Laying out of Holmes Road as a public road South Burlington City Council Meeting Participation Guidelines City Council meetings are the only time we have to discuss and decide on City matters. We want to be as open and informal as possible; but Council meetings are not town meetings. In an effort to conduct orderly and efficient meetings,we kindly request your cooperation and compliance with the following guidelines. 1. Please be respectful of each other(Council members,staff,and the public). 2. Please raise your hand to be recognized by the Chair. Once recognized please state your name and address. 3. Please address the Chair and not other members of the public,staff,or presenters. 4. Please abide by any time limits that have been set. Time limits will be used to insure everyone is heard and there is sufficient time for the Council to conduct all the business on the agenda. 5. The Chair will make a reasonable effort to allow everyone to speak once before speakers address the Council a second time. 6. The Chair may ask that discussion be limited to the Councilors once the public input has been heard. 7. Please do not interrupt when others are speaking. 8. Please do not repeat the points made by others,except to briefly say whether you agree or disagree with others views. 9. Please use the outside hallway for side conversations. It is difficult to hear speaker remarks when there are other conversations occurring. Motion passed unanimously. 4.Ratify the May 19,2014 City Council vote to assess a penalty of 2%for both residential and non-residential property owners who do not file a Homestead Declaration in a timely manner: Mr.Dorn noted that the Council passed this prior to the date of the new effective legislation. The City Attorney felt that the Council should ratify this with the new legislation in place. Ms.Emery asked why the 2%. Ms.Nowak said the Council felt that it was appropriate to have a penalty but that 8%was too high a number. Having a penalty will send the message to people to follow the regulations and to file on time. Ms.Nowak moved to ratify the 19 May 2014 City Council vote to assess a penalty of 2%to property owners who do not file a Homestead Declaration in a timely manner. Mr.Shaw seconded. Motion passed unanimously. 5.Approve Tax Rate and Tax Payment Due Dates: Mr.Hubbard advised that the good news is that the Grand List came in slightly higher than the estimate, so the tax rate will be a bit lower. It was previously.4285 and will now be.4278. This means taxpayers will pay a little less. Ms.Nowak moved to set the tax rate at 0.4278 and to set the due dates for tax payments at 18 August 2014,17 November 2014,and 16 March 2015. Ms.Emery seconded. Motion passed unanimously. 6.Discuss Underwood Property Cover Crop Management Plan;Authorize City Manager to Sign Contracts: SPECIAL CITY COUNCIL 1 JULY 2014 PAGE 2 Ms.Mackenzie reviewed the history. She said the recommendation is to put together a task force to plan for the property and to have them report on or before 1 January 2015. The Task Force would engage a consultant at a cost not to exceed$10,000. In the meantime,money from the FY14 budget and/or contingency fund would be used to insure the maintenance of the property. Ms.Nowak said that to manage the property goes without saying,but there must also be a decision as to the best use of the property for the city. She felt the Task Force should survey what the city needs(e.g., a recreation park,ball field,tennis court,etc.). She didn't want to see this valuable land"only growing rutabagas on it." Ms.Emery noted that Sophie Quest and a group are looking at diverse use in conjunction with Common Roots,Recreation Dept.etc. Ms.Nowak said she would like to see someone from the city defining what the city really needs. She said the other issue is the cost to maintain parks. She noted the city now has more parks than in the past. Mr.Shaw said he was concerned with taking money from the contingency fund. Mr.Hubbard advised there is$9500 in the Open Space Fund which could be used. Ms.Mackenzie said that would mean taking$11,000 from the contingency fund to do both the study and provide a ground crop this year. Mr.Dorn said one question is whether to spend$10,000 this year on a ground crop or to wait until next year when there is a management plan. Mr.Hubbard noted the contingency fund from FY14 is already committed. This would have to come from FY15 where there is$75,000 budgeted for the contingency fund. Another option is to overspend the fund from FY14 which would require reducing the surplus.Mr.Dorn reminded members that the city Is going into a very lean year and carrying over surplus funds would be an advantage. Ms.Mackenzie suggested leaving the land fallow and using the money for a consultant. Members felt this was a workable suggestion. Ms.Emery then moved to designate the balance of the Open Space account to hire a consultant to head a Task Force comprised of one member each from the Bicycle/Recreation Path Committee,Open Space Committee,Recreation Committee,Energy Committee,Sustainable Agriculture Committee and 4 members of the community to deliver a report on or before 1 January 2015. Mr.Shaw seconded. Motion passed unanimously. 