This project, consisting of constructing a four bedroom single family residence on a 2.5 acre lot
which shall connect to the sanitary sewer line extension approved by Water Supply & Wastewater
Disposal Permit #WW-4-0854and municipal water services located off Spear Street in the City of
South Burlington, Vermont, is hereby approved under the requirements of the regulations named
above subject to the following conditions.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from local officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:
Project No. 02179, Sheet 1 "Site Plan for Proposed House Property of Victor and Anne
Ratkus" dated May 30, 2002 revised 9-9-02 and Sheet 2 "Details for Proposed House
Property of Victor and Anne Ratkus" dated Sept. 2002 prepared by Civil Engineering
Associates, Inc.
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
No alterations to the building other than those indicated on the approved plan or Water
Supply and Wastewater Disposal Permit, which would change or affect the exterior water
supply, or wastewater disposal, or the approved use of the building shall be allowed without
prior review and approval from the Division of Wastewater Management.
4. The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 64 - Potable Water Supply and Wastewater System
Permit.
All conditions set forth in Water Supply & Wastewater Disposal Permit #WW-4-0854 shall
remain in effect except as modified or amended herein.

6. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations,
with this permit.
7. A copy of the approved plans and this permit shall remain on the project during all phases
of construction and, upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY & WASTEWATER DISPOSAL
The lot is approved for connection to the municipal water and wastewater disposal systems
as depicted on the approved plans. No other means of obtaining potable water or for the
disposal of wastewater shall be allowed without prior review and approval by the Wastewater
Management Division.
9. This permit, for the substantially completed potable water supply and wastewater system,
shall become valid upon receipt by the Wastewater Management Division of a signed and
dated certification from a designer or the installer which states: "I hereby certify that the
installation -related information submitted is true and correct and that, in the exercise of my
reasonable professional judgment, the potable water supply and wastewater system have
been installed in accordance with the permitted design and all permit conditions, were
inspected, were properly tested, and have successfully met those performance tests." This
shall include the sanitary sewer and water services from the mains to the single family
residence.

(Pursuant to Chapter I section 1.102(IV) and 1-201(M) of the Environmental Protection Rules)
"Minor projects" means a single lot subdivision and projects with a design flow of less than 600 gallons per
day where site conditions are favorable for on -site sewage disposal so that no site modifications are required.
Projects involving industrial waste shall not be considered minor projects.
For minor projects as defined in section 1-102 (N) where the consultant submits a certification with the
application stating that the project complies in all respects with these rules, the Division relied solely upon
the certification and application as submitted and that the permit may be revoked if it is determined that the
project does not comply with these rules as certified. False or misleading certification under this section shall
be a violation of these rules, and the statute(s) under which the application is filed, by the person completing
the certification.
The following shall be included in any certification submitted under this section:
"I hereby certify that the application submitted herewith is for a minor project as defined in the Vermont
Environmental Protection Rules, section 1-102 (N), that all the information submitted with this application
is true and correct, and that the design of this project complies in all respects with the Environmental

Dear Mr. Belair:
I own the property at 1460 Spear Street, occupied presently by William B. Ross. We are aware
that the lots across the street from us have a height restriction written into the zoning
ordinances, which is why the yellow house at 1645 (or 1635) is built somewhat down the slope
of the land.
I have been aware of much activity recently on the lot owned by Mr. Ratkus. I think the lot
number is 1465 Spear Street, just to the south of the house that has a mailbox numbered 1475.
Having lived in South Burlington for ten years, I have observed dump trucks and bulldozers on
the lot various times over the years, and this spring watched several more truckloads dumped on
the lot. While I don't know Mr. Ratkus personally, I have heard that Mr. Ratkus has spoken to
mutual acquaintances of building up the grade of the lot so when he applies for a building
permit, his land will start at a much higher grade than it would have been originally. There are
many trees on his lot that block the view of this activity.
Given that the land has been recently surveyed, I assume that Mr. Ratkus is considering his
building plans and may be planning to apply for permits shortly, if he hasn't just recently done
so. I spoke to the assistant to the zoning administrator in early May and was informed that no
application had been filed at that time. I would like the city to be aware of the activity, past and
present, on this lot and be sure that the correct height restrictions are met when approving a
building permit. I would also like to be notified when an application is filed, if this is possible.
Attached are photos of the lot taken in April, attempting to show the irregularities in the grade of
the land at that time.

