Re: Permit for addition to Twin State Electric
Dear Mr. Adams:
After reviewing the plans for a proposed addition to the
Twin State Electric building, it appears that the rear
yard dimension is twenty-five (25) feet. The minimum
required rear yard under Section 11.00 of the zoning
regulations is fifty (50) feet. The present building is,
therefore, non -conforming and before a permit can be
issued a waiver to the dimensional requirements would have
to be considered by the Zoning Board of Adjustment.

He said that the lots and houses would be very expensive. Mr. Levesque asked
if the houses would obscure the view of the existing houses and was told that
those houses did not have a view. -Mr., Segal said that there was a 301 drop
between the existing and proposed houses. Mr. Taft, an adjoining property
owner, said that consideration should be taken of the Hinesburg Road traffic,
which comes up from the south very fast. He also did not want a lot of
other houses served off the road that he uses, and 5 of them would be. He
said that the drainage in the back was poor. Mr. Levesque asked about the
sight distance, and was told that they thought it was 21 short vertically
and 75 - 125' short on the road of State Highway minimums. That is using
the posted speed limits, which are often eXceeded. Mr. Kerwin said that the
perc tests done on the west part of the land, near where the road was to
go were unacceptable because it was so wet. He was concerned about what
poor drainage could do to the road along the tree line, and said that the
existing houses did, in fact, have a view. Mr. Levesque suggested that the
next time they came in, they should have —cross sections to show, and
should discuss drainage and sight distance. Mr. Morency added that they
should be ready to talk about public vs. private streets, and the results
of the perc test.
Site Plan Review for addition to Twin State Electric, Calkins Court
Mr. Walt Adams said that he represented the owner, Mr. Leland Calkins, and
that the proposal was to add a 601 x 70' addition to the present building.
It would be the same type of construction and be painted blue. One of
the loading docks would be relocated and they would do some landscaping.
There would be no new curb cut. Mr. Page said that this is fill and there
would have to be some topsoil put in for the plantings. Mr. Adams said that
he -expected that the increase in room would only generate 3 liore trucks
per week, bringing b,41k deliveries.
Mr. Woolery moved that the South Burlington Planning Commission approve the
site plan of Twin State El ctric for an addition to the existing building,

Mr. Frank Alling showed the Commission the proposed layout, and said that
the two curb cuts that they wanted gave then the best traffic flow ;cssible.

Mr. Rozendaal asked how large the building was, and was told that it was
3600 square feet. Mr. Wessel noted that the permit for the tank would have
the necessary approvals from the Fire Chief, and was shown where it would
be placed. Mr. Morency asked about screening -from the church, and was told
that the trees there now are on the churchts land and that they have no
control over them. 11 1
Mr. Levesque moved that the South Burlington Planning Commission approve
the site plan of Burlington Rent -All, for a repair building, as depicted on
a site plan entitled *Plot Plan. . . Edgar Welch. . . New Maintenance and -
Repair Building " dated 5/16/77, Sheet 1, subject to the following stipulations:

1. A landscaping bond of $1,050-00 shall be posted.
.2-. - Storm drainage shall be, reviewed and approved by the City_Engineer.
3. Bonds, in an amount to be determined by the City Engineer, shall
be posted for curb and storm drainage work.
The motion was seconded by Mr. Ewing. Mr. Rozendaal abstained, the rest
voted'aye, and the motion carried.
Site Plan Review for temporary location of model home on Racine property,
1277 Williston Road -
Mr. Philip Varricchione said that he represented David Carlson and that
they wished to place a model home on the site for one year at which time
it would be reviewed. In addition to being a model - home, it will serve as
a branch office of a real estate firm, and be staffed by two, and possibly
three people. He thought that they might generate 8-10 cars per day and
that employees would park in the back. Mr. Wessel pointed out that there
would not be an additional curb cut for the use. Mr. Page said that he
would like to bes ure that there were not complicated leases such that
the access could not be coordinated and that there should be secondary access.
Mr. Rozendaal moved that the South Burlington Planning Commission approve
the site plan of Mr. David Carlson for location of a model home, aE.
depictedon the plan of record, subject to the following stipulations:
1. This approval in valid for I year from this date, after which
the Rroposed structure will be moved off &he lot and the property restored
to ita original co dition.
2. A landscaping bond of $1,050.00 minus the value of existing
vegetation, as determined by the Tree Planting Committee and Planning_
Assistant, shall be posted.
3. The applicant shall not enter into any lease or other agreements
which preclude or impinge upon the possibilities of -providing plin�ne, �
integrated access to the entire Racine proper y (i.e. single curb cut on
Williston Rd.. access to -abuttin-- DroDerties in the rear. etc.).
The motion was seconded by Mr. Ewing and passed unanimously.
The meeting was declared adjourned at 10:30 Pm.

