Notice of Appeal Rights: Any interested person may appeal this decision by filing a written Notice of Appeal with the clerk of the
Development Review Board within fifteen [15] days of the date of this decision. The notice of appeal must be accompanied by a filing
fee of $223.00.
This permit does NOT authorize commencement of any development activity approved by the permit until the permit takes
effect as set forth above. Site modifications and improvements made prior to this permit becoming effective may be subject to removal
and site restoration if a timely appeal is commenced.

Zoning Permit Application Submittal, (#SP-17-22, #CU-17-05)

Please find enclosed the Zoning Permit Application and fee check for the Lake Champlain Marketplace Project.
This application is associated with the Findings of Fact and Decision for applications #SP-17-22 and #CU-17-05,
dated June 21, 2017 for renovations to the existing building and improvements to site landscaping, lighting, and
stormwater treatment systems at 935 Shelburne Road, in South Burlington. In support of this application, our
office and the applicant have previously submitted to the South Burlington Department of Planning and Zoning
the following documents:
• For recording, a "Notice of Conditions", approved by City Attorney indicating 1) an access easement
shall be granted to the adjacent property at 919 Shelburne Road, and 2) referencing the Irrevocable
Offer of Dedication described below.
• For recording, the Irrevocable Offer of Dedication for the perimeter drive of the project parcel, and the
associated warranty deed, and Vermont Property Transfer Tax Return form (PTT-172)
• Landscape bond in the amount of $118,364.
• Electronic (pdf format) and 3 hard copy set of the approved site plans dated June 6, 2017, with
landscape sheets revised June 22, 2017.
• As previously discussed with Zoning staff, no water and wastewater allocation is required because the
project does not propose an increase in flow.
