HomeMy WebLinkAboutCU-96-0000 - Decision - 1455 Spear StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 25th day of March, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of John and Kim Kane, 1455 Spear Street, also attending this meeting was Francis Sullivan, Architect and Dr. Martin Koplewitz. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R1 District. 2) Section 26.65 Multiple uses and structures requires conditional use approval by the Zoning Board of Adjustment. 3) The applicant is proposing to demolish an existing structure retaining 400 square feet ( former summer cottage) and occupy said structure as a craft studio. 4) The minimum dimensional requirements requires side yards of twenty-five (25) feet, the existing side yard is five (5) feet. 5) Total lot area being 4 acres with 240 feet frontage. 6 ) A new single family residence will be constructed on this site in total compliance with zoning by-laws. 7) Municipal sewer and water is available to the lot in question. Conclusion 1) The cottage in question is unique and has historical value, applicant wishes to preserve it and occupy as a studio. 2) In order to retain the cottage in its present location, a variance is necessary. 3) Planned improvements to the structure should enhance the neighborhood. 4) The proposed improvements to the entire lot will significantly 5) The cottage pre-exist zoning bylaws, constructed as a summer cottage in 1930's. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to renovate a 400 square foot summer cottage and convert to a craft studio in conjunction with the construction of a new single family dwelling, located at 1455 Spear Street.
