This project, consisting of converting an existing five bedroom single family residence to a Bed &
Breakfast with four rental bedrooms and one family bedroom on the lot referenced in Subdivision
Permit #EC-4-2138 served by municipal water supply and wastewater collection systems located off
Spear Street in the City of South Burlington, Vermont, is hereby approved under the requirements
of the regulations named above subject to the following conditions.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Department of Labor and Industry - telephone (802) 828-2106 or
(802) 658-2199, the Vermont Department of Health - telephone (802) 863-7220 and local
officials prior to proceeding with this project.
2. The project shall be completed as shown on the plans dated 8-2-02 prepared by Lucia
Chiu which have been stamped "approved" by the Wastewater Management Division. The
project shall not deviate from the approved plans without prior written approval from the
Wastewater Management Division.
3. The conditions of this pennit shall run with the land and will be binding upon and
enforceable against the permittee and all assigns and successors in interest. The permittee
shall be responsible for the recording of this permit and the "Notice of Permit Recording"
in the South Burlington Land Records within 30 days of issuance of this permit and prior to
the conveyance of any lot subject to the jurisdiction of this permit.
4. No alterations to the building other than those indicated on the approved plan or Water
Supply and Wastewater Disposal Permit, which would change or affect the exterior water
supply, or wastewater disposal, or the approved use of the building shall be allowed without
prior review and approval from the Division of Wastewater Management.

5. All conditions set forth in Subdivision Permit #EC-4-2138 shall remain in effect except as
modified or amended herein.
6. The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 64 - Potable Water Supply and Wastewater System
Permit.
7. This project has been reviewed and is approved for the conversion of the five bedroom
single family residence to a Bed & Breakfast with a maximum of five bedrooms.
Construction of other type dwellings, including public buildings, duplexes, and
condominium units, is not allowed without prior review and approval by the Wastewater
Management Division and such approval will not be granted unless the proposal conforms
to the applicable laws and regulations.
8. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property subject to this permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations.
WASTEWATER DISPOSAL & WATER SUPPLY
9. The project is approved for water supply and wastewater disposal by connection to the
municipal water supply and wastewater collection systems as depicted on the approved
plans. No other means of obtaining potable water shall be allowed without prior review and
approval by the Wastewater Management Division. The project has been allocated 750
gallons per day of wastewater for treatment at the municipal wastewater treatment facility.

I move the South Burlington Development Review Board approve site plan application #
SP-02-48 and conditional use application #CU-02-23 of Jen —Fu and Lucia Chiu for
permission to convert a single-family dwelling to a three (3) room bed and breakfast, 1560
Spear Street, as depicted on a one (1) page plan, entitled "Jeri Fu and Lucia Chiu 1560 Spear
Street South Burlington, VT", as prepared by Engineering Ventures Inc., dated 9/2002, with
a stamped received date of 9/24/02, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) The site plan shall be revised to show the changes listed below and shall require
approval by the Director of Planning and Zoning (hereinafter Director). Three (3)
copies of the approved revised plan shall be submitted to the Director prior to permit
issuance.
a. The site plan shall be revised to show a 22 foot wide aisle for both single
loaded parking areas.
b. The site plan shall be revised to show front yard coverage information.
c. The site plan shall be revised to show one accessible parking space.
d. The site plan shall be revised to show the location of bicycle storage.
3) All new exterior lights must be downcasting and shielded and approved by the
Director of Planning and Zoning prior to installation. All non complying floodlights
lights shall be removed or replaced with downcasting and shielded light fixtures
approved by the Director of Planning and zoning prior to installation.
4) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
5) The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer before use of 1560 Spear Street as a bed and breakfast.
6) Any change to the site plan shall require approval by the South Burlington
Development Review Board.

I have reviewed the plans for the proposed conversion of a residential structure to
a three room bed and breakfast on Spear Street. I have also made a site visit to see where
this project is located. Though the plans are very preliminary they seem to be OK and I
have the following recommendations:
1. Compliance with all requirements of Vermont Labor and Industry Fire Prevention
Division codes and standards.
2. Installation of the necessary fire alarms required for an occupancy such as this.
At this point these seem to be the major issues which present themselves. As this
project moves forward additional items may surface which could be dealt with as needed
with the assistance of the owner and Labor and Industry.

