I have tried to familiarize myself with the potential issues and problems surrounding the F-35 being deployed to our community. I am concerned about potential environmental and economic impacts. Generally, I have four areas of concern: [1] what are the potential negative impacts on our environment? To date,I've heard mostly about noise concerns. Is noise from F-35s the only environmental issue about which we should be concerned? Are there potential environmental concerns, other than noise, about which we should be concerned, what might they be, why should we be concerned and how could these additional issues be addressed in the EIS? At the VTANG presentation last Thursday evening [4/15/10], a Winooski community member said that the F-16 noise is worse on take-off than on landing. He claimed that the former interrupted conversation, while landings did not. Would the noise issues with the F-35 relate more to take- offs than flight and landing? If so, could you explain why? Could you explain how many total minutes per day there would be noise from F-35s from take-offs and landings at South Burlington? At last Thursday's meeting, I understood Lt. Col. Caputo to have said that the total time for noise intrusion from F-35 take-offs to be six to eight minutes per day. Is this a correct assessment? [2] Is it possible for the Air Force to mitigate F-35 noise impacts at South Burlington? If so, how, i.e. what mitigation measures can be used, and what is the basis for believing any such mitigation measures could be successful? The Eglin EIS regarding the F-35's stated that the Air Force would "look programmatically at how best to operate the F-35 aircraft to minimize noise," and that there were construction applications to doors, windows and walls that could result in lessening impacts of noise from F-35s that would lessen interruption to sleeping, conversation and listening to TV. Will these construction applications be evaluated in the South Burlington EIS? How can the F-35 be operated to mitigate noise? [3] As you perhaps know, many in our community are concerned that the F-35s will be 2 to 3 times louder than the F-16s. The basis for this estimate was language in the Eglin AFB EIS. If Ms. Sheryl Parker US Air Force Page 2 of 2 April 19, 2010 no F-35 will be brought to South Burlington as part of the process of the Environmental Impact Statement, how will F-35 noise impacts at South Burlington be measured and assessed? In a recent [4/8/10] e-mail from Brig. Gen. Cray, the commander of the Vermont Air National Guard [VTANG],to our Council Chair, Mr. Mark Boucher, Gen. Cray said that the Eglin Air Force Base [AFB] acoustics data for the F-35 was not as accurate as the more recent data from Edwards. Could you explain the differences between the F-35 Eglin noise data and the Edwards' F-35 noise data and explain the differences, and why the Edwards' noise data is alleged to be more reliable than Eglin's? Was there an EIS published by the Air Force that evaluated the noise impacts of the F-35 at Edwards? If such an Air Force EIS of the F-35 at Edwards was completed, could we have a copy? Would you also please explain the differences in the methods and results of the Eglin and Andrews F-35 noise studies? [4] What are or could be the potential costs to South Burlington, Chittenden County and Vermont, if the F-35 is not deployed here? What is the VTANG's mission? Am I correct to assume that it is in large part a jet fighter unit? In response to questions from me at our City Council meeting on February 17, 2010, Lt. Col. Christopher Caputo said that the F-35s at South Burlington would replace VTANG's F-16s, and the life span for F-16 was 2017. He said that there were 1100 VTANG jobs at South Burlington, and 400 of these jobs were full time. Is this still good information? What is the gross annual payroll at VTANG? What is the average annual salary of VTANG employees and what is the average annual salary in VT? If the F-35s are not deployed to the VTANG at South Burlington, how might VTANG's mission be altered, and how could these potential changes impact employment and salaries at VTANG? It is essential that the City Council protect the SEQ from these massive impacts that were never contemplated when the TDR rules passed with everyone looking at the open land benefits rather than the cost to the rest of the SEQ. What is the Transfer of Development Rights (TDR): Following Planning Commission review of a program of Transferable Development Rights(TDR)the City Council enacted Land Development Regulations(LDR)enabling TDR's in the South East Quadrant(SEQ). Insufficient consideration was given to the burden that TDR would place on other portions of the SEQ. Virtually the entire focus of public attention to this major change in the zoning of the SEQ was on the opportunity to conserve large areas of the SEQ The IMpact of TDR on the SEQ: Perhaps even this Council was unaware of the impact of the vastly increased density on the stability of the neighborhoods affected. It is fair to say that the vast majority of working people who live in the area of the SEQ to be burdened with over 300% increased density were unaware of what was planned and implemented by the TDR rule. Be that as it may(and yes, everyone could have followed the process more closely)the people most adversely affected need your urgent reconsideration of these TDR Rules. Traditional neighborhoods of single family homes are now planned to increase density from 1.2 units per acre to 4 units per acre under TDR.No other area of the City is asked to bear this impact of drastic change. It is happening now and will soon happen elsewhere in the SEQ. One developer recently testified to the DRB that it could have proposed 26 unit apartment buildings of 4 units each on lands abutting traditional SEQ single family homes on less than 20 buildable acres! The planned build out of the SEQ with 4 unit apartment buildings is a bad idea for the City. The DRB seems to interpret the Rules as permitting maximum build out without regard to neighborhood impact. TDR was never advertised as a plan to impose 4 unit apartments on existing SEQ neighborhoods. This density will destroy the neighborhood character of the affected SEQ areas. Even the Comprehensive Plan of the City still includes a definitive map, Appendix E (attached), which provides zoning at maximum of 2 units per acre in some portions of the SEQ. However,the TDR rule was so poorly thought out that now the Planning Department and the DRB believe that Appendix E is a"mistake"and is to be ignored in their deliberations. What if this were YOUR Neighborhood: • Imagine for a moment waking up one morning to find that the density in your neighborhood had been increased by over 300%. (Would it be an answer to be told, "Well,there were lots of hearings you could have attended?") • Imagine being told by the Planners that the Comprehensive map which says the zoning would be 2 units per acre "really" means 4 units per acre. (Would it be an answer that a planner says the map is "a mistake"?) • Imagine if you and all of your neighbors were to find that the zoning had been changed to require that the Planners and the DRB must accommodate 4 unit apartment houses in your single family home neighborhood because the Plan decides the future. (Would it be an answer that the Plan and the DRB does not even allow the discussion of the impact of such density or the impact on the traditional residential patterns in your area?) Please suspend or freeze the TDR Rules and take another look ! Comments & Questions from the Audience (not related to Agenda items): No issues were raised. 