The number of vehicles entering and exiting the parking lot was counted between the hours of 4;00 and 6:00 PM, which is typically the busiest time for the hospital. Other Business: Mr. Weith advised members that next week's meeting has been cancelled as it is election night. 2. Minutes of 13 April 1993: Ms. Peacock moved the Minutes of 13 April be approved as written. Mrs. Maher seconded. Motion passed unanimously. 3. Site Plan Application of Brown Animal Hospital for con- struction of a 8400 sq. ft. building for animal hospital and kennel use and a 225 sq. ft. accessorty building for crematory, 8 Calkins Court: Mr. Rabinowitz said the proposed facility will replace the existing facility. He said the actual size is closer to 7,000 sq. ft. It will be one story, wood frame. There will be paved parking for 31 cars which is more than required. The fire chief has had input on the 30 ft. access road. The entrance will be on the south side of the building. They are adding a kennel for boarding dogs. An additional handicapped space will be added on the other side of the entry. Mr. Austin moved the Planning Commission approve the site plan application of Brown Animal Hospital for construction of a 7,200 sq• ft. building for animal hospital and kennel use and a 225 sq. ft. accessory building for crematory as depicted on a plan entitled "Brown Animal Hospital," prepared by Brad Rabinowitz Architect and dated 3/16/93,_last revised 5/1/93, with the following stipulations: PLANNING COMMISSION 11 May 1993 page 2 1. All previous approvals and stipulations which are not super- seded by this approval shall remain in effect. 2. The applicant shall post a $13,000 landscaping bond prior to issuance of a zoning/building permit. The bond shall remain in effect for three years to assure that the planted landscaping takes root and has a good chance of surviving. 3. A sewer allocation of 1,635 gpd is granted. The applicant shall pay the required sewer allocation fee prior to issuance of a zoning/building permit. 4. All exterior lighting shall be downcasting and shielded and shall not cast light beyond the property line. Any change in existing lighting or new lighting shall be approved by the City Planner prior to installation. 5. The applicant shall contribute prior to issuance of a zoning/ building permit $4,040 to the Williston Road Area 2 Improvement Fund based on the 28 peak hour trip ends estimated to be gener- ated by the project. 6. The plan shall be revised prior to issuance of a zoning/ building permit to show one additional handicapped parking space. 7. The applicant shall obtain a zoning/building permit within six months or this approval is null and void. 8. Public Hearing: Preliminary Plat applicatioin of Hannaford Brothers Company for a twelve building planned commercial de- velopment consisting of a new 64,000 sq. ft. supermarket, new 107,806 sq. ft. department store, 79,740 sq. feet of new retail space, a new 95 room hotel, a new 6,000 sq. ft. restaurant, a new 2,500 sq. ft. bank with drive through service, an existing 6,014 sq. ft. restaurant and existing 6,150 sq. ft. fast food restaurant with drive through service, on 41.9 acres of land, Southland, Shelburne Road: Mr. Austin stepped down during this public hearing due to a conflict of interest. The Municipality shall not file with the Bank a statement of default until sixty (60) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 9. All monies released by the Bank to the Municipality pursuant to paragraph 6 shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgment of the Municipality shall accomplish the work most expeditiously and economically. 10. Site Plan application of Brad Rabinowitz to amend a previously approved site plan by revising the parking layout and making other minor modifications. The site is developed with a 7,900 sq. ft. animal hospital, 8 Calkins Court: Mr. Rabinowitz noted there were several issues: a) The applicant had a chance to save several large trees by mod- ifying the parking layout. They left out one or 2 spaces from what was in the plan. They are still above the requirement. b) They reduced the size of the building by about 500 sq. ft. c) They extended the roof over the dumpster. Mr. Weith said they still meet the landscaping requirement. There is, however, a question of substandard parking spaces which are too narrow (8.5 ft. instead of 9 ft). He recommended the plan be revised to show the correct dimensions of the parking spaces. Mr. Austin moved the Planning Commission ap rove the site plan application of Brad R binowitz to amendagreviouslyapproved__ site plan by revising the parking layout and making other minor modifications. Sketch plan application of Germaine LeClair to construct two single family dwellings on a 43,560 sq. ft. lot as a PUD on a lot currently developed with a single family dwelling and a large accessory structure, 185 Patchen Road: Mr. LeClair and Mr. Morin explained that this is the former Melna property. The LeClair lot backs up to Summer Woods. The plan is to build a structure for Mr. LeClair's mother and another house on the lot. They have had a problem getting plans of the Arbor Road area of Summer Woods. They want to tap into water and sewer lines, and they need the plans for this. The applicant is also asking the Commission to waive the 50 ft. setback because the lot is only 100 ft. wide. Enclosed is the siteplan for the referenced project - in both 24" x 36" and 11" x 17" format. This has been updated to address changes during construction and to address your letter expressing concern over inconsistencies with the approved Drawings. 2. Also enclosed are a site plan application for the amended site plan and a check for $25. 3. Landscaping: Due to efforts to save and work with existing trees, the landscaping is quite in excess of that indicated on the original site plan. A. The main change from the approved drawings was that we were able to save several oaks of significant size (14"+!; some 8-9") at the west end of the building. Due to this, we deleted the new trees that were scheduled for this area. (1) To accommodate the largest of this group, we needed to alter the parking island, to allow existing grades at this oak tree. We shifted one handicap space- putting two adjacent. (2) In reviewing the parking striping, we did inadvertently eliminate 2 spaces. There is room to add these two on the existing paving. However, I believe we do exceed the number required and we would prefer leaving the striping as is. B. Planting beds were added in 3 areas in excess of the approved plan: (1) One on either side of the entry area and a third at the major oak that was saved. C. Also, on the east end of the building, several existing pines and oaks were maintained in addition to the new planting. 4. Building Footprint: A. The footprint is identical to that submitted on the plan. (1) An additional light, as submitted, was added at the east end of the building at the trash area. B. Lighting was added to the rear of the building. We did fail to submit this at the time of the permit. They are indicated on the enclosed siteplan and cuts are also enclosed. Please let me know if this is a problem. They are intended mainly as security lights and also as an aid since they do walk some of the animals in their woods behind the building. C. A light was added over the employee entrance. This is indicated on the enclosed siteplan and cuts are enclosed. 6. The above items are intended to address the concerns noted in your letter of September 1, 1994. This particular development is more complex than most because of the mixture of residential and commercial. The entire parcel is 33.53 acres and to satisfy density requirements at least 21.4 acres (7 units per acre divided by 150 units = 21.4) must be allocated to the residential portion. This leaves 10.04 acres for the commercial portion. The maximum building coverage and lot coverage for residential uses in this zone is 20% and 40%, respectively. At 20% maximum building coverage, 21.4 acres allows a maximum of 186,437 square feet of building footprint. At 40% maximum lot coverage, 372,874 square feet of overall coverage is allowed.
