Kensel, Greg Rabideau, Paul O'Leary, Roger Schibani 1. Other Business: Mr. Weith noted that House Bill H616 gives municipalities the right to control telecommunications towers. It will be possible for Planning Commissions to request an applicant to pay for reasonable costs for Commissions to hire a consultant to review an application (traffic consultant, wetlands specialist, etc). 2. Public Hearing: Preliminary and Final Plat Application of Amy Sylvester Averill to subdivide a 19.65 acre parcel into two lots of 13.98 acres and 5.67 acres, 1985 Spear Street: Ms. Averill said the lot being created is entirely located in the Town of Shelburne. There have been no changes in the plan since sketch plan review. Mr. O'Rourke moved the Planning Commission approve the preliminary and final plat applications of Amy Sylvester Averill to subdivide a 19.65 acre parcel into two lots of 13.98 acres and 5.67 acres, 1985 Spear Street as depicted on a plat entitled "Subdivision Map Alan & Diane Sylvester 1985 Spear Street South Burlington, Vermont 05403 Town of Shelburne and City of South Burlington" prepared by Brooks Land Surveying Inc, dated January 15, 1998, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plan shall be revised to show the changes listed_ below and shall require approval of the City Planner. Three_ copies of the approved revised plat plan shall be submitted to the City Planner prior to permit issuance. a. The final plat plan shall be revised to show any existing or proposed water lines serving either lot. PLANNING COMMISSION 28 April 1998 page 2 b. The final plat plan shall be revised to include the metes and bounds information for the r.o.w. serving either lot. 3. Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 4. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void The plan shall be signed by the Planning Commission Chair or Clerk prior to re- cording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format, if possible. The format of the digital information shall require approval of the City Planner. Mr. Teeson seconded. Motion passed unanimously. 3. Sketch Plan application of Edward Wolfstein to amend a previously approved three building planned unit development consisting of a restaurant, an office building (TV studio) and car wash. The amendment consists of adding a 1622 sq. ft. outdoor terrace to the restaurant building, 520 Shelburne Rd: Mr. Wolfstein showed the proposed location. The addition would be only for summer and fall months. Patrons would enter through the regular building entrance. Lighting around the perimeter of the building would be upgraded. There would be cut-off lighting around the front of the building. They will also submit a formal striping plan for the parking lot. Mr. Weith raised the issue of allowing parking spaces in the r.o.w. Mr. Wolfstein said that traffic rips through there and they felt this would slow it down. Mr. Dinklage asked if they would be jeopardizing the city's right to build a full street there in the future if parking is now allowed in the right of way. Mr. Weith said the right-of-way is private and was never dedicated to the city. Mr. Dinklage wanted to be sure nothing would jeopardize what could happen there in the future. He noted there will one day be development on the back piece. Mr. Wolfstein said there are already green areas in the r.o.w. Mr. Weith said he didn't feel striping the lot would slow traffic. The proper thing to do is to put in curbs, etc. Mr. Teeson asked if the applicant can meet parking requirements without striping. He said he shared Mr. Dinklage's concerns. If the Commission allows striping and the applicant doesn't meet parking elsewhere, the Commission could be creating a "hardship" for them. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Planning Commission approves a sewer allocation of 720 gpd for lots #1 and 2 (includes 20o reduction allowed by State). The applicant shall be required to pay_ the per gallon fee prior to permit issuance. 3. Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 4. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Sketch plan application of Amy Sylvester Averill to subdivide a 19.65 acre lot (13.98 acres in South Burlington and 6.34 in Shelburne) into two lots of 13.88acres (lot #1) and 5.67 acres (lot #2). Lot #1 is developed with a single family dwelling. This property lies partly in South Burlington and partly in Shelburne. The lot being created (lot #2) lies entirely within Shelburne, 1985 Spear Street. Ms. Averill said the lot is divided by the town line. There is also an easement to Velco across the lot. The larger parcel has been her parents' home for 25 years. Lot #2 will be accessed from the same access as lot #1. The Commission raised no issues. The applicant asked for preliminary and final plat to be held on the same night. The Commission had no objections. MEMORANDUM To: South Burlington Planning Commission From: Joe Weith, South Burlington City Planner Re: April 28, 1998 agenda items Date: April 24, 1998 2) AMYSYLVESTERAVERILL-2LOT SUBDIVISION -PRELIMINARY&FINAL PLAT 4 This project consists of the subdivision of a 19.65 acre lot (13.98 acres in South Burlington and 6.34 acres in Shelburne) into two (2) lots of 13.98 acres (lot #1) and 5.67 acres (lot #2). Lot #1 is developed with a single family dwelling. This property lies partially in South Burlington and partially in Shelburne. The new lot being created (lot #2) lies entirely within Shelburne. The City Attorney has ruled that we should treat this subdivision as if it was entirely within the City of South