2.Announcements & City Manager's Report: Ms. Dooley: Will be attending the Business & Industry Days for the Air National Guard in Tennessee. Mr. Knapp: Attended an information session at the Air Guard base today. Discussion centered on the EIS. Mr. Boucher: Received a letter from the Airport dated March 15th. They have done a traffic study which concludes that the bus terminal would add 109 new trip ends. In addition, the cell phone lot has now been designated. Ms. Emery: Was reassured that maintenance of F-16s is at high standards and security levels are very high. Mr. Hafter: Groundbreaking for the upgrade of the Airport Parkway Sewage Treatment Plant will be on Wednesday at 9:30 a.m. The CWD Board will meet on 13 April, at noon. The next City Council meeting will be held at the Middle School and will focus on the F-35 issue. Because of the recent excellent city audit, a trial balance instead of a full audit will be run when the change of City Managers occurs. Mr. Hafter will host his retirement party on 6 May, 4:30 p.m., at the Higher Ground. The Gravelin Brothers Band will entertain. All are welcome. 3. Interview with Elizabeth Melizia for appointment to the Natural Resources Committee: Ms. Melizia read her letter of application. She indicated she has attended Committee CITY COUNCIL 5 APRIL 2010 PAGE 2 meetings, and her participation has been welcomed. She is a member of the South Burlington Land Trust Board of Directors and has served on other boards and committees as well. 4. Discussion of Council policy &procedures for appointments to City Boards: Ms. Dooley noted that the City Charter doesn't indicate when you recruit, terms of appointment, etc. She indicated that she had prepared a proposal, most of which is similar to what is already done. One change would be that after a person had served 8 consecutive years, there would be recruitment. She felt there shouldn't be automatic reappointment. Mr. Boucher asked whether a person with 8 years experience would have a"demerit" against them. He said his dilemma would be if you interview 2 people and one is an incumbent who has done a good job for 8 years, what criteria do you use to make a decision? Mr. Knapp suggested referring the proposal to the Chairs of various boards for their input. Mr. Murray felt that to be respectful all members of the boards should be contacted. Ms. Dooley moved to get input from all committees prior to the May meeting. Mr. Murray seconded. Motion passed unanimously. 5. Discussion of Process for April 19th Meeting with Air Force Officials: Mr. Hafter noted that Sheryl Parker for Langley Air Force Base in Virginia will be present at the 19 April meeting. She is coordinator of the EIS process relative to the potential housing of F-35 fighter jets at Burlington International Airport and VTANG. The order of events for the meeting will be: 1. Presentation by Ms. Parker 2. Questions from City Council 3. Sign-up list for members of the public to ask questions Lt. Col. Caputo explained that Ms. Parker will be bringing the latest data from the Eglin EIS. This really doesn't compare with the Burlington area because of different noise contours and the extended hours of operation at Eglin. Mr. Plumeau suggested an open house prior to the meeting where people could view any CITY COUNCIL 5 APRIL 2010 PAGE 3 exhibits. Lt. Col. Caputo felt that was possible. 6. Consideration of First Reading of Additional Sign Ordinance Amendments; schedule public hearing for 3 May 2010 with other Sign Ordinance Amendments: Mr. Conner noted that a few additional things had come up. The first regards temporary signs. It was noted that there are businesses which operate in residential districts and those businesses are not permitted to have those signs. The Sign Ordinance Committee agreed that all businesses in residential districts could have a temporary sign up to 6 sq. ft. with the same frequency as other businesses. There is also clarification on how size of signs is calculated. "Weekly signs"are now cross-referenced. Mr. Hafter asked whether home occupations could have signs. Mr. Conner said they cannot. Ms. Dooley moved to waive the first reading, approve the first reading, and include the amendments in the public hearing scheduled for 3 May 2010. Mr. Murray seconded. Motion passed unanimously. 7. Consideration of Request for Proposal for Banking Services: Ms. Kinville reviewed the history. She noted they always try to get the best deal for the city. In the recent RFP, 7 banks provided quotes. The principal concerns were: security, cost to the city, and protection of the city's data. After review, the 3 applicants were invited in for consultation. Members of the committee felt that Merchant's Bank was the best fit for the city. Mr. Murray moved to award the city's banking services to Merchant's Bank as presented. Ms. Dooley seconded. Motion passed unanimously. 8. Discussion of Proposed Code of Ethics & Conflict of Interest Policy for Elected Officials and Appointed Members of City Boards and Commissions: Mr. Hafter noted that the DRB has its own Conflict of Interest policy which is required by the State. It is much more specific than what is proposed here. He stressed that the policies being presented do not address any current need and there are no conflict of • CITY COUNCIL 5 APRIL 2010 PAGE 4 interest issues. Mr. Knapp said his understanding of a"conflict of interest"is a situation where a third party might influence your decision. Mr. Hafter said that decision should be made on the basis of merit, not undisclosed considerations. Ms. Emery said she would like to talk with someone from VLCT before making a decision. She felt their language was clearer. Mr. Conner said the key is "potential" conflict of interest or what can be perceived as a potential conflict of interest. He noted that VLCT does a lot of training in this area. They are also aware of what is different for a quasi-judicial board. Ms. Emery asked whether the code of ethics/conflict of interest policy would apply only at meetings or at all times. Mr. Halter said a Council member is always a Council member. Members felt it would be good to hold this discussion when the new City Manager is on board. Mr. Murray moved to continue the discussion until a meeting in July. Ms. Dooley seconded. Motion passed unanimously. 