Dear Mrs. Calkins:
This letter will serve as authorization for total release of the
landscaping escrow pertaining to the addition to the Twin State
Electric building located on Calkins Court,

THIS AGREEMENT, in triplicate, between (Applicant -
Developer) hereinafter referred to as Developer, the City of
South Burlington, hereinafter referred to as City, and
hereinafter referred to as Bank.
WITNESSETH:
WHEREAS, Developer has received prelimi" sub ivision

forth leg -end of final plat plan inclviding name, owner, date
and engineer)"; and
WHEREAS, Developer is required by said approvals, at
its own expense, to complete certain improvements:
(set forth specifically the improvements required s
contained in the preliminary or final approval of the
planning commission); and
WHEREAS, thb parties to this agreement wish to establish
an escrow account to secure the obligations of the developer -
as set forth above; and
WHEREAS, the bank executes this agreement solely in the
capacity of escrow agent.
NOW THEREFORE, the parties hereby covenant and agree as
follows:
1. Developer will at its own expense complete the
following improvements in connection with its development:

structed as specified in the preliminary or
final approval)
2. Developer will convey to the City by property
executed Warranty Deed, free and clear of all encumbrances,
its proposed conveyance of the streets in the development,
together with all easements designed for acceptance as
public easements, (or whatever the case may be).
3. The Developer shall complete the improvements set
forth in Paragraph One no later than
4. The Developer shall repair or replace any faulty or
defective work or improper material which may appear within
years of completion.
5. For the guaranty of Developers performance of all
requirements hereinabove set forth, -Developer and Bank agree
that the sum'of shall be set aside and

held in escrow by the Bank and shall be available for
payment to the City, in accordance with the terms here-
inafter set forth.
6. If the City shall file with the Bank a statement
that Developer is in the judgment of the City in 60 day
default under the terms of this agreement, the Bank shall
from time to time pay monies from said escrow fund to the
City, in amounts not to exceed a total enabling the City to
complete the improvements and requirements set forth in this
agreement.
7. The City will promptly submit to the Developer a
copy of any such statement as it files with the Bank. The
consent of the Developer to such payment by the Bank to the
City shall not be required. The Bank shall incur no liability
to the Developer on account of making such payment to the
City, nor shall the Bank be required to inquire into the
propriety of any claim by the City of default on the part of
the Developer or into the use of such funds by the City in
completing such improvements.
8. The City shall not file with the Bank a statement
of default until 60 days after notice has been sent by it to
the Developer by certified maill return receipt requested,
setting forth its intention to do so.
9. All monies released by the Bank to the City pursuant
to Paragraph 6 shall be used by the City solely for the
purpose of performing obligations imposed upon the Developer
by that portion of this agreement upon which the Developer
is then in default. Any work contracted for by the City
pursuant hereto shall be let on a contractual basis, or on a
time and material basis, or shall be performed by the City
with its own work force and equipment or shall be acco-
mplished in such other manner as in the judgment of the City -
shall accomplish the work more expeditiously and economically.
10. If monies are released by the Bank to the City
pursuant to Paragraph 6 and if it shall later develop that a

portion of the released monies are surplus to the City's
needs, any such surplus shall be refunded by the City to the
Bank to be held and distributed by the Bank pursuant to the
terms of this agreement.
11. The Bank will not refuse or delay to make such
payments to the City when requested by the City by the
appropriate statement, and Developer will not interfere with
or hinder such payments by the Bank to the City. Said
statement shall contain a certificate of compliance with the
notice requirements of Paragraph 8 of this agreement.
12. This agreement shall terminate and shall be of no
force or effect upon performance of all requirements contemplated
hereby.
13. Upon request of Developer, but only at the sole
discretion of the City, the City may release a portion of
said escrow funds if the City believes -that the retention of
said funds is not necessary to protect its interests after a
portion of said work has been completed. Bank may release
such funds only upon written consent of the City.
14. Nothwithstanding the provisions of Paragraph 13
the sum of � J'�jjq , ('-e) shall be in any ev'ent maintained in
escrow until certification to the Bank by the City of
satisfaction of the terms of this agreement.
15. This agreement shall not only be binding upon the
parties hereto, but also their respective heirs, executors, ,
administrators, successors and assigns.
