Final plat application #SD-12-17 of Brett Grabowski & Jen Milot to amend a previously approved three
(3) lot subdivision. The amendment consists of expanding the building envelope on lot #2, 112
Springhouse Road.
The subject lot was approved on 9/25/03 when the zoning in the SEQ designated the easterly portion
of the lot as "restricted" thereby precluding development within this portion of the lot. The SEQ zoning
has since been amended to eliminate this designation. The applicant is requesting to eliminate the
"restricted" designation on the plat to allow for greater flexibility in the location of his new house.
9.06 (B) Open Space and Resource Protection.
(1) Open space areas on the site shall be located in such a way as to maximize
opportunities for creating usable, contiguous open spaces between adjoining
parcels, creating or enhancing stream buffer areas, or creating or enhancing buffers
for primary or secondary natural communities.
(2) Building lots, streets and other structures shall be located in a manner consistent
with the Regulating Plan for the applicable sub -district, allowing carefully planned
development at the average densities provided in this bylaw.
(3) A plan for the proposed open spaces and/or natural areas and their ongoing
management shall be established by the applicant. Such plan shall describe the
intended use and maintenance of each area. Continuance of agricultural uses or
enhancement of wildlife habitat values in such plans for use and maintenance is
encouraged. Existing natural resources on each site shall be protected through the
development plan, including (but not limited to) primary natural communities,
streams, wetlands, floodplains, conservation areas shown in the Comprehensive
Plan, and special natural and/or geologic features such as mature forests,
headwaters areas, and prominent ridges. In making this finding the Development
Review Board shall use the provisions of Article 12 of this bylaw related to wetlands
and stream buffers.
The applicant has submitted a narrative addressing the above open space requirements (see
attached).

The entire lot is wooded so in order to concentrate the disturbance to the smallest area possible, staff
recommends that the applicant show a building envelope comprising the smallest area necessary to
construct the house. The present proposal shows the majority of the lot as the proposed building
envelope. The Board should evaluate the building envelope in light of the above open space
standards and have the applicant propose a suitable location.
The Board has received a copy of a letter sent to the applicant dated September 11, 2012 from Peter
Collins, Esq. on behalf of an adjacent property owner (see attached).

Regulations. Five (5) regular size copies, one reduced copy (I I" x 17"), and one digital (PDF-format)
copy of the plans must be submitted. A subdivision application fee shall be paid to the City at the time
of submitting the application. See the City fee schedule for details.
NOTE: NOTIFICATION of ADJOINING PROPERTY OWNERS: Notification of adjoining
property owners, in accordance with 24 V.S.A. §4464(a) and Section 17.06(B) of the South Burlington
Land Development Regulations, is the responsibility of the applicant. After deeming an application
complete, the Administrative Officer will provide the applicant with a draft meeting agendas or public
hearing notice and sample certificate of service. The sworn certificate of service shall be returned to the
City prior to the start of any public hearing.

Dear Mr. Grabowski and Ms Milot:
Bob and Marley Skiff have requested this office to represent them in connection with your
proposed plans to build a house on Lot #2 of the existing subdivision. They were recently
informed by the City that you have applied to the Development Review Board to change the
"building envelope" for Lot #2 to eliminate the easterly limit of the prior approved building
envelope.
Unfortunately, you did not inform the Skiffs of your plans, nor offer to meet with them to discuss
their concerns prior to applying to the City.
As you are aware, the deed of conveyance of Lot #2 to you in 2003 contained express conditions
and restrictions regarding any future development or construction on the lot, including the
following:
"The land and premises conveyed herein are subject to and have the benefit of the following:
1. Springhouse Road Subdivision, A Planned Residential Development, Declaration of
Covenants, Conditions and Restrictions, dated August 13, 2003 and recorded in
Volume 630, Page 334 of the City of South Burlington land records, as amended by
First Amendment to Declaration of Covenants, Conditions and Restrictions, dated
October 5, 2003 and recorded in Volume 641, Page 468 of said land records.
("Declaration")
4. City of South Burlington Subdivision Approval SD-01-36 and SD-01-37 dated
September 25, 2001, and the conditions contained therein, as amended by City of
South Burlington Subdivision Approval SD-03-57."