9. Consideration of Approval of Municipal Planning Grant Application: Mr. Conner said the Planning Commission felt the most pertinent area to work on would be the Land Development Regulations as they relate to Natural Resources. The grant is requesting about$7000 to hire a consultant to do this work. Mr. Murray moved to approve the Municipal Planning Grant Application as presented. Ms. Emery seconded. Motion passed unanimously. 10. Consideration of Award of Stormwater Engineering Contract for Water Quality Projects to Dubois & King: It was noted that the contract relates to work at Laurel Hill and Stonehedge. Proposals were received from 6 firms, and 2 were interviewed. The recommendation is to award the contract to Dubois & King pending successful contract negotiations. The Army Corps of Engineers will pay 65%of the cost, and the remainder will be divided between the 2 districts and the storm water budget. This will require a public vote, as in the past. Mr. Hafter felt they might not make the August ballot, so it would probably be in November. Consideration for a $348,000 Grant Anticipation Refunding Loan for Storm Water Mitigation Project: Mr. Halter said this is the third year of the Farrell St. Project(next to the Correctional Facility). The $132,000 is already earmarked. The loan is at 1.99%. Mr. Murray moved to approve the refunding note and accompanying documents as presented. Ms. Emery seconded. The City,just so you know, cannot restrict military air operations. It is, however permitted by law to restrict the commercial air operations. According to the Act 250 noise regulations for the State of Vermont--and the City attorney--the City is well within its power to make these noise ordinances. In anticipation of questions: These restrictions were taken almost verbatim from the airport noise regulations at Laurence G. Hanscom Field in Bedford, MA. They too are surrounded by residential neighborhoods and have an air national guard base there. They are reasonable guidelines that have precedent. Stage 3 aircraft are the newest, quietest type. Stage 2 have propellers. In addition to nighttime operations being considered twice as loud as daytime operations, per FAA guidelines, one nighttime operation is calculated into the noise contour map as equal to ten daytime operations. Thus, restricting flights after dark will perhaps shrink the 65 db DNL contour. N.B. The wording does not prohibit nighttime flights. Nighttime flights would be charged an additional fee in order to incentivize companies to fly during the regular hours of operation between 7 a.m. and 11 p.m. This petition does not belong to any one person. The Council does not have the authority to block the deployment of military aircraft, but its opposition will have to be taken officially into account. Two U.S. cities where the F-35 is already deployed have sued the Air Force due to the noise emissions, measured to be twice as loud as the F-15. These law suits have led to major concessions on the part of the Air Force,thus confirming the validity of local concerns. In South Burlington, increased noise emissions would push the 65 db DNL contour further into our oldest and most affordable housing in South Burlington, including Chamberlin, but also perhaps Mayfair Park(no forecasts have been provided to the City). There is simply no comparable housing available in the City or immediately surrounding communities. In addition, all land purchased through the FAA noise mitigation program would belong to Burlington,who owns Burlington International Airport. My family and I have lived about %2 of a mile west of the BVT for 15 years. I am strong supporter of the VTANG, but I believe the basing of the F-35 at BVT will have a huge negative effect on South Burlington's and Vermont's environment, on the health of its citizens and wildlife and on the economic and social well being of my family and neighborhood. I also believe that my Fifth Amendment rights would be violated if the Federal Government forces the basing of F-35's at VTANG upon me. It's unfair for the Air Force to ask me to formally comment, as part of the Environmental Impact Statement(EIS), on how basing F-35's at BVT will affect my livelihood when the Air Force has failed to provide me with any facts concerning the noise levels that I will experience from F-35's at BVT. The Air Force has not had any meetings in South Burlington in which they have make themselves available to answer questions directly from the citizens of South Burlington. So I make my comments based on information I've had to seek out on my own, over the internet. I've learned that the USAF's original environmental assessment(done for Eglin AFB) determined that the noise level created by a landing F-35 measured 105-106 dB, 15 db more (3 times as loud)as the noise level created by a landing F-16 (90 dB). Independent audio professionals and sound engineers have measured the noise levels of F-35 takeoff and landings at 2 to 4 times as loud as those of F-16's. I've noticed that the F-16's at VTANG have got louder over the years. I'm told many have been updated with new more powerful engines,which would explain the higher noise levels. I bought my house knowing about the noise levels of F-16's and I can live with that level (even though it has increased from when I first moved here)which currently rattles windows in my house,makes it hard to hear conversations inside my home and occasionally wakes my family up from sleep. But asking my family to endure noise levels even 10%to 20%higher, let alone 2 to 4 times louder, is asking too much. I believe that basing F-35's at BVT will cause hearing damage or loss to members of my family, will cause increased stress levels(which can lead to other illnesses) to my family and will cause economic and social losses to my family. My property rights and right to live in a healthy environment will be violated if F-35's are based at BVT. My neighborhood has already lost 80 homes(with 30 more to be bought out and destroyed in the near future)to the expanded noise buffer zone surrounding BVT. The buffer zone will be expanded to take away more homes from my neighborhood if F-35's, and the higher noise levels they will bring, are allowed to be based at BVT. We have the award winning, highly regarded Chamberlin Elementary School in my neighborhood. If more homes are taken due to the increased noise levels from F-35's there is a good chance this school would have to close due to low enrollment. This school is an important