Date: July 10, 2008 To: City Council of South Burlington From: Winding Brook (WB) Homeowners' Association Board Re: The City's Industrial, Chain-Link Fence at the Main Entrance to our Residential Community The large, industrial fence which the City constructed on land that it seized by eminent domain from WB homeowners during the widening of Kennedy Drive mars and defaces the main entrance to our residential community. The City's landscaping plan has failed to block the view of the fence as promised in a letter to Lorraine Berkett, a resident of WB, dated July 12, 2007. We are fully aware that Lorraine Berkett started a petition at the WB Homeowners' Association's Annual Meeting on January 17, 2008, which we support and signed. The petition states: Petition to the City of South Burlington to Have Them Remove the City's Industrial-Style, Chain Link Fence at Winding Brook Entrance We, residents of the Winding Brook community, strongly request the City to remove the industrial-style, chain link fence it constructed at the main entrance to our residential community on land that it seized by eminent domain. The City's chain link fence mars and defaces the primary entrance to our residential community. We want it replaced with one that is appropriate to this residential area of 84 homes. ti The industrial fence is in total conflict with the high standards of the City to enhance and maintain the visual quality and integrity of South Burlington residential areas. We request that the industrial fence be replaced immediately with one appropriate for a residential entrance. Any further delay in replacing this industrial fence only extends the defacing of our residential community by the City and adds injury to our property values. Berkett, Ph.D., 8 Winding Brook Drive Enclosed please find a copy of a letter from the Board of the Winding Brook (WB) Homeowners' Association to the City Council of South Burlington requesting the immediate replacement of the City's industrial fence at the main entrance of the Winding Brook residential community. Also, please find a copy of the petition signed by residents of Winding Brook to replace the fence. One hundred percent (100%) of the residents that were approached to sign the petition were in favor of it. The original, signed letter and petition will be submitted to the Council tonight at the City Council meeting. I have confirmed with the attorney who represents the Allen Road Land Company that she will attend the hearing. The hearing and site visit will provide the Council an opportunity to review the project site and note specifically the property' s access to Hinesburg Road and the proximity of the proposed on-ramp to an existing residence. Representatives of the Allen Road Land Company have, in preliminary discussions, suggested that the proposed taking will render the balance of the property unusable. I have also received new preliminary design proposals for the interchange. The Council' s review of this information should assist it in deciding how it wants to proceed with this acquisition. This interchange is presently designated as Exit 12B. The Council voted to hold a public hearing and site visit on July 21, 2008 . At its May 19th meeting, the Council was shown a plan of the Allen Road Land Company property with the area to be acquired by the City delineated by a red line. Following the Council meeting, in discussions with representatives of the Chittenden County Metropolitan Planning Organization ("CCMPO" ) , I learned that the CCMPO had contracted for preparation of new preliminary designs of the Exit 12 interchange. In hopes of receiving these additional plans, I delayed issuing the thirty-day notice for the July 21' hearing. Unfortunately, I did not receive the revised plans by June 20th and the required date for issuing the public notice passed without the notice being issued. I apologize for this oversight on my part . Despite the lack of the required notice, I recommend that the Council proceed with the scheduled hearing and site visit . Shortly after the Council meeting on May 19th, Amanda Lafferty and Joe McLean in this office informed representatives of the Allen Road Land Company and others participating in the pending Environmental Court appeal involving the subject property of the scheduled hearing. This was later reported to the Environmental Court during a status conference. This section expressly authorizes the City Council, without amending the City Charter or otherwise obtaining voter approval, to change the date of the annual city meeting. Such change, if made, will also change the date of the school district meeting. The City Council is not required by the City Charter to hold a public hearing to exercise this authority. Nonetheless, we recommend that the Council hold at least one public hearing that is warned in the same manner as public hearings on ordinance adoptions are warned. I have attached a draft public hearing notice for such a hearing. Following the public hearing, the Council can take action on the proposal . You have asked what impact the change would have on incumbent City and School District