HomeMy WebLinkAboutSP-03-42 - Decision - 0000 Hinesburg RoadCITY of SOUTH BURLINGTON DEPARTMENT of PLANNING & ZONING CHITTENDEN COUNTY TRANSPORTATION AUTHORITY — BUS SHELTER SITE PLAN APPLICATION #SP-03-42 FINDINGS of FACT AND DECISION The Chittenden County Transportation Authority, herein referred to as the applicant, is requesting Site Plan approval for one (1) bus shelter in South Burlington. Application #SP-03- 42 is for a bus shelter in the State Highway right-of-way south of the Salvation Army Store on Route 116. The South Burlington Development Review Board (DRB) held a public meeting on October 21, 2003. Based on testimony provided at the above mentioned public meeting and the plans and supporting materials contained in the document file for this application, the DRB finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is requesting Site Plan approval for a bus shelter south of the Salvation Army Store on Route 116. 2. The owner of record is the State of Vermont, Technical Services Division. 3. The proposed bus shelter location is in a State Highway right-of-way. General Review Standards (Section 14.06) Relationship to the South Burlington Comprehensive Plan: This application adheres to the goals of the South Burlington Comprehensive Plan, which promote bus service through the CCTA. The proposed bus shelter is in an intensively used compact area, where the Plan states bus services should be rendered. Relationship of Proposed Structure to the Site: The proposed structure is a standard CCTA bus shelter, measuring 36 square feet with a height of 8 feet six inches. The Development Review Board feels the structure accomplishes a desirable transition from structure to site, provides for adequate planting, and provides for safe pedestrian movement. Relationship of Structures and Site to Adjoining Area: Section 14.06(C)(1) of the South Burlington Land Development Regulations states that the Development Review Board (DRB) shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens, and visual interruptions to create attractive transitions between buildings of different architectural styles. As this is a bus shelter, the Development Review Board feels the proposed materials and architectural characteristics are suitable. Landscaping, buffers, screens, and visual interruption are not applicable to the proposed project. Specific Requirements for Bus Shelters (Section 13.09) A. Shelters may be constructed adjacent to or within street rights -of -way in any zoning district after approval of a site plan by the Development Review Board. The proposed bus shelter is located in a State Highway right-of-way along Hinesburg Road. B. The shelter shall be located to permit ample room for a bus to conveniently leave the traveled roadway to pick up or discharge passengers. As the proposed shelter is along Hinesburg Road, there should be ample room for busses to safely pick-up and discharge passengers. C. The design shall be harmonious with adjacent properties. The proposed design is a standard CCTA bus shelter. The Development Review Board feels this structure is harmonious with adjacent properties. D. The structure shall not have more than one (1) sign. This sign shall not exceed two (2) square feet in area. The proposed structure does not include a sign. E. Other The applicant has received a letter from the Vermont Agency of Transportation, Utilities and Permits Unit, stating that proposed bus shelter meets all requirements for work within the highway rights -of -way. DECISION Motion by Mark Boucher, seconded by Gayle Quimby, to approve Final Plat Application #SD- 03-42, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect, except as amended herein. ti'A.- 2. This project shall be completed as shown on the plans submitted by the applicant, as amended by this decision, and on file in the South Burlington Department of Planning & Zoning. 3. The applicant shall obtain a zoning permit within six (6) months from the date of this decision, pursuant to Section 17.04(B) of the South Burlington Land Development Regulations. 4. The applicant shall obtain a certificate of occupancy prior to use or occupancy of the structure. 5. Any changes to the site plan shall require approval of the South Burlington Development Review Board.