social and learning center for my neighborhood. The value of my house will decline if F-35's are based at BVT. There is a huge shortage of affordable housing in South Burlington,so the continued destruction of my neighborhood which consists of low to medium priced homes will cause my family and other families to be forced to move to a different area of Vermont. I don't want to have to move, my family has friends in South Burlington and we like what the great city of South Burlington has to offer. South Burlington has the one of the best school systems in Vermont and is in a great location. If I have to move my family won't be able to worship at the same neighborhood church that we've been a member of for 15 years. Then there's the stress associated with having to worry about one of the new F-35's, with their experimental/new age electronic control systems, crashing into my neighborhood. It's just not wise to have these loud and dangerous aircraft based in the middle of a highly populated neighborhood. The increased noise levels of F-35's will also have a negative effect on the enormous amount of wildlife that we are blessed with throughout Vermont as the jets fly over all areas of Vermont. I am also told that the EIS the Air Force will conduct only measures the average noise level of the F-35's over a certain distance and does not take into account the spikes in noise levels that happen during the shorter takeoff and landing time periods. If this is true, then the Air Force is will be doing a disservice to the citizens it serves by reporting that the F-35 noise levels are within the 65 dB range (average noise level)deemed acceptable to pass the current regulations. In order to be honest about the noise levels that my neighborhood will experience the Air Force must measure and report the takeoff and landing spikes which have been recorded as being 2 to 4 times (aprox. 105 — 108 dB) louder than the noise levels of F-16's during takeoff and landing. I hope the Air Force and the VTANG will decide to be good neighbors and find a more appropriate location to base F-35's other than at BVT. I understand that other considerations for the future mission of VTANG could be a aircraft repair facility or an intelligence facility. Both would be much better choices for the future of VTANG. Although the EIS is not complete, I believe that these aircrafts will be noisier than the Fl6s and the noise from these aircrafts combined with the buyout of houses near the airport will be detrimental to the value of houses in my neighborhood and in any neighborhoods within a mile and a half of the airport. My family moved to 22 Pinetree Terrace almost 15 years ago. We have raised our family in this neighborhood and we love living here. Almost 15 years ago, when we bought our house,there were very few houses in South Burlington that were affordable. We founds ours and we felt that this is where we wanted to be. Almost 15 years later, this is still where we want to be. I am disappointed in what I see as a lack of respect for the neighborhoods near the airport,people have lived here with their families for a long time, and we have put up with the noise from the airport because the houses here are affordable and for some of us these were the only houses we could afford in South Burlington. I think there is no doubt that with the louder jets and the airport expansion our houses will lose value and there are very few alternative neighborhoods in South Burlington with affordable houses. I understand that if the F35s do not come to BTV that people may lose their jobs and I feel for those people, I appreciate how hard the military works to keep us safe. I just feel that I am not hearing much of a voice for those of us who live here. We will be losing money on what is, for most of us, our biggest investment and our quality of life. Allowing the F35s to come to BTV is not a decision to be made lightly. It's not just a matter of supporting the military. It's important to take into consideration all those affected by this decision. If these jets are louder and if the increase in noise will move the buffer zone farther from the airport and cause more houses to have to be taken down,there is no doubt that our houses will lose value and we will lose money. So it seems that either the Vermont Air Guard members lose some jobs or we lose some of the value on our homes. Either way, someone will lose. I think the right thing to do would be to locate these F35s in a location where whole neighborhoods will not be affected and if possible, find another way to employ the local guard members. In fact the current noise levels are unacceptable. I work down on Pine Street and I operate a forklift in a noisy warehouse but when the Air Guard's jets fly overhead we can still hear the roar for a good 15 seconds so I can't imagine what it must be like when they take off. What I really want to talk about though is the waste that these jets represent. These new planes by a conservative estimate cost 122 million dollars each. Surrounding the airport on all sides are residential neighborhoods with families, schools, day care centers, churches, businesses (including telecommuters), and the quality of life and socio-economic well- being of these neighborhoods would be severely impacted were the F-35 to be based here. All the news surrounding the fifth generation fighter jets,the F-22 Raptor and the F-35 Joint Strike Fighter, indicates that these planes are dangerously loud: new "advanced ground crew hearing protection" is being issued to "protect F-35 pilots, maintainers, and carrier deck crews" (Joint Communications Release, April 2009). The lower frequency of the noise produced by their engines generates more powerful vibrations, which suggest that noise attenuation over distance will be less than the lighter F-16, our current aircraft. The principal of Chamberlin Elementary School, which is three to four blocks from the Airport, has told me that any increase in either noise or sortie frequency"will be a problem." The current noise levels and sortie numbers from the F-16s already interrupts instruction; and kindergartners are given orientation at the beginning of the year in order for them to become familiarized with something that is scary and painful for them. Local home care providers for small children repeat similar stories of children grasping their ears and bending over in pain. The hearing of the most vulnerable among us must be protected as well. The Chamberlin and Mayfair Park neighborhoods, those neighborhoods of South Burlington most affected by airplane noise,resemble the neighborhood where I grew up. There's a diversity of classes and cultures. They're walking and biking communities where children can play outdoors, knowing that they can trust their neighbors. When older, children