This project consists of amending a site plan for a 3,500 square foot two story single
family dwelling, at 1560 Dorset Street. The amendment consists of converting the
single-family dwelling to a three (3) room bed and breakfast.
This property lies within the Southeast Quadrant District. It is bounded to the north,
south, and east by single-family residences, and on the west by Spear Street and Overlook
Park.
CONDITIONAL USE CRITERIA
The proposed project complies with the stated purpose of the Southeast Quadrant District
"To encourage open space preservation, scenic view and natural resource protection,
wildlife habitat preservation, continued use, and well planned residential use in the
largely undeveloped area...," and does not adversely affect:
a) The capacity of existing or planned municipal or educational facilities- no
effect expected
b) The essential character of the neighborhood or district in which the
property is located, nor the ability to develop adjacent property for
appropriate uses- no effect expected
c) Traffic on roads and highways in the vicinity -no effect expected
d) Bylaws in effect- no effect expected
e) Utilization of renewable energy resources -no effect expected
f) General public health and welfare -no effect expected
SITE PLAN CRITERIA:
Access/circulation: Access is provided via a 12 foot wide private drive off of Spear
Street. The circulation on site is inadequate for the proposed use. A single loaded
parking area requires a 22 foot wide aisle to accommodate cars pulling out of the spaces.
The applicant should revise the site plan to show a 22 foot aisle.
Coverage: The proposed building coverage remains unchanged at 4.4% (maximum
allowed is 20%) The proposed overall coverage is 10% (maximum allowed is 40%).
The front yard coverage is 5.3% (maximum allowed is 30%), and should be so noted on
the plan.

Parking: The minimum parking requirement is five (5) spaces, one space per guest
bedroom and two for the owners (2 + 3=5 spaces). The applicant is proposing seven
parking spaces. A single accessible parking space is required and should be so noted on
the plan, and on the site with appropriate signage. The width of an accessible space is 13
feet total. The plan should reflect the correct width for the accessible space. The site has
more than adequate parking and staff recommends two of the proposed spaces be
converted to a single accessible space.
Bicycle parking or storage facility is required, and should be noted on the plan.
Landscaping: There is no minimum landscaping requirement based on minimum
construction costs.
Lighting: Any floodlights or non-downcasting and non -shielded firxtures should be
removed or replaced with downcasting and shielded light fixtures approved by the
Director of Planning and Zoning prior to installation.
DumRsters: No proposed dumpsters.
10) SKETCH PLAIN, TWO LOT SUBDIVISIOIN, 1750 VAIN SICKLEIN ROAD
This project consists of a planned unit development, which includes: 1) a two (2) lot
subdivision, lot # I is 1.25 acres and lot #2 is 3.34 acres, 2) construction of four (4),
three (3) bedroom housing units in two (2) buildings on lot 92, and 3) a single-family
residence to remain on lot 91.
This property located at 1750 Van Sicklen Road lies within the Southeast Quadrant
zoning district. It is bounded on the north, east, and west by single family residential lots,
and on the south by Van Sicklen Road.
Access/circulation: Access is provided via a paved 18 foot private roadway. The
proposed roadway serves a multi -family residential lot, and serves four (4) units. The
preliminary plat plan should be revised to show any access drives located across Van
Sicklen Road. The preliminary plat plan should also show a turnaround at the end of the
private roadway.
Coverage/setbacks: Lot #1 proposed building coverage is 5.2% (maximum allowed is
20%). Overall building coverage is 9% (maximum allowed is 40%). Lot #2 proposed
building coverage is 4.3%, and the overall coverage is 12.8%. All setbacks are met.
Density: The allowable density for this project is 5 units as proposed. One of the units is
the existing single family dwelling (4.57 acres x 1.2 units/acre = 5.4 units).
The proposed density complies with Section 6.403 of the zoning regulations. The
developable area for lot #1 is .34 acres which results a maximum of 1.36 units on lot #1
(.34 acres x 4 units/ acre = 1.36 units). The developable area for lot 92 is 1.69 acres,
which results in a maximum of 6 units (1.69 acres x 4 units/acre = 6.76 units).

