Conditions of Approval — Plan Revisions
Dear Mr. Belair:
We house outlined below the conditions of approval associated with approval SD-17-06
for the subdivision of the parcel at 25 Harbor Ridge Road. We have embedded in bold
our responses to each.
3. The plans must be revised to show the changes below and will require approval of
the Administrative Officer. Three (3) copies of the approved revised plans must be
submitted to the Administrative Officer prior to recording the plat plans.
a. The survey plats must be revised to include the signature and seal of the land
surveyor. This has been added on the mylar to be filed in the land records
and previously submitted for filing.
b. Proposed Site Plan (C1.0) must be revised to have a title different from Proposed
Site Plan (C1.1). Sheet C1.0 title is "Proposed Overall Site Plan while Sheet
C1.1 is "Proposed Site Plan"
c. The plans must be revised to show the portion of the proposed shared driveway
in the right-of-way being paved at 25 Harbor Ridge Road. Sheet C1.1 has been
revised to show the driveway apron being paved.
d. The plans must be revised to show arrows with single heads indicating the
direction in which the zoning district boundary line will be adjusted rather than the
two -headed arrows currently shown. Sheet C1.0 has been revised to show an
arrow in the proper direction for the expansion of the regulations.
e. The Stormwater Worksheet plan must be revised to show the arrows (which
indicate the location of a grass swale) to the east of the possible house on Lot 2

pointing south rather than north. The direction of the arrows have adjacent to
the proposed house site on Lot 2 has been revised to point southerly. The
corresponding drainage watershed area has also been revised as a
byproduct of the arrow directional change.
In accordance with the requirements of Condition of Approval #10, "The applicant must
submit to the Administrative Officer a final set of project plans as approved in
digital(PDF) format prior to recording the final plat plans" .we have attached a CD that
includes the revised project plans.
This completes our summary of the recent revisions to the application plans. If you

Proposed PUD, 2- Lot Subdivision - Sketch Plan Application
Dear Ms. Britt:
We would like to thank the Planning & Zoning staff for taking the time to work with Don
Cummings and myself in determining the most appropriate means of enabling the
proposed subdivision of the 1.08 acre parcel located at 25 Harbor Ridge Road into two
lots.
This parcel is currently divided by the zoning district line between the Residential 1 and
Residential 2 zoning districts. Mr. Cummings owns the adjacent 1.55 acre parcel to the
east where his home fronts on Spear Street. This parcel is wholly located within the
Residential 1 zoning district.
By themselves, the properties cannot support a subdivision due to density
requirements, However, when these two properties are combined into a Planned Unit
Development (PUD), it creates the following breakouts of areas in each District.
R1 91,909 SF /43560 SF per Unit = 2+ Units
R2 29,859 SF /22,000 SF per Unit = 1+ Units
Cummings House Lot = 70,864 SF (1811 Spear St.)
25 Harbor Ridge Lot = 50,904 SF
Article 15 of the LDRs describes how the PUD process provides "for relief from the strict
dimensional standards for individual lots in these Regulations in order to encourage
innovation in design and layout, efficient use of land, and the viability of infill
development".
Using a PUD approach also seems to fit within a strategy from the Comprehensive Plan
by "accommodating compatible infill and additions in existing neighborhoods". The
intent of this strategy and the LDRs appears to be to relieve the pressure on
development in open spaces elsewhere in South Burlington. An additional lot within the
existing Harbor Ridge Road area would make a small contribution to that end.

The goal of using the PUD process is to create no more than three single family housing
units while retaining the shape of the Cummings Lot on the east end. This would result
in creating two lots on the Harbor Ridge parcel that are 25,000 SF in size, one to host
the existing house and one to create a new home on the north half of the lot.
When considered in aggregate with the Spear St lot this would seem to fit the density
requirement in that "the overall density ... allowable for the land in question shall be the
same as for the underlying district(s) involved in the application".
We would still be likely submitting a Conditional Use application to expand the R1
regulations 50 feet to the west for the proposed new northern lot and the R2 regulations
50' to the east on the southern lot that will site the existing house to assist with the siting
of the proposed home.
These lots would be in keeping with feel of the other lots on Harbor Ridge and perhaps
be larger than some while retaining the character of the existing Spear St and Harbor
Ridge road neighborhoods as compared to other subdivision approaches. Additionally,
this could avoid an awkwardly shaped lot required with a conventionally subdivision
approach which could provide maintenance challenges for future owners. The PUD
approach would preserve a heavily landscaped lot boundary between the Spear St.
property and the Harbor Ridge Road property.