The approved subdivision Plats for the Skiff subdivision referenced in the deed and the
Declaration clearly show the original "building envelope" that the Skiffs intended to apply to
each lot, and paragraph #24 of the Declaration provides, "Each residence and any accessory
outbuilding must be constructed within the "building envelope" of each Lot, so as to maintain a
reasonable buffer from adjoining lots shown on the plan." We would strongly urge you to
review your deed as well as the Declaration of Covenants, original Plats and approvals in
connection with the Skiff subdivision.
The Declaration is still in full force and effect, and even if you can convince the City to enlarge
the "building envelope" of Lot 42, the Skiffs will take steps, including litigation if necessary, to
enforce the Declaration and prohibit a violation of the original "building envelope" condition for
Lot #2, including an appeal of any decision of the Development Review Board.
The Skiffs have requested our office to appear on their behalf at the hearing on September 18`h
and to voice opposition to your present plan.
If you wish to avoid further controversy and litigation, I strongly recommend that you have your
attorney contact me to discuss.this matter.

proceeding, which we learned last night from our neighbor Dr. N ichael. Scollins is on the DRB's
schedule for the September 18, 2012 meeting. The Applicants' Revised Site Plan can the City's
web site shows our lot as owned by Robert and Christine Quinn. Please be advised that we
purchased the Quinn property in Decetttber 2006.
We respectfully object, on lack -of -notice grounds, to the above -referenced application
and we asic that tomorrow night's hearing on the application be adjourned. Without vaai vixrg oux
lack -of notice objection, we object to the proposed building envelope as it appears on the

This project, consisting of amending Subdivision Permit #EC-4-2440 for the construction of one five
bedroom single family residence on Lot #2 served by municipal water and wastewater services
located off Springhouse Road in the City of South Burlington, Vermont, is hereby approved under the
requirements of the regulations named above subject to the following conditions.
1. This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from local officials prior to proceeding with this project.
2. The project shall not deviate from the plans stamped "approved" in Subdivision Permit #EC-
4-2440 in a manner which would change or affect the exterior water supply or wastewater
disposal, building location, or the approved use of the building without prior review and
written approval from the Wastewater Management Division.
3. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the South
Burlington Land Records within thirty, (30) days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this permit.
4. This project has been reviewed and approved for the construction of one five bedroom single
family residence on Lot #2. The permittee shall not construct any other type structures
requiring plumbing, including public buildings, duplexes, condominium units, or commercial
buildings, without prior review and approval by the Wastewater Management Division. Such
approvals will not be granted unless the proposal conforms to the applicable laws and
regulations.
5. All conditions set forth in Subdivision Permit #EC-4-2440 shall remain in effect except as
modified or amended herein. Special attention is made to Condition #9 of Permit #EC-4-2440
requiring a certification of construction for the sanitary sewer line extension prior to
occupancy of a structure on Lot #2.
6. The Wastewater Management Division now reviews the water and wastewater disposal
systems under 10 V.S.A., Chapter 64 — Potable Water Supply and Wastewater System Permit.

7. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with the Vermont environmental and health statutes and regulations.
8. A copy of the approved plans and this permit shall remain on the project during all phases of
construction, and upon request, shall be made available for inspection by State or local
personnel.

approval. There is no Act 250 permit required.
Mr. Penniman noted that exterior lights have been removed. All utilities are
being provided by UVM or the City of Burlington. The upgrade is being done to
meet NCAA standards. It is anticipated that there will be an additional 5-10
games on the field each year.
Mr. Kupferman noted a track is being removed which was an impervious surface.
He added that the soils there are generally not very permeable.
The Board was shown a sample of the proposed astroturf. There will be pipes
to collect water which then goes north to Spear St. and then to Williston Rd.
Existing landscaping was reviewed. Mr. Belair said staff has no problem with
the landscape waiver.
Stipulation #7 was added to the approval motion as follows: The Development
Review Board grants a credit of $1.0,080 for existing landscaping.
Ms. Quimby then moved to approve Preliminary Plat Application #SD-03-54 and
Final Plat Application #SD-03-55 of the University of Vermont subject to the
stipulations in the draft motion as amended above. Mr. Bolton seconded.
Motion passed unanimously.
6. Public Hearing: Final Plat Application #SD-03-57 of Robert & Marjorie Skiff
to amend a previously approved three lot subdivision. The amendment consists
of a boundary line adjustment between lots #1 and 2, Springhouse Road:
Mr. Rowe noted the subdivision was approved on 18 September 2001. He showed
the change which will result in lots 1 and 2 being almost equal in size. Lot
#3 will not be changed. Mr. Rowe also indicated the restricted area on the
property.
Lot #1 goes from 7.5 to 5.3 acres. Lot #2 goes from 2.1 acres to 5.3 acres.
No issues were raised.

SUBDIVISION CRITERIA
Pursuant to Section 15.18 of the South Burlington Land Development Regulations,
subdivisions shall comply with the following standards and conditions:
Sufficient water supply and wastewater disposal capacity is available to meet the needs of
the project.
According to Section 15.13 of the South Burlington Land Development Regulations, the existing
public water system shall be extended so as to provide the necessary quantity of water, at
acceptable pressure.
1. The applicant shall comply with the requests of the South Burlington Water Department, as
outlined in the letter from Jay Nadeau dated June 8, 2001.
According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider
or developer shall connect to the public sewer system or provide a community wastewater system
approved by the City and the State in any subdivision where off -lot wastewater is proposed. Prior
to final plat approval, the City Engineer shall certify that available sewer capacity is sufficient to
serve the proposed subdivision.
The proposed alteration to the subdivision boundary will not alter the wastewater disposal of the
property from what was previously approved, on September 18, 2001. Therefore, the same
stipulations remain in effect for the proposed resubdivision.
2. The Development Review Board approved a sewer allocation of 2, 010 GPD
3. The applicant shall be required to pay the per gallon sewer fee prior to issuance of a zoning
permit.
Sufficient grading and erosion controls will be utilized during and after construction to
prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the
subject property and adjacent properties.
4. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03
of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the
standards set forth in Section 16.04 of the South Burlington Land Development Regulations.
The project incorporates access, circulation, and traffic management strategies sufficient to
prevent unreasonable congestion of adjacent roads.
Access to this property is currently provided by a 30' wide private right-of-way from Swift Street,
known as Springhouse Road. The applicant has proposed using this right-of-way and extending
the road, with a width of 18', to serve Lot #2. This private ROW currently provides access to three
(3) single-family dwellings. According to Section 15.12(C) of the South Burlington Land
Development Regulations, a roadway that serves four (4) or more separate developable residential
lots shall be constructed to public roadway standards. The applicant requested a waiver from this
requirement. The Development Review Board approved this waiver in its decision for the
previously approved subdivision, dated September 18, 2001. This waiver will not need to be
granted again by the Development Review Board.

