The sign you placed along Spear Street is in violation of the City Sign Ordinance. This is a temporary sign and all temporary signs are prohibited unless they are placed in a window. The fact that you are advertising the driving range with a sign on the street leads me to believe that the range is open to the general public. Approval by the Planning Commission is needed for use by the general public. Therefore, until this approval is obtained, the driving range must be restricted to members only. If you have any questions, please give me a call. i 'c y l�- oe Weith, City Planner 1 Encl Jw/mcp cc: Quarry Hill Club PLANNING COMMISSION 30 JULY 1991 The South Burlington Planning Commission held a meeting on Tuesday, 30 July 1991, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset St. Members Present: William Burgess, Chairman; Mary -Barbara Maher, Terry Sheahan, Catherine Peacock, Ann Pugh Also Present: Joe Weith, City Planner; Garland & Helen Withers, John Steele, David White, Guy Rosenthal, Christina Wall, Roger Whitaker, Doug Fitzpatrick, Lee Murphy 1. Other Business: a. Mr. Weith noted that Quarry Hill has withdrawn its application and will provide the golf driving range for members only. b. Mr. Weith gave members a tentative schedule for Southeast Quad- rant zoning. The Council wants the Commission to relook at goals minus the TDR's and to look at more conventional zoning methods to promote goals without major changes in zoning. c. Ms. Peacock asked whether the Commission will still have a site visit to Allenwood. Mr. Weith said the Allenwood people will not allow the Commission on the site. d. Regarding the City Center, staff has met a few times with Peter Judge regarding developing the parcel along Corporate Way. They have been talking about streetscape issues. Mrs. Maher asked if Mr. Judge is looking at a separate lot on Corporate Way or trying to tie it into Dorset St. Mr. Weith said it would be just for Corporate Way. He said he had suggested a committee to make recommendations on design issues such as tree spacing, lighting, benches, etc. Mr. Sheahan agreed to represent the Com- mission on the Committee. 2. Preliminary Plat application of Garland and Helen Withers for subdivision of approximately 41,700 sq. ft. of land into two lots of 15,700 sq. ft. and 27,000 sq. ft., 265 Kirby Rd. Mr. Withers said there is a small ranch on the front of the property and there would be a larger split level on the rear. He proposed a 40 ft. right of way to the back property, 12 ft. of which would be paved with the remainder gravel. There is a ravine in back with a small creek. Mrs. Maher asked if the applicant had any objection to putting in a row of evergreens . Mr. Withers said he would object to being told to do it. Mrs. Maher noted the Commission has the right to r i PLANNING COMMISSION 30 July 1991 page 2 reject the application as there is no frontage for the rear pro- perty. Mr. Rosenthal noted that there is a growth of old trees that protect the adjoining development from noise, etc. He asked if these can be saved. Mr. Withers said he didn't know how many trees he would cut down. Mrs. Withers said she wants to garden and pine trees are no good for gardeningas they make the soil too acid. She said the property has been in her family for three generations, and the Picard development should not have guaranteed residents that those trees would always be there. Mr. Burgess said the Commission's concern is that the property will be a subdivision with a piece that has no frontage. The Commission will consider doing something to protect adjacent properties because of the long driveways, but the Commission is not empowered to protect trees. Mrs. Wall noted they had paid more for their home because of the trees, but acknowledged that that was her problem. She said the biggest concern she had was the long driveway because of small children in the area. She asked for a fence. Mr. Weith said he felt a fence and some land- scaping would have the most effect for screening. Ms. Pugh said she would like to see some discussion between the developer and the neighbors for something mutually beneficial. Mrs. Maher sug- gested the possibility of deciduous trees. Mr. Sheahan said he would like to view the site in order to make a more intelligent decision. Members agreed. Ms. Pugh moved to continue the application until 6 August to allow members to view the property and be clear what is being voted on. Mrs. Maher seconded. Motion passed unanimously. 