This project, consisting of the proposal to demolish four old farm structures and replace them with 3 new buildings,
resulting in no additional flows from the pre-existing farming operations, (150 milking cows, 14o dry/replacement cows,
milking/cleaning flows, 9 employees), construction of new water service lines and wastewater collection system, and
connection to existing municipal water and wastewater disposal services, located on 490 Spear Street in South Burlington,
Vermont, is hereby approved under the requirements of the regulations named above subject to the following conditions.

This permit does not relieve the landowner from obtaining all other approvals and permits PRIOR to construction
including, but not limited to, those that may be required from the Act 25o District Environmental Commission;
the Drinking Water and Groundwater Protection Division; the Watershed Management Division; the Division of
Fire Safety; the Vermont Department of Health; the Family Services Division; other State departments; or local
officials.
The conditions of this permit shall run with the land and will be binding upon and enforceable against the
landowner and all assigns and successors in interest. The landowner shall record and index this permit in the
South Burlington Land Records within thirty, (3o) days of issuance of this permit and prior to the conveyance of
any lot subject to the jurisdiction of this permit.
The landowner shall record and index all required installation certifications and other documents that are
required to be filed under these Rules or under a specific permit condition in the South Burlington Land Records
and ensure that copies of all certifications are sent to the Secretary.
No permit issued by the Secretary shall be valid for a substantially completed potable water supply and
wastewater system until the Secretary receives a signed and dated certification from a Vermont Licensed Designer
that states:

"7 hereby certify that, in the exercise of my reasonable professional judgment, the installation -related
information submitted is true and correct and the potable water supply and wastewater system were
installed in accordance with the permitted design and all the permit conditions, were inspected, were
properly tested, and have successfully met those performance tests",
or which otherwise satisfies the requirements of §I-3o8 and §1-9i1 of the referenced rules.
1.6 All conditions set forth in Permit Numbers WW-4-0544, WW-4-0544-2 and ww-4-0544-3 shall remain
in effect except as amended or modified herein.
1.7 This project is approved for the demolition of four old farm structures and replacement with three new buildings,
construction of new water service lines, and wastewater collection systems, connecting to existing municipal
services, resulting in no additional flows on the existing 67.4 acre lot.
1.8 Construction of additional nonexempt buildings, including commercial and residential buildings, is not allowed
without prior review and approval by the Drinking Water and Groundwater Protection Division and such approval
will not be granted unless the proposal conforms to the applicable laws and regulations. No construction is
allowed that will cause non-compliance with an existing permit.
1.9 Each purchaser of any portion of the project shall be shown a copy of the Wastewater System and Potable Water
Supply Permit and the stamped plan(s), if applicable, prior to conveyance of any portion of the projec to that
purchaser.
1.10 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the
property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with the Vermont
environmental and health statutes and regulations, and permit conditions.
1.11 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of
issuance of this permit in accordance with to V.S.A. Chapter 22o and the Vermont Rules of Environmental Court
Proceedings.
2.WATER SUPPLY
2.1 The components of the potable water supply herein approved shall be routinely and reliably inspected during
construction by a Vermont Licensed Designer who shall, upon completion and prior to occupancy of the associated
building, report in writing to the Drinking Water and Groundwater Protection Division that the installation was
accomplished in accordance with the referenced plans and permit conditions, as specifically directed in Condition
#1.5 herein.
2.2 This project is approved for connection to the water supply system owned by the Champlain Water District
(VT0005092) for a maximum of 9612 gallons of water per day.
2.3 The landowner shall install and maintain backflow prevention devices that conform to Vermont Department of
Public Safety standards and NFPA 13 for any connection of a sprinkler fire suppression system to a public
drinking water system:
2.4 This permit is based, in part, on a municipal approval for connection to their water distribution system. If the
municipal approval expires, this permit shall be invalid unless the municipality rei,ews its approval. If the
municipality approval expires, a new permit must be issued for the project. An updated application form and an
application fee will be required for the project. A new municipal approval letter shall be required. The rules in
effect at the time of the filing of the application for a new permit will be applied to the project.
3WASTEWATER DISPOSAL
3.1 The components of the sanitary wastewater system herein approved shall be routinely and reliably inspected during
construction by a Vermont Licensed Designer who shall, upon completion and prior to occupancy of the associated
building, report in writing to the Drinking Water and Groundwater Protection Division that the installation was
accomplished in accordance with the referenced plans and permit conditions, as specifically directed in Condition
#1.5 herein.
3.2 This project is approved for connection to the City of South Burlington wastewater treatment facility as depicted
on the plan(s) stamped by the Drinking Water and Groundwater Protection Division. The project is approved for a
maximum of 9612 gallons of wastewater per day.

