HomeMy WebLinkAboutSD-00-51 - Decision - 0197 Allen Road# SD-00-51 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of Champlain College, Inc. for a previously approved three (3) lot subdivision plat, 1845 & 1855 Spear Street and 197 Allen Road. On the P of October, 2000, the South Burlington Development Review Board approved the final plat application of Champlain College, Inc. under Section 204 of the South Burlington Subdivision Regulations based on the following findings: This project consists of the re -approval of a three -lot subdivision plat approved by the Planning Commission on June 23, 1970, 1845 & 1855 Spear Street and 197 Allen Road. This plat was recorded without the signature of the Commission's clerk required by 24 VSA § 4416, consequently the approval became null and void. No changes are proposed. The lots meet the current size and frontage requirements under present zoning. 2. The owner of record of this particular property is Champlain College, Inc. 3. Legal document: Once the plat is approved, the Chairman should sign and stamp the recorded plat and record a document explaining the Board's action. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat application #SD-00-51 of Champlain College, Inc. for a previously approved three (3) lot subdivision plat, 1845 & 1855 Spear Street and 197 Allen Road, as depicted on a one (1) page set of plans entitled, "Spear Street Heights", dated 6/l/70, and recorded in plat volume 80 of the land records with the following stipulations: The Chair or Clerk of the Development Review Board shall stamp and sign the plat recorded in map volume 80, page 161 of the South Burlington Land Records within 90 days or this approval is null and void. Prior to the Clerk or Chair of the Development Review Board stamping and signing the recorded plat, a legal document shall be recorded which explains the Development Review Board's action regarding this approval.