can bike to the neighborhood store or ice cream shop for a treat or ride to the local library. These neighborhoods are within easy walking distance to city-center shops and services, and residents benefit from an urban life style that is quickly coming back into vogue. These close-knit communities have a neighborhood school,parks and natural areas for recreation, neighborhood block parties, and holiday gatherings. They are"real places"to which people are deeply attached. And they are patriots, who only want to their needs and concerns to be taken into consideration. A 7 dBA, 9 dBA, or greater difference at lower frequencies will without a doubt have an impact on their lives. If by chance Burlington is selected for the bedding down the F-35, I do hope that the Air Force will provide noise barriers (blast deflectors, engine runup enclosures, sound walls) in order to provide a buffer to the families that live nearby. This is the least our Air Force can do in order to mitigate the noise. But what I truly hope is that our local Air Guard can become an intelligence wing or a CIRF repair facility since they are uniquely qualified for these kinds of missions, which would also preserve the quality of life in our local neighborhoods. I have tried to familiarize myself with the potential issues and problems surrounding the F-35 being deployed to our community. I am concerned about potential environmental and economic impacts. Generally, I have four areas of concern: [1] what are the potential negative impacts on our environment? To date,I've heard mostly about noise concerns. Is noise from F-35s the only environmental issue about which we should be concerned? Are there potential environmental concerns, other than noise, about which we should be concerned, what might they be, why should we be concerned and how could these additional issues be addressed in the EIS? At the VTANG presentation last Thursday evening [4/15/10], a Winooski community member said that the F-16 noise is worse on take-off than on landing. He claimed that the former interrupted conversation, while landings did not. Would the noise issues with the F-35 relate more to take- offs than flight and landing? If so, could you explain why? Could you explain how many total minutes per day there would be noise from F-35s from take-offs and landings at South Burlington? At last Thursday's meeting, I understood Lt. Col. Caputo to have said that the total time for noise intrusion from F-35 take-offs to be six to eight minutes per day. Is this a correct assessment? [2] Is it possible for the Air Force to mitigate F-35 noise impacts at South Burlington? If so, how, i.e. what mitigation measures can be used, and what is the basis for believing any such mitigation measures could be successful? The Eglin EIS regarding the F-35's stated that the Air Force would "look programmatically at how best to operate the F-35 aircraft to minimize noise," and that there were construction applications to doors, windows and walls that could result in lessening impacts of noise from F-35s that would lessen interruption to sleeping, conversation and listening to TV. Will these construction applications be evaluated in the South Burlington EIS? How can the F-35 be operated to mitigate noise? [3] As you perhaps know, many in our community are concerned that the F-35s will be 2 to 3 times louder than the F-16s. The basis for this estimate was language in the Eglin AFB EIS. Cray said that the Eglin Air Force Base [AFB] acoustics data for the F-35 was not as accurate as the more recent data from Edwards. Could you explain the differences between the F-35 Eglin noise data and the Edwards' F-35 noise data and explain the differences,and why the Edwards' noise data is alleged to be more reliable than Eglin's? Was there an EIS published by the Air Force that evaluated the noise impacts of the F-35 at Edwards? If such an Air Force EIS of the F-35 at Edwards was completed, could we have a copy? Would you also please explain the differences in the methods and results of the Eglin and Andrews F-35 noise studies? [4] What are or could be the potential costs to South Burlington, Chittenden County and Vermont, if the F-35 is not deployed here? What is the VTANG's mission? Am I correct to assume that it is in large part a jet fighter unit? In response to questions from me at our City Council meeting on February 17, 2010, Lt. Col. Christopher Caputo said that the F-35s at South Burlington would replace VTANG's F-16s, and the life span for F-16 was 2017. He said that there were 1100 VTANG jobs at South Burlington, and 400 of these jobs were full time. Is this still good information? What is the gross annual payroll at VTANG? What is the average annual salary of VTANG employees and what is the average annual salary in VT? Dickinson THE CLEAN AIR ACT AND THE GENERAL CONFORMITY RULE CAA - General Conformity Rule unlike noise, federal law provides states with an important additional measure of control over emissions of military aircraft. The state of Vermont is in Region 1 and is an attainment area according to the EPA. The General Conformity Rule (42 USC 7506), prohibits the federal funding of activities that do not CONFORM to a state (Vermont) SIP; State Implementation Plan. The CAA provides for air quality standards for certain pollutants. I am very concerned about how the EPA will rule, regarding the Burlington, VT EIS, and I will be monitoring their decision and what criteria was used to arrive at their decision. Submitted by Mark A. Me, being able to express my concerns to you is also "the sound of freedom". I've gained a much greater appreciation for our democracy, over the past few months, as a result of this dialogue. I am skeptical that the basing of F35's here is a good fit for the surrounding communities of South Burlington, Williston, and Winooski. In Valparaiso, Fl., as a result of the law suit, concessions were made to move flight operations to a different runway, away from the population at large. There's a comparison of scale between here and there that really makes me wonder. Eglin AFB is larger than all of Chittenden County, Vt. Eglin AFB is 724 sq. miles, Chittenden County is 539. If you had to move runway operations there, I'm not sure why you think this is going to work here. Edwards AFB, which I hear is more of a comparable, is 470 sq. miles, and out in the Mojave Desert. The Air Force has had to design new hearing protection equipment for it's F35 pilots and support crews. I work from home, on the phone, as a tech support engineer for a software company,just a mile from the runway. If noise levels and number of sorties per day increase any more than they already are, my ability to make a living may be at risk. I also think this is going to affect our children's ability to learn at Chamberlin