unit apartment project at 200 Kennedy Drive to two weeks from tonight, November 27, at City Hall, at 7:30 pm. Mr. Ewing seconded the motion and it carried with Messrs. Jacob and Woolery voting no. Public hearing on final plat a nlication of the Glenwood Corporation,) for Phase II 10 condominium units of the Stonehed a development. Mr. Page said the area in question was 43 acres, of which 7 were deeded to the City for parkland. It is zoned R4 and final plat approval has been given for phase 1 (92 units). The applicants are aware that the City has made application for federal funding for a land swap and purchase of some property and if that happens they will come to the Commission for approval of buildings and parking. Walkways will be constructed from the buildings to parking areas and detailed construction drawings will be given to the staff in City Hall. Buildings will be constructed as shown on the plan, and detailed drawings will be given to the City before building permits are issued._ Additional access points to the loop road, asked for by the Fire Chief, have been shown. They propose that the loop road in this phase be the same asin phase 1 - 20' pavement with gravel base and 5' shoulders on both sides. There is room for a 6C' right of way in phase 1 and in phase 2 also. It was mentioned that if the Commission wanted City street standards in phase 2, it could also ask for them in phase 1. Mr. Page noted that the first cluster of units was built in 1975 and is served by a private road. No requests have been made to the City to change the status of that road. Phase 1 is 112 completed, Mr. Page said. The City :Manager has suggested public streets. ir. Mona felt 20' streets were inadequate. Making the streets public was discussed. The base necessary to widen the streets exists. The Commission did not feel curbs were necessary, and a 24' pavement width was mentioned. There is parking provided within the clusters and none will be on the streets. 6. PLANNING COMMISSION NOVEMBER 13, 1979 Mr. Page said two sewer gaugings had been done and showed excess capacity for sewage flow into the Laurel Hill and Andrews Avenue sewers. There is a bottleneck on Imperial Avenue. Mr. Page said public streets would be acceptable if the standards were modified. Rights of way are shown to properties north and south of this project. It was pointed out that if a section of the loop road were blocked, emergency vehicles could not get all the way around the project. All utilities are public. The Commission would like to see 24' of pavement width and a 30' base for the road in both phases. Yir. Woolery moved to continue the public hearin., on the final plat application of the Glenwood Corporation for phase 2 109 units of the Stonehedge development until two weeks from tonight, November 27, at City Hall at 7:30 pm. Mr. Jacob seconded the motion and all were in favor. Continuation of site plan review of parking lot expansion for McDonald's at 1225 Williston Road The applicants have requested a postponement of the hearing. The meeting was adjourned at 11:45 pm. Poger Chairman South Burlington Planning Commission October 27, 1979 M E M O R A N D U M To: Stonehedge File From: SSP Re: Informational requirements for Stonehedge Phase II final plat Date: 9/18/79 I met with Mervin Brown, owner, and Lance Llewellyn engineer, this afternoon to discuss information requirements for the final plat for phase 2 of Stonehedge. I told them that the following information would suffice for the purpose of the final plat: plan view of loop road (with spot elevations) public sewer (with invert elevations) and water mains storm drainage and cluster layout, all at a scale of 50-100'; it was also understood that larger scale (20'-30' per inch) "as -built" drawings would be submitted on a cluster by cluster basis; further review by the Commission would be required if there were substantive changes in building or road layout from the approved final plat to the large scale working drawing stage. Additional information may be required during the course of the final plat public hearing, including a review of the issue of design standards and owner- ship for the loop road. cc: Merve Brown, Lance Llewellyn, Dick Ward, WJS M E M O R A N D U M To: South Burlington Planning Commission From: Stephen Page, Planner Re: Next Meeting's Agenda Items Date: May 4, 1979 #2 Meadowood South I have conferred with Dick Spokes on the access question; he has recommended clearing this up at the outset, and that the Commission not proceed towards a preliminary approval conditioned on the resolution of the road situation. I would add that the sewer and water lines to be extended to the new project, presently lie within the private street rights of way at Meadowood at Spear; consequently,they too are a part of the street issue. The other items left open for discussion at the last meeting were: drainage (see comments from City Engineer), pedestrian trail location (apparently no meeting has taken place yet), and parkland dedication or rquivalent fee - the site obligation works out to about 2/3 of an acre (equivalent fee would be about $900). My recommendation is to acquire the land in this situation. I will be consulting with Bruce O'Neil on this prior to the meeting. In summary, I strongly urge you to resolve the street and utility situation uP front; I reiterate my very firm recommendation that public streets and utilities be required for this proposal - to do otherwise invites continued disputes with this and other developers, as well as home- owners, over utility extensions, school bussing, road maintainence, and other municipal services. #3 The Partners