Howe of South Burlington in the County of Chittenden and State of Vermont, Grantor, in the consideration of TEN OR MORE Dollars paid to her full satisfaction by Sally D. Howe and Richard M. Rogers and Elizabeth O'Gorman Rogers dated June 14, 1996 and recorded in the City of South Burlington Land Records at Vol. 394, Pages 422-423 on June 19'h, 1996 and being further described therein as follows, viz: Being all and the same land and premises conveyed to William R. Rogers and Elizabeth O'Gorman Rogers by Warranty Deed of Peter W. Levinsky and Candace C. Levinsky dated 8/26/92 and of record in Volume 329, Pages 363-365 of the Land Records of the City of South Burlington and being more particularly described therein as follows: Parcel I: A lot of land, with all buildings thereon, situated on the northerly side of Woodbine Street, the dwelling house thereon being known and designated as No. 12 Woodbine Street, having a frontage on said Woodbine Street of seventy-five feet (75') and a depth of ninety-five feet (95'), and being a portion of Lot 26 as laid down in a plan of Mayfair Subdivision showing Section "A" dated July, 1939, and recorded in Volume 11, Page 201 of the City of So. Burlington Land Records.' Said Parcel I being all and the same land and premises conveyed to Peter D. Levinsky and Candace C. Levinsky by Warranty Deed of Robert J. Cotter, Jr. and Lesley E. Cotter (f/k/a Lesley E. Orndorff) dated July 2, 1990 and recorded in Volume 295, Page 325 of the City of South Burlington Land Records. Parcel Il: A parcel of land measuring 36 feet in length and 75 feet in width contiguous and adjoining the rear boundary of said Parcel 1. Said Parcel II being a portion of the land conveyed to James S. Billings and Charlene M. Billings by Executor's Deed of David A. Lavalette, Executor of the Estate of Donald W. Lavalette dated May 30, 1989 and recorded in Volume 279, Pages 424-425 of the Land Records of the City of South Burlington, Vermont. Further having all the same land conveyed to Peter and Candace Levinsky by Quit -claim Deed of James S. Billings and Charlene M. Billings dated June 26, 1991 and recorded in Volume 307, Page 346 of the Land Records of the City of South Burlington, Vermont. ` This parcel is subject to Deferral Permit DE-4-1586 dated 6/17/91 dated 6/17/91 and recorded in Volume 307, Page 343 of the City of So. Burlington Land Records, and is further subject to the "Waiver of Development Rights" of record. Parcel I and Parcel 11 are both subject to certain Protective Covenants recorded on 9/25/40 in Volume 11, Page 204 of said Land Records, and as amended by instrument recorded on 1/30/67 in Volume 69, Page 381 of said Land Records. Said land and premises are subject to a waterline easement and right of way from Arthur Elsom to the Town of So. Burlington dated 5/14/40 and recorded in Volume 18, Page 66 of said Land Records. Said land and premises may be subject to a sewer easement to the Town of South Burlington dated 7/28/66 and recorded in Volume 78 at Page 433 of said Land Records. Said land and premises are also subject to an easement for the original Mayfair Park Storm -water system approximately as shown on "Plan of Mayfair Park, South Burlington, VT, showing Drainage system" prepared by Hoag, Stone & Associates, Engineers, Burlington, VT. Dated Feb., 1946, Scale: 1"=100' and recorded June 26, 2012 in the City of South Burlington Land Records in Map Slide 564, Page 4. As shown on this Plan, the location of the pipe as it crosses the northerly portion of the original Lot 26 differs from the actual "as built" location of the pipe which is located more southerly on the lot much closer to the buildings thereon. The 8 inch underground pipe for this system enters the property along its westerly boundary from Lot 25 as Lot 25 is laid down in a plan of Mayfair Subdivision showing Section "A" dated July, 1939, and recorded in Volume 11-1, Page 201 of the City of So. Burlington Land Records. Lot 25 is currently owned by Brian B. and Anne S. McKenzie by Warranty Deed dated May 9, 1991 and recorded at Volume 306, Pages 378-380 of the City of South Burlington Land Records. The pipe's westerly location can be established by a so-called above -ground "clean -out" several feet inside the property. The pipe then skirts the outside of the underground footing of a new basement under a new addition to the building on its northerly side which was constructed in 2011. There is a second above -ground "clean -out" just outside the northeast corner of the new addition. The pipe then redirects to a third above -ground "clean -out" just inside the easterly boundary of the property before exiting the property along its easterly boundary to a storm drain located close by on adjoining Lot 27 as Lot 27 is laid down in a plan of Mayfair Subdivision showing Section "A" dated July, 1939, and recorded in Volume 11, Page 201 of the City of So. Burlington Land Records. Lot 27 is currently owned by Lionel A. and Barbara M. Deslaurier by Warranty Deed dated July 22, 1987 and recorded in the City of South Burlington Land Records at Book 248, Pages 243-244. This conveyance is made subject to and with the benefit of any utility easements, spring easements, easements for ingress and egress, covenants, and rights and obligations incident to each of the same as may appear more particularly of record, provided that this paragraph shall not reinstate any such encumbrances previously existing and extinguished by the Marketable Record Title act, Chapter 5, Subchapter 7 of Title 27, Vermont Statutes Annotated and any amendments thereto. Reference is hereby made to the afore -mentioned or afore -referenced deeds, instruments, maps and land records, the records thereof and the references therein made, in further aid of this description.
