Monday, March 7, 2011 1) Election of City Council officers (City Manager presiding): Even though Roseanne and Paul have already been sworn in, I've asked Donna to do a "ceremonial" swearing in Monday evening for the cameras, so to speak. a) Chair; b) Vice Chair; and, c) Clerk 2) Establish Newspaper of Record. I have added this item to the Organization Meeting agenda for the first time this year. I believe this should be affirmed annually. CC had, late in 2010, designated The Other Paper as the paper of record. 3) Establish Banking Institution of Record. This is another new agenda add this year. I also think it is wise to annually and publicly affirm who we have our depository relations with. Merchants Bank has been our bank for about 8 to 9 months now. 4) ***Set dates &time for regular meeting being held March 2011- Feb. 2012. We've been meeting the first and third Mondays of each month, except when the meetings conflict with a national holiday. In July and August, CC has traditionally met once per month. Also, I am asking CC to consider whether or not you want to keep April 18 or switch to the 19th (it is the first night of Passover and I'm good with you keeping the 18th and having Bob fill in or switching). Another date with which I have a conflict is Sept. 19th which is the annual ICMA Conference and I'll be in Milwaukee all week. So, same thing — Bob can fill in or we can change the date. 5) ***Annual appointments to be made by majority vote of City Council pursuant to City Charter, Chapter 13, Section 301 (2). There is a separate listing of all the appointments which need to be made annually to conform to state statute and city charter requirements. 6) Reception. Sandy (D) has invited former Governor Madeline Kunin (who will attend) and make some brief remarks. And, there'll be some punch and cookies. The reception is anticipated to end about 6:45 p.m. A press release about this is attached to the CM Update. the July 1st billing which covers the prior three month period. The fees changed last July and, hence, we can't change them any earlier than that. 9) ***Consider approval for a Resolution amending the Sewer Disposal Charges, pursuant to Article IV, of the South Burlington Sewer and Stormwater Ordinance. This change will also occur with the July 1st billing which covers the prior three month period. The fees changed last July and, hence, we can't change them any earlier than that. 10)***Third Reading, Second Public Hearing, of Re-Adoption of Amended Comprehensive Plan, Paul Conner, Planning Director. This is the second of two warned public hearings on the re-adoption of the 2006 Comprehensive Plan. Following the closure of the hearing, the Council may vote to adopt the Plan. Paul has provided a brief summary memo and a copy of the January 18th memo to Council outlining the nature of the amendments and overall proposed strategy for this re-adoption as the 2011 Comprehensive Plan continues to be developed. 11)***Consider approval of a technical correction to the Planning &Zoning permit fee schedule adopted on Feb. 22, 2011, Paul Conner, Planning Director. Staff has identified a pair of minor technical omissions from the Planning & Zoning Fee Schedule adopted February 22, 2011. Paul's memo describes these proposed adjustments and recommends adoption effective as passage of the motion. 12)***Consider approval of Entertainment License Application for the following (all have been reviewed and okayed by the appropriate city departments): • Benefit for Leukemia Lymphoma Society Walk-a-thon (this was a holdover from the last agenda and involves a benefit activity for the aforementioned charity and the information we needed has been completed). • Miller Amusement- Carnival at the University Mall (this is carnival which is coming to town and the Mall will provide security). • Healthy Living (annual —regular events Sundays) 13)***Review and approve minutes from the regular meeting held Feb. 22, 2011. NOW, THEREFORE, BE IT RESOLVED the South Burlington City Council establishes the Stormwater ERU at$5.94 per month. SOUTH BURLINGTON CITY COUNCIL Sandra Dooley Meaghan Emery Paul Engels Roseanne Greco James Knapp RESOLUTION A RESOLTUION AMENDING THE WATER RATES PURSUANT TO ARTICLE VIII, SECTION 1 OF THE CITY OF SOUTH BURLINGTON WATER ORDINANCE WHEREAS, it is necessary for the City of South Burlington to amend its current Water Rates; and, WHEREAS, a user fee is paid by all users of the water system based upon their metered water usage; and, WHEREAS, the City has the authority to establish rates to defray costs of planning, design, construction, operations and maintenance of its water system; and, WHEREAS,Article VIII, Section 1 of the City of South Burlington Water Ordinance states, "The rates shall be established by resolution at an open meeting of the Legislative Body; and, WHEREAS, the current Water Rate is $21.842 per 1,000 cubic feet of metered flow. NOW, THEREFORE, BE IT RESOLVED the South Burlington City Council establishes the Water Rate at $24.174 per 1,000 cubic feet of metered flow. SOUTH BURLINGTON CITY COUNCIL Sandra Dooley Meaghan Emery Paul Engels Roseanne Greco James Knapp RESOLUTION A RESOLTUION AMENDING THE SEWAGE DISPOSAL CHARGES PURSUANT TO ARTICLE IV, SECTION 1 OF THE CITY OF SOUTH BURLINGTON SEWER AND STROMWATER ORDINANCE WHEREAS, it is necessary for the City of South Burlington to amend its current Sewage Disposal Charges; and, WHEREAS, the City charges every person having a building or structure on their premises who is served by the municipal public sewage system where sewage may be collected for the use of the premises by the Owners; and, WHEREAS, the total annual Sewage Charges received by all customers shall be sufficient for the payment for the costs of operating,maintaining and repairing the sewer collection system and plant facilities; and, WHEREAS, Article IV, Section 1 of the City of South Burlington Sewer and Stormwater Ordinance authorizes the City Council to set an annual Sewage Disposal Charge, and, WHEREAS, the current Sewage Disposal Charge is $27.25 per 1,000 cubic feet of metered water flow. NOW, THEREFORE, BE IT RESOLVED the South Burlington City Council establishes the Sewage Disposal Charge at $34.88 per 1,000 cubic feet of