Snyder-Braverman Development Company, LLC has submitted sketch plan application #SD-21-12 to subdivide
an existing 11.9 acre lot into four lots of 9.4 acres (Lot L), 1.0 acres (Lot M4), 1.2 acres (Lot M5), and 0.4 acres
(Lot M6) for the purpose of constructing projects on each of Lots M4, M5 and M6, which will be reviewed
under separate site plan application, 311 Market Street.
The Board began review of the application on April 20, 2020 and continued the meeting to review additional
submitted information pertaining to connections to adjoining properties.
Subdivision standard #8 reads as follows.
(8) Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting
have been designed in a manner that is compatible with the extension of such services and infrastructure to
adjacent properties. For Transect Zone subdivisions, this standard shall only apply to the location and type of
roads, recreation paths, and sidewalks.
The City plan includes a pedestrian connection across the wetland on proposed Lot L to the existing City Center
Park on Barrett Street.
15.12D(4) Connections to adjacent parcels.
(a) If the DRB finds that a roadway or recreation path extension or connection to an adjacent
property may or could occur in the future, whether through City action or development of an adjacent
parcel, the DRB shall require the applicant to construct the roadway to the property line or contribute
the cost of completing the roadway connection.
(b) In determining whether a connection to an adjacent property may or could occur, and the
location and configuration of such connection, the DRB may consider:
(i) The existence of planned roadways or recreation paths in the City’s Comprehensive Plan,
Official Map, or these Regulations;
(ii) The requirements of the Zoning District in which the adjacent property is located and
whether these Regulations allow additional development or development density on the adjacent
parcel;
(iii) The context of the proposed development’s setting in relation to the adjacent property;
(iv) The presence of physical obstacles to such a connection, such as wetlands, water bodies,
or steep slopes;

(v) The presence of legal restrictions to development or use on the adjacent property; and/or;
(vi) Any other information it deems necessary to make its determination.
On April 20, the applicant argued that the City should be responsible for constructing the connection to City
Center park because the “City Center – Dumont Park Phase A Alternatives Summary & Recommendations” report
prepared by LandWorks refers to the connection as an element of the City Center Park. City Council resolution
R-2015-5, entitled “A Resolution Approving a Preferred City Center-Dumont Park Project Preferred Concept,
Circulation Plan and Land Acquisition,” included in the April 20 packet for the Board, approves ONLY the
following.
1. A preferred park concept for Dumont Park as shown in Exhibit B1.
2. A preferred circulation plan as shown in Exhibit A1.
3. Exploration of land acquisition of the parcel directly to the west of and adjacent to Dumont Park.
No element of the City Council resolution approves the full recommendations of the LandWorks study, consistent
with typical practice of the City Council, DRB and Planning Commission regarding consultant reports, nor does it
indicate who is responsible for construction of the park. Therefore, Staff considers the Board’s direction to the
applicant should be based only on the Land Development Regulations and not by the contents of the LandWorks
report other than those elements adopted by City Council.
Staff notes the City is not the owner of the lands on Lot “L” depicted in Exhibit B, nor does the City intend to
acquire those lands. As described in the notes for the April 20 meeting, Staff considers that since City Center
Park exists today, 15.12D(4) requires the applicant to construct the connection to City Center Park to the limit of
the applicant’s property.
Since there is no development proposed on Proposed Lot “L,” Staff recommends the Board consider whether
instead of actual construction as required under 15.12D(4), they will allow the applicant to instead provide a
conceptual connection design sufficient to demonstrate feasibility in horizontal and vertical space, and to provide
a 30-ft wide easement to the City centered on the connection, at the next stage of review. As previously noted,
the provided design should demonstrate compliance with the approved wetland impact permits, including DRB
conditional use approval #CU-18-01, State wetland permit #2013-293, State stormwater permit 7736-INDS.A, Act
250 permit #4C0503-11, and all other applicable approvals.
