Section 25.00 Dimensional requirements, minimum front yard setback 50 feet, existing setback 34 feet. Existing structure 40'x 66' with 13'x 23' attached garage. Section 26.00 Non complying structures, sub section 26.002 extensions. Proposed 10'x 23' addition to garage. Lot 21,700 square feet with 140 foot frontage. 2 Responses to Zoning Board of Adjustment: 1. Because the backyard falls away precipitously 10 feet to the east of the existing garage, it would be a hardship to place the garage addition 16 feet to the east of the existing garage(see photographs). Furthermore, if this were done it would completely block off the light and view from the screened porch which is situated behind the current garage (see 1:10 drawing and photos). 2. Because of the configuration of the lot and the existing structure, it is impossible to construct an additional garage on the house without compromising the current structure to an unacceptable degree(see photos). Up to the present time, the owners have been able to exist with a single car. However, since Dr.Gump has now retired from the University and no longer commutes to UVM by bicycle, he is in need of his own vehicle and a garage to house this vehicle. It would be a definite hardship for him to have to leave this vehicle out-of-doors during the winter and would definitely be detrimental to the vehicle. Furthermore, parking the vehicle out-of-doors is aesthetically unappealing to the appellants, and neighbors as well. 3. The appellants have not created the current hardship. No alterations have been made in the configuration of the house or the lot since the appellants purchased the property in 1985. Appellants have put in a hedge on the extreme western border of the property to keep motorists from using their front lawn as an area to turn around in. 4. The variance would in no way impact negatively on the neighborhood. The ridge line will not be raised above its current position. The neighbors to the north and south of the property have indicated their approval to the proposed addition (see supporting letter). It would certainly not be detrimental to the public welfare. It is important to note that the current garage is over 50 feet from the edge of Spear Street(see photos). S. The variance will represent a minimum variance that will afford relief from the current situation and represents the least modifications, consistent with the desires of the appellants, of the current zoning regulations. Note that the current garage is 13 feet wide and the addition would only add 10 feet to the current structure. No widening of the current driveway is required (see photo).
