Staff and the Planning Commission reviewed the 2006 Plan looking for any technical errors that might exist that should be corrected and found a handful, all related to maps and map references. They also reviewed the requirements of 24 VSA 4387 (re-adoption of plans) and were satisfied that the standards had been met through its work in developing the 2011 Comprehensive Plan(presently nearing completion). The Commission approved of the following minor changes be included in this re-adoption: 1. Change the date of adoption on all pages 2. Page 26: Amend the text as shown: "Map 8-6 shows the future land use plan for the City of South Burlington." 3. Page 26: Amend the text as shown: "A discussion of the various land use categories and areas of special concern(i.e., City identified on Map 8 6 is provided below:" 4. Page 28:Amend the text as shown: "In light of the goals described in this section, the City recommends a general land use pattern of higher residential densities in the City Center urban core with a transition to lower densities on the periphery. As shown on Map 8 6, high density residential is proposed in the City's proposed urban center(i.e., city center and Kennedy Drive areas). Moving outward from the proposed urban core,residential densities transition to moderate density in the Williston Road/White Street area and Shelburne Road corridor, and then to low moderate density outside of the "core area" and on the periphery of the City,namely within the SEQ. Recommended Action: Staff recommends that the Council open the public hearing and gather any feedback, and to couple this feedback with feedback received at the second public hearing, scheduled for March 7th. At that time the Council may choose to re-adopt the Plan. 3 Co ,a1 south � �G PLANNING & ZONING MEMORANDUM TO: Sandy Miller, South Burlington City Manager FROM: Cathyann LaRose, Associate Planner RE: Naming Recommendations for 1100 Dorset Street DATE: February 16, 2011 Earlier this fall the City Council requested a recommendation from the Natural Resources Committee on an official name for the city-owned property adjacent to Dorset Park. This property has in the past been referred to as the 'Calkins Property' or the `Dorset Park Natural Area.' However, it has never been officially designated in name by the City Council. Planning staff worked with the Natural Resources Committee to investigate the property in reference to its historical, geographic, and geologic attributes. The Natural Resources Committee also solicited recommendations from a talented group of South Burlington Middle School students who participated in a place-based learning module throughout the first semester. The Committee considered nearly 20 different naming options. The final recommendation of the Natural Resource Committee is: Wheeler Highlands Nature Park Historical Reference The Committee considered several historical references to a proud history of the property, including Crossman, Wheeler, Heald, and Calkins. While each may be appropriate, the Committee unanimously believes that Wheeler most robustly reflects the property and the City's heritage: • Herman H. Wheeler constructed the three-story brick farmhouse (now the headquarters of the National Gardening Association) on the property in 1903. • Mr. Wheeler served as the City's Town Clerk and Town Treasurer, and also served as a representative to the Vermont Legislature. For at least sometime, the building served as his office in these official capacities. • The Wheeler family maintained ownership of the property for nearly 40 years. The Committee also carefully considered the common name of Calkins but ultimately did not feel any responsibility to the Calkins name. Research indicates that: • While Rena Calkins owned the property, she never actually lived on the site or even in the City of South Burlington; she rented the house to various people and members of her extended family used the remainder of the property to raise cattle. He recently approached me to inquire about any surplus lockers we might have at the old police station. CUSI is in need of three that would be used to secure evidence at their Burlington office. South Burlington is an active participant in CUSI and I believe the donation of three lockers would be worthy measure. There are currently 50 or more lockers at 575 Dorset Street. The donation of three would still leave ample lockers for other uses. A requirement of the grant process is that the expenditure plan be reviewed by the local governing body. It also requires that there be a period for public comment. The public comment can be met by warning the review as an agenda item at a council meeting and then providing a time for any public comment during the meeting. I would respectfully request this be warned for the next council meeting(February 22"d)with a brief time allowed for public comment. This is a no match grant that was authorized by the Department of Justice(DOJ)on October 1,2009. We are now at a point of wishing to expend funds and need to complete the above requirements. I have attached the spending plan that was presented to DOJ when the application was