3.3 This permit is based, in part, on a municipal approval for connection to their wastewater treatment facility. If the
municipal approval expires, this permit shall be invalid unless the municipality renews its approval. If the
municipality approval expires, a new permit must be issued for the project. An updated application form and an
application fee will be required for the project. A new municipal approval letter shall be required if the project is
served by the municipal wastewater collection system. The rules in effect at the time of the filing of the
application for a new permit will be applied to the project.

Dear Joe:
In keeping with our informal policy of updating your office on university
agricultural projects, Greg Eurich, Manager of UVM Farms has proposed for
immediate construction a concrete bunk silo structure (30'w X 2001) at the south
side of the Miller Farm facility. Greg plans to slope the soil up along the
perimeter of the 10' high sidewalls. All soil will be seeded.

RE: Miller Horse Farm, Spear Street — Riding Ring Location
Dear Joe:
UVM's College of Agriculture and L ife Sciences recently received internal university
planning approval for the relocation of their outside horse ring. The ring is currently
located south of the white house with a proposed location east of our new Horse Barn.
Although the project, due to its agricultural status, does not require formal South
Burlington City review, it is our current practice to share our projects with your office for
comment. After our recent telephone discussion, you did not indicate any potential
issue with the project, but requested a project description and site plan for your files,
which follows:
PROJECT SCOPE
The ring is 220 feet by 120 feet with 45-foot radii. The reason for moving the horse ring
is twofold -- the most important being safety. Presently horses must be walked from
the new horse barn south past the dairy operation, which often uses tractors and other
equipment. In addition, there is vehicular traffic to contend with which is entering and
departing the dairy complex, as well as this being an area where city police cars park for
radar monitoring of passing vehicles (which sometimes means the use of sirens.)
Secondly, this relocation would allow us to store jumps and other support materials, and
to consolidate horse activities in one area. The visual appearance will be the same as
the present ring, with fencing matching the existing.

RE: 24 V.S.A. §4495 Farming Exemption
Dear Larry:
You have asked for a determination if the University of Vermont barns in South Burlington are
"agricultural structures" and are exempt from municipal regulation pursuant to 24 V.S.A. §4495(b).
You have also asked if the cultivation of the 350 acres associated with the barns is an "accepted
agricultural practice" and likewise exempt from municipal zoning jurisdiction.
The University farms' land and facilities are used for the production of corn, hay, and pasture to
feed the dairy cows and horses at the Miller Center, and in the production of fruits, vegetables, and
ornamentals at the Blasberg Center for Horticulture_ These activities are an integral part of the teaching,
research, and extension activities of the College of Agriculture and Life Sciences.
Under certain circumstances, 24 V.S.A. §4495 exempts agricultural activities and buildings from
regulation under a zoning plan or bylaw. In order to satisfy that requirement, however, the agricultural
activity must be one that is an accepted agricultural practice as defined by the Commissioner of
Agriculture, Food and Markets in the Accepted Agricultural Practice Rules. The University's farming
activities are accepted agricultural practices. Furthermore, the barns and ancillary structures qualify as
farm structures and are likewise exempted from municipal zoning regulation.
In order to maintain the exemption relative to 24 V.S.A. §4495, the University must conduct the
farming enterprise in accordance with these regulations. I enclose a copy of the A,.APs.

The University wishes to construct two new silos at the Miller Research
Farm on Spear Street in South Burlington. Both silos would exceed the
present height limitation of thirty-five feet; one being 60 feet, and
the other 90 feet. I understand that the revised zoning ordinance, now
pending before the City Council, would exempt agricultural uses from
the height restriction, and that the Council could grant the University
a variance permitting the construction.
I wish to apply for this variance on behalf of the University. Accompa-

Re: Conditional use - Miller Miller Research Farm, Spear Street

This proposal includes the construction of two silos at the
U.V.M. farm on Spear Street. Both s."I" exceed the height limit-
ations allowed under the present zoning, maximum height 35 feet.
One silo being 60 feet will replace an existing 45 foot unit,
the second silo is 90 feet in height, two other units are in the
same location, they are at 45 feet.
Under the proposed zoning (Section 19.112 subsection f) height
limitations will not apply to farm buildings.
