The South Burlington Development Review Board held a regular meeting on
Tuesday, 17 May 2005, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset
Street.
Members Present: J. Dinklage, Chair; M. Boucher, R. Farley, G. Quimby, C. Bolton, M.
Behr, L. Kupferman
Also Present: R. Belair, Administrative Officer; B. Robertson, Associate Planner; G.

Mr. Belair reminded audience members that they must sign the attendance sheet if they
have any intention of participating in a future legal action.
The meeting of 21 June is cancelled due to lack of staff to plan for it. The next meeting
after the 7 June meeting will be on 5 July.
Interviews are being held for a replacement for Brian Robertson who is leaving to attend
graduate school. This is Brian's last meeting.

C3.) Public Hearing: Motion & Request to Reconsider Findings of Fact and
Decision of South Village Communities, LLC, regarding Master Plan
Application 4MP-04-01 for: 1) 334 residential units, and 2) a 100-student
educational facility, and 3) a 35 acre community supported farm, 1840 Spear
Street:
Mr. Dinklage noted receipt of 2 new documents, one from the City Attorney and one
from Mr. Vallee's attorney. The latter reiterates objections to the development in
sensitive areas of the property. Mr. Dinklage noted receipt of a letter from Mark Hall,
representing South Village, stating the reasons they are asking to reopen the application.
Mr. Belair drew attention to the paragraph in the City Attorney's letter outlining the
parameters for reopening a hearing. The applicant must show that either of the following
has occurred: 1) a substantial change in circumstances, or 2) something in the Board's
decision that is based on fraud, a mistake, etc. If the Board does reopen, they must state
specifically which items it wishes to reconsider.

Mr. Hall then outlined their reasons for requesting a reopening of the hearing. The first
reason involves minor mistakes (mislabeling of north and south, location of a utility line,
etc.). The second larger issue is the number of houses that triggers construction of the
bike path and the road (Stipulations 11 and 21).
Mr. Hall said the latter issue seems to have resulted from a compromise position with the
City Council. He felt it would be appropriate for the Board to hear from the applicant as
to what would be an appropriate number of houses. Mr. Dinklage agreed that the
applicant did not have an opportunity to comment on the 206 number.
Mr. Kupferman said he had no objection to reopening. He was not sure what would
trigger a developer's financial ability to build a road.
Mr. Dinklage stressed to the applicant that if the Board does reopen, they would have to
get all of their information to staff so both staff and the City Attorney can review it prior
to the hearing.
Mr. Boucher then moved to reopen Master Plan Application #MP-04-01 of South Village
Communities as detailed in a letter from the applicant to the Development Review Board
dated 10 May 2005 and to set 5 July 2005 for the reopened hearing. Ms. Quimby
seconded. Motion passed unanimously.
4. Public Dearing: Final Plat Application 4SD-05-34 of Daniel Morrissey to
amend a previously approved planned unit development consisting of the
existing Vermont Gas Building and a 38,428 sq. ft. building for general office
use and a bank with drive -through service. The amendment consists of
eliminating the proposed internal access road connecting 69 Swift Street and
85 Swift Street:
Mr. Vock noted that when the project was approved the Board had felt strongly about this
connection. However, staff now notes a serious impact on wetlands as well as changes in
the site including plans of Vermont Gas.
Mr. Vock then showed the location of both buildings. He said the proposed road made
sense 10 years ago. Mr. Vock then showed the location of the wetland and said that the
impact of the road on that wetland is far greater than any benefit the road might bring.
Mr. Belair said staff had no objection to the request.
Ms. Quimby moved to approve Final Plat Application #SD-05-34 of Daniel Morrissey
subject to the stipulations in the draft motion. Mr. Bolton seconded. Motion passed 6-1
with Mr. Boucher voting against.
5. Public hearing: Preliminary plat application #SD-05-36 of University Mall
Realty Trust to amend a previously approved planned unit development
consisting of 675,115 sq ft CFA shopping center complex with 614,338 sq ft of

The applicant was not present. Members continued to application to the end of the
meeting. The applicant was still not present, and the following motion was made:
Ms. Quimby moved to approve Application #VR-04-02 of George Hubbard. Mr.
Kupferman seconded. The motion failed 0-5 with Mr. Behr abstaining.
S. Continued Public Hearing: Preliminary Plat Application 4SD-04-55 of South
Village Communities, LLC, for a planned unit development of Phase 1
consisting of 150 residential units and a 100-student educational facility, of a
344 residential unit project, 1840 Spear Street:
Mr. Marshall said they have 2 points for discussion: rec paths and landscaping/screening.
They did find a way to create a through system for cyclists on Spear Street South. Mr.
Belair said Ms. Calkins wants to know where this will be in regard to her property. Mr.
Marshall said there will be no additional encroachment toward her house.
Mr. Greller gave members written information on what is planned. He showed 3
"sections" along Spear Street with vegetative buffers obscuring views from Spear Street
into the development. The buffer is a mix of native trees, shrubs, etc.
Mr. Marshall showed the areas where view protection zoning is in effect.
Mr. Greller noted that in a third area they will take out all invasive species and use only
native ones. He then showed photos of existing views at key intersections and points on
the site.
Mr. Belair reminded members they cannot approve the Preliminary Plat because the
Master Plan application is still open.
Mr. Dinklage asked about building the rec path prior to the roadway. Mr. Marshall said
that does not make sense. Mr. Belair said this will be discussed at the 5 July meeting
with the reopening of the Master Plan. The preliminary plat will have to comply with
what happens at that hearing. Mr. Marshall said they are willing to discuss a "temporary"
path.
The applicant questioned the bike racks being asked for at the triplex units. Mr. Belair
said they are required but can be waived. Mr. Dinklage said the Board may want to
discuss this with the Planning Commission.
Mr. Belair suggested a triplex "typical" to include setback coverage, parking, lighting,
landscaping... instead of approving each unit. The applicant could then get a permit if the
plan is within the parameters.
Ms. Quimby moved to continue Preliminary Plat Application #SD-04-55 of South
Village Communities, LLC, until 5 July 2005. Mr. Bolton seconded. Motion passed
unanimously.

RE: Recreation Path Committee Review
DATE: July 15, 2004
Mark Negly made a presentation on revisions to the proposed path of the Meadowland
Business Park. The RPC approves the right-of-way connecting to Knoll Circle and
relocated along the southern side of the Park.
In connection with the Pizzagalli development, a path is planned to be located along the
main east -west road with an easement at the eastern end of this thru road connecting to
Technology Park.
In connection with the Milot development on Dorset Street, the sketch shows the path to
be built along the western side of the development along Dorset Street. The committee
recommends that an easement also be asked for along the northern side of the
development.
In connection with the Heatherfield development, the plan shows a path located along the
main east -west road through the development. The committee recommends that the
developer also build a path along the western side of the development along Spear Street
from the western entrance of the development to a point north across the street from the
entrance to the US Forest Service Experimental Station.
The committee feels strongly that at the eastern end of the development a connection be
provided to safely connect the path through the development to the existing path on the
eastern side of Dorset Street. The committee's recommendations have been stated in
previous letters and minutes.
In connection with the South Village preliminary plan, the committee recommends that
adequate and convenient bicycle and pedestrian facilities be built to connect with other
such facilities in the area.

Roadway Acceptance Policy
Dear Ms. Hinds:
We are in the process of preparing an Act 250 Master Plan application for the
proposed South Village which is to include a 334 residential units, 100 student
school and community farm.
Under Criterion 5, subsection 4, the application asks "Has the town agreed to accept the
roadway after it is constructed? [X] Yes [ ] No. (Include letter from the municipality
confirming this.)" In the application we responded that "Provided that the roads are
constructed in accordance with the typical details, certifications and as -built
drawings are provided, the City will accept the roadways. A letter outlining this has
been requested from the City (See Attachment 4)."
Hence, does the City have a written policy that you can share on this issue? Any help

Appeal of Decision of Development Review Board

Dear Jim:
Per our phone conversation last Thursday, South Village Communities, LLC will be
filing a Notice of Appeal of the recently issued Master Plan Approval. In that Decision, a
condition of the approval (# 17, Pg. 16) is that within 90 days we complete a
Development Agreement with the Council detailing the specifics and implementation of
the road phasing for the completion of Midland Avenue. Since this time period extends
well beyond our period to appeal, we are compelled to take the aforementioned action.
Our Notice of Appeal is filed for the purpose of protecting our rights and is in no way
intended to suggest that we will not make a good faith effort to resolve these issues on a
timely basis.
As I outlined to you briefly in our conversation, the requirement that we complete the
road prior to the sale of the 206`h unit (# 11, pg. 15) is an arbitrary mathematical
compromise and is unsupported by the traffic studies and reviews in the record; moreover
it fails to recognize that a significant portion of those units are designated as affordable or
workforce housing. These units, of which there are approximately forty at this point in
the build -out, cannot afford the financial burden of the road cost, pro rata. Thus the
burden of the road cost has to be born by the market rate units.
We had requested that the road cost, which we estimate at 1.7 million dollars, be allowed
to be absorbed by the full market -rate build -out of 269 units. This would require a
withholding, in escrow, of $ 6,320 per unit, which is financially workable. Under the
current permit condition this cost would have to be borne by 165 units, thereby requiring
withholding of $ 10,333 per unit. This is financially unsustainable.

