The project will involve the improvement of swales and ditches, replacing of undersized storm drains, the creation of a new detention pond and several bioretention areas, and the development of a compensatory wetland mitigation area. The project area is shown on the attached Location map. Class II wetland is located in the vicinity of the project. The proposed work in the vicinity of the wetland of concern is shown on the attached Overall Site Plan. The work will permanently impact 12,116 square feet of wetland and 26,099 square feet of wetland buffer. It will temporarily impact 4,523 square feet of wetland and 3,427 square feet of wetland buffer. Because the project will impact Class II wetland and buffer, a State Wetlands permit is required. As required by the Vermont Wetland Rules, a copy of the application for this permit is enclosed, to be kept on file at your office for public review. Date: June 6, 2012 RE: Stonehedge North Sign and South Burlington and Sign Ordinance The Stonehedge master associations own and maintain a sign (the "Sign) on an owned parcel near the intersection of Stonehedge Drive and Spear Street (the "Sign Parcel") which touches a larger parcel which is also part of the common land (the "Other Parcel"). The Sign Parcel and the Other Parcel touch at a survey stake point. The City has asked whether the parcels are contiguous; if not, the Sign would not be in compliance with South Burlington's Sign Ordinance (June 3, 2002) (the "Ordinance"). It is our conclusion that the Sign fully complies with the Ordinance. In 1990, the Supreme Court of Vermont held that that the term "contiguous" should be construed in its primary, ordinary meaning of touching. Route 4 Associates v. Town of Sherburne Planning Com'n and Town of Sherburne, 154 Vt. 461, 578 A.2d 112 (1990). In support of its conclusion, the Court relied on Webster's New Collegiate Dictionary as "a compendium of plain and commonly accepted meanings which we presume are intended by the statutory language." Id. citing State v. Yudichak, 147 Vt. 418, 420, 519 A.2d 1150, 1151 (1986). The Webster's Ninth New Collegiate Dictionary defines contiguous as 1: being in actual contact: touching along a boundary or at a point 2: [sic] angles adjacent [sic] 3: next or near in time or sequence 4: coterminous. Id. The Ordinance provides that, "[w]hen a lot owner owns a lot which fails to meet minimum lot size requirements under the South Burlington Land Development Regulations and such lot is contiguous to another lot owned by the same lot owner, such contiguous lot shall constitute a single lot..." At p. 6. I initially contacted Tom & Ellen Wilkins as the City tax maps listed them as the owner of the parcel on which the Stonehedge sign is located. Mr. Wilkins had a title search conducted which indicated that he did not own this parcel. I am aware that the parcel in question is owned by Stonehedge North Association and Stonehedge South Association. Ownership of the parcel is not the issue; the issue is that it appears that the parcel in question is not contiguous to the Stonehedge property. The sign and property are owned jointly by Stonehedge North Area Association and by Stonehedge South Association, which is managed by Beth Muller. Please include Ms.Muller as well as myself on any communication about the sign. It is the understanding of the Boards of Directors that their two associations are joint owners of the property where the sign is located as well as land on either side of Cedar Glen Drive from Spear Street to Stonehedge Drive. Ownership was conveyed to them and is described in Vol. 287, Page 486 and Vol. 142, Pages 454-457 of the South Burlington land records. Therefore, the reference to the sign being located at 1411 Spear Street is perplexing as that property is located south of the Stonehedge development and Cedar Glen Drive. Thomas and Ellen Wilkins own a house at 1411 Spear Street. Please explain why you believe the sign is located on property that belongs to the Wilkins rather to the Stonehedge associations. In considering this ownership question, we reviewed the title information in our firm's legal file from your purchase of 1411 Spear Street in 1994. One of our paralegals also updated the title search at the South Burlington Land Records on September 8, 2011. From review of this title information, we determined that three of the original subdivided lots along the west side of Spear Street pertain to the ownership question: the original Campbell lot (125' X 6751); the original Curtis lot (140' X 657'); and the vacant lot (250' X 675') lying between them. The vacant lot was acquired by Adcom, Inc. in 1973, in connection with its proposed condominium development of the then open land lying westerly of these three lots. Mr. Thomas E. Wilkins September 21, 2011 Page 2 Adcom subdivided the vacant lot and conveyed the portions