Tuesday, 14 August 1990, at 7:30 pm, in the Conference Room, City

a. Mr. Weith said Howard Johnsons will be coming to the Zoning
Board to request a variance to subdivide property so the
restaurant would be on one lot and the rest of the building, on
the other. They want a setback variance and coverage variance
for the restaurant. This would allow the hotel to gain a lot -)f
undeveloped land so they can expand. Mr. Craig said it sounded
to him like they were trying to subvert the regulations. Mr.
Austin felt the Zoning Board should be alerted to the background
of this situation and that the Commission had asked Howard
Johnsons to put trees on th-e restaurant portion of the lot.
2. Minutes of 26 June and 10 Jul
Mr. Crai moved the Minutes of 26 June be a roved as written.
Ms. Peacock seconded. Motion passed unanimously.
In the Minutes of 10 July, it was noted that Mr. Giebink's name

Mr..-Ratkus showed the existing lot line and said they want to
move it north. A 1.6 acre lot would thus become 1.0 acre and a
1.9 acre lot would become 2.5 acres. He noted that the City
Engineer wants the sewer line extended 25 ft. to reach lot #1.
Mr. Ratkus said the request doesn't affect anything in terms of
view zones. Mr. Weith noted lot 2 would then be able to be sub-
divided. Mr. Craig noted that the City Engineer wants both lots
served by one driveway. Mr. Weith said that is a condition of

the original subdivision. Mr. Ratkus said it is not their in-
tention to create a third lot and would agree to a stipulation
that this will not happen.
4. Site Plan application of Atlantic Cellular/Cellular One -for
conversion of a vacant-7190 sq.-ft. building to cellular
telephone sales -and service use, 3 Baldwin Avenue
Mr. Rabinowitz located the property behind Wesson's Diner. The
building was formerly occupied by Regal Optical. The plan would
decrease the amount of paving. They will have 15 parking spaces.
Only 14 are required. They will ramp the existing paving into
the building. They have a handicapped ramp. They have tried to
do nothing on the residential side of the building. They have
added some maple trees and other screening for the residential
side. They will also add 3 more large maples near the ravine and
wooded area. The shape of the building will stay the same though
they will do some repair work to it. Two outside lights will be
added but light will not go off the property.
Mrs. Maher congratulated the applicant on the landscaping plan.
Mr. Rabinowitz noted he had talked with the City Engineer and
they are willing to put in the manhole.
Mr. Weith said they will be assessed the sewer allocation fee for
105 gpd and also a Shelburne Rd. intersection improvement fee.
Mr. Rabinowitz said the trash area will be fenced. There will be
no trailers for outside storage.
Mr. Austin moved the Planninq Commission approve the Site Plan

The lot is 6.4 acres and is located in the Mixed -Industrial and
Commercial District. The project is to convert an existing
single-family dwelling, consisting of 1716 square feet, to retail
use. A conditional use permit for this use was approved by the
Board of Adjustment on August 13, 1990 with the stipulation that
"should the use be for anything other than a florist that they
come back here for administrative approval".
Setbacks/coverage: The building to be converted meets all set-
back requirements. Only 12% of the front yard will be used for
driveways and parking and the regulations allows up to 30%.
Maximum lot coverage by buildings, parking and outside storage is
not being exceeded.
Access/circulation: The curb cut that was used by the single-
family dwelling will be eliminated. This results in there being
only one (1) 30 foot wide curb cut and drive providing access to
the property. This is the same as is presently serving Ray's
Homes. Circulation pattern is acceptable.
Parking: Eleven (11) parking spaces are required for the new
retail use and the plan shows eleven (11) spaces. The existing
Ray's Homes office would require two (2) spaces for a total
requirement of 13 spaces. The new spaces are 9' x 18' with a 25'
aisle. The three (3) parallel spaces along the entrance drive
are a little short for parallel spaces, it is recommended that
they be lengthened to 22 feet. I do not see a problem with
waiving 2 spaces. It is preferable to removing green space.

