Amount of grant:To be determined depending upon how many applications they receive. There is $195,000 available to be split amongst applications received from Chittenden County. b. We added a line item to the Stormwater Utility budget in anticipation of FRP related expenses. c. The question will be how much money we receive based on how it is split between applicants in Chittenden County. If it is only a small amount,it may not be worthwhile to pursue the grant and have to follow VTrans processes and rules for grant administration. VTrans requirements add time and cost to all projects. 12. Who will manage(project manager)grant and grant paperwork if approved(if different person than who is filling out this form),what are any grant compliance requirements,how much time will this take and how is that time available? Are there funds available in the grant to pay for our administrative costs? Can in-kind service be used as part of the City match?Tom will manage the grant and all associated work. Exceptions can be made especially when the funding source(s) do not provide sufficient lead time 4) Attach any supporting documentation to the Form. 5) Assistant City Manager will review Form for accuracy and completeness—Assistant City Manager does not approve or reject application. 6) After being reviewed if the Form is complete the Assistant City Manager will submit form to City Manager for approval or rejection. 7) City Manager may request meeting with applicant for clarification. 8) City Manager will determine whether to approve or reject the application and have the project manager informed of the decision. Project manager can request a meeting with City Manager prior to Form being reviewed by Council. 9) Whether Form is approved or rejected by City Manager the Form will be reviewed by the City Council. It has come to our attention that the deadline of June 21,2013 for the application of this funding is not conducive to the timeline of submittals required by the Agency of Natural Resources.For that reason we have decided to extend the deadline to July 31,2013 for municipalities within Chittenden County and October 31, 2013 for all other municipalities. Further we have become aware that within the MS4 communities there are concerns of different requirements and processes required for LTF projects utilizing federal funding. To clarify,these projects will be considered scoping efforts and the end product will be at minimum a draft Flow Restoration Plan, Projects will not require environmental documentation,Right-of-way clearances or permitting of any sort. The high flow target requires a 33.9% reduction in flows during the 1 year storm event. The City plans to hire a consultant who will create a FRP capable of meeting these targets. The City is currently working with a consultant and MS4 partners to develop a FRP for the Centennial Brook watershed. When hiring a consultant for the Centennial Brook FRP,the City created a request for proposals process and established a scope of work for FRP development. We anticipate using similar documents(available upon request)for the Bartlett Brook FRP. Estimated Project Cost:We estimate the cost of FRP development for the Bartlett Brook watershed will be-$70,000. Costs to develop the Centennial Brook FRP are expected to be -$92,000. We anticipate that costs for Bartlett Brook will be lower based on watershed size,complexity,flow targets, and other factors. Partnering Municipalities:The Bartlett Brook watershed is located almost entirely within the City of South Burlington. There are 40 acres of watershed (5.4%) located in the Town of Shelburne, but this area is predominately forest/open space and it is highly unlikely that the FRP will require work to be completed in this area. However,the City plans to work with the Town of Shelburne and give them opportunity to comment and participate in FRP development. Partnering MS4s: In addition to the Town of Shelburne,the University of Vermont and the State of Vermont(VTrans)are MS4s that own property in the Bartlett Brook watershed. From that hearing, the Council issued their Findings of Fact and Conclusions of Law which identified five properties impacted by the project. Of these five,four are donating their land to the project and the fifth is being compensated for the value of the lands and easements.The final step in this process is for the City to accept the donated land and issue payment(the payment is reimbursable by the project's Federal earmark)for the remaining property. Staff requests the City Council: 1. Authorize the City to compensate Timberlake Associates(801 Williston Road)$9,000 for property rights necessary for construction of the U.S.Route 2 widening project. 2. STEERING COMMITTEE 22 JANUARY 2013 The South Burlington City Council held a meeting on Tuesday, 22 January 2013, at 7:00 a.m, in the Conference Room, City Hall, 575 Dorset Street. Members Present: City Council: P. Mackenzie, Steering Committee Chair; R Greco, S. Dooley, P. Engels; S. Miller, City Manager; School Board: R. Cassidy, E. Fitzgerald, M. Lalonde, Also Present: J. Stewart, School District; R. Rusten, Deputy City Manager;P. Conner, Director of Planning&Zoning; D. Fleming, P. & B.Nowak 1. Agenda Review: No changes were made. 2. Comments& Questions from the Audience, not related to Agenda items: No issues were raised. 3. Review and Approve Minutes of 19 September 2012: Ms. Riehle moved to approve the Minutes of 19 September 2012 as written. Ms. Greco seconded. Motion passed unanimously. 