Elementary School, which is 5 blocks away from the airport. I believe the Air Force does candidate communities a disservice by not being able to demonstrate the actual SEL of the F35 at mil. Power. You're asking people to prepare for a 30 year commitment they can't refuse, or properly judge. I understand that a number of us made a lot of noise to focus attention on this issue, but we did so because we felt our interests were not being represented by the Council at large, nor the media. I greatly appreciate all of Councilor Emery's efforts. I also appreciate the patience of the VT Air Guard. If this jet is as loud as some of us think, and the 65 DNL line does move further out into the neighborhood, I'm hoping the City Council, as a whole, will get way more involved in policy to protect the quality of life of these in- town neighborhoods. I'm really hoping we don't get fooled with a Normalized DNL level, dumbing down an already watered down metric. If the DNL level reaches 70DB in Mayfair Park, and it becomes eligible for FAA part 150 tear down, let it be so. Discounting it by 5 or 10 DB for good relations, city size designation, etc. to get it back behind the 65 DNL line would be dishonest. It seems to me that this number is way too easy to manipulate. The surrounding affected communities deserve an honest assessment. If this is just my fear of the unknown, I'll be very happy to go back to my normal life as it was before. I've lived in the Chamberlin Neighborhood in South Burlington for nearly 10 years. Our home is a mile from the airport. We were thrilled to be able to move to the gorgeous state of Vermont and even more thrilled when we found a neighborhood that was affordable, had excellent schools and provided in-town convenience. We are a family of seven and all work or attend school within a few miles of our home. My husband was a patron of the airport on a weekly basis for 7 years. We've never had a problem with noise from commercial air traffic and we tolerate the levels produced by F-16's. But now, things are changing. Homes are being torn down, causing sound waves to affect the area more severely. The proposal to base F-35 jets here will subject South Burlington and other areas of Chittenden County to sound levels that are dangerously high. It's obvious that if the F-35 produces sound levels unsafe for inhabitants, they need to be based someplace less populated. I find it hard to believe there aren't other options for the Air Force to explore concerning the placement of this jet in VT. One thing I find most alarming is - no one seems to consider the psychological cost to residents who could be forced to move from a home they love, or must decide to remain in a neighborhood that's being negatively affected and devalued. This is a very serious environmental impact which will affect hundreds of families. The pressure we're feeling is real, and I hope that the City Council and the Air Force are acknowledging this fact. Moving is known to be one of life's most stressful experiences. Suddenly, many of us are filled with questions such as: Should we move? Should we stay? When should we move? If we stay, will our house depreciate in value? What will this mean for our retirement? If we stay, will the sound be bearable? Will my husband be able to conduct business from home? Should I bother to make any home improvements, or will my house and neighborhood not be worth the investment? If we have to move, where will we go? Where will our kids go to school?The concerns are endless. Why is the basing of these jets being opposed all over the world? Citizens have had to do their own digging to find #'s. If the jets come here, and they're too loud, it will be too late. Why are civilians being asked to live with these damaging noise levels? Why does a neighborhood need to be reconfigured to accommodate these jets? We are only 'h mile away from the Vermont Air National Guard and have been good neighbors over the years. We picked this area because of its small country setting with a great place for our kids to grow up. Over the 40 years that we have lived here we have become accustom to planes flying overhead, its our way of life. On daily base there is only a few seconds of noise that we hear from the current F-16 fighter jets a few times a day. The only complaint that we have is that on our dinning room table we have two candleholders that in a weeks time move about 4" after being centered each time. If people are questioning noise level,what about the Fed X plane that leaves at 8:30 a night. We hear no one complain about that noise level. I have been retired from almost 7 years and when my wife comes home from work usually mid-day during the good weather months we sit out side and she always comments "is it always this quite?" The fleet of F-16's that the Vermont Air National Guard is using now is becoming old and outdated. It is understandable that from time to time that new technology in aircraft needs to be in place. It is like the common person who invests in a new car or a new computer. If the fleet of F-16's are not replaced in the future then the consequences of jobs would be lost, both military and civilian and the base could be shut down presently. We do not need any more jobs lost in the State of Vermont. We are proud to say that we have a son who is serving in Vermont Army National Guard currently deployed in Afghanistan for a year. If the Air Guard were to be deployed to Afghanistan in the near future to support our troops on the ground,we would want them to have the best fighter plane available. As a result of that briefing and conversations that I have had with leadership of the Vermont Air National Guard, I know that the F-35 would provide welcome modernization of the Guard's fleet. Placing the F- 35 here would require the creation of jobs in information technology and security. The plane would be a feather in the cap of our highly acclaimed Guard. At the same time, I know that area citizens, particularly South Burlingtonians, are wary of environmental factors that may be associated with the F-35. Residents are carefully watching for results of the environmental impact statement due early this fall. Test results related to F-35 noise and pollution must be evaluated to assure that plans for the plane take into account the densely populated area in which it would operate. We cannot afford to lose more housing in an area adjacent to Burlington International Airport. The single family housing near the airport represents some of the most affordable homeownership opportunities in the core of Chittenden County, an area where housing costs are otherwise high. In addition to environmental and housing questions, I am concerned about job loss that may be associated with converting our fleet to the F-35. My understanding is that the F- 