Subdivision Permit #EC-4-2449 shall remain valid with the understanding that the single family residence may not be occupied until such time as the municipal sanitary sewer has been constructed and accepted by the City of South Burlington and the State of Vermont. The amendment proposes to legitimatize the present landscaping of the planned residential development, 353 & 355 Patchen Road, as depicted on a one page set of plans entitled "355 Patchen Place Plant Inventory" with a stamped received date of 8/23/00, with the following stipulations: I. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Pursuant to Section 26.105(a) of the Zoning Regulations, the Development Review Board grants a landscaping waiver for $1,357.50. 3. Any change to the final plat plan shall require approval by the South Burlington Development Review Board. Mr. Schmitt seconded. Motion passed unanimously. 4. Final Plat application #SD-00-51 of Champlain College, Inc., to re -approve the three -lot subdivision plat approved by the Planning Commission on .Tune 23, 1970, 1845 & 1855 Spear Street and 197 Allen Road. This plat was recorded without the signature of the Commission's clerk required by 24 VSA, 4416, consequently, the approval became null and void: Mr. Collins, legal counsel for Champlain College, said the lot was gifted to the College and the problem was discovered at that time. Public Hearing: Preliminary Plat application #SD-00-49 of Fairway Estates to amend a planned residential development consisting of 297 residential units and an 18 hole golf course. The amendment consists of combining fourteen single family lots into one lot and constructing eleven duplex units and one town home for a total of nine additional units, Economou Farm Road: Mr. Burke showed the parcel and the current approved plan. He noted the applicant had met with residents of Swift Estates. The main problem at the sketch plan hearing was the change of setback from Swift Street. Mr. Burke noted that they had originally proposed 26 units. They are now proposing 23. There will be 3 duplexes and a single home on the Swift Estates side. They have also reduced one unit on the other side. The developer didn't feel the project would work with all single family homes on the Swift Estates side. All infrastructures are the same as what was approved. There are no requests for dimensional variances. Mr. Burke showed pictures of the lighting fixtures. Mr. Dinklage asked Mr. Burke to confirm that what will be built is in exact conformity with what is being shown at this meeting. Mr. Burke said it is, except that the owners of the units get to contribute ideas to the landscaping. The units are the same. No changes are proposed. The lots meet the current size and frontage requirements under present zoning. Legal document: Once the plat is approved, the Chairman should sign and stamp the recorded plat and record a document explaining the Board's action. 6) FAIRWAY ESTATES, LLC. — 13 DUPLEX UNITS - PRELIMINARY PLAT , ECONOMOU FARM ROAD This project consists of amending a planned residential development consisting of 297 residential units and an 18 hole golf course. The amendment consists of combining fourteen (14) single family lots into one (1) lot and constructing eleven (11) duplex units and one town home for a total of nine additional units resulting in 306 units total in the development, Economou Farm Road. The Development Review Board considered the sketch plan application for this project on June 6, 2000 (minutes enclosed). The property is located in the Southeast Quadrant District. It is bounded on the north by Swift Street, on the east by the golf course, and on the west by single family residences. The Board, at the sketch plan meeting, expressed concern with placing duplex buildings adjacent to the Meadowood Drive development which consists entirely of single family homes. This application proposes three (3) duplex buildings along the boundary with this single family development. A significant amount of information required for preliminary plat review has not been provided. The Board should decide whether if will approve the proposed concept and if it is acceptable, to then continue the hearing should be continued to a later date until the required information is provided. If the concept is not acceptable, the application should be denied. Access/Circulation: Access to the duplexes will be provided via Economou Farm Road, a proposed public street. The applicant should revise the plans to show the street to City standards including street trees and street lights. Circulation is adequate. In the course of our due diligence in the land records, we discovered that although the Planning Commission had in fact duly approved this three -lot subdivision on June 23, 1970, and the final plat was recorded in Volume 80 (plans), page 161 of the South Burlington Land Records, the plan was never officially signed by the Chairman of the Planning Commission. I have enclosed a conformed copy of the subdivision plat as recorded, a copy of the Minutes of the Planning Commission in which they approved this subdivision, and a copy of the recent deed of gifts from Patricia Pizzagalli to the College. Subdivision is into three (3) lots: one 2.3 acres and two (2) one acre lots. Area is zoned Residence A to a depth of 300 feet on Spear Street. Minimum lot size in Residence A being one acre. My comments regarding this plan are as --ollows: 1. We anticipate construction this fall of a water main to the west of this parcel. This water main pressure will be too low to serve this land. If this is to be utilized it will have to be pumped. 2. Each spring there is a serious drainage problem along east side of Spear Sc-�-eet at this location. The ditches are too flat to carry the spring runoff resulting in overflowing at approximately the southerly property line of this property where a slight depression exists.