7.Other Business: A.Upcoming Meetings: SPECIAL CITY COUNCIL 1 JULY 2014 PAGE 3 Mr. Dorn advised that there will be a Special Steering Committee meeting on Monday,7 July,at 5:30 p.m. prior to the City Council meeting. Both meetings will be at City Hail. The City Council agenda will include 18 interviews for committee positions. B.Ethics/Conflict of Interest Policy: Mr.Dorn gave members a draft of the proposed Ethics/Conflict of Interest Policy. C.Laurel Heights Road Work: Members briefly discussed upcoming work at Laurel Heights. Mr.Dorn said it is anticipated that the contractor will be on site by the third week in July.Where there is clear consensus among residents,the road will be the same as it is now. The 3-way stop that was discussed at the meeting with the neighbors has been deemed to be unwarranted by the engineering consultant. General Discussion of City Center TIF District Proposal from Saxon Partners: Ms. Mackenzie noted she had talked with the Superintendent of Schools and Chair of the School Board about the steps they are taking(e.g.,an appraisal of the property). Mr. Dorn said the city was well into the visioning of the partnership with the schools when the Saxon proposal came in. There will be a consultant on board next week. Mr. Dorn noted that a lot of this discussion relates to the ClP for the city and the visioning process for the schools. CITY COUNCIL, 21 JULY 2014, PAGE 3 One aim is to keep up with who is going into and coming out of debt. Ms. Mackenzie said it behooves everyone to be very respectful of those who want to invest in the community as they feel it is a community worth investing in. There will be discussions about educational funding statewide, and Ms. Mackenzie said if there is talk of consolidation outside of South Burlington,that discussion should also happen in South Burlington. Mr. Dorn stressed that tonight's discussion is just general and is not warned as an action item. It is to give advice and guidance to the staff. He then said it is an exciting concept that 20%of City Center would be built in this project with a huge chunk of housing near services and transportation. He added that the volume and pace of discussions have increased significantly since the Saxon presentation. Ms. Riehle questioned where the School Board is with regard to new schools, moving schools, consolidation,etc. She said this issue is clearly related to new debt and added that with the noise issues at Chamberlin,that may not be the best place to send more children. Ms. Mackenzie said this is a clean slate and the opportunity to work with the community to do something special for students. Ms. Nowak said she has heard interesting comments, none of the negative. People wanted a vision of Market Street beyond this project. The public is asking "what else?" Specifically where is a City Hall and Recreation Center that were part of a previous study. People also felt the proposed development would help others in the area,specifically University Mall. Ms. Riehle felt it was good that the school district was willing to look at this. Ms. Emery said the proposal has caused a lot of excitement. She asked if Phase 2 can happen without Phase 1. Mr. Beaudoin of Saxon Partners said he had seen no negative comments from Front Porch Forum or from the information on the websites. He noted there was a lot of discussion regarding the need for an anchor to make City Center work. At present, the code does not allow an anchor. He then cited failures of other developments where there was no anchor; small stores remain unoccupied below the residential units on upper floors. Mr. Beaudoin noted that the proposed project has only a small portion on Williston Rd. and Garden Street,and those are the only streets covered by Form Based Codes. He added that the only access to Central School would be on Midas Road. CITY COUNCIL, 21 JULY 2014, PAGE 4 Ms. Emery said she always felt there would be an anchor store but questioned why 3 are needed. Mr. Beaudoin said that they are leaning toward all upscale tenants,which will help with apartment rentals. They are not very large anchors(100,000 sq.ft.), more like"junior anchors." They would make the stores on Market Street more viable. Ms. Emery said she would like to see more families in the area. Ms. Louisos noted that in this section,the only thing allowed on the first floor is commercial use. Upper floors can have residential. Mr. Mckenzie added that this is a T-5 district which doesn't lend itself to families. Mr. Shaw felt the Library is very attractive, but he didn't see a "town green" (although this