(802) 846-4107 AGER � •`+ FAX (802) 846.4101 CITY M rowx r'a��, CHAR ES ENHAFTER September 8,2008 Chair and City Council South Burlington,VT 05403 Re: Discussion of enforcement of City policy regarding political signs in the public Right of Way To All Members: Both the State of Vermont Billboard Law and the City Sign Ordinance prohibit off-premises signs and also prohibit signs placed in the public right of way. Political signs are not exempt from the City Ordinance. In past years,the Zoning Department,with the help of other City employees,has enforced these provisions and removed many signs from city streets. In Presidential election years,sign's can run into many hundreds,even potentially thousands. We send letters of information to all political campaigns following the primary,but these are generally ignored. If not by the candidates themselves,they are ignored by supporters. The city staff spends many hours each day trying to be fair to all candidates by removing signs in violation. We do have time constraints,and weekend enforcement is very hit-or-miss,and very visible intersections must be cleaned several times each week. I believe that as a result, South Burlington has a less cluttered look than some neighboring towns that do not enforce,or do not have,local ordinances. However,we are well aware that there are signs we do miss or that are put back right after they are pulled. We place all removed signs behind City Hall and many are reclaimed and put out again. To be clear,this enforcement only effects public property—private property owners are free to put up as many signs as they choose on their own property. We are seeking Council input into whether staff should continue to try to enforce this policy with the effort and time required,or if Council feels a certain period before the election is acceptable for signs in the public right-of-way. Regardless of your decision,I do recommend that the City retain the right to remove any signs that are deemed to be in a location unsafe to traffic and from City Parks. Signs in the median of roads also can present a hazard. Staff is neutral on this issue and welcomes your opinion. Other business/announcements 2. Minutes of August 19, 2008. 3. Continued Site plan application #SP-08-73 of the Crate Escape Too to amend a previously approved plan for a 53,000 sq. ft. building consisting of 46,000 sq. ft. of light manufacturing use and 7,000 sq. ft. of pet day care facility use. The amendment consists of adding kennel use to the pet day care facility to allow overnight boarding of dogs, 68 Nesti Drive (old Bouyea Fassetts plant). 4. Continued final plat application #SD-08-34 of Dorset Street Associates LLC & G&A Associates, LLC, to amend a planned unit development consisting of 149 residential units. The amendment consists of: 1) adding 30 acres to the project area, 2) constructing 79 single family dwellings, and 3) constructing 30 multi- family dwelling units, 1530 Dorset Street (Chittenden Cider Mill). 5. Site plan application #SP-08-41 of Catherine Antley to amend a previously plan for a 5800 sq. ft. building consisting of 2500 sq. ft. of medical office use, 2900 sq. ft. of laboratory use, and 400 sq. ft. for mechanical use. The amendment consists of changing uses in the building resulting in the following: 1) 1500 sq. ft. of medical office use, 2) 1000 sq. ft. of laboratory use, 3) 1957 sq. ft. of general office use, and 4) 1318 sq. ft. of mechanical use, 30 Farrell Street (old American Lung Association building). 6. Miscellaneous application #MS-08-09 of Munson Earth Moving for re-approval to extend the expiration date for removal of approximately 40,000 cubic yards of fill on the property beyond the October 15, 2007 expiration date, 284 Meadowland Drive. 7. Site Plan application #SP-08-78 of Purpose Energy, Inc. to amend a previously approved plan for a 57,137 sq. ft. light manufacturing facility (brewery). The amendment consists of constructing a 5100 sq. ft. digester(accessory structure), 5 Bartlett Bay Road (Magic Hat). 8. Site plan application #SP-08-83 of Joe Eddy Holdings, LLC to amend a previously approved plan for a 14,000 sq. ft. building for multi-commercial and industrial uses. All you would have to say is that the City of South Burlington is proud to announce September 20th as Arbor Day 2008 in South Burlington. In celebration, several members of the community and the City Arborist will be hosting a Tree Pruning clinic.All are invited. I can make fliers or do a memo for that packets if you think that would be helpful. You told me a few weeks ago that you should be able to get the Tree Ordinance on for a first reading for the City Council on October 6th. Can you confirm that? The objective is to help the young street trees in our newly developed neighborhoods to have a better chance to survive and thrive. This outreach project is FREE and open to the public .. it is a great opportunity to make a difference, learn some helpful tips, understand more about our urban trees and have a lot of fun together! Our goal is to promote successful, safe, and environmentally prudent home horticulture practices through education and community activities. Sent to Free Press by December 17th (City responsibility this year 2009) January 5,2009 Charter requires budget be provided to Steering Committee. Combined City Council and Steering Committee budget meeting, 7:00 P.M. (Not required by Charter,it has been tradition) January 6,2009 Budget book sent to printers January 9,2009 Budget book delivered to large conference room no later than 8:30 A.M. Volunteers from RSVP label books.A warning is published for a public hearing to be held January 22,2009 for the City and School District budgets. (City responsibility this year 2009) January 12,2009 Budget books mailed to residents January 22,2009 Public hearing held by City Council and School Board to consider proposed budgets,7:00 P.M. January 22-February 1,2009 A majority of the Council should sign warning(special meeting may be required),file the warning with the City Clerk,and put copies in City Hall and at least six (6) other public places within the City. Copies of the warning must be posted in at least two (2) public places within each voting district. If a warning includes a bonding article,the bonding resolution must be signed by the Council or School Board,incorporated in the minutes of the meeting,and must be published three times (once a week) on the same day of the week. The last publication cannot be less than five (5) nor more than ten(10) days prior to the Annual City meeting (suggest February 10 for first publication). Mail ad to Free Press by 02/03/09. February 17,2009 The second publication of the warning in the Free Press,if the warning includes a bonding article. If the warning does not include a bonding article it need only be published once prior to the annual meeting. The statutes do no specify when the publication takes place,however,Section 1303 of the Charter indicates that the warning must published at least ten (10) days before the date of the annual meeting.
