HomeMy WebLinkAboutSD-12-17 - Decision - 0112 Springhouse Road#SD-12-17 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING BRETT GRABOWSKI & JEN MILOT, 1125 SPRINGHOUSE ROAD SUBDIVISION APPLICATION #SD-12-17 FINDINGS OF FACT AND DECISION Brett Grabowski and Jen Milot, hereinafter referred to as the "applicants," are seeking approval to amend a previously approved three (3) lot subdivision. The amendment consists of expanding the building envelope on lot #2, 112 Springhouse Road. The Development Review Board held a public hearing on September 18, 2012. The applicants were represented by Brett Grabowski. Based on the plans and materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicants are seeking approval to amend a previously approved three (3) lot subdivision. The amendment consists of expanding the building envelope on lot #2, 112 Springhouse Road. 2. The owners of record of the subject property are Brett Grabowski and Jen Milot. 3. The subject property is located in the SEQ Neighborhood Residential Zoning District. 4. The application was received on August 17, 2012. 5. The plan submitted is entitled, "Lands of Brett Grabowski, Springhouse Road. South. Burlington, Revised Site Plan, Lot #2, prepared by Lamoureux & Dickinson Consulting Engineers, dated 07/23/2007, last revised on 09/14/2012. DIMENSIONAL REQUIREMENTS The subject lot was approved on 9/25/03 when the zoning in the SEQ designated the easterly portion of the lot as "restricted" thereby precluding development within this portion of the lot. The SEQ zoning has since been amended to eliminate this designation. The applicant requested to eliminate the "restricted" designation on the plat to allow for greater flexibility in the location of his new house. 9.06 Dimensional and Design Requirements Applicable to All-Subdistricts 9.06 (B) Open Space and Resource Protection. (1) Open space areas on the site shall be located in such a way as to maximize opportunities for creating usable, contiguous open spaces between adjoining -1— CAUsers\Mark\Documents\South Burlington DRB\10.3.12 Meeting Decisions\SD_12_17_1125SpringhouseRd_Grabowski_ffd.doc #SD-12-17 parcels, creating or enhancing stream buffer areas, or creating or enhancing buffers for primary or secondary natural communities. (2) Building lots, streets and other structures shall be located in a manner consistent with the Regulating Plan for the applicable sub -district, allowing carefully planned development at the average densities provided in this bylaw. (3) A plan for the proposed open spaces and/or natural areas and their ongoing management shall be established by the applicant. Such plan shall describe the intended use and maintenance of each area. Continuance of agricultural uses or enhancement of wildlife habitat values in such plans for use and maintenance is encouraged. Existing natural resources on each site shall be protected through the development plan, including (but not limited to) primary natural communities, streams, wetlands, floodplains, conservation areas shown in the Comprehensive Plan, and special natural and/or geologic features such as mature forests, headwaters areas, and prominent ridges. In making this finding the Development Review Board shall use the provisions of Article 12 of this bylaw related to wetlands and stream buffers. The applicant submitted a revised site plan on September 17th 2012 entitled, "Lands of Brett Grabowski, Springhouse Road. South Burlington", prepared by Lamoureux & Dickinson Consulting Engineers, dated 07/23/2007, last revised on 09/14/2012, with a revised building envelope delineated. The Board finds the proposed building envelope to meet the criteria of 9.06 (B) and also finds that the area outside of the envelope shall remain forested / wooded. DECISION Motion by Roger Farley, seconded by Bill Stuono, to approve final plat application #SD-12-17 of Brett Grabowski & Jen Milot to amend a previously approved three (3) lot subdivision. The amendment consists of expanding the building envelope on lot #2, 112 Springhouse Road, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. Any areas outside of the building envelope shall remain forested / wooded with the exception of the driveway. 4. Any change to the final plat plan shall require approval by the South Burlington Development Review Board. 5. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void.