3. Public Hearing: Revised Final Plat application of John Larkin and Gerry Milot to revise the parking layout and circulation of a planned commercial development consisting of 150 multi -family residence units, a 60 room hotel, 20,000 sq. ft. movie theatre and 40,000 sq. ft. of retail use on a 33 acre parcel, Shelburne Rd.. Mr. Steele said the number of parking spaces is essentially the same. The changes involve the number of islands and changes the city wants to see. The entrance at the west has been shifted from the end of the lot down across from the entrance to the theatre in the interest of safety. On the south parking lot, they have reoriented parking to north/south aisles and eliminated two curb cuts. They have created two berms along Fayette Rd. There will be a sidewalk on the west side of the drive. It is anticipated that the project will generate 569 peak hour trip ends. This trip generation fits within the 623 peak hour trip end limit established by the Commission with the 12/11/90 approval. 5. The revised final plat shall be revised prior to recording to show the following: a) More landscaping including shrubbery and/or low berms along parking areas fronting Fayette rd. to better screen parking lots from public r.o.w. This shall be approved by the City Planner. 6. Based on the expressed representation of the applicant, at such time as the 60 foot r.o.w. connection to the Farrell property is opened as a public road, two of the four parking lot curb cuts on the east side of the r.o.w. shall be closed and parking lot circulation revised to accommodate the reduced curb cuts. 7. The revised final plat shall be signed by the Planning Com- mission Chairman or Clerk and recorded in the South Burlington land records within 90 days or this approval is null and void. Mrs. Maher seconded. Motion passed unanimously. 5. Site plan application of Quarry Hill Club to operate a driving range and miniature golf course on a 28 acre parcel which also contains a country club use, Quarry Hill Road: Mr. Shields said the driving range will be 1,000 ft. by 200 ft. He didn't feel there was any chance of a ball being hit as far as the adjacent property. The mini golf course will be 100 ft. by 100 ft. It is a totally portable system that can be dismantled. There will be no permanent structures on the site. It will be fenced in. He noted that Zoning Board approval has been obtained. There will be four 14 ft. high cut off lighting posts. Regarding the access roadway, Mr. Shields said there is a paved part of the road 400 ft. by 24 ft. The next section is a combination of pavement, gravel, etc, and runs 305 ft. The next 400 ft. section is mostly gravel. That goes to the current Quarry Hill Club entrance. There are 18 parking spaces on one side and over 300 on the other side. There are 2 gravelled strips for the miniature golf facility. Mrs. Maher noted the City Engineer wants to see the parking laid out. Mr. Shields said it is just a long gravel space. Mrs. Maher noted the City Engineer also wants it clear that the mini golf course will not be built on top of utilities. PLANNING COMMISSION 25 June 1991 page 7 Mr. Craig asked if they will need a building permit. Mr. Weith said he would check with Mr. Ward. Mrs. Maher asked if the Burlington Tennis Club has been apprised of this application. Mr. Weith said it had not. Mr. Scott noted that Quarry Hill leases out the facility for private parties. There can be hundreds of people and a lot of children all over the road. He felt it would be a very dangerous situation as there is no indication of where to park and there can be a lot of drinking going on. Mrs. Maher said she would like to see a more specific parking plan and she wanted the City Engineer made aware of all the other uses. Mr. Shields said they would be willing to withdraw the application for public uses and just go with the miniature golf. Members wanted the applicant to come back with the location of utilities and a parking lot plan. Mr. Craig moved to continue the application until 9 July. Ms Peacock seconded. Motion passed unanimously. 6. Review first six months of data from the Factory Outlet Mall parking study: Mr. Weith noted there are a lot of illegal packers in front of Grand Union on Friday and Saturday even though there is a suf- ficient number of parking spaces. Mr. Craig felt the data was mixed up on two charts and showed where February's number of parked cars and the percentage of spaces used didn't gibe. Mrs. Maher noted the retail sales are down 10% or more in New England. She felt figures would change when the recession ends. Mrs. Pritchard raised the issue of the Ben Franklin store which she said doesn't have enough parking on Saturday. Mr. Burgess asked that the graphs for the parking study be made available. Members asked to see the stipulations from the original approvals. 