Re: Findings of Fact, application of Victor and Ann Ratkus to
adjust the boundary between two (2) lots thereby creating two (2)
lots of 2.5 and 1.0 acres, 1485 and 1495 Spear Street.
On the 4th of September 1990, the South Burlington Planning
Commission approved the above referenced Final Plat under Section
202 of the South Burlington Subdivision Regulations based upon
the following findings:
1. This proposal is to adjust a lot line between two (2) exist-
ing lots owned by the applicants. The property is located on the
westerly side of Spear Street at the northerly end of Zone B of
the Spear Street View Protection Zone.
2. Area & Dimensional Requirements: Both lots will meet all
area and dimensional requirements.
Zoning Districts: Both lots presently lie within the R1 and R4
Districts. The proposed change will result in no portion of lot
#1 projecting into the R4 District and a greater portion of lot.
#2 lying within the R4 District.

The above calculations for the R1 and R4 Districts are approxi-
mate. The minimum lot size in the R4 District is 9500 square
feet. Since the R4 portion of lot 2 can now potentially be
divided into 2 lots instead of only one, subdivision approval is
required.
View Protection Zone: This boundary change will have no effect
upon the administration of the protection zone.
Traffic: The lots are located on Spear Street which is a high
volume roadway. The South Burlington Comprehensive Plan recom-
mends consolidation of curb cuts on high volume roadways.
Other: An existing sewer line crosses lot #2 and stops 25 feet
short of the proposed lot #1. The applicant's representative
indicated that it is the intent of the applicant to extend the line.
DECISION & CONDITIONS
Based upon the above findings of fact, the South Burlington Plan-
ning Commission hereby approves the Final Plat of Victor and Ann
Ratkus to adjust the boundary between two lots thereby creating
two lots of 2.5 and 1.0 acres as shown on a plan entitled "Pro-
posed Property Line Adjustment, Lots 1 & 2, 1485 and 1495 Spear
Street for Victor Ratkus," prepared by Fitzpatrick -Llewellyn Inc.
and dated June 1990, last revised 8/14/90 subject to the follow-
ing stipulations:
1. The stipulations contained in the subdivision approval dated
10/11/77 shall remain in effect.
2. Access to lots 1 and 2 shall be provided by one shared curb
cut on Spear Street.
3. The plat shall be revised prior to recording to show the 15
foot pedestrian easement extended over the western corner of lot
2 as shown on the approved plat recorded in map volume 105, page
84 of the South Burlington land records.
4. A plan showing the sewer extension profile and trench typical
detail shall be submitted to the City Engineer for approval prior
to recording.
5. The sewer construction work shall be done at the same time as
any building construction on either lot 1 or 2.
6. Lot 2 shall contain not more than one (1) single-family
residence as expressed by the applicant.
7. The revised plat shall be recorded in the South Burlington
land records within 90 days or this approval is null and void.