We are proposing as a solution that the City provide financing for a portion of the pro
rata share of the yet -to -be -built market rate units. The full difference would be
approximately 104 units x $ 6,320 or about $ 660,000. We are requesting financing not to
exceed $ 500,000 or about 75% of the total shortfall.
This financing would be in the form of a direct loan, subordinated to our development
financing. It would be held in escrow and used only in direct application for road
development costs. It would be repaid, pro rata, with the sale of market rate units beyond
# 160.
We believe this financing will preserve our ability to provide the 66 units of affordable
and workforce housing included in our application. In consideration of the City's
financial participation, we are committed to providing employees of the City first priority
to purchase these designated homes at South Village.
We believe this is a positive and creative approach in resolving the financial dilemma the
conditions of the Approval have placed on us, and we look forward to working with you
to resolving this matter shortly.

Enclosed, please find the memorandum of law from the applicant's attorney, Mark Hall,
Esq., dated May 10, 2005. This memorandum of law outlines the applicant's issues with the
Development Review Board's decision for Master Plan application #MP-05-01. It appears
that there may have been a couple of minor errors in drafting the decision. In addition, there
are some components of the decision that the applicant would like to discuss with the
Development Review Board. Staff recommends holding a hearing on June 7, 2005 to
reconsider the decision.

Dear Dave:
The South Burlington Water Department has reviewed the Revised Sewer and Water
Master Plan for the above referenced project. Please refer also to my previous comments
on this project.
General Comments:
1. Prior to any building construction, the building contractor must contact this
Department to discuss City requirements for meter sizing, meter settings, and
backflow protection.
2. The SBWD shall be sent any future hard copy plans involving this project for
review. Future plans must include details and specifications as required.
3. The SBWD shall be notified prior to backfilling to inspect all joints, fittings, main
line taps, appurtenances, water line crossings, and testing.
4. Further review changes may be required as this project proceeds through the
permit process.
5. A hard copy set of As-Builts as well as one electronic copy in Auto-CAD.DWG
Version 14 Format or newer shall be supplied to this department upon completion
of the water system improvements.
Comments specific to the Master Plan review, on pages S 1.1, C-6.0-6.6, C-9.2
Air Release Hydrants: Those locations on water lines requiring air release due to
elevation changes shall have Air Release Valves with Air Release Manholes built into the
design. The Air Release Hydrant Detail you have provided with these plans is not
acceptable to Department standards. Air Release valves shall be installed at those places
along the water line where air may accumulate and prevent or restrict the flow of water in
the line. I have provided a copy of the CWD Specifications on Air Release Valves and
Air Release Manholes for your use.
1. Sheet C6.0
a. A future water connection point to Spear Street may be required at the
northern -most entrance to this project. This connection point will be
through a PRV and vault similar to that one being installed across from
Allen Road.
2. Sheet C-6.1:
a. The tee located on the east -west line on the north side of this page shall
include two 12" gate valves as well as one-8" gate valve.
3. Sheet C-6.3
a. The proposed 12" water main shall be connected to the Spear Street water
main on the west. side of Spear Street. A pressure -reducing vault with an
approved pressure -reducing valve shall be installed on the proposed water
main east of this intersection on the north side of the new road from South
Village to Spear Street across from Allen Road, in the green belt. This
will require the boring and sleeving under Spear Street for the new water
main, and a wet tap on Spear Street on the existing 12" water main. There
will also have to be installed a second sleeve of the same size or larger, for
a future water line that will connect from the SB Main Service area to this
water distribution system. The note on the plans requiring the 12" line be
capped must be removed.
4. Sheet C-6.4
a. All proposed dead end lines for future extensions should be extended to
the opposite sides of the road to avoid future excavation in the roadway.
5. Sheets 6.6
a. Please modify all Water Details to those found in the CWD Specifications.
Specifically, the Typical Hydrant Detail shall show the isolation gate
valve as being connected to the reducing (anchor) tee, not to the hydrant as
shown.
6. Sheet C-9.2
a. Allowable hydrants per the "CWD Specifications" include the Kennedy
K81-A, Mueller Centurion, and Waterous Pacer. The same model should
be used throughout this project.
7. Sheets C4.4-C4.7
a. The correct water line sizes should be used in all future Road Profiles.

At the Dec. 6th meeting of the RPC, David Marshall, representing Retrovest,
made a presentation on the proposed recreation path in the proposed South
Village development. The committee voted to support the path as presented by
David, which loops away from Spear Street in the northwest quadrant of the
development. The paths the committee recommends are shown in blue on the
map made in Aug. 2004 (5.0), and a copy was left for the committee.
The committee voted unanimously to recommend that the recreation path be
constructed to city standards from Spear Street and Allen Road to Midland Ave in
Dorset Farms as part of the Phase I construction.

Dear Ms. Moulaert:
We are in receipt of your review comments for the South Village Conditional Use
Determination Application. With the understanding that there will be a site walk on
April 19, 2005 with representatives of ANR, U.S. Army Corps of Engineers,
Environmental Protection Agency and US Fish & Wildlife, we have prepared our
response in a manner that hopefully aids in your further understanding of the issues
associated with the project (responses follow the order of your review comments).
We would recommend that the actual plan update submittal occur after this meeting
so that any recommended modifications arising out of that site -walk can be
implemented. We have replicated your review comments in bold and have included
our responses accordingly.
1. We were pleased to see that the applicant has removed the units that were
proposed in the vicinity of Wetland T from the plan. We think this is a great
improvement. This revision was a component of additional information provided by
Dave Capen on the wildlife issues and continued design modifications associated with
the South Burlington DRB review process.
2. We have the following questions regarding steps that could be taken to first
avoid and then minimize proposed Class Two wetland impacts:
A. In our previous review letter we recommended that the units in Phase III be
relocated to the front of the property, in the vicinity of Phases I and II, to
minimize wetland impacts. Relocating these units would result in less
stream/wetland crossings, and would have benefits for wildlife. While an
increased buffer was provided for in the current plans, units remain
proposed in this section of the property. Based on our review of the
application we understand that these units are proposed to be sited here
due to the city's viewshed protection ordinance. We also understand the
applicant has received some waivers from the city with respect to the

requirements for the roads. In light of the resource impacts involved in
this project, could the applicant also seek waivers from the city so that
these units could be located in the vicinity of the viewshed protection
zone? This would significantly reduce wetland, stream, and wildlife
impacts. The City has not expressed any interest to date in modifying the
Spear Street view protection zone. This would require a change in the Zoning
Regulations which is not permitted as part of the Development Review Board's
authorization to provide waivers. Between the public good that this view
protection zone provides and opposition from the neighbors on Spear Street, a
change in permitting housing in this area is highly unlikely in our opinion.
B. If the number of units proposed was reduced, for example if Phase III were
eliminated from the plan, would the applicant still need to build the
through road? Please explain what is driving the requirement for this
road. The through road is a component of the City of South Burlington's
comprehensive plan. The elimination of this road connection has been
broached as part of this plan review process but has not been adopted by the
Development Review Board. We have been successful in modifying the typical
road section to reduce the wetland impacts. Since the applicant is required to
follow the City's Comprehensive Plan for both Local and Act 250 approval, the
Comprehensive Plan would have to be changed before the road connection
could be eliminated. Ms. Juli Beth Hinds provides additional information on this
matter in the attached letter.
C. Phase III shows two crossings of the wetland. Could one of these
crossings be eliminated to minimize impacts? If not, please explain why.
This project has adopted a Traditional Neighborhood Design approach which
allows for narrower roads and buildings brought closer to the roads. This
clustering approach does not lend itself to high capacity wide roads designed to
carry a high capacity of traffic. It requires a divide and conquer approach where
local traffic is given multiple options to more evenly distribute the traffic and
therefore multiple points of access and egress are afforded as much as possible
within each neighborhood. The perfect design has not been achieved in all
locations as a result of cutting back on some of these connections to reflect the
presence of certain resources. Cutting back further will erode the goals to an
unacceptable level. This design approach is further outlined in a letter from Mr.
Rick Chelman.
D. Could the stormwater basin be moved outside of the wetland's buffer
zone? This has been designed to be as sensitive to the wetland buffer area as
possible utilizing the State of Vermont's current Stormwater Rules. Future
amendments may allow for a resizing of this. In the interim, we have designed