This proposal is to adjust a lot line between two (2) existing
lots owned by the applicants. The property is located on the
westerly side of Spear Street at the northerly end of Zone B of
the Spear Street View Protection Zone.

Development to the highest limits was not in South iurlington's best interests,
he felt. Mr. Xorency thought that the Commission had not had much choice in
tie matter. Site plan review, he said, is very specific about what the Commission_
can and cannot review. The things that Xessrs. 7evesque and Poger were addressing
were more applicable to the Zoning Board than the Commission. If all t-e
conditions such as access, landscaping, screening, etc. are met, the Co=ission
has no recourse. The Commission agreed with the feelings of Messrs. Foger and
revesque but felt that Xr. Aiorency was also correct. Xr. Wessel suggested that

Public hearing, final plat application of Mrs. Aurora "lowland for an 8 lot sub-
division, dear -treet
':r. tarry Wright represented Xrs. Nowland and said that they had complied with
all the requests made at the previous hearing. There is an 80' reserve strip
for a potential connector between Spear St. and Shelburne Road, a 60' right of 0
way across the bottom of the 6 lots connecting to the 17 acre parcel, and a 15'
pedestrian easement. The buyers will have pert tests done, the applicant will
cr 'gas tat=:ed to the City '_Engineer about storm drainage and the scenic turn -out.
The turn -out is on the east side of the road and is 100' deep and 201-' wide. The
final plat will show the entire parcel, and lots 7 and 8 will be planned and
developed as a unit. He repeated that they had met all the requirements and
told the Co=ission that Dick Spokes had said to tell the Commission that he was
satisfied with everything. There will be one curb cut for ever two
Paul Sutherland, an attorney or .e University of Vermont, said that TiJVX had
some serious objections to this plan. The land which contains the Horticultural
Farm is adjacent to this and the slope of the land is such that there is already
poling there and the University wants to be sure that the sewage systems, when
put in, will not allow seepage or pollution which could damage the things on the
Farm. They request the opportunity to review the engineering plans. For the
same reasons, they would like to look at plans for surface water discharge.
Another objection the University has to the plan is that under it, part of the
?sort Farm is surrounded by the 80'-strip, the 60' right of way and the 15'
pedestrian easement. They are worried about the effects of increased pedestrian
traffic around a carefully planted area with educational uses and special plants.
They already have problems with people in there. When Laurel Bill South went
in, they shared the cost of a cyclone fence with its developer to keep people out.
They would like to do the same with the :lowlands. Their final objection is that
if that 80' strip becomes a road, it will bisect the Fort Farm and do great
damage, and it does not seem necessary. ThelUniversity would like another site
for the road chosen.
Mr. Wessel said that, engineering plans were public and that he thought Uv;,; could
review them. Be as`ed if UVF•: had talked to the Nowlands about the fence and A:r.
Sutherland said t at t ey had talked in tpril about some 1_ndswappirg but had
not been able to agree on a price. Xr. Sam xiggans said that what was tr:ere now
as fa-- as a fence was totally inadequate and he said that the University does
have a problem with people and deer coming through. Mr. Wright pointed out that
most of the University's ob; ecticns did not come from the setting off of the lots,
but rather they arose from the city's request for easements, reserve strips, and
rig its of ::ay. He felt that it would be unfair for Airs. ,lowland to s,.;_re _-_e cost