could be made up for by the Library). He saw the need for the scale of parking that is proposed as the development will attract people from the rest of Vermont and places like Plattsburgh. He did not want to abandon the idea of a community center in this process. Mr. Shaw also noted that closing Central School is not a new idea; it was talked about as far back as 1987. Mr. Beaudoin noted they are in a very long term contract with South Burlington Realty. He suggested the city look at City Center and where a town green might be located. Council members were OK with continuing to do due diligence with the School Board. Ms. Louisos felt it was exciting to see a proposal and it was good to keep the bigger picture in mind. The Library would be a good draw to get people to the area. She also felt the city should look at its need for additional property. Mr. Mckenzie said there should be consideration given to the safety of the school as City Center is built out. He reminded people that there is a 10-year deal to give the school access across South Burlington Realty property for safety reasons. The school district also proposed a list of uses in City Center that should be prohibited because of the school's presence. He stressed the city is considering a lot of urban activity in the area of an elementary school. Mr. Beaudoin noted that the school district had asked for T-4 zoning. Saxon Partners is asking for that to be changed to T-5. 8. Discuss and Develop Plan for Second Round of Committee, Board and Commission Appointments: CITY COUNCIL, 21 JULY 2014, PAGE 5 Ms. Mackenzie reminded the Council that appointments to other committees have been held in abeyance because of the proposed new committee structure. She suggested the Council move forward with the understanding that appointment terms may be shortened if there is a new structure. Ms. Mackenzie also informed the Council that the Energy Committee feels they have a lot to do and they would not mind if they were not represented on the Underwood Property Task Force. Members were OK with appointing another member of the public to the Task Force. 9. Liquor Control Board; Ms. Riehle moved that the Council convene as Liquor Control Board. Mr.Shaw seconded, Motion passed unanimously. Members considered the following applications: Monkey Hospitality, LLC—cater party on 1 August 2014 McKee Enterprises—cater wedding on 8 and 9 August 2014 Ms. Emery moved to approve the applications of Monkey Hospitality, LLC, and McKee Enterprises as presented. Holmes Road is presently designated and classified as a Class 3 Town Highway that is sixty feet wide and that extends westerly from U.S. Route 7 (Shelburne Road) to the easterly boundary of the State of Vermont's railroad right-of-way. The existing right-of-way for Holmes Road (Town Highway 112) is further described in a Warranty Deed of Joseph A. Canavan and Lorraine A. Canavan,dated June 13, 1969, accepted by the South Burlington Board of Selectmen on July 21, 1969, and recorded in Volume 91, Page 217 of the City of South Burlington Land Records. The Notice of Premises Examination and Necessity Hearing for Extension of Holmes Road, TH 112, was posted in the City of South Burlington Clerk's Office on May 8, 2014 and delivered to the City of South Burlington Planning Commission on May 8, 2014. A Certificate of Posting and Delivery is attached hereto as Exhibit 1. The Notice was published in the Other Paper, a local newspaper of general circulation, on May 29, 2014. Financial Report—May: Mr.Hubbard reported that expenditures are at 83.8%of what was budgeted. Refunds will be coming from ADP due to their error. These will be distributed to various departments. Higher expenses are offset by higher revenues including fire inspection fees which are 200%over budget projections. The painting of City Hall and the repaving of the parking lot and other building work($76,000) will begin in mid July. The pension payment was made this month. Merchant's Bank will allow the city to make an extra months payment of principle only. The city is working with the Dorset Park Skating Association for them to take over their insurance costs. This will save the city about$23,000. Building permits are at 150%of the estimate. Police revenue remains down,although there is a$100,000 reimbursement coming at the end of the year. The city received some FEMA money for the White Street project, This resulted from storm damage during the May and June storms of 2012 and 2013. 