officers who were elected at annual meetings conducted in May. The terms of these officers are generally described as one, two and three years . However, the precise duration of these terms is not based on a 365 day year. In this case, Plaintiff was socializing one evening with Defendant Quattlander and others, in Ms. Quattlander's back yard. At some point after nightfall, a loud noise alerted at least one of the persons present to the fact that a tree in the vicinity was falling. I believe the evidence at trial will show that at least one person yelled "TREE!,"perhaps pointing to the tree at issue. I believe the evidence will also show that all of the persons present ran in a direction opposite that of the problem tree. Everyone escaped serious injury, except Plaintiff,who was struck by a part or parts of the tree, sustaining fractures of her skull and right wrist. At this point, the City views Plaintiff as fortunately having recovered quite well. While she has some residual effects from her injuries, the City submits that those effects do not substantially impair her abilities or enjoyment of life. Plaintiff has sued both Ms. Quattlander and the City, ostensibly because there may be a question as to which Defendant(if any) was ultimately responsible for the tree's condition. I believe the evidence will show the tree's condition was poor(dead), and as a result, it was an arguable hazard by virtue of its leaning at a significant angle into the area where the accident occurred. The question of which Defendant(if any) is ultimately responsible for the tree's condition is arguably made more difficult by the fact that the tree, while functionally part of Ms. Quattlander's back yard, was (for purposes of argument) actually rooted in/on City land. June 20, 2008 Page 2 "cultivated area"referred to in the Complaint was land which over the years was the subject of some back-and-forth between homeowners (including Ms. Quattlander's family) and the City as to what could or could not be done on/with the land because the land was, survey-wise, really part of one of the City's parks. Attached is a rough drawing(by yours truly) with information (at least for mediation's sake)which may help. Written discovery has been exchanged, and Ms. Butler and Ms. Quattlander have been deposed. Darla Champine has also been deposed. She is a long-time City employee who spoke with Ms. Quattlander in a telephone conversation on July 21, 2004, the day after the accident. Accompanying is a copy of the memo that Ms. Champine did with regard to that conversation. As you will note, the memo states in part: Jackie was calling to inform us that a tree that she said was dead and that she knew it was dead and had not taken care of it had fallen in her back yard and that a friend had been injured by the tree and was in ICU at the hospital. The City's position is that it bears no responsibility for what happened. The City views the evidence as a clear situation where the tree at issue had been part of Ms. Quattlander's back yard (i.e.; in the mowed, gardened, cared for, etc., area) for decades, and had been a noticeable hazard to Ms. Quattlander for decades as leaning significantly over her back yard. As the memo by Ms. Champine shows, Ms. Quattlander, a day after the accident, acknowledged that she knew the tree was dead and"had not taken care of it." The City anticipates that Ms. Quattlander's position will be that the tree's roots being in City soil make the City solely responsible. Such a view is untenable. The City's arborist would testify that the City owns some 5,000 trees and that the City, like other governmental entities charged with the care and maintenance of trees, undertakes reasonable steps aimed at insuring that those areas of the City where trees' proximity to persons and property could be an issue (especially around significant weather events), are periodically inspected as resources allow. In this case, Ms. Quattlander was in the best position to know of the tree's condition and to do something about it. Accordingly, any liability here should be hers. Notwithstanding the City's view that it bears no responsibility here, the City looks forward to the parties attempting a pre-trial resolution of the case. Because I'll likely be preparing for a jury trial that commences on July 21, 2008, there is a chance that one of my colleagues will attend the mediation in my place, sufficiently informed. HAFTER July 18, 2008 Chair and City Council South Burlington, VT 05403 Re: Discussion of fencing used on Kennedy Drive project to secure stormwater ponds; Lorraine Berkett, Winding Brook resident To All Members: You have received several communications from Ms. Lorraine Berkett a resident of Winding Brook Condominiums. Ms. Berkett is unhappy with the use of chain link fencing on the Kennedy Drive project which she believes takes away from the aesthetics and value of her property and other homes in Winding Brook. As background, the Kennedy Drive project was the first in the State to comply with new stormwater regulations. As such, fencing was needed to provide security at the site of several stormwater