7. PUBLIC HEARING: Continue Preliminary Plat application of Harold Bensen for subdivision of a 3.63 acre parcel containing a Planned Commercial Development consisting of two commercial buildings and 16 residential units into two lots of 1.41 acres (commercial buildings) and 2.22 acres (residential buildings), Patchen Road: Mr. Lisman said the landscaping issue has held up the pending application. The project was built a number of years ago and didn't include some required landscaping. Mr. Tower then presented a landscaping plan. He noted that on the south and west, the plan didn't show native plantings. He recommended scotch pines to screen the residential units from the Post Office. He also noted that some plantings have died and have to be replaced. A white cedar hedge needs to be filled in. Mr. Weith recommended a lot more than this plan shows. He asked for some pines along the JC Park fence. Mr. Craig asked if what is proposed meets the intent of the original approval. Mr. Weith noted they have put in smaller sizes of plantings and haven't kept them up. Mrs. Maher said she wouldn't vote for it as it didn't meet what the Commission originally wanted. A majority of members were satisfied as long as there is a 3-year bond. Mr. Bensen said he wants to keep the commercial land separate from the residential. There will be no change in access or parking. Mr. Burgess asked if anything becomes non -conforming. Mr. Weith said no. He added that the City Attorney advised that the residential units will be on a small lot, but this is allowed because it was originally part of a PCD. He recommended that the right-of-way be recorded, also that a pedestrian easement be recorded over lot 1. Mr. Weith noted the residential lot doesn't meet requirements but it had Zoning Board approval for this as it was a PCD. It is staff's opinion that no additional parking or sewer alloca- tion will result. In addition, staff feels that the new use best fits within the ITE use category of retail -general merchandise. If Planning Commission is concerned with potential increase in traffic, I suggest the applicant conduct counts of a similar use to that proposed and compare to counts of the existing use. If greater traffic will result, an expansion of use is constituted, which requires site plan review. If no increase in traffic will result, there will be no expansion of use and therefore site plan review is not required. 6) QUARRY HILL CLUB This item was continued to this meeting. The applicant has indicated that he would like to withdraw his application. I have not yet received a letter or withdrawal, but should have it by Tuesday's meeting. HAS BEEN CANCELED** a) ALLENWOOD SITE VISIT: The site visit to Allenwood which was scheduled for 6:15 P.M. on 7/9/91 is canceled. The applicant representative could not make that time. A new time will be scheduled. b) EXTEND INTERIM ZONING- The Council has scheduled a public hearing to consider extending, interim zoning. The hearing is scheduled for Tuesday, July 23 and the Council would like the Planning Commission to attend. The Commission originally did not have a meeting scheduled for this date. Would the Commission like to switch the 7/16/91 meeting to the 7/23/91 date (following interim zoning issue) and schedule no meeting for 7/16? c) WITHERS - 2__ LOOT SUBDIVISION. KIRBY ROAD Enclosed is a letter from Mark Ward of Palco, Ltd. regarding the Withers subdivision. He is asking if the Preliminary Plat and Final Plat hearing can be held on the same date (7/30/91). This application is consid- ered a major subdivision because it involves the creation of a lot with no frontage on a public street. The Planning Commission has recently recommended against holding both hearings on the same night, however, I have been told that it has been done in the past. Please note that a number of adjacent property owners have submitted letters expressing concern with the proposed subdivision. 3) QUARRY HILL CLUB, DRIVING RANGE AND MINIATURE GOLF This application was continued to the 7/9/91 meeting. Applicant was directed to revise plans to better delineate parking and circulation. The applicant has not completed the plans and has asked that the application be postponed until the 7/30/91 meet- ing. I do not see a problem with this. BENSEN At the 6/4/91 meeting, the applicant. indicated that they will submit a landscaping plan as part of this application as request- ed by the Planning Con -mission (minutes enclosed). A plan has not been submitted, however, the applicant has indicated that he will have a landscape architect at Tuesday's meeting to address the landscape plan which I suggested to the applicant (enclosed). 