6. Necessity Hearing for the proposed extension of Holmes Road(Town Highway 112)to be held at City Hall: The Chair declared the hearing open. Mr.Rugh explained that this is a statutory process related to the extension of Holmes Road across Vermont Railroad property. The hearing will determine whether this is in the public good. Mr.Rabidoux said he had culled from a file going back to June 2011 any documents related to public good and necessity. These establish a time-line of public will for this project to happen and the City Council's determination that this should happen. He gave the file to the Council. • CITY COUNCIL,16 JUNE 2014, PAGE 3 Rep.Kupersmith said it has been apparent for a long time that there were only 2 possible solutions for homeowners on the other side of the railroad tracks: a private solution with the state for each home involved or a city takeover of the road. Rep.Kupersmith added that a city takeover of the road was the only viable solution and,in her opinion,a perfect solution. Mr.Lipson,Holmes Road resident,thanked the Council for its support. He then reviewed the history as far back as February 2011 when residents were told their deeded rights-of-way were • not legal. At least one homeowner could then not sell their home. Insurance companies researched this and sent letters to the state supporting the homeowners;the state said they were wrong. There has been silence from the state from then on. Mr.Lipson said the only solution was for the city to municipalize a portion of the road. He felt that if the city did not act,homeowners might not have been able to sell or refinance theirproperties. Title insurance companies and banks are also anxious for this to be solved. Mr.Rugh then reviewed the process that will follow this hearing. The city will send out a Notice of intent to survey the right-of-way. The survey will follow and an opinion of record title will be given. Residents can inspect this survey. The city has 60 days in which to return its Order of Necessity to the City Clerk. This will then go to the Transportation Board in Montpelier for a hearing. When this is approved,the road will be laid out. Ms. Emery asked about liability the city might Incur. Mr. Rugh said nothing is changing as of now. This is in a"quiet zone"of the railroad. Maintenance of the crossing is set out,and the state maintains the railway and gates;the city maintains signage and road markings. Ms. Emery then moved to close the hearing. Ms.Riehle seconded. Motion passed unanimously. 7: Comments&Questions from the public not related to Agenda items: Mr.Ryan asked the status of late filing of homestead declarations. Ms.Mackenzie said the City Council has set a 2%penalty. Mr. Ryan felt this was just another way to"grab money"from taxpayers and is not fair. He added that the ones who get hurt are the poorer people who do their own taxes. He also noted that some towns charge a flat$50.00 penalty. 8. Formal Expression of Thanks to the Open Space Committee,receipt of South • Burlington Open Space Report,and Conclusion of Committee Service: Ms. Riehle read comments from Cathy LaRose. Update on MS4 Permit: • Mr.Rabidoux said this report is a preview for more involved discussion later this summer. He noted that the city has a projected stormwater rate to fund$40,000,000 worth of stormwater work. • The city could get involved in the ownership/maintenance of commercial stormwater facilities in any of 3 ways: a. The city could take over ownership and all permitting(the city does not support this) b. The city could remove itself from the equation have the understaffed State Agency of Natural Resources take over commercial stormwater permits(the city does not support this option) c. The city could take over monitoring of commercial waterways. Commercial businesses would have to do maintenance,labor,etc. Staff will work with Attorney Barlow to redraft the ordinance, possibly just removing the words "...residential property only." The city must tell the state what it will do by 30 September 2014 and must notify property owners by the end of October. Ms. Mackenzie asked what other like-size communities are doing. Mr. Rabidoux said other similar sized communities don't have a stormwater utility. Mr.Shaw asked if other communities are complying with MS4. Mr. Rabidoux said they are. This includes the Airport and UVM. He noted that with similar problems there is the opportunity for communities and entities to work together on solution. Members favored option#c. 10. Update from Representative to CCTA Board and interview for appointment: Mr.Magowan advised the CCTA is forming an Operations Committee to get more involved in understanding the day-by-day operations(e.g.,scheduling,allocation of funds,etc.). This committee will be chaired by the Shelburne representative. Mr. Magowan noted that he voted against having this committee as he felt the charter should have required membership of drivers on the committee instead of only Board members. Mr. Magowan said he is interested in continuing to serve on the CCTA Board. He stressed the need to decide how to fund and support transportation in Vermont communities. Federal money is mostly a year-to-year grant that can't be counted on. He added that he would love to see CCTA become a jointly administered organ with drivers who do the day-to-day