the encroachments to be on the downhill side of the wetland but have provided
enough buffer so as to ensure that the hydrological and hydrogeologic system
will not be adversely affected.
E. It appears that one of the proposed roads will impact a rare plant species
that occurs in the wetland. Could the project be modified to avoid
impacting this plant and its habitat? If not, the applicant should propose
some type of mitigation for this impact, in consultation with the Natural
Heritage Program staff. A response on this issue will be issued by
Countryman Environmental.
3. We understand from the application materials that the undisturbed wetland and
wetland buffer zone areas will be preserved as part of this development. What
steps have been taken to ensure that the remaining undeveloped areas will be
preserved in perpetuity? We recommend that some sort of permanent
protective mechanism be proposed to prevent future development of these
areas, such as a deed restriction or a conservation easement. The applicant
proposes to deed restrict any additional development beyond the project footprint
included in the City of South Burlington's Master Plan approval of the project.
Discussions continue on whether a third party will ultimately control a conservation
easement on the remaining lands.
4. We recommend that a split -rail fence or similar be proposed in those locations
where units are proposed adjacent to or in close proximity to the wetland's
buffer zone to help prevent encroachment into these areas. We concur and
these will be added to the plans with the next plan update submittal.
5. The landowner should sign the application as a co -applicant. The agreement
between the landowner and the developer does not replace the landowner
signature requirement as this is an agreement between two private parties, and
the state is not a party to this agreement. A copy of the fully executed document
is enclosed.
6. In the application "bridged" wetland and stream crossings are referenced but
the project specifications refer to culverts. Could you please explain this
apparent discrepancy? Would using an actual bridge help to further minimize
wetland impacts. The proposed "Bridging" of the riparian corridors is to be
completed with a precast arch "culvert" product similar to that depicted in Attachment
I. The installation locations and profiles of these two structures are depicted on
Sheets W1.0 and W3.0 within Attachment J.

7. Ourstream alteration engineer, Chris Brunelle, reviewed the project plans since
the stream crossings occur within the Class Two wetland complex. He
recommends that the culverts meet the following criteria at a minimum: the
road crossing structures and approach fill should not encroach within ordinary
high water (bankfull = Q1.5); should not raise the mean annual water surface
profile (Q1.5) above profile associated with no existing structure; should not
block fish passage; and should maintain natural substrate through the
structure. He also requests that your client contact him regarding the need for
a stream alteration permit. We have no issue with these design recommendations
since we believe that the current designs achieve all of these goals. We will
document compliance of these with the next update plan submission.
8. As mitigation for proposed impacts, we recommend that the applicant
designate all undisturbed wetlands and their buffer zones as "no -mow zones".
This is a reasonable request as long as it does not adversely affect the restoration
management practices required to first reduce the presence of invasive species and
two maintain the native species in an acceptable manner. Mowing will only be done
to establish the native vegetation plantings during the first few years of restoration,
per the management plan. The mowing also mows to a 10" height, 1-2 times during
these first few years of establishment.
9. The plans should be revised to clearly state the restrictions associated with the
Class Two Wetlands and their 50-foot buffer zones, and to reference the CUD.
Notes will be added in the next updated plan submission identifying the jurisdictional
limits and restrictions associated with the management/use of these areas.
10. The plans need a legend (for example, see the plans titled "Wetland Impact
Summary" and Grading and Drainage Overall Plan"). The plans will be updated.
11. Will the road crossings include utility crossings as well? If so please amend
the application to include reference to such crossings. They will. The application
narratives will be amended to reflect this.
12. Reference is made to a recreation path. Please submit a plan that shows the
proposed recreation path, and indicate what sort of improvements will need to
be done in order to create the path. For example, will any vegetation be
removed from the wetland or its buffer zone for the path? Will the path be
paved? How will the prohibition on dogs in the trail be enforced? There is a
City mandated recreation path which has been shown on the plans (Attachment J).
There is also a proposed "quiet path (no dogs, no bikes, 4' gravel path in steep areas
to minimize erosion potential, perhaps less in certain areas) which will be laid out to

minimize the amount of land disturbance. It is intended to go around trees and
brushy areas. We will provide a copy of the Community Land Management Plan
which outlines the restrictions on the use of this path.
13. We will reserve our comments on the erosion and sediment control plan until
our erosion control specialist, Kim Greenwood, has the opportunity to review
them. This will be a condition of any permit that will be issued. This project will
be applying for an Individual Permit to Discharge Stormwater from Large
Constructions Sites. Ms. Greenwood's management of this program will provide
ample review of the EPSC issues.
14. Please include a plan that shows the limits of the proposed restored areas
referred to in the application, by habitat type. What is the acreage of the
wetland and wetland buffer zone area that is proposed to be enhanced with the
invasive plant management and plantings? Also, we request that any proposed
plantings in the wetland and its buffer zone be 1) non-invasive and 2) native to
Vermont. If this is not the case, the plan should be changed accordingly. We
will provide this information in the next updated plan submittal.
15. The Wetlands Program has started breaking down impacts into two categories,
temporary vs. permanent. We saw that you broke down the proposed wetland
temporary and permanent impact for the Corps of Engineers. We will provide
this additional information with the next plan submittal package.

Dear Mike,
The City of South Burlington is responding to your request, through the applicant
South Village Companies, LLC, for documentation of municipal policies
regarding the roadway and recreation path system and wetland impacts
associated with the "South Village" residential project.
Much of this letter will sound very familiar to you after our discussions
concerning the "Heatherfields" project. This letter reiterates many of the same
City policies regarding connector roads and recreation paths, and also discusses
the alternatives considered and waivers granted to minimize wetland impacts in
the South Village project. I have also specifically discussed the public need and
requirement for the connector loop at the south end of Phase I ("The Village").
City Requirement for Through -Road Connection between Dorset
Street and Spear Street; Acceptability of Alternative Designs
As we have discussed before, the City of South Burlington's Land Development
Regulations universally and unequivocally require connected through -roads
between major north -south collector roadways for all development projects.
South Village, with a total of 337 housing units approved, certainly falls into this
class of projects. A cul-de-sac, or any other option short of a full through road for
two-way traffic, with a fully connected recreation path, is completely
unacceptable for a large number of traffic, public service, and planning reasons.

Creating a network of connected through roads ensures that South Burlington
will not end up a community of dead-end, isolated neighborhoods. The City's
population is expected to grow by roughly 1,000 residents per year over the next
ten years. Anticipating that growth now, and requiring roadway connections to
serve it, will reduce ambulance, fire and police response times as the City grows.
For this reason, connected through -roads sufficient for two lanes of vehicular
travel are required by the City's Fire Chief as part of the development review
process. School transportation also is greatly facilitated, and route times are
reduced, when roads through new developments are appropriately connected to
collector roadways (i.e. Dorset and Spear Streets).
Through road connections also reduce vehicle miles traveled (VMTs) by
residents, who are not forced to travel north or south to get to locations east of
Dorset Street — including Williston, where many South Burlington residents now
work. Modeling by the Chittenden County Metropolitan Planning Organization
consistently demonstrates a reduction in VMTs when through roads and
connections between neighborhoods are built, and unnecessary increases in
VMTs when communities fail to require these connections.
And, again, the failure to connect streets between neighborhoods is known to
exacerbate social and economic fragmentation. This has been documented in a
number of studies by the American Planning Association Planning Advisory
Service and other publications. Creating pods of housing on dead-end road
networks is absolutely contrary to South Burlington's efforts to create a strong
sense of community.
Alternative roadway alignments that -were considered ,and why thegr
were eliminated
In the course of the development review process for the South Village proposal,
which began in October, 2002, the City has considered many, many different
roadway alignments, as well as many different building layouts and setback
arrangements. The applicant's proposal is for a Traditional Neighborhood
Design or "TND" concept which, unlike most standard subdivisions, features a
very tight network of narrow streets and closely clustered house lots. The City
then had to reconcile the applicant's plan for narrow, compact streets with public
utility and safety considerations, such as the required area for fire trucks and
minimum areas for utilities.
Both the City and the applicant also carefully considered the impact of different
alignments on wetlands and wildlife habitat areas. The chosen alignments and
roadway widths, arrived at after much discussion among City department heads,
the applicant, and the Development Review Board, best satisfy these
environmental, social, design, and public safety concerns. The chosen
alignments, roadway locations, and widths are the minimum necessary for fire

protection, school transportation, and public utilities, and have the least impact
on wetlands and wildlife connections.
The Staff of the Development Review Board truly believe that all possible design
and planning measures to minimize wetland impacts, including alternative road
evaluations and setback and pavement width waivers, have been considered in
the design process for this property. Two specific issues — waivers granted to
reduce overall roadway surface area, and necessary impacts for wetland crossings
— are discussed in more detail below.
Roadway Waivers to Reduce Wetland Impacts and Achieve TND Design Goals:
This project was granted a set of significant waivers of the City's roadway width
standards that substantially reduce the total area of roadway surface within the
project. This resulted in a roadway network that promotes TND design goals,
while minimizing wetland and wildlife habitat impacts. The City's Development
Re -view Board approved many waivers that have reduced the wetland impacts of
the roadways and buildings on this property. It is worth noting that the waivers
for roadway width at wetland crossings are the largest roadway width waivers the
City has ever granted.