Circulation patterns will not change through the proposed resubdivison of this property. Traffic
management mechanisms will not be required for this subdivision.
The project's design respects and will provide suitable protection to wetlands, streams,
wildlife habitat as identified in the Open Space Strategy, and any unique natural features on
the site.
This criterion is not applicable to the proposed subdivision, as the site does not contain any of the
above -mentioned natural resources.
The project is designed to be visually compatible with the planned development patterns in
the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in
which it is located.
Staff feels the proposed resubdivision is visually compatible with the planned development pattern
in the area and is in conformance with the stated purpose of the SEQ, as outlined in Section 9.01
of the South Burlington Land Development Regulations.
Open space areas on the site have been located in such a way as to maximize opportunities
for creating contiguous open spaces between adjoining parcels and/or stream buffer areas.
Staff feels this requirement is met through the proposed resubdivision.
The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to
ensure that adequate fire protection can be provided.
The proposed resubdivision of this property will not alter fire protection or create any additional fire
hazards.
Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and
lighting have been designed in a manner that is compatible with the extension of such
services and infrastructure to adjacent landowners.
The design and layout of these services and infrastructure will not be altered from the originally
approved subdivision, and therefore should be acceptable to the Development Review Board.
Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is
consistent with City utility and roadway plans and maintenance standards.
The design and layout of these services and infrastructure are compatible with the City's utility and
roadway plans.
5. Pursuant to Section 15.13(E) of the South Burlington Land Development Regulations, any new
electric, telephone, outdoor lighting, and cable distribution systems shall be underground.

The project is consistent with the goals and objectives of the Comprehensive Plan for the
affected district(s).
Staff feels the proposed resubdivision of this property is in conformance with the South Burlington
Comprehensive Plan.
Landscaping.
According to Section 13.06(F)(3) of the South Burlington Land Development Regulations the
Development Review Board shall require street trees to be planted sixty feet on center on both
sides of the street, on average and there should be a minimum of two (2) street trees per lot. Also,
the Regulations state the applicant shall submit a landscaping phasing plan with the subdivision
application. The plans depict at least two (2) trees per lot. The plans show the landscaping as
previously approved. The proposed resubdivision does not require additional landscaping.
Lot Layout.
According to Section 15.10 of the South Burlington Land Development Regulations, a minimum
width to length ratio of one to five (1:5) shall be used as a guideline by the Development Review
Board in evaluating lot proportions. Square or roughly square lots shall not be approved.
With regard to this criterion set forth by the South Burlington Land Development Regulations, staff
has concerns about the layout of lot #3. However, this lot, as depicted on the plans, was previously
approved by the Development Review Board. The lot that will be altering (lot #2) will comply more
closely with the South Burlington Land Development Regulations through this proposal, as it will
become rectangular rather than square.

Portions of Lots #1, 2, and 3 are located within the Restricted Area of the SEQ. However, the two
building envelopes of the undeveloped parcels are shown to be completely within the Development
Area of the SEQ. According to Section 9.06 of the South Burlington Land Development
Regulations, land located within a designated restricted area shall not be included in any lot
created for residential purposes. However, as a condition of approving a subdivision of land that
results in the creation of a lot located in a Restricted Area, the Development Review Board may
require the recording of a notice of appropriate restrictions regarding such a lot in the land records.
The Development Review Board, as part of the previous approval, allowed portions of these lots to
be located in a Restricted Area. This proposed resubdivision does not affect this stipulation.

The South Burlington Water Department has reviewed the final plans for the above
referenced project. Please find my comments below.
1. The owners shall be responsible for all fees associated with the tapping the CWD
24 " DI transmission main along Swift Street. I have attached a copy of the
CWD tapping application for your completion. Please complete boxes three
through twelve and note the information in box thirteen. Send the application
back to this department for final calculation and we will notify you of approval
and tapping fees.
2. I have forwarded these plans to the CWD Wholesale department for their review
and comment. They will also send you a letter of allocation regarding your
request for design flow of 1,890 GPD.
3. This department shall be notified of any changes to this project with revised hard
copy plans.
4. At the completion of the project As-Builts shall be provided to this department in
the form of one hard copy and one electronic copy.
5. After the above items are completed and if there are no other changes to these
plans, the South Burlington Water Department approves these plans relative to all
water related activity.