Burlington. This subdivision will be treated as a major subdivision because lot #2 has no road frontage. The sketch plan was reviewed on 3/24/98 (minutes enclosed). This property located at 1985 Spear Street lies within the R1 and R2 Districts. It is bounded on the north, west and south by residences and undeveloped land, and the east by residences and Spear Street. Access: Access to lot #1 is provided by a curb cut on Spear Street. Access to lot #2 will be provided by a 20 foot r.o.w. across lot #1 since lot #2 has no road frontage. The metes and bounds information for the r.o.w. should be shown on the final plat. Both lots will share the same curb cut. Lot size/frontage: Both lots meet the minimum lot size requirement of one (1) acre. Lot #1 meets the lot frontage requirement of 170 feet. Lot #2 has no frontage. Sewer: No additional sewer allocation needed. The proposed dwelling will be located in Shelburne. By way of background, this application for sketch plan review concerns my proposal to build a single family home on a 5.5 acre parcel of land located on Spear Street entirely within the Town of Shelburne. Our house would be serviced exclusively by the Town of Shelburne municipal facilities. We have received approval from the Shelburne Planning Commission and Zoning Board for the same plan that has been submitted for your review. The 5.5 acre lot in Shelburne that we propose to build our home upon is part of a 19.65 acre parcel of land that has been owned by my parents, Alan and Diane Sylvester, for the past 25 years. Their 19.65 acre parcel is located along the western side of Spear Street and is partially in South Burlington (13.21 acres) and partially in Shelburne (6.44 acres). Their property is not only bisected by the political boundary between South Burlington and Shelburne, but is essentially divided into two separate lots by a 150 foot wide permanent easement to Vermont Electric Power Company that runs along the town line on the South Burlington side of the property. As shown on the sketch plan, my parents' home, driveway and all improvements are located on the South Burlington side of the property (proposed Lot 1), while my home will be located entirely on the Shelburne side of the property (proposed Lot 2). The only property interest I would have in South Burlington is an access easement over my parents' existing driveway. According to the Preliminary Comments, this matter has been classified as a Major Subdivision. It is my understanding that the basis for this classification is that the proposed Lot 2 lacks frontage on Spear Street. However, proposed Lot 2 is located entirely in Shelburne and the issue of frontage for that Lot has been addressed and approved by the Shelburne Planning Commission and Zoning Board as the municipal bodies having jurisdiction over lands located in Shelburne. In terms of proposed Lot 1, it remains unchanged, retaining all of the existing frontage (200 feet), which is more than the amount required under the applicable zoning regulations. In the event the Planning Commission determines that the proposed plan does, in fact, meet the definition of a subdivision over which South Burlington has jurisdiction, then we respectfully request that this matter not be considered a Major Subdivision. Rather, because we are proposing to build only a single home on proposed Lot 2 and because proposed Lot 1 will remain unaffected, we ask that the Planning Commission regard this as a Minor Subdivision and allow us to proceed from sketch plan review to final approval. Of additional concern is City Engineer, William Szymanski's, recommendation that the traveled portion of my parents' private driveway be widened to 20 feet of blacktop and that the access easement itself be expanded to 25 feet in order to accommodate the two—way traffic which he believes will result if the driveway is used for two homes rather than one. The fact that this private driveway will accommodate two homes does not create the need for it to be widened to nearly the width of a public roadway in order to allow for two-way traffic. Indeed, my parents have told me that in the 25 years they have utilized this driveway, they have encountered two- way traffic no more than once every year or two. In those rare instances when one vehicle has happened to pull in while another was leaving, the situation has been easily remedied by one vehicle simply pulling off the shoulder of the driveway to allow the other to pass. If we were to share this driveway with my parents, then the instances of two-way traffic would still be negligible. Furthermore, the area where our driveways would divide provides an additional place for a vehicle to pull off to allow another to quickly and easily pass. Moreover, there are a countless number of private driveways in South Burlington of the same width as ours that are easily shared by two, three or even four homes. For example, on Spear Street, to the north of our property, the Belisle and Unsworth residences share a driveway of the same width as our driveway. Across Spear Street, on Harbor Ridge, the Dewey Irish residence shares a driveway of this same size with at least two neighbors. Also on Spear Street, within a'/4 mile south of our property, there are three separate driveways each shared by two homes and none any wider than ours. Shared driveways are not unique to the Spear Street neighborhood. For instance, on Swift Street, David Austin shares a standard size driveway with his parents and the Skiffs. Across the street from the Austins, there are two other homes that share a lengthy, standard