5) GREEN ACRES 11-LOT INDUSTRIAL SUBDIVISION - HINESBURG ROAD This is a continuation of a public hearing held on April 10, 1990 (minutes enclosed) for preliminary plat approval of an 11 lot. subdivision. Green Acres, Inc. proposes to subdivide a 262.53 acre parcel as a Planned Industrial Development (PID) located on Hinesburg Road south of Lane Press and north of the Ledgeknoll residential development. The property is zoned Industrial and Agricultural (I -A) and in an interim zoning; district adopted by the City Council on June 25, 1990 which has a minimum lot size of 10 acres. Since this subdivision meets minimum lot size requirements, approval is not required by City Council. The applicant proposes to do a Planned Industrial Development which is allowed in this zone on a parcel containing 80 acres or more. Please read over the I -A section of the zoning regulations prior to Tuesday's meeting. The property is bounded by Dynapower to the north, Muddy Brook and the Town of Williston to the east, residences to the south, and Hinesburg Road and several single-family residences to the west. The site slopes downward from Hinesburg Road. The western half of the property is primarily open with fields while the eastern half is primarily wooded. An old quarry exists on the site as well as a small pond. A stream (beginnings of Potash Brook) runs north -south in the center of the property. Two small tributaries lead into this stream. Minimum lot size/frontage: The zoning ordinance requires a 10 acre minimum lot size, however, the average size of all the lots must equal a minimum of 20 acres. The plan shows 10 lots each between 10 and 12.5 acres, and one 145.8 acre lot. Memorandum - Planning June 25, 1991 agenda items June 21, 1991 Page 4 The redesign of the retail building results in a greater amount of parking visible from Fayette Road as opposed to the previous plan in which much of the parking was hidden by the building. The applicant should consider more shrubbery along the parking lots fronting Fayette Road to better screen these lots from the public r.o.w. Traffic circulation would be improved by connecting the hotel parking area with the theater parking area but we understand that there is a grade problem which would make this connection diffi- cult. 5) QUARRY HILL CLUB _ DRIVING RANGE & MINI -GOLF This proposal is to add to the Quarry Hill Club's existing facil- ities a 160'xl,000' driving range and 1001x100' 18 hole miniature golf facility. The driving range will be located between the northerly end of the quarry and the Gaynes property. The minia- ture golf facility will be located to the east of the driving range near I-89. This property is located at the end of Quarry Hill Road and is bounded on the north by the Burlington Tennis Club and Gaynes, on the east by I-89, on the west by single-family residences and on the south by City property, an underdeveloped lot and Horizon Heights residential development. This property is located in the R7, R4 and C1 zoning districts. The Zoning Board of Adjustment granted a conditional use permit for the proposed use on May 13, 1991. There will be no permanent structure erected as part of the miniature golf facility. It will be enclosed with a six (6) foot high fence covered with green fabric. The projected season is Memorial Day through Labor Day. The facility will be open from 10:00 A.M. to 10:00 P.M. seven (7) days per week. The applicant anticipates that during the day the facility will be used pri- marily by existing Quarry Hill Club members (children) and that during the evening hours there will be a slight increase in usage. Landscaping There is no minimum landscaping requirement for this project since there will be no buildings. 4 Memorandum - Planning June 25, 1991 agenda items June 21, 1991 Page 5 Access/circulation: Access to the site is via the Quarry Hill Road, a private r.o.w. which dead -ends at the Quarry Hill Club. The plan shows an existing roadway that connects Quarry Hill Road with the Gaynes property. Also shown is a r.o.w. from Williston Road going across the Chittenden Bank property and the Burlington Tennis Club property to the subject property. This property should not be allowed access to either the Gaynes property or Williston Road. The plan should show the limits of the existing roadway (i.e., width). The 3/22/77 Planning Commission approval for Horizon Heights included a stipulation that Quarry Hill Road shall be fully upgraded to City design and construction standards in the event of a) additional subdivision, or b) substantial further develop- ment. In my opinion, this application does not constitute sub- stantial development. No major structures are proposed, little additional traffic would be generated, and the facility would only operate during the summer months. Parking: There are no minimum parking requirements for outdoor recreation use. The plan does not show any individual parking spaces. There is a note on the plan adjacent to the proposed miniature golf facility which says "existing parking". The plan should show the limits of the proposed parking area. Coverage/setbacks: Insufficient information submitted to deter- mine coverage. The site is 28 acres and is mostly undeveloped. Since the only structure added to the site is the 1,000 square foot miniature golf facility, it does not appear that coverage limits will be exceeded.
