The layout proposed in Exhibit #3 meets the Staff’s recommendations by neither encroaching on the drip zone of existing trees, nor interfering with the right-of-way. 2.) The Applicant will not re-surface the right of way, for the following reasons: a. The Applicant’s counsel has advised that there is neither a need nor precedent to do so; b. The surface of the right of way used by City emergency personnel and first responders to access the rear of the building was resurfaced in 2016, and remains in good shape (see Reference Image #1 below). 3.) The applicant no longer uses the premises for a dumpster. Furthermore, the layout proposed in Exhibit 3 would afford the same turning radius as currently maintained, thus eliminating the need for this consideration. 4.)