as follows: a 60'-wide road parcel was conveyed to the City of South Burlington in October 1973 - the road parcel curves, leaving irregular portions of the vacant lot to the north and south of the road parcel; the entire portion of the vacant lot lying south of the road parcel was conveyed to Campbell in July 1973 - this parcel has Spear Street frontage of 601; - a part, only, of the portion of the vacant lot lying north of the road parcel was conveyed to Curtis in July 1974 - this part has Spear Street frontage of 40'; and there then remained a small parcel with a Spear St. frontage of 96' lying between the part conveyed to Curtis and Cedar Glen Drive - this is the parcel about which ownership is questioned ("Subject Parcel"). I have enclosed portions of a 1974 subdivision plat and the current South Burlington tax map which show the pieces of the vacant lot as it was subdivided. Adcom gave a mortgage to Burlington Savings Bank in July 1973 encumbering the vacant lot and the 50 +- acres lying westerly. Adcom subsequently defaulted on this mortgage, Burlington Savings Bank foreclosed the mortgage, and Burlington Savings Bank then sold the property to Glenwood Corporation in August 1978. The foreclosure decree excepts the parcels conveyed by Adcom to Campbell, City of South Burlington and Curtis. The foreclosure decree did however include the Subject Parcel, which was then included in the deed from Burlington Savings Bank to Glenwood Corporation. We did not chase down any subsequent conveyance of the Subject Parcel by Glenwood Corporation, and assume for these purposes that Glenwood Corporation, or the condominium project that it developed, continues to own the Subject Parcel. In September 1994, Campbell conveyed 1411 Spear Street to you, which included only the original Campbell property (125' X Mr. Thomas E. Wilkins September 21, 2011 Page 3 6751) and the parcel which was conveyed to Campbell by Adcom in 1973. Your deed from Campbell did not include the Subject Parcel, and we conclude that you do not own the Subject Parcel. Your property is identified for city real estate tax purposes as 41640-01411. If you look at the numbering on the current South Burlington tax map, you will see that the City has listed you as the owner of the Subject Parcel. That listing is erroneous. The City previously applied for site plan review of this project and received approval on July 18, 2014. Subsequent to this approval, the project encountered unanticipated problems while obtaining its State wetlands permit. As a result, modifications were made to the site plan to reduce wetland impacts adjacent to the proposed stormwater treatment pond. In addition, the project now also includes a wetland mitigation component. An area of existing wetland between K & L clusters, which is approximately 37,217 s.f. in size, has been overtaken by an invasive plant species (Giant Reed, Phragmites). The revised site plan will remove the Giant Reed and native plant species will be planted in their place. A planting plan is included with the site plan on sheets L-405 and L-406. I have included a letter from Vermont DEC indicating that our Individual Wetlands Permit application was deemed technically complete on April 10, 2015. Distribution requirements (per section 9.2 of the Vermont Wetland Rules) were completed that same day. VWR § 9.5(a). The Vermont Agency of Natural Resources (Agency) received an application dated February 10, 2014 and last revised March 10, 2015 from City of South Burlington Public Works, Tom DiPietro (permittee) seeking an individual Vermont Wetland Permit for a project involving activities in a wetland and associated buffer zone located in South Burlington, Vermont. The Agency gave notice of the application in accordance with the VWR. The Agency considered all comments received during the public comment period during review of the application and issuance of this permit. DECISION. AND PERMIT CONDITIONS Based on the Findings contained in this permit below, the Secretary has determined that the proposed project will comply with 10 V.S.A. chapter 37 and the VWR and will have no undue adverse effect on protected functions and values of the wetland. The permittee has demonstrated that the project will have no undue adverse effects on the protected functions and values of the significant wetland and associated buffer zone, provided the project is conducted in accordance with the following conditions: 2 of 7 City of South Burlington Public Works, Tom DiPietro 2007-469 A. All activities in the wetland and buffer zone shall be completed, operated, and maintained as set forth in permit application #2007-469, the Wetland Mitigation Plan and the supporting materials submitted with the permit application. Within 30 days of the date of issuance of this permit, the permittee shall supply the Vermont Wetlands Program with a copy