metered water flow. SOUTH BURLINGTON CITY COUNCIL Sandra Dooley Meaghan Emery Paul Engels Roseanne Greco James Knapp 4-14014 • Split PLANNING & ZONING MEMORANDUM TO: South Burlington City Council & City Manager FROM: Paul Conner, Director of Planning & Zoning SUBJECT: Second Public Hearing on consideration to re-adopt the 2006 Comprehensive Plan with minor amendments; consider adoption of same DATE: March 7, 2011 City Council meeting In accordance with 24 VSA 4385, the Council at its January 18th meeting warned two public hearings on the re-adoption of the 2006 Comprehensive Plan, with minor amendments. The first of these was held on February 22nd; the second is warned for this Monday, March 7th For background, staff has included a copy of the January 18th memo to City Council describing the proposed strategy of re-adoption of the Plan and enumerating each of the minor edits proposed by the Planning Commission. At Monday's hearing, the Council will have the opportunity to gather public input on the re- adoption of the 2006 Plan. No members of the public offered input at the February 22nd City Council hearing. Following closure of the hearing, the City Council may elect to vote on the re-adoption of the Plan. A vote to adopt would make the Plan effective immediately. Re-adoption of the 2006 Plan does not in any way preclude the adoption of the fully updated 2011 Comprehensive Plan(presently under development by the Planning Commission) once it is complete. Copies of the Plan under Consideration Copies of the 2006 Comprehensive Plan, with the revisions described in the January 18th memo incorporated, can be found on the city's website at www.sburl.com/planning. Please contact staff if you would like to receive a printed copy. Copies were not automatically included in your packet in order to save paper and printing costs on these minor revisions. Recommended Action: Staff recommends that the Council open the public hearing and gather any feedback. Following closure of the hearing, staff and the Planning Commission recommend adoption of the Plan. 1 40 • south PLANNING & ZONING MEMORANDUM TO: South Burlington City Council & City Manager FROM: Paul Conner, Director of Planning & Zoning SUBJECT: Consideration of 2006 Comprehensive Plan Re-Adoption, with minor changes DATE: January 18, 2011 City Council meeting In the course of preparing the revised city Comprehensive Plan, ongoing, the Planning Commission in November reviewed its completion schedule and recommended a dual-track adoption. • Part I will be to complete the 2011 Comprehensive Plan as quickly as possible in the new year, while at the same time ensuring that appropriate consideration is given to the various issues and policies. • Part II is a proposed re-adoption of the existing 2006 Comprehensive Plan(with very minor amendments) as a short-term action while the full update is completed. The current Plan will expire on March 9th, 2011, if not action is taken. The Planning Commission held its formal public hearing on the readoption of the 2006 Comprehensive Plan with minor amendments on January 11th and voted unanimously to approve the Plan and submit it to the City Council for consideration. Proposed Amendments: Staff and the Planning Commission went through the 2006 Plan looking for any technical errors that might exist that should be corrected and found a handful, all related to maps and map references. The Commission approved of the following minor changes be included in this re-adoption: 1. Change the date of adoption on all pages 2. Page 26: Amend the text as shown: "Map 8- 6 shows the future land use plan for the City of South Burlington." 3. Page 26: Amend the text as shown: "A discussion of the various land use categories and areas of special concern(i.c., City Center and Southeast Quadrant)identified on Map g 6 is provided below:" 1 10. Eliminate"Appendix E Southeast Quadrant Goals Based Plan". This map does not appear to be referenced anywhere in the text of the Comprehensive Plan and reflects the planning & zoning that was in place prior to the planning work completed between 2002 &2006. The text of the Plan does not relate to this map. Staff recommends simply eliminating this map or replacing it with the current zoning map for the area. 11. Change Title of"Land Use" map to "Map 1: Current Land Use" 12. Change title of"Public Utilities Map #2"to "Map 5: Public Utilities #2" 13. Change title of"Southeast Quadrant Natural Communities and Buffers" map to "Map 9: Southeast Quadrant Natural Communities and Buffers" 14. Implications of Non- Re-Adoption Under Vermont law, municipalities are not required to have an adopted Comprehensive Plan. Not having a Plan in place, however, makes the city ineligible for a number of programs and actions. Without a Plan in place, the city: • May not amend its Land Development Regulations (Zoning & Subdivision); • May not adopt or amend a Capital Budget and Program; • May not apply for State grants, including Municipal Planning Grants; • May not have the Plan considered in an Act 250 review of applications; and, • May not have the Plan considered by the State when considering new state buildings. Following adoption, there is one final step that the Council may take: to request approval of the Plan from the Regional Planning Commission. The city will remain ineligible for some state grants, and for consideration of location for new State building until the Plan is approved. Because this is a re-adoption, we may not at this time be eligible for regional approval,but staff will contact the Regional Planning Commission for details. Proposed Public Hearing & Adoption Schedule: State Statutes require that the City Council hold at least two (2) warned public hearings prior to the adoption of a Comprehensive Plan. The first of these must, further, be held no less than thirty(30) days following the Planning Commission's public hearing. Staff is proposing a pair of small technical corrections to this schedule. The present fees do not include a minimum fee for non-residential additions and alterations, and the language differs slightly between residential and non-residential peiniits. Minimum fees have been applied to non-residential and residential projects alike for several years.