submitted. In brief,this grant will be used to outfit the police training space with state of the art media equipment as suggested by the South Burlington Schools Information Technology staff. The remaining funds were requested to fund the attendance of one supervisory officer at the International Chiefs of Police conference. NOW, THEREFORE, BE IT RESOLVED the South Burlington City Council establishes the Pavement/Concrete Excavation Square Foot Fee at$20.00. Enclosed is a copy of the revised draft amendments for your consideration. Warned for Public Hearing 22 February: 1. Clarify standards for the height of structures in the R1-Lakeview District, Queen City Park District, and Lakeshore Neighborhood District;generally re-arrange where height standards are displayed in the regulations. These amendments would clarify which standards apply in which zoning districts. In the past, it was unclear as to which sets of height standards applied in the Rl-L and Lakeshore neighborhood. The city has more strict requirements along Lake Champlain,but there is some confusing language in the regulations that make it unclear as to which standards apply in some cases. This amendment also re-arranges the LDRs to put all height requirements and standards into a single place in the regulations, and adds heights to the table of dimensions at the back of the regulations. The city attorney noted that in the Central zoning districts, height is measured from the post- construction grade of a property rather than the pre-construction grade. It was recommended that the regulations either define "post-construction grade"or change the standard to read "pre-construction grade" as is the case throughout the rest of the document. The Planning Commission recommends the latter, to promote consistency and clarity. The attorney also noted that the regulations have a duplicate definition for"pre-construction grade" and recommended removal of one. As you'll see, the Commission is confident that the amendments—as well as the change to accessory apartment requirements being considered by the Council—are consistent with the Plan. I think it's important to note, however, that the Commission feels that the issue of where the owner- occupant lives on a property with an accessory apartment is being looked at from different perspectives at the Council and Commission level. In discussing the issue,we've tried to consider the situation of the individual homeowner, especially those looking for ways to stay in their neighborhoods despite changing stages of life or household incomes. We discussed the problem faced by the elderly resident who wants to stay in the neighborhood but who has"too much house."With the amendment, he could live in the smaller unit and rent the primary home to help pay the bills. We also discussed the issue of who is looking after rental properties. It was our feeling that by allowing the owner to live on the property, in the smaller unit, it keeps a responsible person on the site. That same property owner, not being permitted to live in a small accessory apartment on site, may simply move out to live in an apartment elsewhere in the city or county and rent out single family home(no accessory apartment). In that scenario, there is no oversight on the property. I think we can all agree that this is a complex issue to which there are pros and cons on all sides, and that each property owner will make different choices about how and where to live. We recognize the need for neighborhood stability and have included it in our long-range work plan to explore ways in which we can ensure that accessory apartments best complement the neighborhoods in which are located. First, my review of the facts and circumstances indicates the SBPOA's grievance was untimely made and thus is subject to denial on this basis. Under Article XIX of the City of South Burlington and Police Officers Association Agreement(hereafter"Contract"), a grievance must be presented in writing no later than 15 working days after the date of an aggrieved employee becoming aware of the subject of the grievance.2 The SBPOA's grievance was submitted in writing on February 2, 2011,outside the 15 working day limitations period if measured against a December 29, 2010 occurrence date. Therefore, it is untimely and denied for this reason. Second, even if not time-barred, an alternative/additional reason to deny the grievance is that, in my view, it is substantively incorrect. You have asserted that the"practice of allowing officers to use Department vehicles as noted above constitutes a mandatory subject of bargaining." I disagree that the take-home use of vehicles was a so-called "past practice"subject to bargaining. In order for a practice to constitute a mandatory subject of bargaining,courts have said "the conduct of the parties must encompass a continuity, interest, purpose and understanding which elevates a course of action to an implied contractual status." Enclosed is the proposed new fee schedule consistent with the overall concept presented in January. Below is a (somewhat) brief summary of the thinking behind, and content of, the proposed fee schedule. Two attached documents, the proposed fee schedule and comparison chart, are also described below. 