HomeMy WebLinkAboutO - Amended - Untitled - EXISTING ORDINANCE (as revised thru 2/2/04) MOTOR VEHICLE AND TRAFFIC REGULATION ORDINANCE CITY OF SOUTH BURLINGTON,VERMONT SECTION 1. Operators of vehicles shall exercise due care and shall keep to the right of the center of the roadway so as to meet other vehicles without interference. Rev. 4/28/58. SECTION 2. Except as hereinafter provided, all vehicles shall give the right of way to other vehicles approaching at intersecting roadways from the right, and shall have right of way over those approaching from the left;provided that plainly designated ambulances,police and fire department vehicles, when using a siren and/or a red light, shall at all times have the right of way over other vehicles-when such vehicles approach and are using their siren and/or a red light, all other vehicles must pull over to the right and stop. It is further provided that wherever traffic officers are stationed,they shall have full power to regulate traffic irrespective of the foregoing provisions. Rev. 4/28/58. SECTION 3. All intersecting highways shall be approached and entered slowly and with due care to avoid accidents. In making a turn to the right into an intersecting roadway,vehicles shall keep to the right of the center of both intersecting roadways and close to the right-hand side of the same. In making a turn to the left into an intersecting roadway,the operator shall cause his vehicle to pass to the right of and beyond the center of the roadway intersection before turning.Rev. 4/28/58. SECTION 4. The operator of a motor vehicle,before changing his direction or materially slackening his speed, shall give a warning of his intention with such hand signal as the Commissioner of Motor Vehicles may prescribe,or with a mechanical or lighting device approved by such commissioner. Rev. 4/28/58. SECTION 5. No operator of a motor vehicle may proceed beyond a stop sign without first bringing the vehicle to a full and complete stop at the sign, and looking to see that the way is clear. Rev. 4/28/58. SECTION 6. An operator of a motor vehicle overtaking another vehicle proceeding in the same direction may pass such vehicle at a safe distance to the left thereof,but in so doing shall exercise due care and shall not pass to the left of the center of the roadway unless the way ahead is clear of approaching traffic. The operator of the motor vehicle overtaken shall promptly,upon suitable and audible signal being given by the operator of the overtaking vehicle,keep to the right-hand side of 1 the roadway to allow free passage on his left, and shall not increase his speed until completely passed by the overtaking vehicle. Rev. 4/28/58. SECTION 7. A vehicle shall not pass another from the rear at the top of a hill or on a curve where the view is in any way obstructed, or while the vehicle ahead is crossing an intersection or is about to turn into the same. Rev. 4/28/58. SECTION 8. Motor trucks and all slow-moving vehicles shall keep at all times as close to the right-hand side of the roadway as is reasonably practicable. Rev. 4/28/58. SECTION 9. All curves shall be approached and entered with due care to avoid accidents, and all vehicles rounding the same shall keep as far to the right-hand side of the roadway as reasonably practicable and proceed with due care to avoid accidents. Rev. 4/28/58. SECTION 10. A person shall not turn or back a vehicle of any kind in a public roadway without taking due and reasonable care to avoid injury to other users of the roadway in so doing. A vehicle shall not be driven in a backward direction further than is absolutely necessary to avoid accident, or to proceed on its way. Rev. 4/28/58. SECTION 11. A person shall not drive any vehicle on any roadway across which there is a bather or a sign indicating that such roadway is closed to public travel. Rev. 4/28/58. SECTION 12. No vehicle shall be stopped with its left side to the curb except in an emergency, and no vehicle shall stop in any public street except close to the curb on its right side except to allow another vehicle or a pedestrian to cross its way. Rev. 4/28/58. SECTION 13. No person shall park a motor vehicle or other vehicle on any street within thirty feet of the curb line of another street, lane or alley.Rev. 4/28/58. SECTION 14. No operator or driver of any vehicle shall stop,stand or park the same within an intersection, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic sign. Rev. 4/28/58. 