size driveway. On Dorset Street, the Jewett, Scott, Goldberg and Bolduc residences share a lengthy driveway in common that is no wider than our driveway. These are but a few examples of private driveways that are easily shared by two or more homes without the need to expand the width of the driveway to 20-25 feet to accommodate two-way traffic. Moreover, shared driveways are in keeping with the philosophy of promoting green -space and eliminating additional curb cuts. If we were required to widen our driveway to 20-25 feet, it would result in the loss of the many cedar, pine and maple trees that border the driveway on either side. Sacrificing valuable green -space to make way for more blacktop is seemingly unnecessary and not in keeping with the rural character of this neighborhood. We are further concerned that widening the driveway in this manner would invite a dangerous condition and give rise to potential liability. In this regard, if this private driveway is widened to essentially a two-way roadway, motorists travelling on Spear Street, including the many people who use this stretch of Spear Street to test drive cars from the Shelburne Road auto dealerships, will inevitably use our private driveway as a public turn around. The danger presented by cars using the driveway to essentially make illegal U-turns is obvious. A standard size driveway simply does not pose the same risk. Accordingly, we ask that the Planning Commission decline to adopt the recommendation of William Szymanski to widen a private driveway serving two homes to nearly the width of a two- way public roadway. ZONING EVALUATION (The Staff report evaluates the site plan submitted with the application): Alan and Diane Sylvester own a +/- 19.65 acre lot which supports a single family house and garage. The lot straddles the municipal line resulting in a portion of the lot being in the Town of Shelburne and a portion of the lot being in South Burlington. Amy Sylvester-Averill (the Sylvesters' daughter) is applying to subdivide the Sylvester's property into two (2) lots: 1. A 14.65 acre lot (hereafter referred to as Lot 1) located in South Burlington and Shelburne which contains her parents house (existing); and, 2. A 5.00 acre lot (hereafter referred to as Lot 2) located entirely in the Town of Shelburne for the applicant's proposed house. The subdivision plan as amended by the Planning Commission moves the lot line to subdivide the property along the municipal boundary resulting in Lot 1 being entirely within South Burlington and Lot 2 being entirely within the Town the Shelburne. The applicants are requesting the entire frontage of the existing lot remain with Lot 1 rather than create two noncomplying lots. Lot 1 (in South Burlington) will remain a conforming lot and therefore does not require any variances; and, Lot 2 (in Shelburne) will require a variance from the minimum lot width requirement of 400 feet and may require a variance from the minimum lot frontage requirement of 150 feet (see Lot frontage and the Variance Data table). Lot frontage. The frontage of the existing +/-19 acre lot is 200'. South Burlington requires a minimum lot frontage of 170' and the Rural 1 district in the Town of Shelburne requires a minimum lot frontage of 150'. Therefore a minimum of 320' of frontage is needed to comply with the minimum zoning requirements of Shelburne and South Burlington'. 'The Board may determine a variance from the minimum frontage requirement is not needed for this application. Zoning Bylaw Section 1690.1, Required Frontage and Approved Access, allows the Planning Commission to approve the development of a lot as long as the lot is accessed by a permanent easement or right-of-way of at least twenty (20') in width. This section seems to imply the Planning Commission can approve a lot that does not have frontage as long as the lot has legal access by way of a permanent easement or right-of- way. The access to Lot 2 is proposed by way of a 20' access easement down a portion of the existing driveway and therefore complies with this section of the Zoning Bylaws. The applicant is not proposing to add an additional driveway to Spear street. Surrounding uses and districts. The applicant's property is adjacent to single family houses or undeveloped land to the north, south, east and west. V. VARIANCE CRITERIA (Applicants Response Sheet Follows Staff Report): 1. Unique Physical Circumstances or Conditions. The applicant's lot contains the following unique physical circumstances: a. A 150' wide Vermont Electric Power Company easement crosses the property; and, b. The Shelburne/South Burlington town line divides the property. The proposed subdivision will divide the lot along the Shelburne - South Burlington boundary and will share the existing driveway with the lot to the north. Therefore the proposed subdivision will simplify municipal jurisdiction of the property by creating property lines that do not overlap municipal boundaries. 2. Reasonable Use of Property. The overall lot supports a single family house, therefore a reasonable use of the property is possible without a variance. However, the existing lot is approximately 20 acres in size and the minimum lot area for the Shelburne portion of the lot is 5 acres. Therefore further subdivision of the land would typically be possible. 3. Hardship Not Self Created. The applicant state the hardships in #1 above were beyond the control of the property owner. The 150' wide utility easement was taken by a condemnation proceeding. 