work. This CITY COUNCIL,16 JUNE 2014, PAGE 5 would take commitment from member communities and some expense to bring in people to build confidence between the two bodies. Ms. Riehle said she has trouble equating the value of CCTA to South Burlington. She had no idea how many of the city's residents CCTA serves and often sees empty buses driving around. She noted the city has no control over the money it is assessed,and she was not sure it was spent as it should be. Mr.Magowan said he was troubled that the Council hasn't gotten this information as it is available. He suggested there is value in bringing UMall employees from Burlington to the Mali. It keeps cars off the road. He said there is information as to where people get on and off buses and the numbers of people going to businesses in South Burlington. Mr.Shaw asked about the viability of a gas tax to support CCTA. Mr. Magowan said 8 years ago he would said yes. Now,CCTA is providing service to 6 other counties,and it would be unfair to Chittenden County residents to have to support that. He added that his main question is whether CCTA should be a directly elected authority. He felt that what exists may be a dated model. Members agreed to make an appointment to the CCTA Board after the position is advertised. 11.Consideration of Ordinance Regarding Licensure and Regulation of Circuses,Carnivals and Shows;first reading of draft and consideration of public hearing warning for 21 July 2013 or another date as directed: Mr. Dorn reviewed the history and current process for events in the city. His recommendation is to delegate authority for approval of such events to the City Manager's office. He noted that sometimes,when time is of the essence,a special City Council meeting is now needed. The new ordinance will enable the city to act more quickly. Ms.Riehle moved to warn a public hearing on Licensure and Regulation of Circuses,Carnivals and Shows for Monday,21 July 2014,at 7 p.m.at City Half. Ms.Emery seconded. Motion passed unanimously. 12.Liquor Control Board: Mr.Shaw moved the Council convene as Liquor Control Board. Ms. Emery seconded. Motion passed unanimously. Motion passed unanimously. 13. Public Hearing on Report of Committee Task Force: Ms.Mackenzie reviewed the history and invited interested parties to speak. Ms.Dooley said she wasn't sure the proposed system would enhance volunteerism. She also thought there should be a better name for the proposed Transportation Committee. She suggested tying the 3 committees to chapters in the Comprehensive Plan and also revisiting the number of yearly meetings for those committees. She was concerned with disbanding the Rec Path/Pedestrian Committee and the Energy Committee. She suggested delineating responsibilities for city staff with regard to committees and also attaching minutes of ,— committee meetings to the City Council agenda package and providing them to department heads. Ms.Dooley felt the city might not be as"future-oriented"as it should be, especially with regard to global warming, attracting young families and serving an aging population. Ms.Goldberg said she agreed with most of the proposal. Her one concern was with committees that would have no city staffing. She felt it was important for committees with the city's endorsement to be served by city staff. Ms.Greco said she agreed with Ms.Dooley. She felt reducing city staff support was important but she wasn't sure the proposal was"there yet." She was concerned with losing public enthusiasm and also felt quarterly meetings of the 3 committees wasn't enough. Mr.Cummings agreed with the need to be more frugal with staff time and also with the need to address transportation,which has no representation today. He was concerned with committees operating outside of the city structure,especially with regard to the application for the Georgetown prize. He proposed that the Energy Committee remain a city committee until 2017;the Committee in turn would minimize the use of city staff as much as possible. Mr.Sproul felt the Recreation/Leisure Arts committee needs a clear mandate. He felt some . form of oversight of recreation is important as is the general oversight of parks. He also thought there should be a formalized process for recreation space in new developments. CITY COUNCIL,16 JUNE 2014,PAGE 7 Ms.Quest said she realizes how hard staff works and cited receiving e-mails sent at midnight. She felt this should not be happening. She agreed with the Energy Committee that they should remain a city staffed committee. Ms.Milizia felt consolidation seemed the natural thing to do. She felt having quarterly meetings seems to eliminate decision making from committees. Following the public comment period, Ms. Emery said she heard the need to reallocate staff time. She felt that moving too hastily would lose something. She also read comments from a resident who felt it was unwise to disband committees