Necessary Impacts on Wetlands at Roadway Crossings: There are three
wetland crossings involved in the approved roadway network of South Village.
Two of the proposed roadway crossings of the wetlands are associated with the
"L" Street Connector between Allen Road/Spear Street and Dorset Street. The
City's absolute requirement for this roadway connection has been described
above. Again, reducing the required pavement width from 30' to only 2o' at
crossing points represents a significant effort by the applicant and the City to
reduce the wetland impacts of this necessary road connection.
The third wetland crossing occurs on the "D" Street's southern most connector
between "L" Street and Spear Street. As discussed above, the TND design
approved in this project creates a compact neighborhood lA ith a very tightly
designed street system that reduces overall wetland impacts. Another key benefit
of a TND design is the creation of multiple, inter -connected travel paths between
homes, neighborhoods and other streets, instead of the (very damaging)
conventional pattern of collecting a neighborhood's traffic and depositing it in
one location on a high -volume roadway.
In this one case, a connector roadway essential to the overall TND design, traffic
pattern, and City objectives must cross a wetland. The "D" Street southern
connector represents an important component of these goals which are discussed
in more detail in Rick Chelman's February 9th letter. The City fully supports the
position that this roadway in this location is essential to the overall function of
the project. Again, the roadway width at the crossing has been reduced from the
usual standard of 30' to 20' in order to minimize the impact while still keeping
the road where it needs to be.
Effects of reducing the width of the recreational paths or eliminating
the paths
As you and I discussed regarding the Heatherfields project, South Burlington is
extremely proud of its 17+ miles of recreation path — the largest network in
Vermont. While there are wetland crossings throughout the path network, the
City's recreation paths increase social integration and non -vehicular travel
options, and provide a significant community amenity. Reduced recreation paths
provide less mobility, reduce the appeal of non -vehicular travel, and provide a
reduced community amenity.
Because this recreation path is not in the heavily -used City Center area, as was
the case with Heatherfields, the City's Recreation Path Committee and the
Development Review Board have approved an 8' width (reduced from the
standard 1o') where the path crosses wetlands, and a standard clear distance of 5'
between the edge of road and the path (reduced from the standard of 8'). These
waivers are intended to reduce the wetland impact of the path without
compromising its public use.

Re: South Village Street Connectivity
Dear Mr. Marshall -
This letter is furnished as additional support of the dual connections between the two
neighborhoods in the proposed project off Spear Street known as South Village
diagramed below (arrow) described in my letter to you of last month; specifically the
southerly connection which will have some wetlands impacts in order to be effected.
South Village is not a conventional development, if it were, a simple cul-de-sac would
"solve" this connection problem.
How then, is South Village different from a conventional development?
Conventional subdivision design (CSD) is predominately single -use development,
where apartments are in one "pod", condominiums in another, single families in
another, various types of commercial uses each in their own isolated pods and so on.
Typically, these pods are not directly linked with pedestrian and local vehicular
connections, but only with connections to linking collector and arterial roadways.
Such complete separations of uses, and vehicular dependencies, also result in
neighborhoods of essentially completely congruent residential characteristics. In turn
creating environments where it is quite probable that a typical day begins in th��e�� home,

has a vehicular connection to work or other outside destination and a returning
vehicular trip with no one-on-one direct human interactions.
Those few that do occur are not likely to introduce the participants to any enriching
societal interactions: apartment dwellers meet apartment dwellers; single family
owners interact with single family owners, etc. I am not a sociologist, but I have
worked with several and they are weighing in strongly against CSD.
Also, each such CSD pod of development is required independently provide its own
drainage, parking, lighting, access and other infrastructure and land use
management criteria. In distinction, in a TND such features may be usefully shared
and impervious surfaces reduced.
To use conventional jargon, the CSD developments are often accurately characterized
as "sprawl" and the TND projects are more urban. TND projects consume less land,
create less traffic and as a result of the latter create less air pollution from vehicular
travel.
For quite valid environmental and societal reasons, including those indicated above,
the type of development evidenced by South Village is part of a significant national,
and also international trend in current projects. For example, the labels previously
furnished ("New Urbanism" and "Traditional Neighborhood Development") can yield a
wealth of supporting information with a simple internet search by each label.
By my definitions, and my international experience, the Project Purpose of South
Village should, at a minimum, include the desired goals of enhancing non -vehicular
travel while reducing and dispersing vehicular trips.
I wish to emphasize that a TND project is the sum of its parts, and that to focus too
closely on any one aspect may miss the point of the overall project. However, as a
general rule, multiple connections and small block sizes represent the best in design.
Such connections and block sizes may be most readily seen in the South Village plan
directly west and northwesterly of the crossing under consideration.
By contrast, the block formed around the westerly part of the Ridge neighborhood and
the Village center neighborhood is a "superblock", not as easily walked around
(simply because it is longer). This is true both for pedestrians and vehicles.
To quantify this, a typical TND maximum block perimeter is on the order of 1,200 feet.
The "superblock" around this wetland area is three times that in length. In other
words, were we simply attempting to create the "best" TND regardless of its wetlands
and other environmental conditions, at least two additional wetlands crossings would
be requested.

These additional wetlands crossing were not requested due to the truly
environmentally sensitive nature of South Village (which is in tune with the desires of
its Founder), and the desires to present the best practicable alternative at the start,
and not a specious one from which to "negotiate". Presenting more than is needed
and practicable is not in keeping with the proper anticipation of the 404 process nor
should it be a part of ethical dealings with the Army Corps, no matter how common it
may be in practice.
Finally, I ask that the Corps reconsider some of the national criteria quoted previously
the ITE work has been extensively peer reviewed, including comments from regulatory
agencies. I also offer the following quantification of one series of impacts if the
crossing is not granted.
While travel behavior is sometimes difficult to predict, there is no doubt that vehicular
trips across this wetland will not occur without the road connection across it.
As the author of the traffic impact study for South Village, I am familiar with all of the
discussions, now extending back almost three years, that went into its preparation,
and its peer review by the City of South Burlington's consultants.
The primary direction of vehicular travel to and from South Village (95%) is headed to
or coming from Spear Street. Of this westbound traffic, 63% is northbound (or from
the north); 21 % westbound (or from the west) , and 16% is southbound (or entering
from the south).
Using these distributions, I have approximated the difference in daily vehicle miles
traveled (VMT) with or without this connection. While the connection, or lack thereof,
will likely have no measurable impact for the northerly neighborhood around the farm,
and little impact for the Village neighborhood (it will for westbound traffic, but I have
discounted that to be conservative) it will have measurable impacts for the Ridge
neighborhood.
On inspection, therefore, it is evident that there will be less VMT with the connection
than without it.
Looking at the distribution of unit types and their locations within the project, and the
lengths of the connecting streets', I conservatively estimate a daily reduction of 60
VMT within the project and along the immediately abutting portions of Spear Street.
I While it is possible to do, I have not calculated on a lot -by -lot basis, but have used a neighborhood
centroid approach. In my opinion as a professional engineer, this should provide a good approximation of
final results.

In summary, therefore, provision of this wetlands crossing will directly and
measurably contribute to one part of the Project Purpose to reduce vehicular travel
within the project.
As I know the Corps is not charged with air quality concerns, I have not taken the next
steps to consider the reductions in turning movements as well if the connection is
allowed and therefore an additional measurable improvement to air quality with the
crossing than without it.
The benefits of this crossing for non -vehicular purposes is apparently recognized by
many, if not most regulatory agencies and officials. I hope that this letter provides
additional support for its need to be a little bit wider so that it may also provide a
vehicular connection.

