westerly side of Spear Street and more particularly described as follows:
Commencing at a point on the westerly side of Spear Street, which point is the
southeast corner of land nova or formerly owned by Morty and Rhoda Kaufman; thence
proceeding in a general westerly direction along the southerly boundary of said
heretofore referred to Kaufman property, a distance of 160 feet to a point; thence
turning to the left and proceeding in a general southerly direction a distance of
100 feet to a point; thence turning to the left and proceeding easterly a distance
,of 160 feet, more or less, to a point in the westerly boundary of said Spear
Street; thence turning to the left and proceeding northerly along the westerly
boundary of said Spear Street a distance of 100 feet, more or less, to the point
of beginning.
Being all and the same land and premises conveyed to the mortgagors herein by
Warranty Deed of Donald B. and Emeline F. Miller of even date herewith and to be
recorded in said Land Records.of the City of South Burlington.
Included therein are all rights of said -Donald B.-and Emeline F. Miller over a
certain right of way 25 feet in width lying southerly of and immediately adjacent
-to the above -described premises.
Included therein is the right to enter upon the premises now or formerly of said
Morty and Rhoda Kaufman located on the westerly side of Spear Street, and on the
premises of land now or formerly owned by Irving and Edith Kaufman located on the
easterly side of Spear Street for the purpose of maintaining, repairing and renew-
ing a certain water line running from the main water line of the Town of South
Burlington to the premises now or formerly owned by Morty and Rhoda Kaufman, loca-
ted northerly of the within described premises, and the further right to install,
repair and maintain a further connecting water line from the present terminal on
the premises now or formerly owned by said Morty M. and Rhoda Kaufman to the
within described premises. It is specifically understood and agreed that the owners
of the within described premises, their heirs and assigns, shall share equally
with the said Morty M..and Rhoda Kaufman, their heirs and assigns, the cost of
maintaining and repairing the above -described pipe line. The aforesaid main water
line of the Town of South Burlington is located within a 10-foot right of way
conveyed by the said Irving and Edith Kaufman to said Town. In the event that the
owners of the within' described premises, their heirs or assigns, shall terminate
their use of the above -described water line, then the aforesaid Agreement to share
equally in the cost of.repairing the same,; -shall be of no furtherforce and effect.
"Reference is herebymade to the above -mentioned deed and the record thereof and
the deeds and records contained therein in further aid of this description.
