Mr. Jewitt will attend also. • Discussion with Paul Conner regarding latest on John Larkin's plans for the Marceau property EXECUTIVE SESSION: Following Meeting • Request for approval of two-year labor contract with South Burlington Career Firefighters, Local 3671, IAFF. Copy attached. Besides a few specific to the Fire Department operations (no costs),the salary, health and pension cost drivers are on the exact same basis as contracts previously approved for City Hall/Public Works and Water Quality Associations. This will complete the negotiations for this round of labor contracts. The next contract will be the Police Union which will expire on June 30, 2010. • Deliberate on appointment to Library Board. • Discussion with Council on procedure to select the five citizens to be on the first phase City Manager interview committee. CITY COUNCIL 21 DECEMBER 2009 The South Burlington City Council held a regular meeting on Monday, 21 December 2009, at 7:00 p.m., in the Conference Room, City Hall, 575 Dorset St. Members Present: M. Boucher, Chair; S. Dooley, M. Emery, J. Knapp Also Present: C. Hafter, City Manager; D. Gravelin, Assistant City Manager; D. Kinville, City Clerk; P. Conner, Director of Planning & Zoning; B. Stuono, M. Young 1. Comments & Questions from the Audience, not related to Agenda items: Ms. Kinville said it has been more than 3 years since the city has looked for quotes for banking services. She suggested they do that now as there have been several small issues. 2. Announcements & City Manager's Report: Ms. Emery said she felt the possibility of a City Council code of ethics should be on an upcoming agenda. Mr. Hafter noted there is one already drawn up and ready to be discussed. He will put it on a future agenda. Mr. Boucher noted he received an e-mail from Bill Stuono regarding a decision he made on a recent DRB vote. He said it raised a questions as to what should be the policy regarding dialogue between the DRB and City Council. The City Attorney says a DRB member has no obligation to explain the reasons for his/her vote, and the City Council should not comment on an issue. Mr. Stuono said he felt the Free Press had misrepresented his position and he wanted the Council to know the facts. Mr. Hafter: the CWD Board will meet tomorrow at Noon. Bids will be opened on Wednesday, 10 a.m. for the paving of 5 miles of the Rec Path Greyhound representatives have asked to speak with the Council at the 4 January meeting. One of the February meetings will take place at Central School. The budget public hearing will take place on 21 January 2010. 3. Continuation of public hearing from 7 December 2009 on proposed amendments to the Land Development Regulations; second reading of same: Mr. Conner reviewed the amendments as follows: CITY COUNCIL 21 DECEMBER 2009 PAGE 2 A. Bartlett Brook Stormwater Overlay Boundary: Mr. Cornier explained that for 10 years the city has had an overlay district in place to address areas subject to flooding. There is now more scientific mapping. The recommendation is to change the map to include the new information. B. Design Overlay District in City Center: Mr. Conner said the City Center area has 2 levels of zoning, a basic zoning and a design overlay. The design overlay has set out an architectural standard for what is built. In recent years, there have been some changes to the basic districts, and the amendment seeks to match the design review overlay to the base districts. Mr. Conner noted there is an exemption for single family/2-family homes and also for school property. Should the school sell any of its property, that property would then fall under the design review standards. C. Homes in the Southeast Quadrant-NRP District: Mr. Conner said the main piece of the amendment clarifies the allowance of a single family home on less than a 15-acre property. This applies only to lots in existence since 1992. The other piece of the amendment allows the replacement of a house in the same location or in a"less harmful" spot on the property. Mr. Boucher question whether to limit the increase of the house footprint. Mr. Conner said the size of homes in the city has not been explored. Ms. Dooley suggested language such as"...will improve conservation aims." Mr. Boucher said he didn't want to discourage people from moving a home to a less impacting area. Ms. Dooley asked whether it is clear that an existing structure cannot become an"accessory structure." Mr. Boucher said the existing structure would have to be eliminated if a new principal structure were to be built. Mr. Stuono said he would like to see clear standards for the DRB. Mr. Knapp suggested adopting what is presented so that there is standard and then having the Planning Commission relook at it to make it clearer. Mr. Conner noted this does not apply to a large number of properties. D. Location of Parking on a Parcel: Mr. Conner noted the regulations currently say parking shall be to the side or rear"where practical." This is not a standard that can be applied. The City Attorney has recommended more specific language. The proposed language would list the specific CITY COUNCIL 21 DECEMBER 2009 PAGE 3 exceptions as follows: 