that have done well. Ms.Riehle said she agreed with a lot of comments. She is concerned with maintaining the energy and enthusiasm that citizens bring to multiple committees. She added that the city probably doesn't have enough staff to carry out the city's vision. Ms. Mackenzie said the most difficult thing is to manage change. She cited the need to continue to honor volunteerism. She suggested consolidating comments and then making some hard choices at a work session. Ms.Dooley suggested soliciting public comment on the web site. 14.Other Business: Mr.Shaw noted the"posted"sign is still on the Underwood property. Mr. Dorn said that will betaken care of. F• REPORT OF THE AFFORDABLE HOUSING TRUST FUND FEASIBILITY COMMITTEE May 2014 Introduction Over the past 20 months citizens committees have addressed the limited availability of affordable housing for lower and moderate income residents, and the critical need to find ways to increase the supply of affordable housing. The initial study and report, "The Path to Sustainability",was followed by a City Planning Commission subcommittee's work that examined regulatory approaches to stimulating the building of affordable housing. Potential private developers of affordable housing reported to the subcommittee that given land and construction costs, housing affordable to households earning below 80%of median household income(2014$57,550 for a household of three) could not be built profitably. As a result, regulations such as those in the current South Burlington Land Development Regulations setting the required standard for housing"affordability"at 65% of median household income would continue to discourage private development of needed affordable housing. On the other hand, those same private developers reported that setting the minimum standard at 80%would stimulate new affordable housing in the City to meet a significant shortfall of housing for moderate income households. Regulations such as inclusionary zoning and density bonuses would work for those households. For the many households with incomes below 80% of the County's median the subcommittee concluded that the regulatory approach relying on private development by itself would not produce enough housing to begin to address the need. Additional tools are needed. The"Path to Sustainability" report also recommended that the City consider an Affordable Housing Trust Fund citing its successful use in other municipalities to stimulate affordable housing development for working and senior households having the greatest need—those in the 50%to 80% of median income range. Affordable housing trust funds are public sector tools used to direct financial resources to the development of affordable housing for low income households. At present,there are more than 600 housing trust funds in the United States. In Vermont the municipalities of Burlington, Charlotte and Montpelier have established Housing Trust Funds. Additional tools needed by the City to make progress in developing additional affordable housing include strong partnerships with non-profit housing developers, private developers and housing advocates; an ongoing public education effort to dispel inaccurate negative perceptions about affordable housing and to increase recognition of the ways in which affordable housing strengthens communities;the support of non-governmental community leaders; and the support of federal, state and other funding sources. Examples are Community Development Block Grant funds,Vermont Housing and Conservation Board funds,Affordable Housing Tax Credits and foundation and other private sources. The Committee concludes that the community would benefit from more affordable housing. Community development is not a matter of numbers. It is a matter of creating a community that balances residences,jobs and amenities that serve the population we have. South Burlington is a center for manufacturing, retail and service jobs in the County and includes parts of nearly all the major transportation corridors in the region that enable some of our residents to work in and outside the City. The several reasons for reducing individual consumption of fossil fuels for transportation have made living closer to work and other activities more desirable both for working households and for the growing numbers of senior citizens in the City. Furthermore,the City has high quality schools, energy,water and sewer capacity, an excellent library, recreational facilities, shopping,the lake and close by open land and other features that make it a desirable place to live. While the City has welcomed several developments that include housing affordable to households in the 50%to 80%of median income range, including employed and retired City residents,there remains a substantial shortfall of housing these households can afford. TO HELP ADDRESS THIS SHORTFALL,THE COMMITTEE RECOMMENDS THE CITY COUNCIL 1. CREATE A SOUTH BURLINGTON AFFORDABLE HOUSING TRUST FUND(SBHTF) 2. IDENTIFY ONE OR MORE FUNDING SOURCES The purpose of an affordable housing trust fund for South Burlington is to provide an ongoing stream of funds to support strategic participation in development that will increase the City's stock of housing that is affordable to households with income below 80% of median. The trust funds can be used: 1) To participate in new housing development by providing needed funds to support the financing of a project undertaken by a non-profit or for profit developer that meets affordability standards of the SBHTF. 