Public Hearing: Final Plat application of Edward & Michele von Turkovich for subdivision of a 30,107 sq. ft. lot with a single family home into two lots of 16,969 sq. ft. and 13,138 sq. ft., 260 Spear Street: Mr. von Turkovich said the plans had been revised based on pre- liminary plat comments. He felt the plan now complies with the conditions of the zone. Mr. Weith recommended the plan show the location of existing water service to the house and if it crosses lot one, an easement will be needed. No other issues were raised. Mr. Austin moved the Planning Commission approve the final plat application of Edward and Michele von Turkovich for subdivision of a 30,107 sq. ft. lot with a single family home into two lots__ of 16 969 s ft. and 13,138 s ft. 260 Spear Street as de- picted on a plan entitled "Property Map, Edward & Michele von Turkovich, #260 Spear Street, South Burlington, Vermont" Qrepared by William A. Sketch plan application of Economou Farms Development for a project consisting of 1) construction of an 18 hole golf course including a clubhouse, snack bar, pro shop, driving range and putting green and 2) construction of a 240 lot planned residential development, on a total of 400 acres, Dorset Street: Mr. Economou said this project is in conjunction with the city, and the planning process began in 1988. On the Master Plan, there are 135 acres shown for a school and park. To date, no information from the city has been given about this. Mr. Economou noted this is some of the most valuable property in South Burlington. There are 4 possible options for the property at present: 1. a park and school with some housing and some commercial de- velopment 2. a municipal golf course with some housing (which is the plan being considered tonight) 3. a private golf course with housing 4. a housing and commercial mix Under the plan being proposed, the city would get 300 acres in - 2/14/95 MOTION OF APPROVAL EDWARD VON TURKOVICH I move the South Burlington Planning Commission approve the final plat application of Edward and Michele Von Turkovich for subdivision of a 30,107 square foot lot with a single family home into two (2) lots of 16,969 square feet and 13,138 square feet, 260 Spear Street, as depicted on a plan entitled "Property Map, Edward & Michele Von Turkovich, #260 Spear Street, South Burlington, Vermont" prepared by William A. Robenstein, dated 12/29/94, subject to the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall record a "Notice of Conditions" which indicates that the conveyance of lot #1 requires the reservation of an access easement as shown on the plat and that the conveyance of lot #2 requires the grant of the easement. This legal document shall be reviewed and approved by the City Attorney and shall be recorded prior to recording the final plat. If the water service for lot #2 crosses lot #1, an easement for this water service shall be noted in this "Notice of Conditions". 3. Lighting: Exterior lighting will consist of the following: --- seven (7) 250 watt high pressure sodium lights with downcasting cut-off luminaires mounted on 12 foot poles. --- 17 100 watt building mounted incandescent lights. Dumpster: A screened dumpster area is shown on the plan. Applicant should indicate type of fence to be used. Other: The landscape plan should be revised to use commas instead of periods in the numbers listed under "Lot Information". 4) EDWARD VON TURKOVICK - 2 LOT SUBDIVISION - FINAL PLAT This project consists of subdividing a 30,107 square foot parcel into two (2) lots of 16,969 square feet (lot #2) and 13,138 square feet (lot #1). Lot #2 is developed with a single family dwelling. The sketch plan was reviewed on 8/9/94 (minutes enclosed). This property located at 260 Spear Street lies within the R4 District. It is bounded on the north, south and east by single family residences and on the west by Spear Street. Access: Access to lot #2 is via an existing 14 foot wide curb cut on Spear Street. Access to lot #1 is proposed to be via a 10 foot wide curb cut on Spear Street. A portion of the existing driveway for lot #2 will cross a portion of lot #1 thereby requiring an easement. A "Notice of Conditions" should be recorded prior to recording the final plat which notes'' that the conveyance of lot #1 requires the reservation of an easement as shown on the plat and that the conveyance of lot #2 requires the grant of the easement. This legal document should be reviewed and approved by the City Attorney prior to recording. Lot size/frontage: The minimum lot size requirement is 9,500 square feet. Both lots