DECISION do FINDING OF FACT
On the 24th day of October 1988 , the South
Burlington Zoning Board of Adjustment heard evidence regarding
the appeal of Brian Lloyd, 5 Adams Court
based on the following facts and findings:
1) The topograpky and interpretation of thp 7nninq rPqulatinns
would not enable reasonable use wiPhout filling the land,
thus changing the character.
2) Other buildings have finished grade which allows fnr
walkout basements, therefore -the characer of the area is not
affected.
3) Appellant purchased the land with the intent to cnnstruc-t
three story dwelling prior to recent interpretation of
height limitations.
4) Height limitations weren't intended to restrict constructinn
of residential dwellings.