it was about S5.85 per foot and that would be about 410,0C3 for each party. Drx.
Page said that the easement would probably not go in for some time. I1r.
Suterland said that if t'_.e fence were put uF between the Farm and the 6 lots,
the cost would only be about 52,000 apiece. Mr. Ewing felt that if the Commission
required a fence along the easement, every landowner could request one ar_d he
objected to the Commission requiring anyone to build a fence. Mr. Sutherland
said that the Universit; should not be considered -ust another landowner since
it .erfor:ed a public function and was different in other ways.
:r. Pcg.er moved to conclude tiie :;ublic Learing. :",r. Xorency seconded the motion
and it passed unanimously.
Kr. '.,'easel said that the reserve strip is in the :'aster Plan and that the Commis-
sion should leave it the way it is. :r. Korency agreed but felt that alternate
locat-43ns should be looked for and said that he would like to keep, the options

to look at sewer and drainage systems. - said that the Ccm^ission -wanted the
pedestrian easement and that at issue was the fence. Mr. Yorency suggested
moving the location of the easement away from the Farm and I.r. Page thought
that could be done if no one objected. 'Mr. Levesque felt that the fence issue
should be resolved between the city and the University. e,r. 'Morency said that
he was happy to get the easement and did not think Mrs. Lowland should have to
build a fence. He hoped that it could be placed where it was not a problem to
UVM but if not, he felt that the University should talk about a fence and perhaps
the city could help fund it. Mr. Poger said that the University was an asset
to the city but that he was not sure that the two should split the cost of a
fence even though he agreed that the Hort. Farm. should be protected. 111r. Ewing
felt that a developer should not have to build a fence on scmeone else's land
to benefit someone else. Mr. Wessel pointed out that the Ncwlands have given
the city quite a bit and that they are happy about that. He suggested trying to
move the easement and if that failed looking at the fence issue again when the
easement went in. Mr. Poger said that he felt there would be a problem and that
he would like to know that when it arose, it could be dealt with quickly. He
wanted to stress preservation of that green area and thought partial payment of
a fence might be good. Mr. Wessel wanted to wait until the easement was built.
Mr. Poger felt that this was a different situation because the Farm is a unique
piece of property and serves the public. Mr. Ewing said that other land served
the public and that he would not recommend paying for a fence.
Mr. idoolery moved that the South Burlington Planning Commission approve the final
plat application of Mrs. Aurora Howland for an 8 lot subdivision as depicted on
a plan entitled "Proposed Nowiand Property Subdivision - S ear Street". drawer}
by THR, dated 4 27 77, subject to the following stipulations:
1) The storm drainage easement be relocated to the vicinity of the south
line of lot �2, with"exact location to be determined by the City Engineer.
2) The plan to be recorded shall shcw lots 1 - 6 surveved in their
entirety, with the balance of the property shown clearly with the notation that
perimeter survey of lots 7 and 8 has not been cem,leted.
3) All corners of lots 1 - 6 shall have permanent markers set. -

Site Plan Review, 7. - Up Warehouse, Berard Drive
err. Berard located the property for t_e Commission. He said that waste water
will go into a galley and then into the Winooski but that it will be treated
and that they will have a permit from the 'cater Resources Board. Phosphates
taken from the water will be placed in the landfill area. Mr. Poger asked about
the storm drains and was told that they will not really hook up to they, and that
they are about 1000' from the river. Mr. Wessel was concerned about the effect
of outdoor lighting on the airport and Mr. Berard said that they would check it
out but did not anticipate a problem. ins. Page said that if there was a problem,
the Zoning Ordinance would have a provision for it. Mr. Woolery asked if this

was told that there would probably be 5 of their own and 1 trailer truck per day.
Mr. Woolery moved that the South Burlington Planning Commission approve the site
plan proposal of Mr. Rene Berard, for a soda bottling and warehouse facility,
as depicted on a plan entitled "New 7-Up building", by Gordon G. Woods Associates,
dated 9177, revised 10 3 77, subject to the following stipulations:
1) Bonds for landscaping, as deter=ired by the Zoning Administrator, and
roadway and utility extensions as deter:--ired by the City E'r_Eineer, shall be pc_'.:,.
2) Storm draira-e shall be reviewed and apLroved by the City Engineer.
3) A graveled turnaround shall be added to the end of the city, street.
4) s ap: royal s::all ex -ire 6 mcr_ths from this date.
The motion was seconded by Yr. Levesque and passed unanimously.