Please find a summary of comments from City Engineer Bill Szymanski and Chief Doug
Brent concerning the proposed Phase I Village Neighborhood for the South Village project.
We have provided responses to each item to assist in Staffs review of the issues.
Comments from City Engineer Mr. Bill Szymanski
Spear Street is 4 rods (66') in width. Plans show it as 80 ft. The plat plan
depicts the right -of -width of Spear Street and Allen Road as 66 feet. Other plans
which utilized parcel mapping from the City did identify this as an 80' wide road.
This has been edited to make all of the plans reference a 66' wide right-of-way.
2. Public streets should have concrete curbs, concrete sidewalks, and drainage
system. Private utilities -power, telephone, and T.V. should be placed outside
of the street R.O.W. Water mains shall be centered within the grass strip with
curb stops in a one foot strip at the edge of the R.O.W. Trees must not be
planted on top of water mains. The typical street section has been added which
shows the inclusion of concrete curbs, concrete sidewalks and drainage
improvements.
Water mains have been located to avoid conflict with the new street trees as
requested, but this often puts the water main within the paved portion of the street.
Private utilities have been placed in position along the edge of the right-of-way in
a manner that does not require any easements or licenses from the City.
3. Bike path should be constructed in Phase I. At least that part in Phase I area.
The master plan for the recreation path calls for that section beginning at Allen
Road and ending at the southeast corner of the Village neighborhood. This phasing
approach has been accepted by the Recreation Path Committee.

4. Downstream sewer mains shall be evaluated by the project engineer for
capacity to handle the added flow. The as -built profile of the sewer main has
been ascertained and observations of the flow depths in the existing sewer main
have been evaluated and it has been determined that no additional mitigation
measures are required. A copy of the report was forwarded under separate cover.
5. Sewage pumping station shall be privately owned and maintained by the
home owners. City Pollution Control Superintendent shall review the design.
The applicant recognizes that this will be a privately owned and maintained set of
pump stations. The design of these pump stations will include those components
outlined in the most recently revised written standards and a copy of the design will
be forwarded to Mr. George Dow.
6. Sewer manholes must be at locations that are accessible to mobile cleaning
equipment. All of the proposed manhole structures have been located to facilitate
access by the City's vactor truck.
7. Street lights shall be shown on the plans and installed in the first phase. The
proposed street lights are now depicted on the grading and utility plans. Generally
they are proposed only at the street intersections.
8. The gas mains shall be shown on the plans. The gas mains are now depicted
on the utility plans.
9. Each corner lot shall have a 20' x 20' sight easement. This requirement has
been added to the plat plan.
10. Developershall furnish and install all streetsigns including traffic and parking
signs. The applicant acknowledges that all traffic control (stop, parking, speed limit,
caution) signs, street signs, and pavement markings will be installed by the
applicant. A note to this effect has been added to the grading and drainage plan.
11. Allen Road - Spear Street intersection traffic signals shall be Econolite or
approved equal and detail plans submitted for review and approval.
Installation should be in Phase I. The applicant proposes that the construction
plans be submitted for review and approval prior to the issuance of a land
development permit for the traffic lighting infrastructure improvements associated
with Phase I of the project.
12. All buildings with basements shall have footing drains connecting to storm
sewer or drainage ditch. They shall be shown on the plans. A dedicated

foundation drain collection system has been added to the Grading and Drainage
plan.
13. Water and sewer connections shall be shown on the plans. These have been
added to the utility plans.
14. Road gravel base shall be 18 inches thick with 4 inch bituminous (2.5" base,
1.5" surface) road surface. The typical pavement section on Sheet T4.4 has been
revised to conform with the Land Development Regulations requirements.
15. Bike Path typical section shall be shown on the plans. Also profile, grades,
alignment and curve data. The recreation path typical section has been added to
Sheet T4.6. The horizontal alignment information has been added to the plans.
Based on the benefits of the gentle, rolling topography of the site, the recreation
path master plan calls for the path to be staked in the field and reviewed and
approved by City staff prior to initiation of construction.
16. Water, sewer and drainage lines within private streets shall be privately
maintained by the homeowners. The applicant acknowledges this and a note has
been added to the drainage and utility plans.
17. As -built drawings shall be prepared by Civil Engineering Associates. A note
has been added to the utility plan requiring the preparation of as -built drawings by
a professional engineer or surveyor prior to conveyance of the public street to the
City.
18. Plans shall include a final grading plan (2 foot contours) in the building area.
The future school is being shown for planning purposes but is not being proposed
for approval at this time. When the school has developed its program further, we
will submit a detailed site plan for the proposed improvements.
19. Tree planting plan shall show all water mains. There shall be a minimum
clearance of 5 feet. The proposed water main has been added to the street tree
planting plan and modifications to the water main locations have been made to
maximize the separation from the trees where possible.
20. All curb work shall be concrete and delineated on the typical sections. This
has been depicted on the new typical section detail sheet.
21. Sewer lines shall be bedded in 3/4 inch crushed stone only. The typical sewer
trench detail has been modified accordingly.

22. Pipe for drainage shall be plastic or concrete or approved equal. All of the
gravity storm drainage is proposed to be constructed with High Density Polyethylene
(HDPE) pipe.
Comments from Fire Chief Douglas Brent
1. Compliance with all Requirements of Vermont Labor and Industry Fire
Prevention Division codes and standards. The applicant proposes to comply
with these requirements. A note has been added to the site utility plan identifying
this.
2. Automatic sprinklers and alarm system as required by Vermont Labor and
Industry Fire Prevention Division. The applicant proposes to comply with these
requirements. A note has been added to the site utility plan identifying this.
3. Number and location of fire hydrants to be determined by the South
Burlington Water Department. Actual Spotting of said hydrants to be done
jointly with SBFD. Plans have been forwarded to the Water Department for their
review and a note has been added stating that the field siting of each hydrant shall
be coordinated with the SBFD and the Water Department.
4. The turning radii should be designed for operation of fire apparatus to include
our aerial ladder -tower. I have previously provided this information to the
developers and look for them to certify to me that their designs will
accommodate our vehicles. Based on a recent meeting with Chief Brent, the
applicant has completed a turning radius analysis to identify any locations that
needed revision to accommodate the Tower truck with the presence of on -street
parking. This analysis has been completed and the necessary revisions have been
completed. A certification has been added to the grading and drainage plans.
5. The road widths within this property should be properly sized to allow for
parking, set-up and operation of fire apparatus to include our aerial ladder -
tower. I still have some concern that the roads of 20 feet in width or less
could be a problem for our vehicle and department needs. The site plan has
been revised to eliminate those lots with frontage on a public street. Based upon
the most current proposed housing mix and layout, the applicant has developed a
plan depicting the relationship of the buildings to the proposed landscaping and
proposed scrub down locations for both the small and large structures associated
with the project.

6. Tree heights in front of some of the buildings could block potential rescue
pointwindows. This has been accommodated with the revised street tree planting
plan and the issues outlined in Item 5 above.

Thank you for your review comments associated with the proposed South Village project located
at the intersection of Allen Road and Spear Street. To assist in your review of the revised plans,
we have provided a written response to each of your requests for additional information. The plan
submittal also includes the road/water main profiles so that a better understanding of the vertical
installation issues can be addressed.
The attached Application for Water Allocation must be completed and returned to the
South Burlington Water Department as soon as possible. As your project continues,
the Application for Water Allocation will need final approval from this Department,
which will be contingent upon available water storage capabilities within the City.
Current water distribution system upgrades have been substantially completed that
should allow for the construction of your project, pending approval of all other local
and State requirements. This application has been completed and has been attached for
your review.
2. All construction drawings and plans shall have a note stating the following "All water
line and related work to be performed in accordance with the Specifications and
Details for the Installation of Water Lines and Appurtenances for all Water Systems
Owned by the Champlain Water District, the City of South Burlington, Colchester
Fire District #1, and the Village of Jericho, (henceforth the "CWD Specifications.")
You have included this note in your current drawings. However, you may remove the
last sentence in your note that states "Details should be modified to the above
referenced specifications" as that was a note I requested specific only to a former set
of plans we reviewed. The text in the note narrative has been changed to reflect the
inclusion of "Colchester Fire District #1" and has eliminated the last sentence concerning
the notes. This note is not yet on the profile plans but will be added as part of future
submissions.