4. Review of Proposed FY14 City Budget: Mr. Miller noted that all budget documents are on the city's website. There is a small increase in the Grand List. General fund expenditures are up 13.7%, mostly related to one-time expenses (e.g., long-term deficit). Non-property tax revenues are up 24.91% for the same reason. Water rates will increase by 3.9% (South Burlington has the 4th lowest rates in the County) due to an increase from CWD. Storm water poses a challenging situation because of the state MS4 permits which will cost the city $40,000,000.00 over the next 20 years. There will be a one-year study period followed by 19 years of repairs to damaged waterways. The ERU rate will increase 2.5% for each of the next 10 years to cover this. There is also a proposed 2%increase in sewer rates to build up cash reserves for a planned 2022 Bartlett Bay Treatment Plant upgrade. Mr. Miller noted that a portion of the payment due for the Airport Parkway Treatment Plant will be paid for by the Town of Colchester. There is also an increase of$109,000 in the charge from the City of Burlington for the portion of South Burlington sewered by Burlington. The city will do a scoping study to determine if connections STEERING COMMITTEE 22 JANUARY 2013 PAGE 2 can be reconfigured to tie into the South Burlington sewer system. The average condo owner will see an increase of$62.84 in the tax bill for city services, and the average single family home owner will see an increase of$82.54. Mr. Fleming asked about the future outlook for the Grand List. Mr. Miller said the city doesn't project beyond the current year. Mr. Rusten explained that the Grand List is comprised of both an increase in existing property values and new building. He also stressed that the city is working with an estimated Grand List and did this very conservatively. The actual Grand List won't be available until June. Mr. Miller noted the city is working with the school district to combine pension management, and that process is going very well and is a good example of city/school collaboration. 5. Review of School Budget: Superintendent Young said they have worked hard to put forward a budget that moves students forward in the stated areas of academics, life-long learning, skills of personal development and positive citizenry. They are also working on a financial vision for the future. Superintendent Young noted a significant drop in revenues (13%)which posed a major challenge. Mr. Stewart explained that there were non-tax revenues received in 2011 which helped balance the budget. These funds are no longer available. Mr. Stewart noted that tuitions from other districts continue to be strong, and the city gets about$300,000 from"school choice" students. There are concerns, however,with potential new legislation that would not have money"follow" a student to a school of choice. Mr. Cassidy said because South Burlington runs a quality school program,people want to send their children to South Burlington. The new law would keep the money for those students in their home districts. Superintendent Young said this is as critically important as is the education of the students who come to South Burlington. He noted there are now 38 "school choice" students in South Burlington schools. This does not include students from Grand Island and Georgia, where there is no local high school. Money for those students would continue to come to South Burlington. Ms. Riehle asked about money for students who go to the Technical schools. Superintendent Young said that money would continue to follow the students. Superintendent Young said the proposed budget shows a 2.09% increase over the previous year; however, with decreased revenues there would be an 8%increase in the residential tax rate over FY13. A single family home would show an increase of$364.00. STEERING COMMITTEE 22 JANUARY 2013 PAGE 3 Superintendent Young also noted that South Burlington will be required to have a split vote on the school budget because spending exceeds both the state average per equalized pupil and the proposed budget exceeds the current year's budget plus 1%. Mr Stewart noted that this law sunsets this year. 40 districts statewide will be splitting their vote. Superintendent Young then directed attention to those programs which could be affected if the second part of the budget vote goes down. This include academic programs at all schools,the pre-K program,replacement of a bus, IT support, and supplies. The total tax increase for the average single family home for both city and school would be $429.00 or 5.70%. Superintendent Young noted the schools have already had to reduce programs to achieve this budget. This includes reduction in teaching staff. School funding is complicated by a slight downward trend in student numbers since state funding is based on the number of students. Some of this is offset by students from Grand Isle and Georgia. Ms. Riehle asked about the capacity of the schools to absorb students without having to hire significantly. Superintendent Young said some elementary grades are at the maximum per class or exceed the maximum. There is some capacity at both the middle and high schools. Some programs could absorb more students,others could not. If funding doesn't follow"school choice"students,there could be a significant problem. Ms. Mackenzie said a 13% increase in property taxes is hard to swallow. She noted the Business Roundtable is working on a number of issues to try to develop "employable youth." Mr. Cassidy said this is a hard year for city taxpayers. But he stressed that the school spending increase is actually lower than the city's. Ms. Mackenzie said they will have to be very transparent about the lost revenues. Ms. Dooley asked if there would be more layoffs if the second part of the vote fails. Superintendent Young said there could be. 6. Review School Plans/Update regarding School Safety and Emergency Preparedness: Ms. Mackenzie noted that a citizen had asked if there are plans to address any type of emergency incident at the schools. Superintendent Young said the schools are very involved with the Police and have regular safety audits. Because of recent incidents in other places, there are changes being made, including new hardware on door fronts, restricted access from the Library into the STEERING COMMITTEE 22 JANUARY 2013 PAGE 4 school, and updated protocols and procedures. 