of the recording of this permit. C. The permittee shall notify the Vermont Wetlands Program in writing or by email prior to the start of the approved project. D. Prohibitions: No additional activities are allowed in the wetland and associated buffer zone without the approval of the Secretary unless such activities are allowed uses under VWR § 6. No draining, dredging, filling, grading, or alterations of the water flow is allowed. No cutting, clearing, or removal of vegetation within the wetland and buffer zone is allowed with the exception of the proposed project area as approved by this permit. The construction of the facility will be conducted in such a manner that no rutting, compaction or other soil disturbance shall occur within the wetland or buffer zone, other than those impacts specifically approved by this permit. E. The permittee shall assign a compliance monitor to be on site during all site preparation and construction related activities taking place in the Class II wetland and buffer zone to assure compliance with the conditions of this permit. A preconstruction meeting will be scheduled with the monitor and Agency Wetlands Program prior to project commencement. The monitor will immediately notify the Agency of any non -permitted disturbance to the wetland or buffer zone. A site inspection with the Agency Wetlands Program will be scheduled within 20 days of the completion of construction and installation. F. All construction activities in the wetland and adjacent 50-foot buffer zone shall be completed within five years of the issuance date of this permit or this permit will expire. Any request for an extension must be received by the Agency at least 30 days prior to the end of the five year period in order to prevent the expiration of the 3 of 7 City of South Burlington Public Works, Tom DiPietro 2007-469 permit. A request for extension may be considered a minor modification at the discretion of the Secretary. Pursuant to VWR § 9.1, projects may not be extended beyond ten years of the issuance date. G. The wetland boundary delineation is valid for five years. The delineation will need to be re-evaluated by a qualified wetland consultant if the project is not constructed during the five-year period and a request for an extension is submitted. H. Within 30 days of completion of the work approved by this permit, the permittee shall supply the Vermont Wetlands Section with a letter certifying that the project was constructed in compliance with the conditions of this permit. A continuous line of orange snow fence or flagging tape shall be installed along the limits of disturbance prior to the start of site preparation and construction. If a stormwater construction permit is obtained for this project, the erosion prevention and control requirements of that permit shall be followed. If a stormwater permit is not required, the permittee shall comply with the following: A continuous line of silt fence shall be properly installed by the permittee immediately upgradient of the snow fence or tape prior to any construction and shall be regularly maintained. Care shall be taken to ensure that silt fence is installed on the contour and not in areas of concentrated flow such as stream channels or ditches. Sediment shall be cleaned out before and after any significant storm event or when sediment has reached less than half the height of the fence. Removed sediments shall be disposed of in a stable, upland area outside the 50-foot buffer zone at least 100 feet from waters of the state and stabilized immediately with seed and mulch at a minimum. All other disturbed soils shall be seeded and mulched within 48 hours of final grading. All sediment barriers and construction fencing shall be removed following the successful establishment of vegetation. K. The method of construction shall be that which presents the least disturbance of stream flow and prevents any discharge of sediment downstream. Stream flow at all times shall be diverted from the work area. The contractor's equipment shall be clean and well maintained, free of fuel, hydraulic, and gear oil leaks, especially if such equipment is to be used in or adjacent to the water. There shall be absolutely no discharge of uncured concrete to the stream flow. Pumping from excavation areas shall be discharged to an overland area or settling basin such that the effluent shall be essentially clarified before reentering the stream flow. All areas of stream bank disturbed during construction shall be suitably reshaped and stabilized with stone fill or a_vegetative planting prior to completion of the project. Additionally, the extent of stream bank disturbance shall be strictly limited, and all existing vegetation maintained to the greatest degree practicable. L. All contractors' equipment shall be cleaned so as to contain no observable soil or vegetation prior to work in wetlands and buffer zones to prevent the spread of invasive species. The permittee shall monitor the portion of the wetland in question annually during early July for five years following construction for the nuisance plant species purple loosestrife (Lythrum salicaria) and common reed (Phragmites australis). All nuisance plants found shall be pulled by hand and disposed of by 4of7 City of South Burlington Public Works, Tom DiPietro 2007-469 burial or burning in a non -wetland location. If hand pulling is not feasible, a state approved invasive species control plan is required. 