2 SECTION 15. No person shall put,place or park any vehicle on any public street for the purpose of selling or renting the same or for the purpose of displaying or advertising the same for sale or rent. Rev. 4/28/58. SECTION 16. No vehicles shall be driven along or upon any sidewalk within the City. Rev. 4/28/58. SECTION 17. Owners,managers and proprietors of automobile garages and automobile salesrooms and/or sales lots are prohibited from using any public street in the City for the purpose of making repairs on or for the washing of automobiles.Rev. 4/28/58. SECTION 18. The City Manager,with the approval of the City Council, shall have authority to regulate and manage vehicle traffic on all public streets and to designate the method of parking motor and other vehicles in streets where permitted, all in accordance with the provisions of these ordinances. In case of emergency,police officers in regulating traffic may depart temporarily as far as may be necessary from the traffic regulations of this chapter. Rev.4/28/58. SECTION 19. The driver or operator of any vehicle shall at all times comply with any direction by voice, hand, or sign of any member of the police department as to stopping, starting or slowing down his vehicle, approaching or departing from any place and the manner of taking up or setting down passengers or loading or unloading goods in any place, and shall comply with the instructions and directions of all official traffic signs,unless directed otherwise by a member of the police department. Rev. 4/28/58. SECTION 20. It shall be unlawful for any person willfully to deface, injure,move or obstruct, or interfere with, any official traffic sign. Rev. 4/26/58. SECTION 21. No operator or driver of any vehicle shall stop, stand or park the same in front of a private driveway, lane or alley, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic sign.Rev. 4/28/58. SECTION 22. No operator or driver of any vehicle shall stop, stand or park the same abreast of any vehicle (commonly called double-parking)in a public street, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic sign. Rev. 4/28/58. 3 SECTION 23. The provisions of this chapter governing the movement,parking and standing of vehicles, shall not apply to authorized emergency vehicles while the drivers of such vehicles are operating the same in an emergency in the necessary performance of duty. Said vehicles shall have the right of way in any street and through any procession when operated in such emergency,but shall approach all official traffic signs with due care. Rev. 4/28/58. SECTION 24. No person shall park any vehicle at any time in any space herein or hereafter specified as reserved for a bus stop. Rev.4/28/58. SECTION 25. A driver or operator of a vehicle shall not enter the intersection of, or cross,without first having brought his vehicle to a complete stop at a point at or near the intersection of the street and not more than ten feet there from, any street that has been designated and marked as a stop street. The City Manager,with the approval of the City Council,is hereby empowered to designate stop streets; a record of all such designations and any changes thereto, shall be kept by City Manager and Chief of Police. The Police Department shall conspicuously place suitable"STOP" signs in and near the areas affected by the provisions of this section, and action hereunder. A"STOP"sign shall be placed on the south side of Baycrest Road where the road intersects Harbor Ridge Road. The following intersection(s)be designated as"STOP"street(s) 1. Mammoth road exit to Queen City Park Road. (Resolution dated 11/3/69) 2. Kennedy Drive, Williston Road and Airport Drive(resolution dated 3/17/69) 3. Allen Road and Spear Street(4/15/68) 4. Airport Parkway and White Street(1/8/01) Also,that NO THROUGH TRAFFIC signs be placed on Farrell Street off Swift Street;Hadley Road of Shelburne Street;Proctor Avenue off Shelburne Street. Added 12/21/92.Amended 1/8/01. SECTION 26. The Police Department shall conspicuously place suitably marked signs in and near the areas affected by the parking regulations of this chapter. Rev. 4/28/58. SECTION 27. The City Manager,with the approval of the City Council,may regulate the manner of parking any vehicle, in places where parking is permitted by this chapter,by causing parking spaces for vehicles to be marked off or painted on the pavement of the street in the areas affected, and no person,in places where such spaces are marked off or painted for the parking of vehicles, shall park any vehicle otherwise than wholly within a space so marked off or painted. Rev.4/28/58. SECTION 28. The practice of endeavoring upon the streets in this City by words, gestures, and other means,to beg,demand, invite, ask for or secure transportation in any vehicle not engaged in passenger carrying for hire is deemed both annoying and dangerous to the general public, and therefore unlawful unless such is done to solicit aid in the event of accident, or because there is a bona fide case of sickness in which an emergency exists. Rev. 4/28/58. SECTION The Chief of Police is hereby directed and authorized to remove or cause to be removed any vehicle found parked on any street in the City so as to interfere with the plowing or removal of snow from any such street between December 1 in each year and the ensuing first day of April. The expense of the removal shall be borne and paid for by the owner or owners of any such vehicle so removed. The Chief of Police is further directed and authorized to remove or cause to be removed from any street in the City any other vehicle found illegally parked thereon. Rev. 4/28/58. SECTION 30. 