2) To participate financially in projects that preserve existing affordable housing stock in the City. 3) To provide pre-development funding under strict guidelines to housing agencies or developers to assess the feasibility of a planned affordable housing project in the City 4) To support or participate in the purchase of land intended for affordable housing development 5) To provide an amount necessary to administer the fund The Committee has heard from the Champlain Housing Trust that the availability of SBHTF participation would attract affordable housing projects to the City. The fund would be administered by the City. The Committee recommends the City Council appoint a three member advisory board to oversee the fund, issue guidelines for allocation of funds, review proposals for fund commitment and make recommendations to the Council for funding. The board members would have staggered terms. City staffing would be provided by the City Manager or his designee and would consist of collecting proposals and staffing meetings of the advisory board. Meetings would be scheduled semi-annually and could meet additionally as the need arises. The Committee has identified the following potential funding sources: 1. A penny added to the property tax rate. This would be the most powerful and reliable source of funding producing$290,000 annually. It would require a positive City vote to initiate. 2. A portion of the local option tax. The current 1% is currently essential to ongoing City expenses but a charter change to add an additional percent to the rooms and meals tax dedicated specifically to affordable housing could be requested from the Legislature. 3. Payments by private developers in lieu of building affordable units under future inclusionary zoning regulations in areas outside of City Center. This source has potential in the future if inclusionary zoning becomes part of the City-wide Land Development Regulations. Prior to my first term on the Council,I was an active citizen and advocate for the public school system and for Chamberlin neighborhood. My interest led me to become an active member of the PTO,a parent director of the after-school French and Spanish programs(K-5),and a member of the Charter Review Committee. Application Requirements: In order to obtain an Education Sampling Event permit you must provide the following information with your application. Application fee of$230.00 be made payable to the Department of Liquor Control. Permit Restrictions: The Liquor Control Board may grant an Educational Sampling Event Permit to a person to conduct an event that is open to the public and at which malt,vinous, or spirituous liquors or all three are served only for the purpose of marketing and educational sampling, provided the event is approved by the local licensing authority first. Attendees at the Educational Sampling Event shall be required to pay an entry fee of no less than$5.00. Malt/Vinous beverages shall be offered in glasses that contain no more than two (2) ounces of beverage. Spirituous liquor shall be offered in glasses that contain no more than one-quarter ounce of each beverage and no more than a total of one ounce to each individual. At least 15 days prior to the event,an applicant shall submit an application to the Department. The application shall include a list of the alcoholic beverages to be acquired for sampling at the event. No more than four Educational Sampling Events shall be issued annually to the same person. An Educational Sampling Event shall be valid for no more than four consecutive days. The event shall be conducted in compliance with all the requirements of this title. An Educational Sampling Event permit holder: (1) May receive shipments directly from a Manufacturer, Bottler, Certificate of Approval Holder, Wholesale Dealer, or Importer licensed in Vermont or that provides evidence of licensure in another state or foreign country satisfactory to the Board. (2) May transport malt, vinous,and spirituous liquors to the event site, and those beverages may be served at the event by the permit holder or the holder's employees, volunteers, or representatives of a Manufacturer, Bottler, or Importer participating in the event,provided they meet the server age and training requirements under Title 7.