2. The Secretary maintains continuing jurisdiction over this project and may at any time order that remedial measures be taken if it appears that undue adverse impacts to the protected functions and values of the wetland or buffer are occurring or will occur. 3. This permit does not relieve the permittee of the responsibility to comply with any other applicable federal, state, and local laws, regulations, and permits. 4. The permittee shall allow the Secretary or the Secretary's representatives, at reasonable times and upon presentation of credentials, to enter upon and inspect the permitted property for the purpose of ascertaining compliance with this permit, the VWR, and the Vermont Water Quality Standards, and to have access to and copy all records required to be prepared pursuant to this permit. The Agency accepts no legal responsibility for any damage direct or indirect of whatever nature and by whomever suffered arising out of the approved project. This permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to public or private property, or any invasion of personal rights, or any infringement of federal, state, or local laws or regulations. This permit does not obviate the necessity of obtaining such federal, state, or local permits or approvals as may be required by law. Nothing in this permit shall be construed to preclude the institution of legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject to under other laws. 6. Within 15 days of the date of the decision, the permittee, any person entitled to notice under VWR § 9.2, or any person who filed written comments regarding the permit application may request in writing reconsideration of the decision by the Secretary in accordance with VWR § 9.6. 7. The wetland and adjacent 50-foot buffer zone are located west of Stonehedge Drive in South Burlington. 3. Julie Foley, District Wetlands Ecologist, conducted a site visit to the subject property with Tom DiPietro of the City of Burlington and Charlotte Brodie of Dubois and King on June 14, 2014. 4. The subject wetland is identified as a palustrine wetland on the Vermont Significant Wetlands Inventory maps and therefore is designated as a Class 11 wetland under VWR § 4.6. The wetland in question is described in detail in Sections 7 and 8 of the permit application. The subject wetland is at the northwestern end of an approximately 6-acre, largely forested complex. The subject wetland is the headwater to an unnamed tributary of Potash Brook. 6. The proposed project is described in detail in Sections 10 and 11 of the permit application. The project consists of construction of a stormwater detention pond and other stormwater infrastructure improvements. 7. Proposed impacts to the wetland and buffer zone, summarized in Section 12 of the permit application, are as follows: Wetland Alteration:Buffer Zone Alteration: Wetland Fill: 12,116 sq.ft. The protected functions of the wetland complex include the following: water storage for flood water and storm runoff (VWR § 5.1), surface and groundwater protection (VWR § 5.2), and erosion control through binding and stabilizing the soil (VWR § 5.10). 9. The protected functions of the subject wetland include the following: water storage for flood water and storm runoff (VWR § 5.1), surface and groundwater protection (VWR § 5.2), and erosion control through binding and stabilizing the soil (VWR § 5.10). 10. The following functions are either not present or are present at such a minimal level as to not be protected functions: fish habitat (VWR § 5.3), wildlife and migratory bird habitat (VWR § 5.4), exemplary wetland natural community (VWR § 5.5), threatened and endangered species habitat (VWR § 5.6), education and research in natural sciences (VWR § 5.7), and recreational value and economic benefits (VWR § 5.8). 11. The subject wetland is significant for the water storage for flood water and storm runoff function as demonstrated in Section 16 of the permit application. The detention basin will 6 of 7 City of South Burlington Public Works, Tom DiPietro 2007-469 increase the amount of water stored from development runoff, where the continuation of the current sediment load reaching the wetland over time would lower the water storage capacity. The downstream portion of the wetland will receive less sediment from the development. Based on the factors described in Section 16.2 of the application, as confirmed through a site visit by Agency staff, the proposed project will not result in an undue adverse impact to this function. 