We are in receipt of your notice of appeal. In order to be scheduled for
the hearing of October 22, 1979 the scaled site plan must be filed with

Dear Attorney Belcher:
I am enclosing an application to the Zoning Board of Adjustment.
I suggest that you request a hearing as soon as possible. Pro-
visions within the Vermont Planning and Development Act provides
that the same requirements applies to any structure whether it
be conventional, mobular, or mobile home.
The Zoning Board has already denied a variance to construct a
24' x 24' two story conventional structure, I feel that a similar
request might also be denied. However, you may wish to request
a different application, such as a mobile home.
In review of a request the Board must consider the criteria set -
forth in Section 4468 of Chapter 117 - Title 24 of the Planning
and Development Act.

This office now represents Helen Fernandez who desires to make use of
70 Central Avenue in Queen City Park. I am familiar with some of the
correspondence between yourself and attorney Burke relative to this
matter, and in particular your letter of June 21, 1979.
Preparatory to any action by the Board of Adjustment, I would like to
request a zoning permit regarding this lot. This is done to obviate any
jurisdictional problems at the Board of Adjustment level, and also to
acquaint you with all of the facts as I know them.
The lot in its present size was created in 1915. A cottage was built on
the lot soon thereafter, but burnt to the ground sometime during the late
1930's or early 1940's. The foundation markers still exist on the lot.
The property was involved in an extended estate settlement, finally vesting
title in Mrs. Fernandez. It is my understanding that taxes and sewer
charges have been assessed against the property to the estate of Lucy.
Archambault since 1938. The property is bordered on the East by Fire District
No. 1 and on the West by Central Avenue.
Mrs. Fernandez desires to construct or place a modular home or mobile home
on the lot. As you have pointed out in your letter of June 21, 1979, the
lot size is not in compliance with 24 V.S.A. §4406(1) or with §11.00 of your
zoning ordinance. Since the lot dimensions have existed since 1915 and
since Mrs. Fernandez seeks the minimum possible use of the property, it is
requested that a zoning permit be issued. If such a permit cannot be issued,
I request to know (1) whether a modular home (requiring functional assembly
of 2 half shells) has been construed to be a mobile home under your ordinance,
and (2) what information should be submitted to the Board of Adjustment in
seeking the variance for the lot size restrictions.