Subdivision A site inspection will be held 4:00 P.M. Monday, May 7, at the rear of the Grand Union building. A response from the School Board, on access across their property, is still pending. Kr. Page showed the Commission a draft of the letter to the Highway Department regarding the subdivision. The Commission felt the following should be added to the letter, " The Commission feels the road would be better served and the possibility of accidents would be reduced if a left turn stacking lane and a through lane were shown on Shelburne Road with a striped line." The motion passed unanimously. There are also questions about site layout. There will be 109 3-bedroom condominiums in 7 clusters in phase 2. The additional hydrants requested by the Fire Chief have been shown and additional access points between the loop road and parking lots for fire trucks have been also. Access to the sewer will be via a paved way over which trucks can travel to get to the manhole. This is a walkway in addition to providing access for utility maintenance equipment. On the final plat the loop road will not be shown going through a stand of trees. An area of about 100' x 60' has been shown for parking boats, campers, etc. A 60' right of way has been shown throughout the project's loop road and 22' pavement width has been proposed. Xr. Woolery wondered if the Commission should suggest that the original part of the loop road be upgraded to 22-24' of pavement and Mr. Poger said the Commission would like to retain the option that if at any time there was an unsafe condition in the development because of road width, they could require the road to be widened. ;fir. lioolery wanted it made clear in,the final motion that there would be no city services provided on the roads and that they would have to be up to city standards before the city would accept them. Mr. Boyle anticipated a 3-5 year build -out period for phase 2, and said that the excess runoff which would be created by paving much of the land in the area would follow the existing drainage pattern. All the things required before, when the apFlication was for residential units have been shown again, such as the possible on ramp for the Interstate and land for Dorset Street widening. This building is smaller than the last one. There will be 7 medical and dental offices of 1,000 sq. ft. each, and the building will be 1 112 stories tall. It meets all the setback requirements. Each office will have two entrances - one in front and one in back. Mr. Page said that if the city land next to this were developed, if the city wanted to, and at its expense, access to this property could be provided and the two could share a curb cut. Y.r. With some minor modifications, the one way circulation pattern around the building, with diagonal parking, is adequate. A waiver of 2 spaces from the required 35 will be necessary. With these exceptions, the site plan is -acceptable in-�all respects (Fire Chiefs comments forthcoming). Q� Stonehedge - Phase II The basic concept of a perimeter loop road linking clusters of 10 to 20 units as in Phase I, has been continued for the 109 (all 3 bedr0 0 m3 units of Phase II. All applicable conditions of the previous approval have been complied with. Site layout considerations include building separations and cluster drive dimensions, maintaining a 601 right-of-way at least alon the east segment of the loop road, rerouting the loop road to avoid the only 2 significant stands of trees on site, loop road pavement width, water system review by Champlain Water District and Fire Chief, details on path system, supplementary parking for trailers, and on site recreation amenities. Impacts on major community services have been assessed for schools and sewage treatment plant capacity (both adequate). Traffic can be estimated but there are no areas nearby where unreasonable congestion could be attributed to this particular project. Spitz, City Planner Re: Potter Park - Land Swap Date: 10/15/81 The federal government has approved the Potter Park Land Swap (see attached letter). however, several questions were raised about the appraisal; and the appraiser must reply to those questions. It is possible that the final appraisal will go up, but that should only be for a small amount. We plan to close on the land purchase next week. Federal and State reimbursement will take place later, shortly after all questions related to the appraisal have been resolved. The amount we must pay next week is $199,428. Federal reimbursement, based on the current appraisal, will be $99,367 (approximately 50%). State reimbursement is based on an earlier approval and will be $54,900 (slightly under 30%). Our balance will be $45,161. If the final appraisal amount will be changed, it will be primarily due to the year that has passed since the original appraisal. I don't expect the amount to go up more than $1,000 an acre, or a total of $13,500. The State will not pay any portion of that additional cost, but the Federal Government will probably pay 50% of it. A contract has been let for the removal of up to four feet of material '' immediately adjacent to the existing Phase 1 Loop Road. Following removal, fifteen inches of gravel aril three inches of crusher run gravel were to be placed and compacted. 2. The work described in l above has been completed. 3. We propose to pave up to three feet from the existing loop road edge thereby providing a twenty-three foot wide road and a one foot plus shoulder. 4. The shoulder shall be covered with topsoil and seeded. 5. The bituminous pavement shall be placed in two lifts as follows: a. 12 inch base course b. 1 inch wear course 6.