12. The wetland is significant for the surface and ground water protection function as described in Section 17'of the permit application. The project in general will decrease the amount of sediment and associated nutrients from reaching the wetland complex. By decreasing the load, it will lower the likelihood of nutrient overload and allow the wetland attenuate a more natural level of nutrient and sediment. Based on the factors described in Section 17.2 of the application, as confirmed through a site visit by Agency staff, the proposed project will not result in an undue adverse impact to this function. 13. The wetland is significant for the erosion control function demonstrated in Section 25 of the permit application. The majority of the wetland adjacent to the stream will remain and continue to serve an erosion control function. Based on the factors described in Section 25.2 of the application, as confirmed through a site visit by Agency staff, the proposed project will not result in an undue adverse impact to this function. 14. Under 10 V.S.A. § 913 and VWR § 9.5, the Secretary may authorize activities in a Class II wetland or in its buffer zone if the Secretary determines that it complies with the VWR and will have no undue adverse effect on the protected functions and values. Based on the permit application, the site visit(s) by Agency staff, and the foregoing findings and analysis, the Secretary has determined that the proposed project will have no undue adverse effects on the protected functions and values of the subject Class II wetlands. 15. Pursuant to VWR § 9.5(b), the permittee has demonstrated that the proposed activity in the subject wetland cannot practicably be located outside the wetland or on another site owned, controlled, or available to satisfy the basic project purpose. All practicable measures have been taken in this proposal to avoid adverse impacts on protected functions, as described in the application. The location of the stormwater basin is located on the low end of the property to capture and treat the greatest amount of stormwater runoff from the existing Stonehedge Development and existing infrastructure. The specific location was partially restricted by the presence of existing buried utilities. Necessary erosion control measures will be utilized during construction and all disturbed areas will be stabilized following construction to prevent discharges to the adjacent wetland and stream. Additionally, approximately 37,000 square feet of the impacted wetland will be enhanced by the removal of invasive giant reed and the reestablishment of native vegetation. 16. June 6, 1978 After conferring with our City Attorney, and meeting on separate occasions with the citizens group and the applicants representatives, I would like to make the following recommendations in lieu of those made in my previous memoranda of May 19 and May 23, 1978. 1. Water & Sewer -on -Site (a) Applicants agreement that no new units will be occupied until city issues a certificate of occupancy. A condition of the issuance of any certificate will be the filing of "as-builts" for sewer and water mains. (b) Bond for additional hydrants as per recommendation ' of fire chief. (c) Specify meter locations for each cluster. (d) Water and sewer mains, including new hydrants, are,to be brought up to city standards, inspected, approved, and deeded to the city, prior to the .issuance of any certificate of occupancy. (e) The city shall immediately request sewer and water easements for the mains servicing cluster "C". (f) All service connections shall be diagramed for new units. However, our City Attorney has ruled that it would not be appropriate to require the applicant to diagram service connections for cluster' "C" . (g) The original plan was for a private water system. Water & Sewer -off -Site (a) It is not feasible to "loop" the Glenwood water main with the Laurel Hill area water lines. There is the danger that someone may accidently open a valve or not close a valve completely; causing excessive high pressures :especially along Shelburne Road and in Shelburne now that they are connected to the Champlain Water District. The Champlain Water District has the potential for interconnecting and controlling the pressures in the two service areas in the event of an emergency through their pumping facilities at the District filtration plant. (b) The city is presently having the Laurel Hill Drive sewer flow gauged in a manner similar to the method used in the Paulsen Associates report. The results of this analysis should be available within a few days. The applicant will be required to complete the improvements to the Laurel Hill Drive sewer at the time dictated by these results. These improve- ments consist of installing another eight inch line parallel to the existing line, and shall be bonded for an amount of $14,000. 