We want to be as open and informal as possible; but Council meetings are not town meetings. In an effort to conduct orderly and efficient meetings, we kindly request your cooperation and compliance with the following guidelines. 1. Determine what the City is/will be obligated to do City of South Burlington City Council Priorities- Fall 2012 14 SOUTH BURLINGTON CITY COUNCIL AGREED-UPON PROCEDURES MAY 2012 To assist in accomplishing City business, we agree to the following guidelines. A. Regarding City Councilor conduct at City meetings,we will 1. Raise our hands and wait to be acknowledge by the Chair 2. Not interrupt whomever is speaking 3. Refrain from side conversations and remarks 4. Speak only once on a topic until all other Councilors have had the opportunity to speak 5. Use motions, and seconds for all action items prior to voting 6. Empower the Chair to rule on all procedural matters unless over-ruled by a majority of the Council 7. Make all decisions by majority vote 8. Refrain from using cell phones (voice or text) during meetings B. Regarding City Councilor conduct outside of meetings, we will 1. Maintain confidentiality on all matters discussed in executive session 2. Contact the City Manager and Deputy City Manager only on matters needing clarification 3. Refrain from contacting other City staff 4. Refrain from tasking any City staffer, including the City Manager and Deputy (tasking of the CM and DCM is done only by majority vote) 5. Refrain from contacting any appointed officials to include, the City attorneys and auditors C. Regarding City Council Agendas, 1. The Chair and City Manager prepare it 2. At the end of each meeting, Councilors may suggest items for subsequent meetings. These will be placed on a subsequent agenda provided that they are approved by a majority of the Council 3. No new items will be introduced or added to the agenda on the day of the meeting (unless they are urgent and time sensitive) 4. Written copies of any issue/proposal/resolution, etc., will be provided to each Councilor at least a day in advance of the meeting D. Regarding the location of meetings 1. City Council meetings will continue to be held in City Hall 2. Town forums—not City Council meetings—will be held at area schools on area-relevant topics E. Regarding public participation guidelines at City meetings (see attached) F. Regarding the relationship to City boards, commissions, committees, liaisons 1. Joint sessions with the Development Review Board should occur annually 2. Joint sessions with the Planning Commission should occur at least semi- annually 3. Representatives of these groups are expected to be present at City Council meetings when items in their area are discussed 4. Annual written reports are required from all City appointed groups 5. Routine attendance at City Council meetings are expected from all appointed liaisons and representatives 6. The current appointment process/criteria/qualifications will be evaluated during the next appointment cycle G. Regarding interacting with the media, responding to residents, and the use of social media 1. The City Manager or the Chair will be our official spokespersons with the media and residents 2. The use of print and social media will be discussed as part of our communications priority H. Regarding the evaluation of the City Manager • We will develop a process and time frame I. Agenda Review: Additions, deletions or changes in order of agenda items. 2. *** Discuss and possible update of City Council 2012 Priority Tasks that were set in April (City Council, Sandy Miller, City Manager, & Staff). Attached is the document I circulated last week in the CM Update as a preview in case you wanted to suggest changes. The appropriate department heads will be there to work with us to help establish timeframes and discuss resource issues. Please keep in mind there are a number of tasks CC has asked Staff to engage in that are not on the priorities list(not to mention day-to-day operational issues) and we need to factor that into any discussion about time and resources. 3. *** Discuss/Review Council procedures. (City Councilors). Rosanne had asked that we review these as well and the procedures in effect are attached. 4. Discuss and possibly schedule additional meetings: a. Interim Zoning Steering Committee (IZ Committee Chairs and Councilors). Is it time to look at scheduling another meeting of the chairs? b. Follow-up to joint City Council/Planning Commission meeting regarding attending each others' meetings. This is something that was raised at the joint meeting of CC/PC. 5. Comments from the public on items not related to the agenda. 6. Other Business: Yesterday, I received via hand delivery a petition from GBIC with 10,741 signatures asking CC to abandoning its current position on the F-35a debasing. I will bring it to the meeting Tuesday and I recommend you accept and file it. 7. Consider entering executive session to discuss personnel, contract negotiations and litigation: PLEASE NOTE: All items are time permitting. Although we have said this would be a 5 to 7 p.m. meeting, consider staying beyond 7 p.m. to address these items or carry over onto the November 5 agenda. a. *** Library Trustees—Attached you will find applications from the three individuals who applied and were not appointed to the Library Board or another committee. They are Dan Jenkins, Elaine Dates and Jennifer Kochman. Please note Michele Canon has now resigned and there are five remaining Trustees out of a possible nine. Even if all three remaining applicants are acceptable to CC we would still need to seek one additional applicant, so I recommend CC ask Staff to advertise for the vacancy or vacancies. b. ***"Underwood Property"—Time permitting. The Underwood family heirs are interested in selling the City 57.6 acres bounded roughly by Spear and Knowland Farm Rd. They cited a two year old appraisal of$1.9 million, though they admitted they have not received any viable offers from developers during that time. A PDF map is attached (we'll have larger versions Tuesday. c. *** Methadone clinic legal issues? Time Permitting should we discuss possible options regarding the citizens' requests for CC to get involved. Three things to