7. Review City/School Planning: Members agreed to continue this item to the next Steering Committee meeting. 8. Other Business: Ms. Dooley commended Mr. Lalonde for joining the form based codes committee. She said she would welcome a School Board member on the affordable housing committee. He was a diligent member of the DRB, regaling us with stories of his travels,sports scores and statistics(the Red Socks,especially)to help keep the atmosphere light. He was serious in his participation in DRB matters,although not vociferous. His comments were helpful,thoughtful, and respected. He helped us find common ground,and the community can be grateful for that. He found his larger voice in writing for The Other Paper and for Vermont Maturity Magazine. Roger was appointed to the Planning Commission on August 18, 1998 and when the Development Review Board was created on July 19, 1999, Roger was appointed to this newly created municipal panel. Roger served on this Board until passing a few months ago and was the only remaining original member of the Board. Roger was a unique individual and he is greatly missed. From that hearing,the Council issued their Findings of Fact and Conclusions of Law which identified five properties impacted by the project.Of these five,four are donating their land to the project and the fifth is being compensated for the value of the lands and easements.The final step in this process is for the City to accept the donated land and issue payment(the payment is reimbursable by the project's Federal earmark)for the remaining property. Staff requests the City Council: 1. Authorize the City to compensate Timberlake Associates(801 Williston Road)$9,000 for property rights necessary for construction of the U.S.Route 2 widening project. 2. The Bartlett Brook watershed is 736 acres in size and is listed as impaired by the Vermont Agency of Natural Resources (ANR) (http://www.anr.state.vt.us/dec/waterq/mapp/docs/mp 2008.State Lists Final.pdf).The ANR released a TMDL for the Bartlett Brook watershed that was approved by the U.S. Environmental Protection Agency in 2007.The TMDL set targets for flow modification in the stream. The low flow target requires a 13.9%increase in stream flows during low flow conditions. The high flow target requires a 33.9% reduction in flows during the 1 year storm event. The City plans to hire a consultant who will create a FRP capable of meeting these targets. The City is currently working with a consultant and MS4 partners to develop a FRP for the Centennial Brook watershed. When hiring a consultant for the Centennial Brook FRP,the City created a request for proposals process and established a scope of work for FRP development. We anticipate using similar documents(available upon request)for the Bartlett Brook FRP. Estimated Project Cost:We estimate the cost of FRP development for the Bartlett Brook watershed will be"$70,000. Costs to develop the Centennial Brook FRP are expected to be—$92,000. We anticipate that costs for Bartlett Brook will be lower based on watershed size, complexity,flow targets, and other factors. Partnering Municipalities:The Bartlett Brook watershed is located almost entirely within the City of South Burlington. There are 40 acres of watershed (5.4%) located in the Town of Shelburne, but this area is predominately forest/open space and it is highly unlikely that the FRP will require work to be completed in this area. However,the City plans to work with the Town of Shelburne and give them opportunity to comment and participate in FRP development. Partnering MS4s: In addition to the Town of Shelburne,the University of Vermont and the State of Vermont (VTrans) are MS4s that own property in the Bartlett Brook watershed. Mr. Shaw moved that the City Council grants a credit against any Road Improvement Impact Fee that the South Burlington Impact Fee Ordinance requires the Applicant to pay, to include a 20' southbound left turn lane, the pedestrian crossing infrastructure north to south and east to west, and sidewalk, parking, curbing, lighting, and drainage system for future road, and road CITY COUNCIL 1 JULY 2013 PAGE 4 connection, in an amount that equals the actual cost to the applicant of the in-kind contributions, as defined in the Impact Fee Ordinance, and only to the extent that the actual cost to the Applicant of the In-Kind Contributions does not exceed the total amount of any Road Improvement Impact Fee that the Applicant must pay in association with the current DRB application. Mr. Shaw then moved the City Council authorize the expenditure of no more than $79,250, with funds to come from Fund 221, for the box culvert and half of its installation, along what is currently known as"Street A,"to be used as part of the total cost of construction of the road connection to the westerly property line of the Malone property near 200 Dorset Street, and of no more than $2613 to complete construction of east-west pedestrian crossing infrastructure. We further authorize the City Manager to enter into a legal agreement with Malone Dorset Street Properties, LLC, to reflect the cost sharing authorized herein and to reflect an appropriate time frame and assurance for the completion of the work, appropriate stormwater easements, and that any additional funds beyond this contribution shall be the applicant's responsibility. Executive Session: Ms.Nowak moved that the Council meet in executive session to discuss personnel issues. Mr. Shaw seconded. Motion passed unanimously. Regular Session: 1. Consider Appointment of City Manager Search Committee: Ms.Nowak moved to appoint the following persons to the City Manager Search Committee: Charles Baker Martin Kenny Rene Lebarge Ellen Shapiro John Wilking David Young Chris Smith Jessica Louisos Martha Lyons Mr. Shaw seconded the motion which was then passed 4-0.