3. Storm Drainage (a) Proper functioning of existing storm system shall be checked periodically during construction of units in Phase I. (b) Applicant shall reach an agreement with Mosers conc- erning drainage improvements on Moser property and the timing of these improvements. (c) Repair erosion at ortheast corner of existing loop road. CONTINUATION OF PUBLIC HEARING ON PRELIMINARY PLAT APPLICATION OF GLENWOOD CORP. Chairman Wessel reported that the Planning Commission had walked the site of the proposed development. Lawyer Carl Lisman said he had talked with Mr. Moser, an adjoining property owner, about the drainage run-off and had reached an agreement. He said there would be site work on the second Moser lot and that Mr. Moser seemed satisfied. Planner Stephen Page said he had met with residents of the area,And'they, bave serious and legitimate concerns about the ability of the sewer lines to accomodate the enlargement of Cedar Glen North. They have reservations about the city•s review of the sewer capacity when the development was first constructed and now. Mr. Page felt that preliminary approval should have a stipulation that City Engineer Szymanski meet with the resident's engineer to resolve the differences. The residents should have a response to their concerns. Other concerns brought out at the meeting were about traffic, drainage and water supply. Mr. Wessel remarked that improvements on the above concerns wotild be .bonded and Mr. Page said the people seemed to want more details on the improvements... 'Mr. Morency said that Mr. Szymanski would be the one to answer the questions on the sewer, and other improvements, agreeing that Mr. Szymanski should get together with their engineer. 2 PLANNING CU MISSION MEETING APRI L 2 5, 1978 Mr. Mona and Mr. Poger both felt that the sewer problem should be looked into. Mr. Robert Lang, a resident of the area, said that Mr. Page had covered the concerns of the people. He said they questioned the wisdom of adding demands on the sewer system and felt the sewers should be repaired before being added to. He said there are other areas in the system that were never looked at, pointing out that some of the system has been in more than half the normal lifetime of 25 years. Mr. Morency asked -what else beside the sewer system presented problems. Mr. Page said there were some drainage problems on the lower section of the project, but that it was nothing costly and also that looping of the water line should be done. Mr. Lang said having more units would bring on the added expense of educating the children in our schools since the original Cedar Glen plan did not include children. Mr. Levesque pointed out that we must have housing for our children when they graduate from high school or college. Mr. Mona brought up the questions of catch basins and was told that all the catch basins were in place. Mr. Mona then questioned having a single access road to take care of what will eventually be a fair number of houses. Steve said he had asked for a reservation for a 50' right-of-way. Mr. Ewing felt it should be a 60' right-of-way- if it was eventually going to be a street. Mr. Woolery made a motion for approval of the preliminary plat applicsation which was seconded by Mr. Poger. Mr. Wessel asked for discussion on the motion and the following changes were agreed upon: In stipulation 2: That for a total of 6 be inserted after the phrase "4 additional hydrants." In stipulation 3: Delete the words (goverened by the Paulsen Associates report associated with the Cedar Glen North proposal) and change the word "interpreted" to determined. Add stipulation 5: City Engineer to meet with Laurel Hill residents and their Engineer and the applicant, if he so desires, re sewers and looping of water lines and a report,of the City Engineer's conclusions be sent to the Planning Commission by May 5th. Mr. Mona then read Mr. Woolery's amended motion as follows: I move that the South Burlington Planning Commission approve the preliminary plat application of the Glenwood Corporation, for 92 condominium units as depicted on a plan set of 2 pages, entitled "Glenwood Site Plan", dated 2 23 8. drawn by Terrance Boyle, subject to the following stipulations: 1. A pedestrian easement, skirting cluster "C" to connect the UVM property to the city parkland, shall be shown on the final plat. 2. SITE PLAN REVIEW, LOT #I, MUDDY BROOK INDUSTRIAL PARK Chairman Wessel called on Mr. Alan Palmer to comment on this proposal. Mr. Palmer pointed out details of the application on the plan, saying this would be a 40' by 60' steel building with access