FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER
This matter came before the South Burlington Zoning Board of Adjustment on November 10,
1997 by application of Dieter & Valerie Gump, the appellant, for a variance to construct a 10'x
23' addition to an existing garage located at 226 Spear Street according to plans submitted. The
Zoning Board of Adjustment finds as follows:
1) 226 Spear Street is a residential use.
2) The existing structure is a non -complying building to the dimensional
requirements.
3) The existing structure has a setback of thirty-four feet, the minimum setback is
fifty feet.
4) The existing structure is a 40'x 66' single family dwelling with an attached 13'x 23'
garage.
5) The proposal is a 10'x 23' addition to the garage.
6) Because the backyard falls away precipitously ten (10) feet to the east it would be
a hardship to construct the garage addition with a fifty (50) feet setback.
7) The appellants have not created the current hardship. Property purchased in 1985.
No alterations have been make by the appellants.
8) Request for a variance has the support of adjoining property owners.
9) Variance does not alter the character of neighborhood.
ORDER
The variance to construct a 10'x 23' addition to the existing garage located at 226 Spear Street is
hereby GRANTED.
