HomeMy WebLinkAboutVR-96-0000 - Decision - 1475 Spear StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 13th day of May, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Daniel and Martha Ferraris, 1457 Spear Street. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-1 District. 2) Section 25.00 Dimensional requirements requires a minimum side yard of twenty-five (25) feet. 3) The proposed addition 12'x 22' screened porch with a four (4) foot overhang to be constructed to within sixteen ( 16 ) feet of northerly side yard. 4) Lot contains 1.3 acres with 172 foot frontage. 5) The property is developed with a 301x 70' single family dwelling and a attached 24'x 36' garage. Conclusion 1) The configuration of the lot and location of the structure prevents the development of a porch to the north side of the property without a variance. 2) The property lines do not run perpendicular to the street. The irregularity prevents development in conformity. 3) Will not be a detriment to the neighborhood. The addition is in keeping with the character of the area. 4) Construction of the house occurred in the 1950's before setback requirements, hardship created by others. 5 ) Proposed porch can not be located to the southerly side of the house due to the floor plan ( bedrooms located on south side) . 1 Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a 12'x 22' screened porch with a 4 foot overhang to within sixteen (16) feet a of ortherly side yrd, located at 1475 Spear Street.