Slide 1: Existing Conditions
• The blue Lot on the west fronts on Harbor Ridge Road while the Green Lot fronts of Spear Street.
• Note the character of the Harbor Ridge Road neighborhood.
Slide 2: Proposed Subdivision
Looking at the character of the surrounding neighborhood residential lots, subdividing the blue lot into
two lots would appear to be in keeping with the existing conditions. The blue lot fronting on Harbor
Ridge Road is proposed to be split in two to creates of generally the same size as those in the immediate
neighborhood.
Slide 3: Existing Conditions with Zoning Boundaries
• Unfortunately subdivision the Harbor Ridge Road Blue parcel is not that straight forward.
• The zoning district line between the R1 and R2 districts runs through the Blue Harbor Ridge Road Lot.
• Rather than running the line along the back of the Spear Street lots, the line was set 600-feet from the
center of Spear Street.
• The available area in the R2 district does not permit the subdivision of the blue lot as there is only 1.49
units of density available.
• Interestingly, the two properties in the R1 district would allow for a subdivision of the Green lot and a
portion of the blue lot into two lots as it has 2.04 units of eligible density.
• The total residential density between the two lots is 3.53 units.

existing neighborhoods"
• The LDRs describe the PUD process as allowing "for relief from the strict dimensional standards for
individual lots in these Regulations in order to encourage innovation in design and layout, efficient use
of land and the viability on infill development"
Providing that overall density requirements are met. The existing conditions permit 3 Units of
residential density and the proposed condition creates 3 Units of density.
Slide 5: 3 Lots as proposed
• One of the challenges with the PUD approach is that staff requested that the allowable number of future
units be located within the respective zoning district.
• This can be achieved through a Conditional Use Approval. On those lots where a district line runs not
along the lot line but through the lot, the zoning district line can be moved by up to 50 feet .
• The revised district regulation line enables two units in the R1 District consistent with the allowable
density in that district and provides one new unit in the adjusted R2 zoning area.

• This plan shows the application of the R1 and R2 front, side and rear yards.
Discussion on opportunities to make the southern half of the Blue Lot consistent with the remaining
neighborhood with side yard waiver.
The Benefits of this PUD

• It makes an infill lot viable and is the most efficient way to use the existing land to create 2 new lots
sharing 1 common driveway with each having easy access to existing utilities (city fresh water and waste
water & electrical)
• Allows for 2 lots that are in keeping with the feel of the existing Harbor Ridge neighborhood
• Maintains the existing feel of the Spear Street neighborhood and allows the existing heavily landscaped
border to remain.
• This PUD allows an innovative and creative way to avoid unusual shaped lots that could result from a
typical subdivision process. Those lots could allow for an odd placement of a house site or create
maintenance problems in the future due to part of a lot being out of sight of the house.
• the real innovative use of the PUD here is to create 2 nice lots in keeping with their respective
neighborhoods vs. a new lot with a house being placed in what is effectively the Spear St house's
backyard.

South Burlington Development Review Board Meeting Participation Guidelines
The Development Review Board (DRB) presents these guidelines for the public attending Development Review Board meetings to
insure that everyone has a chance to speak and that meetings proceed smoothly.
The DRB is a Quasi -Judicial Board that oversees the approval of development projects within the City. It is made up of citizens
appointed by the City Council. The role of the DRB is to hear and review applications for development under the applicable
regulations. The DRB can only approve applications that comply with the applicable bylaw or state law, and the board can only levy
conditions that are permitted under the bylaw. By the same token, if a projecCreets the applicable bylaw criteria, the DRB is bound
by law to grant the approval.