ponds. Kennedy Drive was a 90/10 project, in that the State provided 90% of the funding and the City 10%. State specifications, and participating costs, are limited to the use of chain link fencing for this type of use. We did specify green fencing to try to minimize the impact of the fencing—but we overlooked that the poles were not specified as green, so the contractor installed silver poles. The state would not share in the cost of any other type of fencing. Staff agrees that the impact of the fence can be mitigated, especially as the landscaping installed at the Winding Brook site has not grown as well as that at other sites. We have investigated the alternatives, and some information is attached to this memo. To summarize, the alternatives for Winding Brook are: • Chain Link: $1722-$2756; Installed $3400-$5500 • Wood Picket: $2411-$4134; Installed $4800-$8000 • Steel/wrought iron: $7234-$10335; Installed $14000-20000 • PVC: $5856-8268; installed $11500-16500 • Aluminum: $7234-8957; installed $14000-$18000 • 5-6 ft Arborvitae: $1550 installed • 6-8 ft Arborvitae: $2650 installed Although there are seven stormwater ponds with fencing in the project area, we believe that only two have an impact on residential properties. It is staff's opinion that the use of 6-8 ft Arborvitae hedge will present the most efficient alternative to minimize the impact of the fence and we are prepared to move forward with this option. Alternatively, if a condominium association wants a more expensive option, the City could offer them the opportunity to pay the difference between their chosen option and the cost of the Arborvitae hedge and install the option chosen. I plan to be at the next Council meeting on July 21, 2008, and submit to you the petition, signed by the WB Board and residents, to remove the fence and replace it with one appropriate to this main residential entrance. The City in its letter dated July 12, 2007, committed to change the "type of fence" if the project's "extensive" landscaping did not "both block the fence and return the area to the conditions before the project started." The City has stated that the "projects landscaping is done" (letter dated November 27, 2007). The landscaping was not "extensive" and the project failed to block the industrial fence as has been documented by numerous pictures taken throughout this past year and submitted to the City. It is time for the City to fulfill its commitment to change the type of fence. In previous correspondence with you, I have included pictures of security fences that have been constructed in high visual impact areas on private and City land (i.e., the Marcotte School security fence along Williston Rd. and the security fence at the Heatherfield stormwater pond) as examples of an appropriate type of security fence for the entrance to the WB residential community. Again, the City's industrial, chain-link fence is not appropriate for the main entrance to the WB residential community. I look forward to the City Council meeting on July 21. The Resolution also establishes a policy for the method the City Council will use to allocate these funds. The Resolution has been drafted by Steve Stitzel, with my input and has been designed to give City Council maximum flexibility in the use of these funds, while maintaining transparency and public input. Sincerely, (ji,,ki Charles Hafter City Manager • RESOLUTION ESTABLISHING RESERVE FUND FOR ROOMS, MEALS AND ALCOHOLIC BEVERAGE TAX REVENUES WHEREAS, pursuant to Section 1506 (a) of its charter, the City of South Burlington is authorized to impose a tax on those transactions in the City involving rooms, meals and alcoholic beverages; and WHEREAS, pursuant to Section 1506 (b) of the City Charter, the City Council may, in its sole discretion, deposit some or all of the revenues received from the above-said tax in a reserve fund to fund the purchase of land or construction/reconstruction of City buildings and infrastructure; NOW THEREFORE, BE IT RESOLVED by the City Council that there is hereby established a reserve fund, to be known as the Land Purchase and Construction Reserve Fund, and that the City Council be authorized to expend monies in the fund to purchase land or to construct or reconstruct City buildings and infrastructure; AND BE IT FURTHER RESOLVED that the City Cou it may expend monies in the fund for the above-stated purpose y including proposed expenditures in the annual City budget or, in the event the Council identifies an expenditure not included in the annual budget, by approving the expenditure only after soliciting public comment at a public meeting held with at least fifteen (15) days 'public notice; AND BE IT FURTHER RESOLVED that all of the revenues received from the above-stated tax be deposited in such fund unless otherwise directed by the City Council. The City's landscaping plan has failed to block the view of the fence as promised in a letter to Lorraine Berkett, a resident of WB, dated July 12, 2007. We are fully aware that Lorraine Berkett started a petition at the WB Homeowners' Association's Annual Meeting on January 17, 2008, which we support and signed.