meet this requirement. The minimum frontage requirement of 100 feet is being met. Setbacks: The existing building will meet the side yard setback requirement from the new property line. Sewer: The sewer allocation requested is 450 gpd. The applicant--14-�- will be required to pay the per gallon fee prior to permit. Impact Fees: The applicant should be aware that a new house on lot #1 will have to pay school, recreation and road impact fees. The current fees would be approximately $3300. Other: --- the final plat should be signed and stamped by the land surveyor. CW --- the water service should be shown on the plat. If the service line crosses lot #1, the plat should show the easement and the easement noted in the "Notice of Conditions". 5) ECONOMOU FARMS DEVELOPMENT - GOLF COURSE/RESIDENTIAL PRD - SKETCH PLAN This project consists of: 1) construction of an 18 hole golf course including a clubhouse, snack bar, pro shop, driving range and putting green, and 2) the construction of a 240 lot planned residential development, on a total of 400 acres, Dorset Street. This property is located on both sides of Dorset Street in the SEQ District. The property located on the east side of Dorset Street is bounded on the north by Dorset Street Park (Calkins parcel), on the east by Oak Creek and Butler Farms, on the south by Old Cross Road and on the west by a single family dwelling and Dorset Street. The property located on the west side of Dorset Street is bounded on the north by Swift Street Estates, on the west by the Nowland II subdivision, on the south by undeveloped property and on the east by Dorset Street. Southeast Quadrant Zoning: There are a number of inconsistencies between the proposed plan and the City's zoning regulations and Official Map. These inconsistencies are summarized in a memo from the City Planner to the City Manager dated 3/3/94 (see enclosed). Sketch plan application of Edward & Michele von Turkovich to subdivide a 30,000 sq. ft. lot into two lots, 260 Spear Street: Mr. von Turkovich located the property on the east side of Spear St. across from the Country Club hedge. His intent is to subdivide to create 2 100-foot lots. If the property line encroaches on the driveway, there will be an easement. Question arose as to whether a 75 ft. lot existed in the past. Mr. Weith said if the applicant can prove such a lot existed, they can build on it and won't have to come back to the Commission. Also, if the applicant can demonstrate that there are other 75 ft. lots in the area so that creating a 75-foot lot won't change the char- acter of the neighborhood, he will not need to subdivide. 5. Site Plan application of Rice Memorial High School to construct a 160 sq. ft. concession stand, 99 Proctor Avenue: Mr. Cavoretto showed where a soccer field is being built. The proposed structure would be 10' x 161, wooden frame construction. He noted they are now using tables and chairs with tarps for a concession area and this is very awkward. Members had no problem with the request. Mr. Austin moved the Planning Commission approve the site plan ap- plication of Rice Memorial High School to construct a 160 sq ft concession stand, 99 Proctor Avenue as depicted on a plan entitled "Proposed Site Modifications, Rice High School," prepared by Thermo Consulting Engineers with a stamped "received" date of 7/21 94 with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning/building permit within six months or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy from the Administrative officer prior to use of the concession stand 4. Any new site lighting shall consist of downcasting shielded fix- tures so as not to cast light beyond the property line. Any new lighting or change in existing lighting shall be approved by the City Planner prior to installation. 5. The single easement that runs with the property is as follows: An easement was granted to the City of South Burlington for purposes of installing and maintaining a sewer line on the easterly line of the property. References of this easement in the form of conveyance from Louise Adele Raynor to the City of South Burlington are recorded in Book 85 Qa Page 110 of the City of South Burlington Land Records. Other than that I believe everything else required has been submitted. It is my understanding that as depicted the subdivision meets the criteria established by South Burlington for the R-4 District. I am including a copy of my Warranty Deed that describes the purchase of three lots by Mrs. Raynor in 1951. I am also including a list of the adjoining land -owners by separate copy.