Mr. Kupferman asked where drainage goes. Mr. Belair said there is a large wetland
behind the property.
Mr. Dinklage noted that any changes to the plan will require Board approval.
Mr. Cameron moved to approve Application #MS-01-05 of David & Heather Main
subject to the stipulations in the draft motion of 18 September 2001. Mr. Boucher
seconded. Motion passed unanimously.
7. Public Hearing: Preliminary Plat application #SD-01-36 and Final Plat
application #SD-01-37 of Robert and Marjorie Skiff to subdivide a 12.85 acre
property into three lots of 7.54 acres (lot 1), 3.13 acres (lot 2), and 2.11 acres
(lot 3), 89 Springhouse Road:
Mr. Collins said the main issue to be resolved is whether the road will remain a private
road. The neighbors want it that way to maintain the ambiance of the neighborhood and
also feel a public road is not needed. The proposed private road will be increased to 18
ft. and will be gravel. Mr. Collins indicated they have signed agreements for the City
Attorney to review for the private roadway and sewer. This would forever be a private
road and would be privately maintained.
Mr. Rowe noted that the driveway was moved so that lights from incoming cars don't
shine into someone's house.
There is also an agreement with the Fire Chief that the 2 new homes will have residential
sprinklers.
Mr. Belair noted that the city denied a project and then a few months later approved a
similar project. There is a question of consistency. The City Attorney has stressed the
importance of being consistent. In another case, this Board required a public road up to
where the houses would be served. Mr. Belair also noted that someday this may not be a
rural part of the city.
Mr. Collins said the Goldberg case was different as that road can be connected to another
property. The road in question here goes nowhere.
A straw vote of members showed that all would support a private road.
The draft motion was then amended as follows: 1) The opening of the motion reads
"...approve preliminary plat application #SD-01-36 and final plat application #SD-0I-
37..."; 2) stipulation #3 reads: "Prior to recording the final plat plans, the applicant shall

record an easement allowing access to the private water line as approved by the City
Attorney; 3) stipulation #8 was amended to read "The ownership and maintenance of

Mr. Farley moved to approve Preliminary plat application #SD-01-36 and Final Plat
application #SD-01-37 of Robert & Marjorie Skiff subject to the stipulations in the
draft motion of 18 September 2001, as amended above. Mr. Schmitt seconded.
Motion passed 5-1 with Mr. Cameron opposing.
8. Public Hearing: Application #CU-01-36 of A Marcelino & Company seeking
approval from Section 26.05, Conditional Uses, and Section 26.605, of the
South Burlington Zoning Regulations. The request is for permission to
utilize four recreational vehicles for temporary residential facilities, 20
Palmer Court: and
9. Site plan application #SP-01-57 of A. Marcelino & Company to amend a site
plan for a 10,981 sq. ft. building used for a contracting business. The
amendment consists of utilizing four recreational vehicles for temporary
residential facilities, 20 Palmer Court:
Members agreed by a vote of 4-2 to hear the amendment on the basis that the change in
the job market was not foreseeable. Mr. Kupferman and Mr. Cameron did not agree with
this finding. Mr. Kupferman noted that the approved use of this site does not include
housing.
Mr. Bombardier said the temporary housing is for seasonal employees from Guatamala.
He then showed the location of the RV's. They are being provided with municipal water
and sewer.
Mr. Dinklage asked when they will be removed. Mr. Marcelino said the latest would be
1 December.
Mr. Schmitt asked about the question of front yard coverage.. Mr. Bombardier said the
front yard had been revised prior to the approval Gordon Woods got for Alan Palmer.
That plan showed 29% coverage and that is what is there now. The plan will be revised
to show this.
Mr. Bombardier noted there is a question of a requirement for extra sewage allocation.
He said the site was permitted for 2800 gpd which included use by 4 companies and an
allowance for expansion. Mr. Dinklage asked if the applicant can attest that they are
under the allocation. Mr. Bombardier said absolutely.