16 requires mechanic support; the F-35 requires differently skilled information technology and workers trained in security. Should the F-35 be awarded to the Vermont Air National Guard, it is particularly important that retraining opportunities be provided to existing staff. In short, I request that you continue to work closely with South Burlington in determining whether the F-35 is a good fit, not only for our Vermont Air National Guard, but for our city. A decision to place the plane here requires attention to environmental, housing, and employment issues. It is our understanding that the noise generated by the F-35 far exceeds either that of the F-4 or the F-16. Noise from the F-16 has not adversely affected the property values in our area, but it has been a real concern for prospective buyers. Any increase in noise levels will undoubtedly adversely impact property values. The Burlington International Airport has been expanding for several years with an increase in noise levels from commercial aircraft. This is a subject of on-going concern and review by the community. Adding new, louder military aircraft is not an acceptable option. Vermont's citizen soldiers have distinguished themselves from Gettysburg to Iraq. We have a strong military tradition. The citizens of the Burlington area have supported of the Air National Guard for many years. What are the environmental impacts to our air quality of an F-16 versus an F35? Noise pollution: Honestly,it doesn't matter at what elevation the F-16's are flying over the New North End of Burlington my ears are ringing. So it must be a combination of the thrust,decibels,or pitch of the engines? I don't have the same ringing in my ears with the commercial jets. From the news I have read those people living in the neighborhoods surrounding the airport are suffering significantly.To take a quote from a friend of mine"hundreds(maybe even thousands)of family's quality of life is affected,and there is an increase in health issues when people live with anxiety associated with loud noise blasting into their lives--elderly, children,and farm animals being the most seriously affected." I understand the Burlington Airport is spending nearly$4 million a year on noise mitigation,but many of us are not aware of any soundproofing, noise barriers,etc.surrounding the airport? The F 16's noise levels are seriously affecting the health and well being of many Vermonters right now,so how can we expect the F35 with higher decibels and more noise to be better than what we are living with currently? Why weren't we working on noise bathers and soundproofing(noise mitigation)years ago? Air Guard officials have stated that bases not receiving the F-35 would have options. They are as follows: become an intelligence wing;become a base for unmanned drones;become a CIRF repair facility,which could be well-suited to our Avionics Tech School at the Airport. Finally,they have stated that no base has been closed. Please,let's not have the F35's based at the Burlington International Airport. The Vermont Air National Guard and the Air Force need to openly work with all South Burlington, Winooski,Burlington(and other concerned surrounding towns)City Councilors and unhappy neighborhood residents to get it right. There is a third way,a way to make everyone happy with your final decision. We know that when we hear one, there will be more. (They seem to be sounding louder as houses are torn down .) Last Thursday,the jets flew over several times during our outside time. The toddler ran to me crying to be held and comforted. I am teaching her to cover her own ears as it's hard for me to cover hers and the infant's. Just this afternoon, she heard a small plane in the distance and put her hands over her ears. Then she put her hands on my ears! While I am holding her,the preschoolers are running around screaming—I think it counteracts the sound pressure. I asked them how they felt when the loud planes fly. One child told me "sad". "Sad", I questioned. "1 want my mommy to hold me". The four-year-old told me it made her tummy hurt. They only act this way with the F16s; the other planes don't bother them unless they're developing a fear of planes. As we all know, every child is different and will have individual experiences. When we're indoors, the sound level is OK. I did have the experience of a four-year-old being surprised by the suddenness of a jet once while in the bathroom . This child needed me to stand by the bathroom door for reassurance for some time. Over time with a shut window, the noise wasn't so frightening. I do my best to comfort children and learn ways of dealing with the noise. With younger children, I make the plane sign and we wave to them. What worries me is if the F35s are as loud as some say, and if they take off much more frequently. Young kids aren't able to understand the jets represent national security. All they know is the immediate experience. I work hard to provide a 5 STAR quality child care program in our community, with safe, healthy, happy and ready to learn children and want to continue doing so in the future. Burlington, Vermont I strongly oppose the installation of F-35 fighter jets at the air base in South Burlington. The F-35 will not benefit Vermont. The health, safety, and quality of life of Vermonters will be harmed. Our environment will be degraded by these incredibly loud fighter jets with their enormous emissions. Removal of more rows of affordable houses near the airport will likely be required and classes at Champlain Elementary School will be disrupted. And worst of all,these planes put South Burlington on the map as a target. Time Magazine says this F-35 program is "in big trouble," has "deep rooted problems," is "devouring dollars," and is the most costly program in Pentagon history, other than the even more expensive F-22, which was canceled. Time Magazine questions whether the planes are even needed, saying the US will have 20 times more fighters than the Chinese and 15 times more than the Russians. It says the rush to build and fly these planes is driven by shortages of F-16 and F-18 fighters that the Pentagon is self-generating so it can justify the F-35. Each F-35 is projected to cost$135 million, double original estimates. The cost for the 18-24 planes considered for Vermont will be nearly $3 billion. The total program's cost for the 2,443 planes on order is $329 billion. At a time people are losing their houses and workers their jobs, can we afford this waste? Our Vermont State budget desperately needs money for health care, education,jobs, roads, bridges,the environment, and human services. These planes will do nothing for Vermont needs. In fact they are taking our resources and wasting them. The only winners are corporate arms dealers. Listen to the words of former US