3. All domestic services and fire sprinkler systems that are connected to the public water
system shall be protected with a backflow prevention assembly, and an appropriate
thermal expansion system in compliance with the Ordinance For The Control Of
Cross Connections Within The Water System Of the City Of South Burlington,
henceforth the "Backflow Ordinance." Please contact this department for more
information on backflow protection devices. This note is on Sheet C9.2
4. Looping of all water lines shall be a design requirement. All looping connections shall
be at a point so as to eliminate any dead ends on any water main. The only dead ends
that were included in the original submittal included the water main along the south road
(K Street) connector and the north road connector. Otherwise the system offered multiple
looping. We have eliminated the south road water main (see Sheet C6.0 comment) and
have extended the water main to the north property line creating a new dead end as part of
a future phase (see Sheet C6.1 item d comment).
5. Eight -inch and larger Ductile Iron (DI) water pipe shall have no less than three (3)
brass wedges installed at each joint. Bury depth to the new mains shall be six feet (6')
to the top of the pipe. DI water pipe shall be Class 52, cement lined. Polyethylene pipe
sleeve encasement shall be required for all DI pipe installed for this project. The
polyethylene encasement requirement has been added to the typical detail on Sheet C6.6.
6. Gate valves shall be installed a maximum of 500' apart. All tee intersections shall
have a minimum of three (3) gate valves. Cross sections (four-way intersections) shall
have a minimum of four (4) gate valves. All gate valves in this project area shall be
made from a corrosion resistant material, and have stainless steel bolts in the valve
body. All street/water main intersections now have the requisite number of valves to
improve isolation capabilities.
7. Fire hydrants shall be placed at each intersection, with a maximum of 500' between
hydrants. Fire hydrant assemblies shall consist of an anchor tee connected directly
to a six-inch RW gate valve, the appropriate length of 6" DI pipe, the fire hydrant, and
appropriate thrust block. All hydrants shall meet the aforementioned CWD
Specifications, and a hydrant flag shall be supplied with each hydrant. Hydrant
drains shall have all drains plugged prior to installation. Note: Waterous fire
hydrants must be installed with a "Boston Operating Nut." The original hydrant design
generally covered each intersection, but we have moved a few and added some additional
hydrants to improve the coverage for Phase I. The hydrant flag installation requirement has
been added to the typical hydrant detail on Sheet C6.6.

8. Generally, single-family residences shall have 1/4" K-copper service lines tapped
directly into DI pipe six -inches in diameter and larger. A curb stop, concrete block,
and Erie box with stainless steel rod shall be installed ,just inside the right-of-way for
each service, per the above referenced CWD Specifications. This information is shown
on the typical water service detail on Sheet C6.6.
9. Fire flow conditions must be able to meet the requirements stated in the CWD
Specifications, as well as meeting any conditions set forth by the Fire Department.
This project is at the end of an area served directly by the South Burlington East
(Dorset Street) water storage tank that has recently been raised to a maximum fill
level of 555' that should provide sufficient fire flows and pressures to meet the above
referenced CWD Specifications. None -the -less, sufficient engineering and design must
be performed in order to meet State Water Supply Rules and the above CWD
Specification requirements. We have forwarded under separate cover a copy of the State
of Vermont Water Supply Division "Engineer's Report" which addresses these issues.
10. Normal working pressure in the distribution system for this project shall be designed
to produce 60 psi and not less than 35 psi. Further, the CWD Specifications require
all hydrants in a residential development be able to supply no less than 500 gpm at 20
psi at the worst -case hydrant residual pressure. The developer and his engineer are
responsible for ensuring any hydraulic design for this project considers these
requirements. The developer and engineer are responsible for all inadequacies in
water supply pressure within the project boundaries, for fire and domestic
requirements, including those associated with the aforementioned changes. It may be
necessary, after your firm reviews hydraulic modeling, to include a booster pump
station for this development. The "Engineer's Report" indicates that although not all
areas will achieve the 60 PSI typical system operating pressure, a booster station is not
required to meet the minimum operating conditions.
11. No underground utility shall be installed within four feet from the water main on
either side, from the top of the main to the finish grade, with the exception of storm
sewer and sanitary sewer as stated in the above referenced CWD Specifications.
Generally, trees shall not be placed over any water main or service line, nor placed
within 20' of any appurtenance, including fire hydrants. Due to the number of cover
requirements of other utility crossings, there will be some instances where less than 4' of
clearance can be provided. However, when other installations run parallel to the water
main, these clearances will be respected. The latest hydrant additions still need to be
reconciled with the proposed street tree locations.

12. Separation between the water main and service line and nearby sanitary and storm
sewer lines shall comply with the VT WSR requirements and the above referenced
CWD Specifications. Acknowledged.
13. Prior to any building construction, the building contractor must contact this
Department to discuss City requirements for meter sizing, meter settings, and
backflow protection. This is shown as Note 11 on Sheet C9.2.
14. The SBWD shall be sent any future hard copy plans involving this project for review.
Future plans must include details and specifications as required in the above
referenced Specifications. This is shown as Note 12 on Sheet C9.2.
15. The SBWD shall be notified prior to backfilling to inspect all joints, fittings, mainline
taps, appurtenances, water line crossings, and testing. This is shown as Note 13 on
Sheet C9.2.
1.6. Further review changes may be required as this project proceeds through the permit
process. Understood.
17. A hard copy set of As-Builts as well as one electronic copy in Auto-CAD.DWG Version
14 Format or newer shall be supplied to this department upon completion of the water
system improvements. This has been added as Note 15 on Sheet C9.2.
Comments specific to the Master Plan review, on pages SL1, C-6.0-6.6, C-9.2
1. Sheet C6.0
a. The future water connection point to Spear Street in the southwest corner shall be
removed. This has been removed.
b. A future water connection point to Spear Street may be required at the northern
entrance to this project, in the future. This connection point will be through a
PRV and vault. Acknowledged. At this point this area represents a future phase of the
project that will be subject to detailed designs when final approvals are sought for this
area.
2. Sheet C-6.1:
a. Please define an "Air Release Hydrant". This is a hydrant located at high points of
the distribution system which has an upward angled connection into the distribution
main as depicted on Sheet C6.6. This detail is used by the Town of Stowe to achieve
the goal of periodic removal of trapped air at high points of the system without exposing
the town to high maintenance air release valves and structures.

water main or a temporary blow off for water quality flushing purposes. On Sheet
C6.0 we have extended the water main to the north property line creating a new dead
end as part of a future phase. The only other retained dead end is the water main along
the north connector road in Phase II_ When the final design drawings are prepared for
these areas, they will have the requisite valving and hydrant installations.
3. Sheet C-6.2
a. The proposed eight -inch water main shall not extend to or connect with the Spear
Street water main. The line shall be removed from future plans at the corner of
this subdivision. The southern connection has been eliminated from the plans.
b. Please define an "Air Release Hydrant". This is a hydrant located at high points of

4. Sheet C-6.3
a. The proposed 12" water main shall be connected to the Spear Street water main
on the west side of Spear Street. A pressure -reducing vault with an approved
pressure -reducing valve shall be installed on the proposed water main east of this
intersection on the north side of the new road from South Village to Spear Street
across from Allen Road, in the green belt. This will require the boring and
sleeving under Spear Street for the new water main, and a wet tap on Spear Street
on the existing 12" water main. There will also have to be installed a second sleeve
of the same size or larger, for a future water line that will connect from the SB
Main Service area to this water distribution system. This sheet has been revised to
include the PRV structure and the connection to the Spear Street water main. We will
work out the installation options with Bruce Hoar since there is limited room for a pit,
and night work may alleviate some of the traffic concerns. The additional sleeve will
be added.
5. Sheet C-6.4
a. Please define an "Air Release Hydrant" This is a hydrant located at high points of
the distribution system which has an upward angled connection into the distribution
main as depicted on Sheet C6.6. This detail is used by the Town of Stowe to achieve
the goal of periodic removal of trapped air at high points of the system without
exposing the town to high maintenance air release valves and structures.

instead shall go around the north end of the culvert while maintaining proper

burial depth. This has been revised to relocate the water main around the north end

7. Sheets 6.6, 9.2
a. Please modify all Water Details to those found in the above referenced CWD
Specifications. Specifically, concrete shall not be poured underneath any gate
valve. The hydrant and tapping sleeve details have been revised accordingly and a
note has been added to the thrust block detail for valves installed on dead end lines.

the restricted area are acceptable. Staff notes, however, that significant landscaping will
be required in this area to further reduce the impacts of the proposed project.
DECISION
Based on the above Findings of Fact, the South Burlington Development Review Board
approves Master Plan application #MP-04-01, of South Villages Communities, LLC, for
334 residential units, a 100-student school, and a 35-acre community -supported farm.
Pursuant to §15.07(D)(1) of the Land Development Regulations, Master Plan Application
#MP-04-01 is hereby approved with conditions.
A. Decision with Respect to Master Plan Umbrella Criteria:
The Development Review Board approves the following Master Plan "umbrella criteria"
pursuant to §15.07(D)(3) of the Land Development Regulations:
a. Overall density and number of residential dwelling units: A
maximum number of 334 residential dwelling units are approved for a
total density of 1.5 units/acre. The base density in the Southeast
Quadrant of 1.2 units/acre yields a total of 269 units. The 25% density
bonus for providing mixed -rate housing, as determined by Section 13.14
of the Land Development Regulations, accounts for the additional 65
units.
b. Building and impervious coverage: A total building coverage of 5.5%
and a total impervious coverage of 13.9% are approved for the master
plan. These are overall limits for the entire South Village property subject
to this approval. Within the individual development phases, as described
and approved in this decision, these overall limits may be exceeded
provided the applicable Southeast Quadrant zoning district limitations of
fifteen percent (15%) for buildings and thirty percent (30%) overall are
met.
c. Location, layout, capacity and number of collector roadways: The
collector roadway system is approved as shown on the Master Plan.
d. Land development proposed in any area previously identified as
permanent open space in the approved Master Plan application: All
areas not approved as development areas in this Master Plan are to be
utilized exclusively for open space use.
e. Maximum number of vehicle trip ends: A maximum of 336 PM peak
hour trip ends from all approved residential and non-residential uses is
approved for the South Village property.
B. Decision with Respect to Individual Development Areas — Proposed as Part
of this Master Plan Application:
a. Phase 1: Village Center: This phase of the Master Plan, as proposed
through this application, is approved as a development area.