1. To meet the Americans with Disabilities Act 2. Single/2-family homes 3. Unstable soil 4. The building is existing 5. Public Recreation areas 6. Multiple buildings on a parcel There is also specific language as to what can take place on a corner lot. Mr. Stuono questioned whether this parking regulation discourages nice facades facing the street. Mr. Conner said that was a concern. The Planning Commission felt it could take a look at design standards in a future round of amendments,but they wanted to clarify the legal issues now. E. Parking Standards for Assisted Living: Mr. Conner noted that the existing standards for assisted living are the same as for congregate housing. The Planning Commission has been told the numbers for assisted living are way off. Research has shown that what is recommended is a half-space per unit. To be conservative, the amendment is recommending .6 parking spaces per unit. It is highly unlikely that anyone living in an assisted living residence will be driving. F. Pet Grooming: The amendment distinguished pet grooming from a kennel use. It would be allowed where other personal services are allowed. G. Outdoor Exercise Areas for Animals: These would not be allowed for pet grooming facilities. The amendment includes standards to address concerns raised by neighbors. H. Gated Driveways/Roads: The amendment clarifies that these are not allowed in the city. I. Outdoor Storage/Outdoor Display: The amendment clarifies the difference between these uses. CITY COUNCIL 21 DECEMBER 2009 PAGE 4 J. Accessory Structures: Mr. Conner noted there have been requests for accessory structures higher than 15 feet (e.g., a barn with a pitched roof). The amendment would allow 25 feet with qualifications (including 1 acre minimum lot size, additional setbacks, roof design). Ms. Dooley said she didn't want to approve a secondary structure that might be higher than the main structure. Mr. Knapp said that didn't concern him. Ms. Emery was OK with the amendment as there are no waivers for additional height to the accessory structure. K. Number of Units in a Structure in an R-4 District: Mr. Conner said the amendment creates a cap of 4 units. This will be further researched. L. Exterior Lighting: The amendment encourages energy-efficient lighting. M. Self-Storage in the I-C District: The Planning Commission agreed to allow this as a secondary use in establishments where there is staff on duty. N. Childcare Facilities: The amendment clarifies that these are subject to site plan review. O. Minor Lot Line Adjustments: The amendment allows these to be handled administratively. If there is a question, the administrator can refer the issue to the DRB. P. Language Regarding Signs: Language regarding signs has been removed for the Zoning regulations since there are separate regulations governing signs. Mr. Conner noted there is also a series of minor word changes and clarifying language. All "may not"language has been changed to "shall not." She felt it takes a vote away from people who cannot get to a meeting. It could also lead to abuse in the future. Mr. Boucher suggested enumerating instances when a floor vote cannot take place. Ms. Kinville felt that would address her major concern. E. Charter Amendment#2 - adjusts the timing budget public hearings,public notification, etc. to align with a March vote. STEERING COMMITTEE 18 NOVEMBER 2009 The South Burlington Steering Committee held a meeting on Wednesday, 18 November 2009, at 6:00 p.m., at the Tuttle Middle School, Dorset Street. Members Present: School Board: A. Clift, Steering Committee Chair; E. Fitzgerald, J. Allo, J. Everitt, Superintendent of Schools; City Council: J. Knapp, M. Emery, S Dooley, C. Hafter, City Manager Also Present: P. Conner, Director of Planning &Zoning, D. Young, Assistant Superintendent of Schools 1. Minutes of 21 September 2009: Mr. Hafter moved to approve the Minutes of 21 September 2009 as written. Ms Emery seconded. Motion passed unanimously. 2. Brief City Update: A. Police Station: Mr. Hafter distributed a current floor plan design for the Police Station on Gregory Drive. He noted that the City has signed the Purchase/Sales Agreement. The facility will be approximately 26,000 sq. ft., most of which will be on the first floor. Lockers and a small exercise room will be on the second floor. The city hopes to lease space on the second floor to help pay for the bond. Renovation work has begun, and it is hoped the Police can move in next April or May. Mr. Hafter noted that a lot of the specialized items are coming in under the original estimate. Ms. Fitzgerald asked if the Police facility near the school will still be used. Mr. Rafter said it won't be used by the city. Mr. Young said it was good to have the Police presence there,but since there are officers in the school, it is not a concern to have them leave that facility. B. Airport Parkway Sewer Project: The project has gone to bid and the contract was awarded to Pizzagalli. They will break ground in the spring. The Town of Colchester will pay about half of the upgrade costs. The upgrade will expand treatment by 650,000 gallons per day. There will also be a co- generation element to the