6 The City Manager,with the approval of the City Council,is hereby empowered from time to time to establish police regulations governing: (a) The location and size of spaces reserved for bus stops within the limits of the streets of the City. (b)The location and size of spaces reserved for commercial vehicles actually engaged in loading or unloading within the limits of the streets of the City,when they shall be so reserved,the manner of their use, and the maximum time allowed each such vehicle therein. Rev.4/28/58. SECTION 31. Parking of any vehicle within an intersection, on a crosswalk, within 15 feet of a fire hydrant,in front of a private driveway, on a bridge,viaduct or the approach hereto, on a sidewalk, within any area wherein parking is prohibited is hereby declared to be public nuisance, and the Chief of Police may remove any vehicle so parked, or cause it to be removed, at the sole expense of the owner of such vehicle,to any public garage or other place designated by him within the City of South Burlington,by towing or otherwise. SECTIO(3 No person shall,between the hours of 12 midnight and 8 A.M.,including Sundays and legal holidays, during the period from December 1 of each year to April 1st of the following year,park any vehicle within the limits of any public highway of the City. SECTIO 33 The parking of any vehicle in violation of Section 32 is hereby declared to be a public nuisance, and the Chief of Police shall remove any vehicle so parked, or cause it to be removed, at the sole expense of the owner of such vehicle,to any public garage or other place designated by him within City of South Burlington,by towing or otherwise.Rev. 4/28/58. SECTION 34. The Chief of Police and the owner of any public garage to which such vehicle is removed shall keep a record of each vehicle so removed by manufacturer's trade name or make,registration number or motor number if the vehicle be not registered,registered owner if the vehicle bear Vermont registration, such other descriptive matter as may be necessary to identify such vehicle, and the name and address of any claimant thereof.The Chief of Police shall, in addition,keep a record showing date of such removal,place to which such removal is made, and reason for such removal.All such records shall be open to public inspection at all times,and the Chief of Police shall publish in a newspaper of general circulation in the City the record of any vehicle which shall remain unclaimed for a period of five days. Rev. 4/28/58. SECTION 35. Before the owner shall be permitted to reclaim a vehicle which has been removed pursuant to Section 31 or Section 34,he shall: 7 (a)Furnish satisfactory evidence to the Chief of Police or to the owner or person in charge of such public garage of his identity and of his ownership of such vehicle. (b)Pay to the Police Department or to the garage or towing facility the fees specified in Section 36 of this Article. (c) Sign a written receipt acknowledging delivery of the vehicle. Rev. 4/28/58; amended 3/17/86. SECTION 36. Towing charges made or incurred under this provision shall not exceed TWENTY-FIVE DOLLARS ($25.00). Parking or storing charges made or incurred under this ordinance shall not exceed TWO DOLLARS ($2.00)per day these fees shall be the sole responsibility of the registered owner of this vehicle.Rev. 4/28/58; amended 3/17/86. SECTION 37. The owner of a motor vehicle towed pursuant to this ordinance shall pay towing and storage charges in an amount established by the City Council by resolution. Such charges shall be a lien imposed on the motor vehicle and its owner. In accordance with Section 37 of this Ordinance and Section 8 of the Fire Lane Ordinance,the City Council hereby resolves to establish the following fees for violations of the referenced ordinances: Maximum towing fee $40.00 Maximum storage per day fee $ 5.00 Rev. 4/28/58; amended 12/17/90(see resolution at A/31) SECTION 38. No charges made or incurred hereunder shall be considered to be a fine,penalty or forfeiture.The removal and storage or parking of any vehicle under this Article shall not be a bar to the institution and prosecution of criminal proceedings against the owner or operator.of such vehicle.Rev. 4/28/58. SECTION 39. A person who violates any provision of this chapter relating to the parking of motor vehicles shall be fined One Dollar($1.00) for the first violation, and Two Dollars ($2.00) for any subsequent violation in any calendar year; the penalty for violation of any other traffic ordinance shall be Five Dollars($5.00). Rev. 4/28/58. SECTION 40. (a)No motor vehicle shall be operated upon any of the streets of the City of South Burlington at any time at a rate of speed greater than 25 miles per hour, unless otherwise herein provided.Amended 6/3/74. 