b. Phase 2: Fields Edge: This phase of the Master Plan, as proposed
through this application, is approved as a development area.
c. Phase 3: The Ridge: This phase of the Master Plan, as proposed through
this application, is approved as a development area.
CONDITIONS
The Development Review Board finds and concludes that the following conditions are
necessary for the Master Plan application to meet the City's requirements and standards
for approval:
1. This approval shall be for 269 units of market -rate housing, and 65 units of affordable
housing as defined in Article 2 of the South Burlington Land Development Regulations.
In no case shall a zoning permit be issued for more than 269 units of market -rate
housing.
2. Pursuant to Sections 15.07(D)(2) and 15.07(D)(4) of the Land Development
Regulation, the Development Review Board requires each of the three (3) phases
included in this Master Plan to obtain separate preliminary plat approval and final plat
approval in accordance with Section 15.18 of the Land Development Regulations.
3. If the proposed 100-student school is not incorporated into Phase 1 of the Master
Plan, it shall be subject to site plan approval, pursuant to Article 14 of the Land
Development Regulations.
4. Any development on the agriculture component of this project that does not fall within
the State of Vermont's exemption shall be subject to Site Plan review, pursuant to Article
14 of the Land Development Regulations.
5. The preliminary plat and/or final plat plans for each of the three (3) phases included in
this Master Plan shall be reviewed by the South Burlington Fire Chief, the
Superintendent of the South Burlington Water Department, the South Burlington Director
of Public Works, and the South Burlington City Engineer.
6. Any application for amendment of the Master Plan or preliminary plat plan that
deviates from the Master Plan in any one or more of the following respects shall be
considered a new application for the property and shall require sketch plan review as
well as approval of an amended Master Plan:
a) An increase in the approved building coverage or overall site coverage, or an
increase in the number of residential dwelling units for the property subject to the
Master Plan;
b) A change in the location, layout, capacity or number of collector roadways on the
property subject to the Master Plan;
c) Land development proposed in any area previously identified as permanent open
space in the approved Master Plan application;

d) A change that will result in an increase in the number of P.M. peak hour vehicle
trip ends projected for total buildout of the property subject to the Master Plan.
7. Pursuant to Section 15.07(D)(5) of the Land Development Regulations the following
minor land development activities will not require Development Review Board approval
and may be undertaken pursuant to issuance of a zoning permit:
a) The addition of decks to dwelling units;
b) The addition of porches to dwelling units;
c) The enclosure of decks;
d) The addition of accessory structures, pursuant to Section 3.10 of the Land
Development Regulations;
e) Other minor land development activities at the discretion of the Administrative
Officer.
8. Pursuant to Section15.18 (B)(6) of the Land Development Regulations, the applicant
shall submit a plan for the management and maintenance of the dedicated open spaces
created through this Master Plan. The management and maintenance plans shall be
submitted to and approved by the Director of Planning and Zoning, prior to final plat
approval for Phase 1 of this Master Plan. Any issues on which the Director of Planning
and Zoning seeks technical review shall be conducted at the applicant's expense.
9. The Master Plan shall be revised to show the following changes. Four (4) copies of the
approved revised plat plans shall be submitted to the Administrative Officer prior to
recording:
a) The plans shall be revised to depict a maximum of 334 dwelling units.
10. All proposed public roadways in conjunction with this project shall be constructed
with a minimum design speed of 25 mph.
11. The roadway identified as "L Street" on the plans last revised on December 23,
2004 shall be constructed, and open for traffic, through to the existing roadway terminus
at Midland Avenue prior to issuance of the zoning permit for the 206th unit in this project.
12. The applicant shall install signalization at the intersection of Spear Street and Allen
Road within one (1) year of the issuance of the first zoning permit for a dwelling unit in
Phase 1 (Village Center). The Director of Public Works shall review and approve all
plans for signalization prior to construction.
13. The applicant shall construct southbound left -turn lane on Spear Street at the "Main
Entrance" within one (1) year of the issuance of the first zoning permit for a dwelling unit
in Phase 1 (Village Center). The Director of Public Works shall review and approve all
plans prior to construction.
14. The applicant shall construct the southbound left -turn lane on Spear Street at the
"South Entrance" of the project, prior to issuance of the last zoning permit for a dwelling
unit in Phase 2 (Fields Edge). The Director of Public Works shall review and approve all
plans prior to construction.

15. The applicant shall construct southbound left -turn lane on Spear Street at the "North
Entrance" of the project, prior to issuance of the first zoning permit for a dwelling unit in
Phase 3 (The Ridge). The Director of Public Works shall review and approve all plans
prior to construction.
16. The applicant shall contribute the sum of $20,000 to the City of South Burlington to
be used solely for upgrades to the Spear Street/Swift Street intersection, and for traffic
calming measures on Midland Avenue. The City Council shall have sole discretion to
allocate these funds among the intersection upgrades and traffic calming measures.
17. The applicant shall have ninety (90) days from the date of this approval to execute a
development agreement with the City Council, governing the timing and disposition of
required payments and any required sureties for roadway, intersection, and
infrastructure work.
18. The water infrastructure and wastewater infrastructure shall be constructed through
to the existing infrastructure terminus in Dorset Farms at the onset of Phase 1 (Village
Center). The Director of Public Works and Superintendent of the Water Department shall
approve all specifications and plans for this infrastructure.
19. Phase 1 of the recreation path (as identified on sheet L-1 of the plans) shall be
constructed prior to issuance of the last zoning permit for a dwelling unit in Phase 1
(Village Center).
20. Phase 2 of the recreation path (as identified on sheet L-1 of the plans) shall be
constructed prior to the issuance of the first zoning permit for a dwelling unit is Phase 2
(Fields Edge).
21. Phase 3 of the recreation path (as identified on sheet L-1 of the plans) shall be
constructed prior to the issuance of the zoning permit for the 206th unit in this project.
22. The applicant shall hire a full-time on -site construction inspector, to be paid for by the
applicant and approved by the Director of Public Works, prior to initiation of any
improvements on the site. The construction inspector shall be present throughout the
construction on these improvements. Any change to this condition shall require written
approval of the City of South Burlington, signed by the City Manager and the Director of
Planning and Zoning.
23. All sewage pumping stations shall remain private and shall be maintained by the
homeowners association(s), unless otherwise determined by the Water Pollution Control
Superintendent and the Director of the Public Works.
24. The following components of the Master Plan shall be reviewed at the preliminary plat
and/or final plat stages of the individual phases:
a) Street lighting details
b) Street landscaping details
c) Curb -cut locations and details

d) Re-evaulation of traffic mitigation measures and implementation details
25. The Development Review Board approves the following roadway waivers from the
Land Development Regulations:
• Minimum pavement width for collector streets from 30' to: 20' at wetland
crossings; 28' (2-14' lanes) for A Street (Section BV-66); 28' with parking on one
side and 20' at bulbouts; and 26' (with a 28' structural base under designated
"collector routes" provided that adequate clearances are provided for large
vehicle turning movements).
• Minimum pavement width for local streets from 28' to: 20' at wetland crossings;
26' in sections with parking on one side; and 24' in sections with no striped
parking (parking is prohibited along Section RD-50).
• Minimum centerline radius of curves for collector streets from 500' to 300'
(sections with 30 mph posted speed) or 180' (sections with 25 mph posted
speed).
• Minimum centerline radius of curves for local streets from 300' to 180'.
• Minimum tangent length between curves for collector streets from 150' to 50'.
• Minimum tangent length between curves for local streets from 100' to 50'.
• Minimum distance between centerline offsets for local streets from 200' to the
dimensions specified below:
C Street to D Street along F Street - 145'
G Street to C Street along F Street - 150'
G Street to B Street along F Street - 145'
Common Lane (south) to E Street along E Street - 60'

on internal South Village intersections with collector roads (i.e. A Street, D Street,
E Street); at minimum, stopping sight distance requirements should be met at all
remaining intersections based on expected operating speeds of on -site traffic. No
waiver is requested for proposed street intersections at Spear Street.