This project, consisting of approving Lot #1 with an existing single family residence located at
#1560 Spear Street in the city of South Burlington, Vermont is hereby approved under the
requirements of the regulations named above, subject to the following conditions.
GENERAL
1. The project shall be completed as shown on the plans "2 Lot Subdivision of Property
Belonging to Aurora Nowland" dated September 4, 1979 prepared by Palmer Company,
LTD. and which have been stamped "approved" by the Wastewater Management Division.
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
2. Each prospective purchaser of Lot #1 shall be shown a copy of the approved plot plan and
this Subdivision Permit prior to conveyance of the lot.
3. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the city
of South Burlington Land Records within 30 days of issuance of this permit and prior to the

approved by the city of South Burlington. No other method of wastewater disposal shall be

IN RE: APPLICATION OF JEN-FU AND LUCIA CHIU
This matter came before the South Burlington City Council
pursuant to the provisions of 24 V.S.A. §4410(d) on the
application of Jen-Fu and Lucia Chiu to construct improvements
in the City of South Burlington which fail to comply with the
"Interim Zoning Regulations" adopted by the Council on
April 17, 1989. The City Council conducted a public hearing
on this application on June 5, 1989. Jen-Fu and Lucia Chiu
were present at this hearing.
Based upon the evidence submitted at the hearing
mentioned above, the Council hereby renders the following
decision on this application:
FINDINGS OF FACT
1. Jen-Fu and Lucia Chiu are the owners of the property
which is the subject of this application which is commonly
know as 1560 Spear Street.
2. The subject property is located on the easterly side
of Spear Street, so-called.
3. By their application to the City Council Jen-Fu and
Lucia Chiu seek approval to expand an existing single-family
residence on the subject lot in accordance with plans filed
with the City Zoning Administrator.

CONCLUSIONS
The Interim Zoning Regulations prohibit the expansion of
existing structures. Since the applicants propose to expand
their existing residence, the proposed construction fails to
comply with the Interim Zoning Regulations. For this reason
this Council must review and approve the proposed construction
under the provisions of 24 V.S.A. §4410(d) and (e).
1. 24 V.S.A. §4410(e)(1) requires this Council to
consider the effect of the proposed use on "the capacity of
existing or planned community facilities, services or lands."
The proposed residence is connected to public sewer and water
services, both of which contain adequate capacity for the
expansion. Based on this, the Council concludes that
construction of the proposed expansion will not have an
adverse impact on the capacity of existing or planned
community facilities, services or lands.
2. 24 V.S.A. §4410(e)(2) requires this Council to
consider the proposed use with respect to "the existing
patterns and uses of development in the area." The proposed
residential structure is located in a portion of the City
developed with and zoned primarily for the construction of
single-family residences. Based on this, this Council
concludes that the proposed expansion is consistent with
existing patterns and uses of development in the area.
3. 24 V.S.A. §4410(e)(3) requires this Council to
consider the proposed use with respect to "environmental
limitations of the site or area and significant natural

resource areas and sites." Because the proposed residence is
served by public water and has adequate sewage disposal, this
Council concludes that there are no environmental limitations
on the site which preclude the proposed expansion. Further,
this Council concludes that the proposed development will not
occur on lands which will obstruct in any significant way
views of the Lake Champlain Valley including Shelburne Bay,
Lake Champlain, and the Adirondacks.
4. 24 V.S.A. §4410(e)(4) requires this Council to
consider the proposed use with respect to "municipal plans and
other municipal by-laws, ordinances or regulations in effect."
The Comprehensive Plan for the City of South Burlington
recommends that the City act to preserve public access to
views of Lake Champlain and the Adirondacks, with a strong
emphasis on City acquisition of scenic turnouts.
(Comprehensive Plan, dated 1985 - Aesthetics, History and
Cultural Resources Chapter). As already noted the proposed
development will not adversely impact these views. Based on
this, this Council concludes that the proposed development
complies with the Comprehensive Plan for the City of South
Burlington.
Zoning regulations in effect for the subject property
limit the maximum height of structures to 35 feet and
establish front yard, side yard and rear yard set backs. The
expansion proposed in this case will comply with these
dimensional requirements. Based on this, this Council

concludes that the proposed development complies with the
Zoning Regulations of the City of South Burlington.
5. 24 V.S.A. §4410(d) requires this Council to
determine whether the proposed construction is consistent with
the "health, safety and welfare of the municipality and the
standards contained in Subsection e." For the reasons set
forth in conclusions 1 through 4 above, this Council concludes
that the proposed project can be constructed consistent with
the health, safety and welfare of the City of South
Burlington.
DECISION
The request of Jen-Fu and Lucia Chiu pursuant to
24 V.S.A. §4410 to expand a single-family residence on Spear
Street, in accordance with plans filed with the Zoning
Administrator, is approved.
