Thank you for your cooperation. From: Paul Conner Sent: Wednesday, October 24, 2018 1:39 PM To: Kevin Dorn <KDorn@sburl.com> Subject: BlackBay Ventures / David Shenk Dear Kevin — The City recently issued a zoning permit for construction of 12 dwelling units at 451-495 Market Street. In issuing the permit, we made a clerical error in regards to Recreation Impact Fees and Police Impact Fees by treating the development as though it were one 12-unit building rather than four 3-unit buildings. We under -collected on these two. The net difference in the impact fees collected is as follows: Recreation Impact Fees: $497.11 per unit or $5,965.32 Police Impact Fees: $137.75 per unit or $1,653.00 Pnr our discussion, I recommend we do the following: 1. Fully fund the revenues for the Impact Fees for the project 2. Pursuant to the City Council's fee schedule, reduce zoning permit fees by $7,618.32 from the zoning permit fees on the project. The fee schedule allows the City Manager, upon recommendation from the Director of Planning & Zoning, to waive all o v) a portion of the zoning fees for a project due to extenuating circumstances. In this instance, the extenuating circumstances are tied directly to the recently -adopted inclusionary zoning requirements. The City had not, prior to the receipt of this application, had the chance to prepare a legal "template" or guide for applicants to use. The applicant in this case therefore developed one of their own and extended time and resources modifying it. The City can use this template moving forward to save future staff resources. Please let me know if you have any questions, or if you concur with staffs analysis and recommendation. Sincerely, Paul Paul Conner, AICP Director of Planning & Zoning City of South Burlington 575 Dorset Street South Burlington, VT 05403 (802) 846-4106 www.sbvt.gov Notice - Under Vermont's Public Records Act all e-mail, e-mail attachments as well as paper copies of documents received or prepared for use in matters concerning City business, concerning a City official or staff, or containing information relating to City business ore likely to be regarded as public records which may be inspected by any person upon request unless otherwise made confidential by law.