project which will allow for the re-use of energy. C. Tilley Drive: Mr. Hafter distributed a copy of the plan for the extension of the Rec Path system. The path will connect the end of a dead end street to Community Drive in Technology Park. f STEERING COMMITTEE 18 NOVEMBER 2009 PAGE 2 The City received an 80% grand for this work which will go under construction in the spring. D. Storm Water Projects: Mr. Hafter noted that the city received 4 federal grants for storm water facilities upgrades. Half of the work will be paid for from these grants,the other half from residents of the areas involved. One project has been completed, 2 others are substantially complete, and the 4th project is awaiting an agreement with a neighboring property. Mr. Hafter said these projects will result in improvements to the quality of creeks in South Burlington. E. Mid-Block Crossings: The City received 100% grants to make mid-block crossings safer. LED lights will be used at these crosswalks to alert drivers to the presence of pedestrians. These have been used very successfully in the west. Installation will begin in the spring. The City also received a grant to upgrade San Remo Drive. This will be done in the spring as well. F. City Charter Changes: The City Charter Committee met yesterday to discuss changes necessitated by the public vote on the city/school budgets and Australian ballot issues. There is a proposal to reduce the number of days the budget goes to the Steering Committee before the vote from 60 to 45. Budgets would be mailed to voters10 days before the public hearing(no change) and 20 days before the vote (reduced from 50 days). The public hearing would be 10 days before the vote instead of 40. This will also move budget meetings outside of the holiday season so more people can attend. In the second issue,the City Charter currently requires all votes to be by Australian ballot. This year,the city received some"time sensitive"federal grants that could not be warned for Australian ballot due to time deadlines. Voting was held at a City Council meeting and then affirmed by Australian ballot at a later date. The City Charter Committee is working on language to address this situation. STEERING COMMITTEE 18 NOVEMBER 2009 PAGE 3 3. "Cars to People": Mr. Conner said the goal of this initiative is to make South Burlington a more pedestrian and bike friendly city. He noted that last fall the City received a grant from the MPO to look into zoning along corridors in order to encourage people to walk and bike in those areas. Mr. Conner noted this relates to the"Safe Routes to School" initiative in which all South Burlington schools are involved. This is a 2-part program: first getting people to think about these possibilities and second to consider what infrastructure can be put in place to make it happen. Ms. Clift asked if there are plans to make it easier to cross Williston Rd. Mr. Conner said that is at the top of the list. He noted that a project has been identified for White Street/ Williston Road as part of the City Center project. Ms. Dooley felt reducing the speed limit is critical. Mr. Hafter noted that the #1 priority for CCTA is a bus directly up Williston Rd. to the Town of Williston which will run every 15 minutes. Mr. Conner noted the only stop off Williston Rd. would be at Umall. 4. Community Outreach on Policy Governance: Ms. Clift said the School Board is trying to reach out to the community to be responsive to needs and interests. A community forum was held last week which focused on what people expect high school students to be able to do when the leave the system. Supt. Everitt said the Board is considering some election day surveying as well. Mr. Hafter said they should check with the State on rules for this. Ms. Fitzgerald asked about demographic number, e.g., the number of families with children in the school system, etc. Mr. Hafter said there are Health Department estimates,but these should be more accurate after the 2010 census. 5. Brief Discussion on Proposed Shift of School Teacher Retirement to Local Property Tax: Superintendent Everitt reviewed the history of this. He noted that it is being considered by a Legislative committee. Issues they are considering include health benefits, contributions by teachers, etc. The significant issue is where funding will come from, and there is talk of moving it to a property tax base. This could result in a"teacher retirement"line item or a surcharge on the state property tax. ti STEERING COMMITTEE 18 NOVEMBER 2009 PAGE 4 Mr. Hafter commented that this doesn't seem to be a savings,just a shift. Supt. Everitt said the State Treasurer has said something must be done and the Governor agrees. Mr. Halter noted that the City's contribution to the retirement fund is about $1,400,000 a year. He felt the School District was looking at a lot more. 6. Other Business: Mr. Hafter noted the City has completed the first draft of the 2010-11 budget. There will be no tax increase on the general operating budget (the city will use funds from the 1 cent local option sales tax to offset the increase). The only increase taxpayers will see is from the Police Station bond they approved.