from a new street, would have a gravel drive and turning access to the building, the water would be connected to the Champlain Water District, that the sewer plans, lot size and setbacks all meet the city requirements, etc. Mr. Poger asked about road improvements and Mr. Palmer said that all road improvements would be bonded and that he is following up on the Improvements to be made by the state. Mr. Poger said he felt the roadways should be completed before the building can be used. Mr. Woolerty asked about the run-off and Mr. Palmer said that it was being taken care of. Mr. Page pointed out that there are 5 lots concerned, 3 could be developed, but the developer would have to come back before the commission before getting approval for the rest. He mentioned that the second curb cut could not be lined up with 100 Dorset Street but he 'thought it was not too bad. Any work contracted for by the City pursuant hereto shall be let on a contractural basis, or on a time and material basis, or shall be performed by the City with its own work force and equipment'or shall be accomplished in such other manner as in the reasonable judgment of the City shall accomplish the work more expeditiously and economically. 9. If monies are released by the Bank to the City pursuant to Paragraph 5 and if it shall later develop that a portion of the released monies are surplus to the City's needs, any such surplus shall be refunded by the City to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the City when requested by the City by the appropriate statement, and the Developer will not interfere with or hinder such payments by the Bank to the City. The items of concern which are open between South Burlington and the Cedar Glen North Association are as follows: 1. As -built drawings for the underground utilities on Cedar Glen 'north property. 2. All underground utilities are to be turned over to the City of South Burlington for maintenance and operation. 3. Project Base Line - it is to be established by documentation, the interfaces between the former Cedar Glen North and new Glenwood projects, where the City of South Burlington is concerned. 4. Parking - there is inadequate parking at Cedar Glen North, Cluster "C". A small parking lot has been built by the road east of Cluster "C" for their use. Should Cluster "C" lose use of this parking lot, parking on the roadway will be inevitable. Pavement width and shoulders - I am satisfied there is ample parking, access, and circulation on the loop road, cluster entrances, and within the clusters themselves. I think the Commission is dead wrong on this 30' pavement crap, regardless of the type of road or location of parking. I will be sending them copies of p. 32 & 33 of'Ttesidential Streets" (enclosed). I feel the parking areas should be paved. There should be a graveled turnaround at the end of the Phase I loop road. 2. dater & Sewer Lines - Check with Bill Szymanski - I believe they are all in O.K. but need a final inspection and a few minor details - corrected. You should also find out from Bill if the sewer line is l�r-_- sized properly for these 02 units. Jim Godette will review hydrant-+'' location. The easements for the sewer and water mains, to be deeded to the city, should be shown on the plan (10' water, 15' sewer). These mains should not go under any buildings (see 4 unit bldg. at the north end, center). 3. Building Separation - maintaining 30' between all structures (units & carports) should be no problem. 4. Proiect name - Glenwood is a poor choice (Meadowood, Ridgewood, Glendale Park, Cedar Glen Dr., etc.). The loop roar' should have a name. 5. Pathways - Cluster G should have a walkway to the tot lot. -Te would like a public pedestrian easement at the northwest corner of the project, sl(i.rting Cluster C, to connect the parkland to the UVM property. 6. Legalese - .As a condition of final approval we will need: (a) sewer & water line easements (b) review of homeowners s assoc. by-laws by our Cite Attorney, (c) pedestrian easement (d) private road agreement (homeowners agree not to petition city to maintain or upgrade private streets). 7. Recreation Facilities - the price has already been paid in terms of the previously dedicated parkland. This parcel is the city's highest priority for development. Any additional cash contribution the developer might make would be pure gravy. 8. Business Park North I have met with Gordon McArthur, from the State Highway Department, and Dick Spokes, concerning traffic and on site sewage disposal, respectively. I will have additional information to present on both topics at the hearing. 2. Dorgan (A1's French Fries) Subdivision Nothing new has been submitted to date on this application since the previous meeting. I feel tabling would be appropriate, until additional information is presented. 