MEMORANDUM
TO: SOUTH BURLINGTON PLANNING COMMISSION
FROM: BILL WESSEL, CHAIRMAN
RE: RAYMOND UNSWORTH SUBDIVISION APPLICATION
DATE: SEPTEMBER 12, 1975
I have conferred with Dick Spokes, Dick Ward and Steve
Page regarding the issues raised at the last Planning
Commission meeting in conjunction with the Unsworth Sub-
division Applicat'on.
From a legal standpoint, Dick Spokes indicated that
approval of the subdivision as shown would indeed create
a non -conforming lot; however, such a lot could be rendered
conforming by the Planning Commission's approval of a
right-of-way at least 20 feet wide. If the Planning
Commission were to require a right-of-way 60' wide, this,
too, could be justified on the grounds that future
development of the remaining interior land may call for the
upgrading of the right-of-way to city road standards.
After discussing adjacent land use and parcel
configurations, the conclusion was reached that the most
desirable situation for all parties concerned would be the
predication of an approval on the following points: 1)
Spear Street curb cut allowed for the northerly 1 acre lot,
2) curb cut on the southerly lot to be off the proposed
right-of-way strip, and 3) the proposed right-of-way
approved as is, provided that, if any development or
subdivision of the remaining interior land is to take place
in the future, that this right-of-way be upgraded to city
road standards.

Several years ago,a two lot sub -division covering the front-
age of my land at 1700 Spear Street was approved by the Plan-
ning Commission. These two 1 acre lots are both on City wat-
er and sewer and fulfill all of the requirements of the cur-
rent Zoning laws. The southern lot, however, has a restric-
tion which we feel is unwarranted - in that access directly
to the Street has been denied.
There have been many instances where people have wished to
purchase this lot, have put money with agents as a deposit
and have later demanded that their deposit money be returned
upon learning that they could not have their driveway on
Spear Street as all others in the neighborhood from the Univ-
ersity to the Town line have. These lost sales have resulted
in substantial hardship and I sincerely request that this
inappropriate restriction be withdrawn.
This restriction definitely runs counter to all concepts of
good planning as well as ecological and environmental criteria.
In today's world, houses should be sited so that the large win-
dows permit solar heating from the south and, with this partic-
ular unfortunate restriction, only the garage can be placed on
the south of a planned house.
Please consider this letter a formal petition to delete this
one restriction.

proposal is a three lot division of a parcel of land located
on the easterly side of Spear Street, at #1700.
The parcel in question contains twenty-nine point two (29.2)
acres, and is presently occupied by a single family unit
owned by the applicant.
The parcel contains 1+37 foot frontage on Spear Street and
;z o is located in the R1 and AR Districts. The R1 District
parallels Spear Street a depth of 500 feet the remaining
°. land is in AR District.

Proposed by Mr. Unsworth is the setting off of two one acre
lots and the remaining twenty sever: will be retained by IMAr.
Unsworth and served by sixty foot frontage on Spear Street.
The two one acre lots are in conformance with the dimensional
requirements of the R1 District, however, the twenty-seven
acre lot will be non -conforming due to the minimum frontage
requirement (R-1 District provides for a minimum of 120 feet).
The soil in this area is Vergennes clay and has a percolation
rate of 45-50 min./in., the site is generally flat in the area
of the two one acre lots.
It is possible to serve the lots with city water, however,
they will require on site sewer systems.

History of pre-existing subdivision.
The southerly side of Joy Drive was divided into eight lots
in the late 1960's.
Lot 9 located northerly of the Court Club received approval
by the Planning Commission in December, 1974, the northerly

side of Joy Drive containing approximately six acres has
never been subdivided.
The proposed lot #10 contains the minimum square footage
required within the Business planned Development District,
lot {#10 is located on the north-east side of Joy Drive and
Farrell Road, four acres will remain undeveloped, this
acreage is all located on the northerly side of Joy Drive
and has frontage thereon.
The soils on the site are Enosburg and dhately (sandy, loamy
mixture). This lot slopes toward the east.
A recreation facility is proposed for this site.
The lot will be served with City water and sewer.