note: i. I am pasting in an e-mail exchange between Steve Stitzel and me regarding the ADA issue and the legal advice we received. It, I think, speaks for itself. Steve, I realize our recollections differ and I do understand the conversation could have been awkward — that, in itself, might have been helpful to have had stated Monday evening. I agree that we discussed it and that I said I would have to look into it. I honestly do not recall that I was supposed to be prepared to address it on Monday. Also, as is further explained below, having such discussion on Monday night in open session would have created an awkward situation. Following our phone conversation last week, I checked with others in the office to find out who was working with the City on the pending application and see if the issue was under review. Joe and David assisted Ray in his review. The issue of federal/state preemption was given some preliminary consideration with some indication that exclusion of methadone clinics could constitute unlawful discrimination. However, this was not pursued when it was determined that, as described in application materials, the clinic qualifies as a medical office under the Land Development Regulations. (As a note: under Vermont law, individuals must be under the direct supervision of a physician who must determine that the individual is appropriate to methadone therapy. ) In connection with this review, the Planning office and this office did receive materials from the Howard Center concerning the proposed clinic. There was some discussion of anti-discrimination issues in this material though it became irrelevant for the reason mentioned above. The permit issued by Ray is now before the DRB, as you know. Joe is working with the DRB. It is not yet entirely clear whether the DRB will have to address anti-discrimination issues in its decision. Joe will be meeting with the DRB shortly to review information and issues presented at the DRB public hearing and in filings submitted by the participants. Assuming the issue must be addressed, Joe will be conducting further research and advising the DRB. To summarize, this office has not thoroughly researched the anti-discrimination issue at this time though it may do so for the DRB in the very near future. Given Monday night's Council discussion, I will have David and Joe proceed with this research regardless of what is required for the DRB's decision. Please note, if the issue is addressed in the DRB decision, we will be providing the same advice to the Council and the DRB. Typically the research and legal analysis we provide to the DRB is not released publicly, at least in a case where an appeal may result. Consequently, the Council will need to consider whether it will want to release our opinion publicly or discuss it at a public session. (Note: It is very unusual for us to be asked by a DRB and a council/selectboard for an opinion on the same issue at the same time; one request for use in a quasi-judicial proceeding and one for consideration of a by-law amendment.) Also, later last night someone indicated that Howard Center attorneys had indicated to him/her that they had been in touch with your office or had transmitted information about the ADA and methadone clinics to you or your office. Whipple, Chief of Po1id nA-V'7 S 61 � Date: October 25, 2012 Re: Police responses to 56 West Twin Oaks T have made a review of South Burlington Police responses to 56 West Twin Oaks Terrace for the past ten years with the following findings: March 17. 2003 Police responded to a reported theft. No additional information is available as the paper file was purged after 7 years February 1,2005 Police responded to a Medical Assist with the ambulance. A female was reported to be "in a catatonic state"inside the clinic. The woman was transported to the hospital. Due to HIPAA no additional information was shared with the police. November 6, 2009 Police responded to a reported theft inside the clinic. A woman in the waiting area reported that her wallet had been stolen when she went outside to smoke a cigarette. A male was accused but video of the incident was accidentally erased by a staff member. No charges were filed. May 5, 2011 Police responded to a report of a disturbance in the waiting area. A patient had been discharged from the program and was angry at staff. The patient made threats to kill staff members. Police were asked to have the male leave the facility but citing HIPAA staff refused to provide officers with any details. The male left the area without further incident. September 17, 2012 Police responded to a reported theft at the clinic. Investigation revealed that a patient entered an unoccupied office and took a purse. The purse was later located with cash and a check missing. With the growth of South Burlington and the library's physical resources being stretched to their limits,the library is at a crossroads. Many decisions regarding the library's future will be made over the coming years. I would like to be involved in those decisions. School libraries were a welcome asset to pursuing research topics and reading magazines and newspapers. In college the libraries became almost like an office for me where I could not only study; but also, I could meet friends. During my thirty-four years of teaching Latin and English, my lesson plans continued to foster the library. I just can't imagine a community without a strong library. Studying abroad emphasized the special nature of American libraries. Once we moved to Shelburne, I was happy to become a trustee of the Pierson Library, become the Chair of the Trustees, continue to be a volunteer working the desk, painting children's chairs, etc. It became clear that Shelburne needed to expand its small space and my husband and I worked to transfer the library to a larger and more pleasant space. Very soon the Pierson Library became a hub of senior citizens, young children, teenagers, young mothers, business men having lunch, and, in short, a place for the whole community. During the process of expanding the library, we worked with the State Library Association and learned a great deal of how to determine what the needs of your community are and how to meet them.