1. Revenue sources Planning & Zoning revenues are gathered from two primary sources: • Development Review Fees: Those which are paid for the review larger residential or commercial projects, including subdivisions of land, planned unit developments, site plans for commercial properties, conditional use applications, variances, design review, and appeals of the administrative officer. Everything that goes before the DRB falls into this category, as do some actions that the city's land development regulations allow us to undertake administratively. • Permit Fees Those which are paid for the issuance of permits to undertake construction, including an addition to a house, a new swimming pool, etc., as well as any development approved by the DRB or staff following a review. For example, once a property owner is granted approval for a site plan from the DRB, they must then get a permit for construction. 2. Overall Approach As discussed during the department's budget presentation, staff developed the proposed new schedule with the following objectives: • Development review costs to be borne by applicants, not taxpayers; • Development review fees to be based on costs of reviews, averaged; 575 Dorset Street South Burlington, VT 05403 tel 802.846.4106 fax 802.846.4101 www.sburl.com taking place without permits. It is used in Colchester, Middlebury, Hinesburg, and elsewhere. Rows 22-24 (Certificates of Occupancy and Compliance) • Fees based on estimated average review time Rows 27-51 (Subdivision and Planned Unit Developments) • Overview: Subdivisions and PUDs involve three steps: an informal "sketch plan", a "preliminary plat", and a"final plat."At present, we charge a flat fee for all Sketch Plans and Final Plats, regardless of project size, and charge a base fee plus "per lot" fee for Preliminary Plats. • Per unit/lot/fee: There is a substantial gap in our existing permit fee structure. At present, the city charges a"per lot"fee of$100 at the preliminary plat stage, but there is no equivalent"per unit"fee. Therefore,while a project like a Butler Farms, with 100+ individual lots,would pay a fee of$10,500, a similar project that came in as a Planned Unit Development with 100 homes on just five(5) lots would pay a fee of just$1000. Our neighboring communities have addressed this problem by having the fee apply to each lot or unit. The proposed fee schedule reflects this change. • Non-residential per sq ft fee. For the same reasons listed above, staff has proposed to establish a small per sq ft review fee. • In reviewing the fees, staff considered not only the costs associated with each stage of review,but the"total" of the three, and sough to balance these. • Sketch Plan: Staff proposes to increase the base fee and to establish a per unit/lot/sq ft fee to better reflect the amount of staff time that goes into this stage of review. While staff is sensitive to the need to keep "sketch plan" as informal as possible, sketch plans have become increasingly labor-intensive for staff. • Preliminary Plat: The base fee remains the same. As noted above,the "per lot"fee is extended to"per unit" as well. The "per lot" fee is actually reduced to $50 rather than the current$100. This is done to spread the costs out more evenly across each of the three stages of review. In the end,most projects are proposed to pay the same $100 per lot (and now unit),with only projects of between 3 & 9 housing units paying slightly more because of the amount of work involved. Larger projects will pay that higher fee for the first 9 units and then the slightly lower fee. • Final Plat. The base fee remains the same. The per lot/unit fee is spear out over multiple stages, now to include Final Plat. • Southeast Quadrant supplemental fee. The proposed fee schedule includes a 50%per unit/lot supplemental charge. This is intended to reflect the additional work that is required to review each of the many development standards that exist in the SEQ. Rows 53-67(Site Plan, Conditional Use, Variance, Design Review, Misc DRB Review) • Basic fees based on estimated average review time 3 Attachment B: Detailed Fee Schedule Comparison Attachment B follows the same basic format as Attachment A,but includes an example of each of the applications (Column E) and shows what the fee would be for this example under the current fee structure(Column F), the proposed fee structure(Column G,highlighted), and in comparable nearby communities (Columns H-L). A few notes related to these examples and comparisons: • Selection of Comparison Communities: staff elected to use Colchester, Essex Junction, Essex Town, Milton, and Hinesburg as comparison communities. These are each communities that not only share similar types of development,but also have somewhat comparable fee structures. Fees in several other communities, notably Burlington and Williston, were also examined and used for reference in developing our proposed Schedule,but were not included in the comparison sheet because their fee structures are substantially different and therefore difficult