8 (b)No motor vehicle shall be operated at any time at a rate of speed greater than 35 miles per hour on the following streets in the City: SPEAR STREET(except that portion which extends from Quarry Hill Road to the Jug-Handle where the maximum speed limit shall be no greater than 20 miles per hour) SWIFT STREET ALLEN ROAD DORSET STREET OLD FARM ROAD CHEESE FACTORY ROAD AIRPORT PARKWAY, from the Colchester-South Burlington City line to its intersection with Kirby Road, excepting that portion which extends from Lime Kiln Bridge to the intersection of Shamrock Road where the maximum speed limit shall be no greater than 25 miles per hour.Added 6/3/74;Amended 10/22/74(See 7/16/73 resolution) (c)No motor vehicle shall be operated upon HINESBURG ROAD at any time at a rate of speed greater than that indicated below: 35 miles per hour from the intersection of WILLISTON ROAD for a distance of 1.10 miles south. 45 miles per hour from the end of the 35 mile per hour zone for a distance of.5 miles south. 50 miles per hour from the end of the 45 mile per hour zone to the City line. (d)No motor vehicle shall be operated upon SHELBURNE ROAD at any time at a rate of speed greater than that indicated below: 35 miles per hour from the Burlington-South Burlington line for a distance of.9 miles south. 40 miles per hour from the end of the 35 mile per hour zone for a distance of.8 miles to.the Shelburne- South Burlington line. (e)No motor vehicle shall be operated upon WILLISTON ROAD at any time at a rate of speed greater than that indicated below: 35 miles per hour from the South Burlington-Burlington City line, east to MILHAM COURT. 50 miles per hour from the end of the 35 mile per hour zone to the South Burlington-Williston line. (f)The following speed limits on the following designated streets are hereby established: 9 A maximum speed of twenty-five(25)miles per/hour On: Airport Parkway from its intersection with White Street to a point five hundred feet north of Kirby Road. State Aid Highway No. 1 extending from the Burlington City line easterly for 2.311 miles and known as U.S. No. 2 (Williston Road)is designated as a"through way"under authority contained in Section 39 of No. 250 of the Acts of 1957.Rev. 4/28/58. SECTION 42. That part of U.S. Route No. 2 designated as State Aid Highway No. 1,which is within the limits of the City of South Burlington, is hereby designated a four-lane highway. The City Manager is hereby instructed to notify from time to time,the local and state police that the part of U.S. Route 2 designated as State Aid Highway No. 1 which is within the limits of the City of South Burlington is a four-lane highway, and to request said police to enforce the provisions of Section 10,219, Paragraph XIII,Vermont Statutes,Revision of 1947,which forbids parking upon paved and used parts of a highway. Rev. 4/28/58. SECTION 43.TO REGULATE THE INSTALLATION OF TRAFFIC LIGHTS A. The traffic lights now or hereafter located and in operation at the following intersections shall be continued in use and operation: Williston Road at#870 Williston Road and Patchen Road Williston Road and East Terrace/Spear Street Williston Road and Dorset Street Williston Road at Interstate 89 south, Exit 14 east Williston Road at#1117 Williston Road. at White Street Williston Road at Kennedy Drive Kennedy Drive at Kimball Avenue Kennedy Drive at Timber Lane 12 Kennedy Drive at Dorset Street Dorset Street at#100 Dorset Street at Market Street Dorset Street at#155 Dorset Street at south entrance to#150 Dorset Street at t#'135 Dorset Street at Swift Street Spear Street and Swift Street Farrell Street and Swift Street By Amendment 2/7/00 The City Manager,with the approval of the City Council,may erect traffic lights in other locations when required for the control of traffic. B. Meaning of signals. Whenever traffic is controlled by traffic-control signals, exhibiting the words"Go,""Caution,"or"Stop," or exhibiting different colored lights successively one at a time,or with arrows,the following colors only shall be used and said terms and light shall indicate and apply to drivers of vehicles and pedestrians, as follows: (1)Green alone or"Go." (A)Vehicular traffic facing the signal, except when prohibited by law from passing a stopped school bus,may proceed straight through or turn right or left unless a sign at such place prohibits either such turn;But vehicular traffic,including vehicles turning right or left, shall yield the right of way to other vehicles and to pedestrians lawfully within the intersection at the time such signal is exhibited. (B)Pedestrians facing the signal may proceed across the roadway. (2)Yellow alone or"Caution"when shown following the