I move the South Burlington Development Review Board approve preliminary plat
application #SD-01-36 and final plat application #SD-or-37 of Robert & Marjorie Skiff
to subdivide a 12.85 acre property into three (3) lots of 7.54 acres (lot I), 3.13 acres (lot
2), and 2.11 acres (lot 3), 89 Springhouse Road, as depicted on a four (4) page set of
plans, page one (i) entitled, "Lands of Robert & Marjorie Skiff Springhouse Road,
South Burlington," prepared by Lamoureaux & Dickinson Consulting Engineers,
Inc., dated 4/2/01, last revised on 9/13/01 with the following stipulations:
i. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. Pursuant to Section 513 of the Subdivision Regulations, the Board waives
Sections 401-i(i) and 40i.i(j) of the Subdivision Regulations and approves a
private street serving five (5) separate residential lots.
3. Prior to recording the final plat plans, the applicant shall record an easement
allowing access to the private water line approved by the City Attorney.
4. The plat plans shall be revised to show the changes below and shall require
approval of the Director of Planning & Zoning. Four (4) copies of the
approved revised plat plans shall be submitted to the Director of Planning &

The Development Review Board approves a sewer allocation of 20I0 g.p.d.
The sewer allocation shall remain in effect for ten (io) years from the date of
final plat approval. Any lots which have not been developed within ten (io)
years shall lose their allocation unless reapproved by the Development Review
Board. The applicant shall be required to pay the per gallon fee prior to permit
issuance.
8. The ownership and maintenance of the sewer lines shall be described in the
Sewage Service Agreement, Waiver and Easement, approved by the City
Attorney.
9. The sewer manhole invert shelf shall not be for the entire pipe diameter not

This project, consisting of amending Subdivision Permit #EC-4-2440 for a boundary line adjustment
for Lot #2 to become 5.35 acres in size and Lot #1 to become 5.31 acres with the existing six
bedroom single family residence served by municipal water and wastewater services located off
Springhouse Road in the City of South Burlington, Vermont, is hereby approved under the
requirements of the regulations named above subject to the following conditions.
GENERAL
1. This permit does not relieve the permittee from obtaining all other approvals and permits as may
be required from local officials prior to proceeding with this project.
2. The project shall be completed as shown on the plans proj. no. 00133, sht. no. 1 "Site Plan"
dated 4-02-01 last revised 5-23-03 and sht. no. 4 "3 Lot Subdivision Plat" dated 4/2/01 last
revised 5-23-03 prepared by Lamoureux & Dickinson Consulting Engineers, Inc. which have
been stamped "approved" by the Wastewater Management Division.
3. The project shall not deviate from the approved plans in a manner, which would change, or affect
the exterior water supply or wastewater disposal, building location or the approved use of the
building without prior review and written approval from the Wastewater Management Division.
4. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be responsible
for the recording of this permit and the "Notice of Permit Recording" in the South Burlington
Land Records within thirty (30) days of issuance of this permit and prior to the conveyance of any
lot subject to the jurisdiction of this permit.

7. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of

We are writing on behalf of Robert & Marjorie Skiff in regards to a proposed Final Plat
Amendment. The Development Review Board previously approved a three lot residential
subdivision (SD-01-36 & SD-01-37) off Springhouse Road on September 25, 2001. The Skiff s
existing residence is located on Lot 1 with the two remaining lots still undeveloped. The three
lots are served by municipal water and sewer, with access provided via a private shared drive.
The proposed change to this subdivision involves adjusting the property line between
Lots 1 & 2. With this change, the lots be both be approximately 5.3 acres. This change does not
affect the size of the proposed building envelope. There are no changes proposed to the
previously approved water or sewer services, or the private shared drive.
The subdivision is located in the Southeast Quadrant zoning district, and includes
designated Restricted and Development Areas. There are no changes proposed to the building
envelopes of the proposed lots. Although the building envelopes for the new homes are located
entirely within the Development Areas, portions of the lots include Restricted Areas. Please see
finding 7 and condition 6 of the Development Review Board's decision approving lots which
include Restricted Areas.