to show as an apples-to-apples comparison. • Comparison Data: It is important top note that while fees vary by community, there may be many reasons for this. Fees may simply not have been updated in many years on one town. Permit fees in another town may include building inspection services (eg, Colchester) or different services than what we provide. In some cases, no simple comparison was possible, or the municipality does not charge for that service, and so the information was left out. • Lines 67-77, highlighted. This section of the table is a summary of the TOTAL fees for all three stages of subdivision and PUD review. I am writing to comment on the impact the potential growth of BTV will have on the South Burlington neighborhoods and communities to the north of the airport. These neighborhoods include Country Club Estates, White Rock Estates, and the apartment and condo complexes near the Lime Kiln Bridge. I do not intend to speak for them, as my comments are my own. My family and I reside in Country Club Estates and have done so for 9 years. In some ways we are almost an island separated from South Burlington as we are bordered by BTV, Williston, Essex and Colchester and of course the Winooski River. The only road that keeps us connected to South Burlington continuously is Airport Parkway. There are currently is no side walks or bike paths, only that road. I would just like to ensure any vision of expanding the airport, including the building of a direct access road from 1-89 to the airport, will consider the impact to these neighborhoods and our access to our city and schools. I would hope that any road that is built does not further separate us from the city and that great care is taken to enhance our connection through sidewalks and bike paths. In viewing the presentation materials, it appears that Airport Parkway would dead end from White Street and we would no longer be able to access the Chamberlin School neighborhood as we currently do. I do not want our neighborhood to be completely disconnected from our town or be diverted to the airport to get to our town. Among other impacts, this could devalue our properties and neighborhoods. I understand the airport must grow, but am still saddened to drive past the empty houses awaiting demolition on Airport Parkway. I feel that South Burlington neighborhoods are paying a large part of the price for this expansion. As the airport considers its growth, I hope that the collaboration with the city of South Burlington and its neighborhoods continue. Thank you for your time. Mr. Maille noted that he had seen the Airport's presentation on their 20-year plan and that it included nothing on noise mitigation. He felt the city should respond to this. 2. Announcements & City Manager's Report: Ms. Dooley: The School Superintendent Search Committee has 5 finalists, all but one from Vermont. There will be a meeting on Thursday to determine whom the School Board should interview. At the MPO meeting in January, the main focus was on the merger process. Ms. Dooley noted that she has been elected to the Board of Champlain Housing Trust. Ms. Emery: Asked if there has been any response from Bob McEwing regarding the Airport presenting its 20-year plan to the City Council. Mr. Miller said Mr. McEwing has expressed willingness to do this in March or April. Ms. Emery asked if that means the City can make comments beyond the 28 February deadline. Mr. Miller said he asked about the deadline and has had no response. Mr. Miller asked if the Council would like to ask the Airport to come in for the 22 February meeting. Councilors said they would. Mr. Boucher added that if the Airport can't come in for that meeting that Councilors Emery and Dooley prepare comments since they attended the Airport's presentation. He felt it was a"hard and fast" data. In subsequent years, conceptual designs were completed for an Exit 14 facility. Sen. Leahy secured $3,00,000. For the Route 2 "third lane" and $4,000,000. For the I-89 split ramp. In 2005, the feasibility study for this ramp was completed. The 2011 CCMPO Regional Park and Ride Plan update has the Sheraton/Exit 14 plan as its#1 priority. A scoping study is to be completed this year. It would include a possible extension of the College St. shuttle(possibly to U-Mall and or the Airport). Mr. Penniman showed slides of two intermodal/intercept facilities, one in Lawrence, Mass., and the other in Ames, Iowa. The latter is similar to what would be located in South Burlington and includes one level of office space which provides income. Mr. Murray asked if the size of the facility has been determined. Mr. Penniman said the scoping study will do that. The Exit 14 Split Ramp option would provide access to the Sheraton and to the Catamount Drive areas. It can be developed within the existing right-of-way. Mr. Boucher asked if the split ramp would be only for the southbound exit. Mr. Penniman said it would. He noted that UVM owns the parking lot behind the Sheraton and leases it to the Sheraton to address their parking shortfall. The current thinking is that the proposed facility would ultimately have 1200 parking space. A