3. Palmer Storage Building Location map and comments previously sent to you. 4. Chastenay Revised Site Plan This plan is for an apartment and office building (now under construction) at the corner of I-189 and Kennedy Drive, which originally showed 20 parking spaces. In order to save more existing trees, and provide a better approach to the main parking area, it has been proposed that 5 spaces be deleted. I feel this is an improvement over the previous plan, and still affords the required number of spaces (15). 5. Glenwood Sketch Plan This is a resubdivision proposal for the former Cedar Glen North property, now under new ownership. The project entails 181 new townhouse units, in addition to the 20 existing units. The overall density conforms to the allowed density of 4 units per gross acre. The impact of the first phase (92 units) on the most critical municipal facilities is nominal because: 1) school children have already been factored in by the School Department in their estimates, 2) sewage capacity is adequate at the Bartlett's Bay treatment plant and 3) the distance from any signallized or congested intersection is so great that it would be difficult to assign any incremental impacts on traffic from this project. The situation is unchanged with regard to police and fire protection, although water line sizing and hydrant location will be reviewed by the Fire Chief. In sum, I feel the primary consideration with regard to Phase I is the physical arrangement of parking, roads, and buildings (utilities are already in). As for Phase II, both physical layout and impact on municipal services merit a thorough review. See attached sketch for location and summery of site and fringe conditions. 6. Econolodge and ICV Site Plans The 60 day time clock expires on these projects March 12 and March 17 respectively. I suggest you deny these applications and invite them to reapply when the various deficiencies are cleared up. Some concerns which I feel should be considered: 1) Private vs. public roads - fire vehicles have experienced problems due to width of travel portions. 2) Development should have recreational facilities such as tennis courts and swimming pool. 3) Pedestrian and bicycle trails easements. Under "Residential Planned Unit Development" provision the Planning Commission is required to waive dimensional requirements - final approval should occur on a cluster by cluster basis. SLAYTON Mr. Douglas Tudhope, Acting Chairman South Burlington Planning Commission 1175 Williston Road South Burlington, VT 05401 Re: Patter Development Dear Commissioners: January 10, 1973 In behalf of our client, Mr. Henry Potter, we ask you to consider the following items in recommending to the Council,who will bear the cost to rebuild the sewer lines on Shelburne Road to allow proper flowage from Laurel Hill and the proposed development of the Potter Project. In accordance with the recommendations made by Paulsen Associates, Inc. and subsequent studies by Engineers Inc. about 380' of 8" pipe, 64' of pipe sleeve and 3 manholes are needed. The estimated cost of this project, including engineering is $15,160.00. We recommend that the City undertake this project for the following reasons: 1. The sewer line when built was improperly graded so as to create a condition under which full capacity cannot be obtained. The Paulsen report also indi- cates that substantial amounts of sewer flow is from sump pumps in Laurel Hills, such flow being a result of inadequate storm drainage. 2. Since the town had accepted this construction at a past date, they are now responsible for the proper maintenance and repair (including rebuilding) of this line. Unconfirmed reports indicate that there have been times in the past when these sections of sewer line have functioned improperly. 3. Since Mr. Potter is developing his land in accordance with the zoning and subdivision regulations adopted by the City of South Burlington, and in fact would not be overburdening the sewer line if it were prop- erly constructed, it is the City's responsibility to rebuild this line. Oversights in providing adequate storm drainage in past developments has also become a burden for our client, necessitating lifting of storm water at considerable expense and diverting it to provide relief from an existing condition. 5. By providing a park on the property line of Laurel Hill south we are already rectifying a past planning error and should not be unduly burdened with correcting other planning or construction errors not of Mr. Potter's making. 6. This project will greatly benefit South Burling- ton land use and tax base (no school children, privately maintained drives, etc.). 7. This project has been stalled for approximately one year with a considerable loss in taxes to South Burlington. Time consumption has escalated the cost of the project which will be born event- ually by the residents of the development.