green or"Go" signal. (A)Vehicular traffic facing the signal is thereby warned that the red or"Stop"signal will be exhibited immediately thereafter and such vehicular traffic shall not enter or be crossing the intersection when the red or"Stop" signal is exhibited. (B)No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic. (3)Red alone or"Stop." 13 (A)Vehicular traffic facing the signal shall stop before entering the crosswalk on the near side of the intersection or, if none,then before entering the intersection, and shall remain standing until green or"Go"is shown alone. (B)No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic. (4)Red with green arrow. (A)Vehicular traffic facing such signal may cautiously enter the intersection only to make the movement indicated by such arrow but shall yield the right of way to pedestrians and to other traffic lawfully using the intersection. (5)Whenever an illuminated flashing red or yellow signal is used in a traffic sign or signal it shall require obedience by vehicular traffic as follows: (A)Flashing red(stop signal). When a red lens is illuminated with rapid intermittent flashes,drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or,if none, then before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign. (B)Flashing yellow(caution signal). When a yellow lens is illuminated with rapid int-nnittent flashes, drivers of vehicles may proceed only with caution. (6)Red and yellow. Whenever the color red and the color yellow shall be exhibited together on any traffic light within the town all traffic facing the signal shall stop before entering the crosswalk on the near side of the intersection, and remain standing until green or"Go"is shown alone. Such red and yellow signal shall indicate that traffic is stopped from all directions to enable pedestrians to cross the roadway in any direction within the crosswalk, and no pedestrian shall, at any intersection where such red and yellow signals are exhibited together for pedestrian crossing, enter the roadway unless such signals are shown. Where traffic at any intersection is so controlled, signs shall be posted to indicate to pedestrians the existence of such controls. Added 9/6/66. No person shall park any vehicle at any time,unless otherwise indicated, on the City streets and roads designated below: That"NO PARKING" signs be installed on the following streets: The west side of Dorset Street from Williston Road to Swift Street. (Resolution dated 9/16/68) The west side of Patchen Road. (9/16/68) The west side of Airport Parkway. (9/16/68) The north side of White Street. Szymanski From: Police Chief Carter- Subject: Amendment to traffic ordinance Due to recent problems which have arisen stemming from vehicles towed under provisions of the winter parking ban and those towed as a necessary part of the city snow removal operations, it is necessary that the city ordinance be amended to bring it into conformity with those of neighboring communities, with regard to specifying the amount that garages or towing operators may charge for this service. $ 25.00 is the standard amount for police authorized towing for snow removal. Recently one local garage charged $46.00 for towing a car from a city street less than a mile to the garage. My interpretation of the law is that prior to 1971 there was no requirement that City officials had to conduct a traffic and engineering survey before setting local speed limits at a limit different from the 50 mile an hour speed limit set by state statute. 23 V.S.A. §1081. However, with the enactment of 23 V.S.A. §1007 in 1971 it became mandatory to conduct such a survey prior to setting speed limits within the City. It is also our position that it was not the intent of the new law to invalidate speed limits that were set before 1971 and have remained unchanged. I went to Montpelier to research the legislative history and turned up very little on this issue. However, I spoke to Deputy State's Attorney, Bob Andres, and he indicated that he would argue our position although he had very little hope that the Court would buy it. Quite apart from the issue of speed limits set before 1971 we have the problem that in South Burlington many speed limits were changed after 1971 without a traffic and engineering survey. There was an especially major change in the speed limit ordinance in 1974. There is absolutely no question that after 1971 the City had to conduct a traffic and engineering survey before changing speed limits. Therefore, any speed limits set after 1971 are suspect and will probably not be upheld in Court. Finally, it is our opinion that the City should conduct a comprehensive traffic and engineering survey and readopt its speed limit ordinance. Only after the state statute is complied with will this problem be cleared up. In the meantime, speeding violations on City streets will probably not be enforced by the Court.