shuttle bus service is also envisioned. The top level of the facility would be at the same height as the top level of the Sheraton and there would be a bridge connection to the Conference Center. Mr. Boucher asked about a site for a UVM athletic facility which has been discussed. Mr. Penniman said the intermodal/intercept facility is not crucial to any arena facility,but it is complementary. The funding mechanism requires a 20%match which Mr. Penniman said CATMA would provide. He did not see any financial obligations for the City of South Burlington. Ms. Boomhower said the scoping study will help understand the conditions of the site (traffic volumes, etc.) and will define the purpose and need for the facility. It will identify a"user profile" and size requirements. It will also identify local and regional concerns and suggest alternatives. Finally, it will develop capital, operating/maintenance costs and tenant participation. She said the study will probably take 12 months, after which the next steps will be identified. CITY COUNCIL 7 FEBRUARY 2011 PAGE 5 Question: Why not just declare bankruptcy and have employee benefits/contracts modified? Answer: An attempt to declare bankruptcy would most likely be unsuccessful in court and would incur legal costs. There would also be an impact on the Grand List and the value of people's property. Question: Why not vote down the borrowing of money for the Airport Parkway Treatment Plan to lower the sewer rate increase: Answer: The voters approved borrowing money to upgrade the plant. Some of the anticipated grant money was not received, and the cost of obtaining some grants was very expensive. The city pledged $2,000,000 to the project,which is no longer available. The contractors must be paid when the project is completed. If the city doesn't fulfill its obligation, it faces breach of contract charges. Mr. Miller noted the city is looking at reducing extraneous costs,but it has no choice but to continue the project. If the voters approve the ballot item, the city hopes to get a 2%borrowing from the State. The State has indicated there is a good chance this will happen. The city is also looking at interim borrowing if the State money is not available in time to pay the contractors. If the voters turn down the ballot item,the sewer rates would have to be increased even more. Ms. Dooley asked what would happen if the budget passes and the bond vote fails. Mr. Miller said they could revote the bond issue, but the budget would be"problematical" if it fails. He suggested possibly waiting until after the election for the proposed rate increase in case the bond vote fails. Rates can be raised only once a year, and if the bond fails, rates will have to be increased even more. Ms. Dopp cited the need to inform voters of this. Mr. Miller noted that he and Mr. Rusten will be appearing on Channel 17 to discuss this. He stressed that addressing this situation any other way would cost more. Question: Why not vote down the budget twice and then have the same tax rate and utility fees as now? Answer: If the budget is voted down twice, the resulting budget would be even higher than what is proposed for FY12 by as much as $700,000. This is because FY11 did not include expenditures from special funds which are included in the FT 12. Mr. Miller said he believes that what is being proposed is the cheapest way to go forward. Consider Approval of Boards, Commissions, and Committee Attendance Policy: Ms. Dooley noted she has been on other committees where this approach did not seem to be effective. Mr. Miller noted that as far as can be determined,there has been only one committee member withbelow70% attendance, and that board has never had a quorum problem. Mr. Boucher questioned whether this is a"solution looking for a problem." He was concerned that this could exclude people who have unpredictable schedules from volunteering for the city, and he would have a problem with this. Mr. Murray felt that requiring 80% attendance is high. He was concerned it would affect people's encouragement to participate. He didn't feel it was worth the risk. Ms. Dooley felt the expectation of what is expected is appropriate. Mr. Boucher suggested something more informal. Mr. Murray suggested the following language: "It is an expectation that people will make a majority of meetings." Ms. Dopp suggested an"expectation"rather than a formal policy. Mr. Miller suggested possibly changing the application form to indicate an expectation of regular attendance. Committee chairs could also be asked to report on attendance. Mr. Knapp felt it was important to encourage everyone to participate, especially younger people with family and work commitments who have a perspective on what the city will look like in 20 years. He didn't think it was good to have only retired people on boards and committees. Mr. Geier felt it was the responsibility of a committee chair to find a meeting time when all members can be present. He didn't want to see anything more formal than that. Mr. Stuono felt attendance should be addressed by the board in questions. He asked what had become of the alternate policy.
