WAIVER OF RIGHT TO APPEAL
The Administrative Officer may issue a Zoning Permit pursuant to an approval of a
Zoning Permit Application prior to expiration of the thirty -day appeal period set forth in 24
V.S.A. section 4471 only if there are no interested persons, as defined in the
aforementioned section, other than the City and the applicant/landowner, and if the
applicant/landowner waives his or her rights to appeal any relevant Development Review
Board approvals. In order to ensure the finality and validity of any relevant Development
Review Board approvals in those cases where there are no interested persons other
than the applicant/landowner and the City, the applicant/landowner must waive his or her
rights to appeal in order to receive a Zoning Permit prior to the expiration of the appeal
period.

Hi Marla —
Attached is a PDF of the zoning permit application for tree clearing at City Center. The application (with fee) will be
delivered this afternoon. This application requests approval for tree clearing on 6.8 acres within wetlands, wetland
buffers, stream buffers, and upland areas. The tree clearing will be completed prior to April 15 to comply with time of
year restrictions to avoid potential impacts to bat habitat. No construction is proposed — only tree clearing. As such, the
State Stormwater program has recommended following the Acceptable Management Practices for Maintaining Water
Quality on Logging Jobs in Vermont (which are attached to the zoning permit application).
In addition to the plan showing the proposed 6.8 acres of clearing, we have also included for reference, the plans
showing the overall clearing limits and wetland impact plan provided with the recently approved Conditional Use
approval (CU-18-01).