President Dwight D. Eisenhower: Every gun that is made, every warship launched, every rocket fired signifies, in the final sense, a theft from those who hunger and are not fed, those who are cold and not clothed. Some people claim these enormously powerful weapons are for defense but they are actually to advance U.S. occupations and wars thousands of miles from Vermont. Wars that enrich certain military contractors while they grind down, kill, and wound our American soldiers. While they impoverish the American people. And while they kill, wound, and displace millions of Iraqi and Afghan civilians. In 24 town meetings Vermonters voted overwhelmingly that the best way to support our soldiers is to bring each and every one of them home now. These planes are counter to those votes. I say to our city council, to our Congressional delegation, and to the Pentagon: cancel the F-35, and send the money to Vermont instead. Let's set an example for towns all over the country to reject these planes and demand funding for human needs. We are told F-35's will use"mil power"-full or near full dry thrust(without afterburners). The second chart from the USAF/ Lockheed-Martin powerpoint shows the F-35 to be 7 dBA louder than an F-16 at full dry thrust(mil power). Moving jets produce a cone of sound, which follows them along the ground. The chart shows the measurement was taken on the ground directly below the jet at 1000' level flight. So the full effect of the jet was not measured, because the sound wake hadn't even got there yet. The difference between the F-35 & the F-16 is greater than shown in the chart. The stealth design of the F-35 produces more sound than a conventional airframe design. Sound is produced by moving air particles. The stealth surfaces&angles break the air less efficiently than conventional design airframes. That means more sound is created by stealth aircraft when turning& landing. Turning& landing was not measured& is not shown in the chart. The powerppoint states the F-35 is comparable to current aircraft: The F-18 is a carrier jet, &uses afterburners to take off. The F-22A is a loud twin engine stealth aircraft. At mil power, the F-35 is just as loud on level flight as the F-22A. The F-35 is not "comparable"to current fighter aircraft at So.Burlington- it is at least 7 dBA louder. The first chart in the powerpoint shows"the worst case scenario"-the Edwards tie-down test. All the chart proves is that at full mil power,at 50 ft, a microphone can hardly distinguish any difference between the jets. The test is designed to show the least difference between the jets. If the microphones were 1000' out to the sidelines, frequency differences would produce a wider range of measurements. And if the jets were in the air, they should show at least 7 dBA difference. Remember, we have the second chart. The noise levels are being presented in dBA, a measurement of sound level that has been adjusted mathematically by using a"filter"equation. Using dBA tends to de-value low frequency sound levels. The F-35 produces more low frequency sound than the F-16. Low frequency sound carries farther distances. Elephants& whales use low frequencies to communicate long distances. Daily Noise Limits(DNL's) & Sound Exposure Levels (SEL's) are averages. And they are computed in dBA's. dBA is also an average. The peak noise levels at take-off& landing will not be revealed to us by the USAF in the EIS. The full effect of low frequency noise will also not be revealed in the EIS. The USAF is well aware that jet noise is reaching the maximum that communities will tolerate. According to the 2009 Naval Research Advisory Committee Final Jet Noise Report, investment in reducing tactical jet engine noise has been inadequate. I did some research on the Internet. When I Googled "F-35 decibel issues" I got 29,00 hits. When I googled "F-35 noise levels too high" I got 1,460,000 hits. In a document by Timothy D. Hogan, Ph.D. it says: Studies of the environs of LAX. Ontario. and John Wayne airports in southern California estimated the negative impact of values of single-family residences ranging from 15 to 43 percent — averaging a 27 percent loss in market value. The studies also included analysis of the impact on non-residential property and found significant negative effects on commercial space.6 I looked at a noise map in Dr. Hogan's F-35 evaluation paper and the difference between F-16s and F-35s in sizes of area affected by noise really got my attention. He is right. In my estimation there is nowhere around here where people won't be largely impacted by the noise levels of the F-35s. An article in the Defense Industry Daily, Nov. 1, 2009 says: The "... audible noise of the F-35... . [is] 4 times louder than an F-16... This issue has forced a delay in critical approvals for Eglin AFB, and has also become an international concern." An article by Bruce Rolfson, staff writer for the Air Force Times, posted on the Air Force Times website on 10/27/08, says about the F-35s, "The Air Force is very quiet about a noisy fighter. At military housing areas and base schools on Eglin Air Force Base, Fla., noise from F-35 Lightning II operations [will reach] 83 decibels. Off base, F-35 noise will be even louder, reaching up to 90 decibels in civilian neighborhoods under an Eglin flight path." Noise in the range of 83 and 90 decibels is experienced as an ear-splitting volume. But aside from the quality of life we would surely lose if F-35s came here, 85 decibels or louder can cause permanent damage to hearing. We have large neighborhoods and schools right next to the airport where these things would be housed. you have agreed to fly F-35s in other areas where you plan to park them so citizens can hear what it might sound like before agreeing to it. We want to hear what it sounds like, too. Will you do the same for us? I have suffered from tinnitus since 1988. If those F-16s fly too close to me it feels like an ice pick in my ear. I don't want to know what an F-35 feels like. I worry for all of us living in this whole area, not just the neighborhoods and schools next to the airport, although I really cringe at the thought of what they would be enduring should the F-35s make a home here. If the residence on the property is destroyed prior to repayment of the City's loan, the City's loan shall be repayable in full within twelve months of such loss if within such time Maker has not commenced and substantially completed reconstruction of a new residence on the property with a value equivalent to the structure lost. 6. During the term of the loan, Maker agrees to maintain loss insurance on the property for full replacement value and pay all property taxes. The Maker agrees to pay all costs and expenses, including reasonable attorney's fees, for collection of this Note upon default.
