HomeMy WebLinkAboutSP-17-13 - Decision - 1250 Spear Street#SP-17-13 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING TRUSTEES OF THE DIOCESE OF VERMONT — 1250 SPEAR STREET SITE PLAN APPLICATION #SP-17-13 FINDINGS OF FACT AND DECISION Trustees of the Diocese of Vermont, hereinafter referred to as the "Applicant", is seeking approval to amend a previously approved plan for a 5,620 sq. ft. place of worship. The amendment consists of: 1) eliminating the southerly curb cut, and 2) widening the remaining northerly curb cut to 24 ft., 1250 Spear Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. Trustees of the Diocese of Vermont are seeking approval to amend a previously approved plan for a 5,620 sq. ft. place of worship. The amendment consists of: 1) eliminating the southerly curb cut, and 2) widening the remaining northerly curb cut to 24 ft., 1250 Spear Street. 2. The owners of record of the subject property are Trustees of the Diocese of Vermont. 3. The subject property is located in the Residential 2 Zoning District. 4. The application was received on February 27, 2017. 5. The plan submitted is entitled "All Saints Episcopal Church 1250 Spear Street South Burlington, VT", prepared by Civil Engineering Associates, Inc., dated 08/09/16, and last revised on 02/24/17. DIMENSIONAL REQUIREMENTS 6. Overall coverage will decrease to 14.3% (maximum allowed is 40%). 7. Setback requirements will continue to be met. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following_ general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. - 1 — #SP-17-13 PARKING 8. The parking spaces are not currently striped but will be striped as shown on the approved plan as part of the improvements proposed. The striping of the spaces will result in a total of 66 spaces, five (5) of which will be handicapped spaces. No additional pavement will be added to the parking area resulting from the elimination of the curb cut so parking will essentially remain the same. ACCESS 9. The property currently has two (2) curb cuts on Spear Street. The applicant is proposing to remove the southerly curb cut (closest to the intersection) and widen the remaining curb cut to 24 ft. The Public Works Director has reviewed the plan and stated in an email dated 2/2/17 that the plan is "an overall improvement to the site". OTHER 10. Snow storage areas are not shown on the plan so the plan will have to be revised to show all snow storage areas. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-13 of Trustees of the Diocese of Vermont, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The site plan must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plan must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to show the snow storage area(s). 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to using the striped parking spaces. 6. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. -2— #SP-17-13 7. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