4. Impact on: Essential Character of the Neighborhood; Use or Development of Adjacent Property; Access to Renewable Resources and the Public welfare. The neighbor to the south (Myette) will be most effected by the addition of a single family house. Some of the lots east and south of the property are noncomplying one (1) acre lots which were created prior to the adoption of the Town of Shelburne Zoning Bylaws. It is important to note the applicant is not requesting variances from building setbacks and therefore the proposed house will have setbacks similar to or larger than the other homes in the neighborhood. Staff does not anticipate substantial negative impacts to the neighborhood, nor expect the variances to be detrimental to the public welfare. 5. Minimum Variance That Affords Relief and Least Deviation from Zoning Bylaws and the Comprehensive Plan. The applicant's variance request appears to be the minimum needed to subdivide the property along the municipal boundary lines without creating two (2) noncomplying lots. STAFF REPORT - SUB98-5, AMY SYLVESTER AVERILL, 1985 SPEAR STREET SHELBURNE PLANNING COMMISSION FEBRUARY 12, 1998 SKETCH PLAN The proposal by Amy Sylvester Averill is to subdivide a parcel of land into 2 lots. The property is located in South Burlington and Shelburne and is owned by Alan and Diane Sylvester. The property is located in the Rural 1 District. PLANS "Subdivision Map, Alan and Diane Sylvester", prepared by Brooks Land Surveying, dated January 15, 1998 PLANNING STANDARDS Site Features and Open Space The site is located on the west side of Spear Street and straddles the South Burlington and Shelburne town line. There is an existing house on the north side of the property, in South Burlington. The subdivision would create a second lot, entirely in Shelburne, with a house site on the southeastern end of the property. The land is relatively flat towards Spear Street and then slopes away to the west. This property is adjacent to the Vallee Farms land which we have looked at earlier and is similar in terrain and cover, with a mixture of open field and woods. The National Wetland Inventory map shows wetlands which may be on a portion of this property, however, they do not appear to be near either the proposed house site or septic system. No land is set aside for open space and this is not necessary, given that the proposed Shelburne lot is the district minimum 5 acres and will not be subdivided further. 2. Traffic, Access, Roads and Paths The proposal for one additional house will not have an adverse traffic impact on Spear Street. Access is proposed across an existing driveway in South Burlington and then onto a short right of way to lot 2 (the new housesite). This should be adequate for the low level of use proposed. No path easements have been discussed with the applicants. We have been talking with South Burlington about linking with new or proposed paths in the southern part of the City, however, the links we have discussed are to the west of this property. Municipal and Other Services The applicant proposes an on site septic system and municipal water for the new lot. Water service will come from Spear Street and a 20' wide utility easement is shown on the plans. For final plan review the applicant should submit engineering information on the proposed water line for review by the Water Department, as well as plans for the proposed septic system. 4. Conformance with the Town Plan and Bylaws The proposed subdivision conforms with the bylaws for lot size and will be able to meet building setbacks. The proposed lot in Shelburne does not meet the bylaw requirement for lot width and frontage and a variance application has been submitted. This will be on the Zoning Board's agenda for March and should be decided by the time of the final plan hearing. The new housesite would be consistent with the pattern of surrounding lots, which include smaller lots and houses along Spear Street. The new lot line follows the town/city boundary, with the exception of a small strip of land across the western end of the lot and the eastern end, with frontage on Spear Street. The applicant should provide more information on the reason for the strip along the western end since it may make more sense to divide the lot more completely along the town/city boundary. Retaining the entire frontage with the larger lot seems to be appropriate, even though it is split between South Burlington and Shelburne. DRAFT SKETCH PLAN APPROVAL MOTION A motion is made to grant sketch plan approval to Amy Sylvester Averill for a two lot subdivision, as shown on the plans submitted with the following conditions: Prior to final plan review the applicant should submit engineering information on the proposed septic system and water line. 2. The final plan should show a 20' wide easement for utilities from Spear Street. Variance Request Justification: 1. Describe the unique physical condition(s) associated with your property which result in unreasonable hardship(s) (i.e. nonconforming lot, nonconforming structure, unusual site constraints, etc): The subject property is bisected by the boundary line between the Town of Shelburne and the City of South Burlington and by a 150 foot wide perpetual easement and right-of-way to Vermont Electric Power Company (VELCO) which follows the Shelburne/South Burlington boundary line. These unique physical circumstances create an unreasonable hardship by essentially dividing the property into two separate lots, one located in Shelburne, the other in South Burlington. As a result, the 6.4 acre portion of the property that is located within the Town of Shelburne is an irregular, triangular shape that is nonconforming in terms of lot width and frontage under the Rural I Zoning Bylaw requirements. 