Minimum horizontal (comer) sight distance for local streets from 300' to 280' on
internal South Village intersections with collector roads (i.e. A Street, D Street, E
Street); at minimum, stopping sight distance requirements should be met at all
remaining intersections based on expected operating speeds of on -site traffic.
26. The Development Review Board approves the following waivers from the Southeast
Quadrant dimensional standards, as outlined in the Land Development Regulations:
• Single-family minimum lot size from 12,000 square feet to 3,600 square feet.
• Single-family maximum building coverage from 15% to 42%.
• Single-family maximum lot coverage from 30% to 61 %.
• Single-family front yard setback from 20' to 10'.
• Single-family rear yard setback from 30' to 10' (5' for rear lanes).
• Multi -family maximum building coverage from 15% to 50%.
• Multi -family maximum lot coverage from 30% to 65%.
• Multi -family front yard setback from 20' to 10'.
• Multi -family rear yard setback from 30' to 5'.
27. Any future requests for waivers will be reviewed in conjunction with the site -specific
preliminary plat or final plat reviews for individual development areas.
28. Any changes to the Master Plan shall require approval of the Development Review
Board.
29. The Master Plan (sheets S1.0 and S1.1) shall be recorded in the land records within
90 days or this approval is null and void. The plans shall be signed by the Development
Review Board Chair or Clerk prior to recording.

ownership issue. There is no agreement on where the property lines are. Surveys have
been done and the surveyors' interpretations of property lines have been filed. Mr.
Dinklage felt neighbors should be sent notice as a courtesy.
Mr. Marshall showed the plan with easements and indicated bike lanes, intersection
corner triangles, etc. The school will be removed from the plan (lot #11). The school
would double as a community building. Mr. Dinklage asked why some common areas
are crosshatched and others not. Mr. Marshall said there was no reason.
Mr. Dinklage asked whether the first creek crossing would be built in this phase. Mr.
Marshall said no, and it will be removed from the plan.
Mr. Marshall then showed the street network plan and unit breakdown by number of
units. They want to work out how to deal with larger buildings and would come back for
a separate site plan approval. They would also come back for future amendments.
Mr. Marshall said staff needs full details for all buildings 3 units or larger. They are not
ready for that level of detail. This represents about 70 units. Mr. Dinklage said the
Board would want to do a frill site plan review of those buildings.
Mr. Belair said staff needs time to think about this. There would have to be an
amendment to the Master Plan to have those buildings reviewed separately.
Mr Dinklage asked what lot 53 is. Mr. Scheuer said a different configuration of a lot
with a building in the rear.
Mr. Bolton asked about street names. Mr. Marshall said they were told to name them by
final plat review.
Mr. Marshall then reviewed Allen Rd/Spear St. intersection improvements including
pavement improvements on the north side, widening in an easterly direction (to
accommodate neighbors). Bike lanes would be 5 feet plus 6 inches.
Mr. Cimonetti asked what bike lanes will look like. Mr. Marshall said on the southbound
side they will be similar to today where the bike lane is discontinuous. It recovers at a
5-foot lane earlier than it does now. Mr. Dinklage asked the applicant to work with the
Rec Path Committee to achieve through lanes on both sides. Mr. Cimonetti said the Rec
Path Committee didn't want to see errors made that would cost money to fix later.
Mr. Marshall said there will have to be an aggressive signage police indicating where
people can and can't park. Mr. Belair said the City Council would have to have a "no
parking" ordinance before they could enforce "no parking". Mr. Dinklage added that the
streets would have to be made safe until then.

Mr. Greller then reviewed the street plan including plantings. There will be a wide
variety of native trees, 2.5" caliper, 11 varieties, for total of 152 trees in the right-of-way
and some outside for screening. This complies with the Fire Chiefs requests. There will
be a variety of native plants, wildflowers along the facades of duplexes. There will be
fences, gates, step stones, screening hedges, etc.
Mr. Cimonetti asked what the space between this development and the city -owned land
would look like. Mr. Marshall said he would envision that, with the city's permission,
they would make that all one management component and also have the rec path in that
area.
Mr. Bresee asked if there will be restrictions on homeowners plantings that might cut
down on visibility. Mr. Scheuer said plantings would be limited to native species.
Mr. Dinklage asked if there is adequate design for rec paths so they don't deteriorate.
Mr. Bresee said if you build to the Vermont State Manual, you get a good product. Mr.
Cimonetti felt the composition of the rec path should be specified.
Mr. Dinklage asked if the developer will build all the houses and not sell lots for others to
build. Mr. Scheuer said "probably."
Mr. Marshall noted they are still dealing with fine-tuning water quality issues. He
showed the proposed drainage system.
Mr. Wetzel asked about lots that back up to the wetland. Mr. Marshall said there will be
a barrier between land uses and the buffer. This is a very important of the state and
federal approvals.
Mr. Belair asked about the view protection zone. Mr. Marshall said they will deal with
that. Mr. Marshall also noted there has been a submittal regarding street lights which
they will also deal with.
Ms. Quimby then moved to continue until 7 June. Mr. Farley seconded. Motion passed
unanimously.
6. Public Hearing: Preliminary Plat Application #SD-05-23 of South Burlington
School District to amend a previously approved planned unit development
for an educational facility consisting of a middle school and high school
complex. The amendment consists of: 1) constructing a 15,100 sq ft
educational facility, 2) constructing an 1160 sq ft addition to the high school
cafeteria, and 3) constructing an artificial turf athletic field, 500 & 550
Dorset Street:
Ms. McIntyre showed the parcels on the plan. She noted they are filed by the city as 400
and 450 Dorset St. The mailing addresses are 500 and 550. This will be straightened out
for final plat. Mr. Belair said the proposed building will be 450 as requested by 91 l .

RE: South Village Preliminary Plat, Phase 1
Date: April 19, 2005
The plans for preliminary plat approval of phase 1 of the South Village Master Plan have
been submitted. The theoretical aspects of this phase have essentially been worked out
during the Master Plan review process. Thus, approving the preliminary plat plans for this
project will involve comparing the detailed plans to the conditions outlined in the Master Plan
decision and the additional requirements outlined in Article 15 of the Land Development
Regulations. In addition, all of the City Staff that reviewed the Master Plan (Bruce Hoar, Jay
Nadeau, Chief Brent, Bill Szymanski, and Craig Lambert) will have to review the preliminary
plat plans to ensure technical compliance with the Master Plan approval, in addition to
reviewing the more detailed aspects that were not part of the Master Plan approval. Below
are the items required for preliminary plat approval that have not been adequately
submitted, or need to be altered, at this point:
1. amend the dimensional data on the plans to reflect only phase 1 of this project
(coverage, number of units, density, minimum lot size, etc... );
2. eliminate all plans and references to the master plan from this set... only phase 1
plans (eliminate overall street layout, recreation path layout, lot layout, etc... );
3. amend the plans to reflect the accurate coverage requirements in the SEQ, which
are 15% and 30%;
4. remove the school and its associated components from the plans;
5. landscaping plans should be submitted as follows:
a) street tree planting plan that shows only proposed street trees, including
details;
b) multi -family family building planting plan, including details, showing proposed
landscaping for multi -family dwelling units (3 units and up);
c) typical planting plan for two-family and single-family dwelling units;
6. submit landscape budget — separate street trees from site landscaping (site
landscaping budget should be prepared pursuant to Section 13.06(G) of the
landscaping plans — total costs should not include single-family or two-family
dwellings);
7. submit planting details in the specification section of plans;
8. submit proposed street names and 911 addresses;
9. submit exterior lighting details for street lights and multi -family buildings;
10. depict building envelope for single-family and two-family dwelling units;
11. identify which lots will be dedicated to single-family dwellings and which lots will be
dedicated to two-family dwellings;
12. depict building footprints, curb -cuts, parking layout, dumpster(s), and bike racks for
multi -family dwelling units (3 units and up);
13. submit management and maintenance plan for open space w/ final plat application.

On Tuesday night, the Development Review Board will be reviewing the preliminary plat

reviewing the plans in detail prior to the meeting. An outline of the outstanding issues and

Vermont on Tuesday, May 17,
2005, at 7:30 P.M. to consider
the following:
1. Application #CU-05-07 of Joel
S. Clements for conditional use
approval under Section 14.10,
Conditional Use Review, of the
South Burlington Land
Development Regulations.
Request is for permission to
allow a 6' x 32' porch to
encroach 15 feet into the front
setback, 24 Maryland Street.
2. Application #CU-05-08 of Paul
& Ellen Gittelsohn for condition-
al use approval under Section
14.10, Conditional Use Review,
of the South Burlington Land
Development Regulations.
Request is for permission to
increase the size of the foot
print of an existing single family
dwelling by 540 sq. ft., 5
Pleasant Avenue.
3. Final plat application #SD-05-
34 of Daniel Morrissey to amend
a previously approved planned
unit development consisting of
the existing Vermont Gas build-