2. Explain why a variance is necessary to permit a reasonable use of your property: A single family residence is a reasonable and permissible use of the property, however, because of the unique physical circumstances described above, it is impossible to achieve such a use of the property or any other use without a variance for lot width and frontage. 3. Explain why the hardships listed in #1 above are not self-created: The hardships listed in #1, above, originated from circumstances beyond the control of the property owner. Indeed, it was several years after the owner purchased the property that VELCO condemned the 150 foot wide easement. In addition, the lands surrounding the subject property are pre-existing lots which were not created by the owner of the subject property. 4. Explain why the variance request(s) will not alter or impair the essential character of the neighborhood, nor be detrimental to the public welfare: The property lies in a rural zoning district populated by single family residences. Some of these residences pre -date the current dimensional requirements for the zoning district and were built on one acre lots, e.g. the adjacent Myette property, while others were built under the current dimensional requirements. The use of the property as a single-family residence is in keeping with the character of the zoning district insofar as the proposed residence will be located on five acres, with a set back from Spear Street of approximately 360 feet and side setbacks of at least 50 feet. The public welfare will not be harmed by the proposed use of the property since it is a typical use for this area and will not affect the surrounding properties. 5. Explain why the variance request is the minimum necessary to allow a reasonable use of the property. The requested variances for lot width and lot frontage represent the least deviation possible from the Rural 1 dimensional requirements to permit the use of the property as a single family residence. The subject property is in conformance with the Rural 1 dimensional requirements in all respects (lot size, setbacks) except for lot width and lot frontage. In this regard, the requested variance for the lot width pertains only to the upper (eastern) portion of the triangular shape parcel that is less than the required 400 feet. Lot #3 is developed with a two (2) family dwelling so lots #1 and 2 can only be developed with single family dwellings. Sewer: The sewer allocation request is 720 gpd (this includes 20% reduction allowed by State). The applicant will be required to pay the per gallon fee prior to permit issuance. Impact fees: The applicant should be aware that the new houses will be subject to school, road and recreation impact fees. 6) AMY SYLVESTER AVERILL -2 LOT SUBDIVISION - SKETCH PLAN This project consists of the subdivision of a 19.65 acre lot (13.98 acres in South Burlington and 6.34 acres in Shelburne) into two (2) lots of 13.98 acres (lot #1) and 5.67 acres (lot #2). Lot #1 is developed with a single family dwelling. This property lies partially in South Burlington and partially in Shelburne. The new lot being created (lot #2) lies entirely within Shelburne. The City Attorney has ruled that we should treat this subdivision as if it was entirely within the City of South Burlington. This subdivision will be treated as a major subdivision because lot #2 has no road frontage. This property located at 1985 Spear Street lies within the R1 and R2 Districts. It is bounded on the north, west and south by residences and undeveloped land, and the east by residences and Spear Street. Access: Access to lot #1 is provided by a curb cut on Spear Street. Access to lot #2 will be provided by a 20 foot r.o.w. across lot #1 since lot #2 has no road frontage. The metes and bounds information for the r.o.w. should be shown on the final plat. Other: — the preliminary plat plan should show any existing or proposed water lines serving either lot. 7) CACTUS PETE' S & THE REC ROOM - DECK & DAY CARE - REVISED FINAL PLAT This project consists of amending a planned commercial development consisting of 150 residential units, a 61 room hotel, a 20,000 square foot movie theater (1000 seats), a 22,500 square foot restaurant/retail/indoor recreation building a 3500 square foot restaurant with drive through service, and a bank with drive -through service located on Shelburne Road. The amendments consist of: 1) adding a 30 child day care use in the 22,500 square foot building, and 2) construct a 480 square foot deck for restaurant use with no additional seating. This property was last reviewed on 11/25/97 (minutes enclosed). The only issues affected by this application are setbacks, landscaping, traffic and parking. Setbacks: The proposed deck does not meet the 40 foot front yard setback requirement. The Planning Commission under Section 12.406(b) ofthe zoning regulations may modify this requirement. Landscaping_ The minimum landscaping requirement, based on building costs, is $240 which is not being met. The applicant is seeking a credit for this shortfall. Traffic: Information submitted by the applicant (see enclosed) indicates that the day care use will increase traffic by 20 vehicle trip ends (vte's) during the P.M. peak hour. The applicant should be aware that the road impact fee is zero (0). Parking: The applicant has submitted an updated shared parking analysis (see enclosed) for the commercial portion of the PUD (excluding the theater and bank).
